L-2.1 ORGANIZATION OF THE PROPOSAL

Each Offeror must submit their proposal materials in three-ring, binders. Individual sections shall be removable and replaceable to the volumes. Each volume shall contain a title page, table of contents, and list of tables and figures for that volume. Use tab separators to separate required sections within a volume. The title page, table of contents, list of tables and figures, and tab separators do not count against page count. Number all pages sequentially. Only material allocated to a specific section shall be in that section. Business and Technical Volumes shall be submitted in separate binders. An original and six (6) copies of the Technical Volume, as well as an original and one (1) copy of the Business Volume, shall be provided.

Offerors shall provide in each volume a Table of Contents and Acronym List. The Technical

Volume shall include a Non-Price Factor Cross-Reference Matrix showing the proposal paragraph number where an evaluator will find the detailed discussion of the non-price factors.

The Table of Contents, Acronym List and the Non-Price Factor Cross-Reference Matrix will not be included as part of the page count. The following instructions apply to the format:

This part also shall include a completed Section B.

Part II. This part shall contain all cost/price data that will allow the Government to conduct an adequate price analysis. This part shall also contain the Offeror’s Small/Small

Part III. Past Performance

Part IV. This part shall explain the Offeror’s ability to meet or exceed the requirements stated in Part IV of Section L-2.2 of this solicitation. The volume shall not include any cost/pricing data.

L-2.2 CONTENT OF THE PROPOSAL

The following instructions are provided for the relevant portions of the proposal:

Part I. Model Contract. The Offeror shall agree to the terms and conditions of the model contract of this solicitation that consists of RFP Sections A - K, including all documents, exhibits, and attachments. The submission of these items in accordance with the instructions will, upon acceptance by the Government, contractually bind the Government and the Contractor to the terms and conditions of the model contract.

(1) The Business Volume shall include a completed, signed original copy of the entire solicitation (Sections A through K), with all appropriate “fill-ins” completed. (NOTE: On the first page of this volume, the Offeror shall certify that the proposal has been prepared completely consistent with the terms and conditions of the solicitation. Any exceptions, deviations, and/or waivers shall render the Offeror’s proposal unacceptable to the Government. As provided below, Offerors must certify that their respective offer provided in response to solicitation

M67854-13-R-5029 does not take any exception to, deviate from or otherwise request a waiver for any of the requirements delineated in solicitation M67854-13-R-5029.

(2) The price proposal shall include a firm-fixed unit price for each separately priced CLIN in SECTION

B in the format provided for each CLIN. Stepladder pricing is requested.

(3) It is expected that this contract will be awarded based upon a determination that there is adequate price competition; therefore, the Offeror is not required to submit or certify cost or pricing data with its proposal. If, after receipt of the proposals, the Contracting Officer determines that adequate price competition does not exist, the Offeror shall provide certified cost or pricing data as requested by the

Contracting Officer.

Part II. Pricing. All dollar amounts provided in a completed Section B shall be rounded to the nearest dollar. A random evaluation quantity will be used for all stepladder and non-stepladder CLINS during evaluation.

Under Section B, a step-ladder pricing structure is preferred; because price breaks may vary by contractor, each Offeror may revise the step ladder pricing structure ranges to better accommodate where the price breaks (discounts) may be applied for their particular organization. However, the minimum quantity for the 1 st range must be 1 and the maximum quantity for the last range must be the max quantity specified for each CLIN.

Under Section B, Offerors shall not complete the Unit Price and Max Amount entry located at the top of the stepladder CLINS. Offerors are hereby notified that the CLIN pricing submitted in their respective proposal will be evaluated in accordance with the criteria delineated in Section M of the RFP.

Element Business Volume Material Submission

Organization Provide an organization chart of the company (need to include name, phone and email of individuals), cognizant DCMA, DCAA, and

DFAS payment office.

Pricing The Offerors shall provide the unit and extended prices, in a completed Section B as well as an MS Excel spreadsheet. In the event of a conflict between Section B and the spreadsheet, the pricing at Section B shall take precedence.

Part III. Past Performance. The offeror shall demonstrate relevant past performance or affirmatively state that it possesses no relevant past performance. To demonstrate past performance, the offeror shall identify a maximum of THREE (3) of its most relevant contracts or efforts within the past three years, and provide any other information the offeror considers relevant to the requirements of the solicitation. Offerors should provide a detailed explanation demonstrating the relevance of the contracts or efforts to the requirements of the solicitation.

Relevance is defined as contracts that are similar in size, scope, complexity, and cost/price. The contracts or efforts will be evaluated in the aggregate in order to allow offerors who may not have the entire scope, magnitude, and complexity of the requirement under one individual contract to still be considered acceptable if experience with the full scope, magnitude, and complexity of the requirement can be demonstrated within the allotted number of contracts or efforts as described above. Only a set of up to three contracts or efforts shall be submitted.

Ensure that accurate and concise information is provided for each contract or effort, whether the data is for the prime or the subcontractor, including:

Title of Contract, Contract Number, and Sponsoring Organization, Name, mailing address, telephone and email address for the Technical POC or COR and Contracting

Officer;

Type of Contract, Value, Award and Completion Dates; Brief description of the services performed, problems identified and corrective action taken, awards/recognition received;

and

Cure/Show Cause notices received, and reasons.

Offerors are advised that the Government may use and evaluate independently obtained past performance data such as Past Performance Information Retrieval System (PPIRS) and Past

Performance Questionnaires (PPQ) as well as and in addition to all recent and relevant past performance data provided by the Offeror. Moreover, since the Government may not necessarily interview all of the sources provided by the Offeror. Furthermore, the Government does not assume the duty to search for data to explain or remedy any inconsistencies it finds in the information provided by the Offeror. The burden of providing thorough and complete past performance information remains with the Offeror.

For each contract of relevant work above, the Offeror shall provide a Past Performance

Questionnaire as provided in Section J (Attachment 1). The Offeror shall send out, and track the completion of, the Past Performance Questionnaires to each of the Offeror’s

Governments/Commercial Points of Contact (POCs). Any completed Past Performance

Questionnaires must be submitted directly from the Offeror's Governments/Commercial POCs to the Government not later than the closing date of the solicitation. Each of the Offeror’s POCs shall email its completed Past Performance Questionnaire directly to the contract specialist at clifton.maxwell@usmc.mill.

Part IV. Technical This part shall explain the Offeror's ability to meet or exceed the factors delineated in the Performance Description. The volume shall not include any cost/pricing data.

The Technical Volume shall include a Cross–Reference Matrix showing the proposal paragraph number where an evaluator will find the detailed discussion of the requirements listed in the Performance Description. The Offeror shall provide data to substantiate their product meets or exceeds the requirements of the Performance Description. It is permissible to submit the substantiating data on a CD-ROM and will not be counted against the page limitations set forth in Section L. Substantiating data in excess of page limit shall be limited to technical drawings, photographs, test reports, and product specification sheets. The offeror shall identify any “value-added” features that will contribute to the overall accomplishment of the Joint Modular

Intermodal Containers (JMIC) program. These elements shall be quantified from the standpoint of improvements to configuration change, performance, cost reduction, innovative business strategies, or other measures the offeror believes will contribute to program execution.

L-2.3 SUBMISSION OF BID SAMPLE

The Offeror must provide one JMIC 3.0 Product sample no later than the time deadline for proposal submission. Earlier delivery is encouraged. Delivery shall be made to Attn: Maj

Clifton Maxwell, CT025-GTES, MARCORSYSCOM, 2201A Willis Street, Quantico, VA

22134-5060. At time of delivery, the Offeror shall provide the Government with a written inventory of all property. Upon conclusion of use of the Product Sample (30 days expected), the

U.S. Government will contact the offeror for pickup of the Product Sample within 30 days.

Offerors should be aware that samples may be damaged in the testing/evaluation process. The

Product Sample shall be painted the color TAN per Fed-Std-595B/33446 (Tan 686).

Accompanying the Product Sample and included in the written proposal shall be offeror certifications that all metals used in the submitted article are proper and prescribed grade/composition/treatment. The offerors are required to complete provision 252.225-7020

Trade Agreements Certificate. These certifications will not count against the 25 total page limit.

mailto:clifton.maxwell@usmc.mil

This Product Sample provision shall be at no cost to the Government and shall not be used as a basis for any claim against the Government. This includes all claims whether in tort or contract.

Accordingly, the Government shall not be liable to the Offeror for any damage to, loss of, or destruction of the Product Sample. Any third party claim for property damage or personal injury arising from the use of the system will be handled in accordance with the Federal Tort Claims

Act.

L-3.0 INTENT TO INCORPORATE CONTRACTOR’S TECHNICAL PROPOSAL

All or part of the successful Offeror’s technical proposal may be incorporated in any contract resulting from this solicitation. Moreover, the successful Offeror’s technical proposal may be incorporated by reference. Nothing contained in the successful Offeror’s technical proposal shall constitute a waiver to any other requirement of the contract. In the event of any conflict between the successful Offeror’s technical proposal and other requirement of the contract, the conflict shall be resolved in accordance with the Order of Precedence clause. (FAR 52.215-8)

The successful Offeror will provide, as necessary, any updated technical proposal changes that reflect the results/responses to any items of clarification and/or discussions.
