Solicitation M67854-13-R-5029 a small business set-aside? It was my understanding that the Presolicitation
Notice originally stated it was a Total
Small Business Set Aside. We are a small business, Garret Container appears to have been awarded some contracts for
JMICs in the past and they appear to be a small business. It also appears other small businesses have produced JMICs.

The JMIC 3.0 K consists of numbers custom aluminum extrusions.
Aluminum Extruded parts take an extremely long lead time to deliver. The first ordering process consists of ordering the extruding dies for the different shaped extrusions. The extruder must first build the tooling for the dies, and then process the material.
Typical lead times on projects such as this take 8-10 weeks for the initial order just to receive the raw material. Then the material must be machined, which in the JMIC there is an extensive amount of CNC machining that is required. On
pg. 54 of the solicitation, it states that
"The Offeror must provide one JMIC
3.0 Product Sample no later than the
time deadline for proposal submission.
Early delivery is required." This is impossible for anyone except the company or companies who have provided the JMICs in the past which limits competition. Will the
Government consider adding to the solicitation that 2 First Articles are due to be delivered no later than 120 days from contract award?

Stowage Box
The Internal Stowage Box description is very vague. Due to this being a Best
Value Solicitation, the vendor that knows what the customer wants has a superior advantage over the other offerors. There are all types of options for the internal cases including plastic, metal, wood. The JMIC is standardized and it is obvious that all offerors are submitting bids on the same product.
The Internal Strage Box can be anything from a tan waterproof lined bag with rigid material all the way to a metal box with 4 handles as the specification is described currently. Will the
Government please make this description more defined so all offerors are able to present a similar product.

If we offer volume discount pricing, how will the contract price be evaluated? If someone knows that the
Government will purchase more units in the first year as opposed to the last year, the Government should want to make sure that the offeror does not fix their price to only benefit the contractor.

Is there a minimum quantity the
Government intends to purchase the first year? The ability to provide competitive pricing due to the potential difference in purchasing 1 unit and 15,000 units is huge. We believe a tremendous savings could be seen by the Government if a larger initial minimum purchase quantity was in the contract.
The amount of units procured will be determined by the price.

Question: How does the Government determine if it was a repair due to misuse by the user or someone customizing the unit for another need?

This paragraph states that "The contractor shall accept or reject all claims within 48 hours of claim being initiated." Question: It would seem more fair to give the contractor time to travel to the destination to see the problem before having to accept or reject the warranty. Will the
Government consider extending the period of 48 hours to a new period of 7
Days? If the period is to short it may force the contractor or the Government to make a poor decision when there may be no problem at all.

The Government is asking the offeror to provide THREE (3) most relevant contracts in the past three years similar in size, scope, complexity, and cost/price. Due to the fact this is a very large solicitation, and the fact that the
Government is asking for contracts of similar size, will the Government consider extending the time period to include the THREE (3) most relevant contracts within the past 6 years, or the longest time possible instead of the past 3 years as currently stated.

SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS

INSTRUCTIONS
L-2.0 PREPARATION OF PROPOSALS
This request for proposals is written in the Uniform Contract Format described in FAR 15.204-1.
The Government advises prospective Offerors to read the terms and conditions of the model contract carefully. Proposals shall be prepared using “Times New Roman” 12 point font style on
8½ x 11 inch white paper. Tables and illustrations may use a reduced font style not less than 8 point. Foldouts are not allowed. Margins shall be 1 inch on all sides. All material submitted may be single-spaced. Offerors shall ensure that each page provides identification of the submitting Offeror in the header or footer. Number all pages sequentially.
Offeror shall include one electronic “soft” copy (one copy of the business volume and one copy of the technical volume on separate discs) of the full proposal using the Microsoft Office application or Adobe PDF, submitted on CD-ROM, formatted for a personal computer. Price breakdown shall include completed MS Excel spreadsheets with formulae intact. Schedules will be in MS Project or Adobe PDF. Delivery of process flows may be in hard copy if not compatible with the above software.
L-2.2 CONTENT OF THE PROPOSAL
The following instructions are provided for the relevant portions of the proposal:
Part I. Model Contract. The Offeror shall agree to the terms and conditions of the model contract of this solicitation that consists of RFP Sections A - K, including all documents, exhibits, and attachments. The submission of these items in accordance with the instructions will, upon acceptance by the Government, contractually bind the Government and the Contractor to the terms and conditions of the model contract.
(1) The Business Volume shall include a completed, signed original copy of the entire solicitation (Sections A through K), with all appropriate “fill-ins” completed. (NOTE: On the first page of this volume, the Offeror shall certify that the proposal has been prepared completely consistent with the terms and conditions of the solicitation. Any exceptions, deviations, and/or waivers shall render the Offeror’s proposal unacceptable to the Government. As provided below, Offerors must certify that their respective offer provided in response to solicitation
M67854-13-R-5029 does not take any exception to, deviate from or otherwise request a waiver for any of the requirements delineated in solicitation M67854-13-R-5029.
(2) The price proposal shall include a firm-fixed unit price for each separately priced CLIN in SECTION
B in the format provided for each CLIN. Stepladder pricing is requested.
(3) It is expected that this contract will be awarded based upon a determination that there is adequate price competition; therefore, the Offeror is not required to submit or certify cost or pricing data with its proposal. If, after receipt of the proposals, the Contracting Officer determines that adequate price competition does not exist, the Offeror shall provide certified cost or pricing data as requested by the
Contracting Officer.
Part II. Pricing. All dollar amounts provided in a completed Section B shall be rounded to the nearest dollar. A random evaluation quantity will be used for all stepladder and non-stepladder CLINS during evaluation.
Under Section B, a step-ladder pricing structure is preferred; because price breaks may vary by contractor, each Offeror may revise the step ladder pricing structure ranges to better accommodate where the price breaks (discounts) may be applied for their particular organization. However, the minimum quantity for the 1 st range must be 1 and the maximum quantity for the last range must be the max quantity specified for each CLIN.
Under Section B, Offerors shall not complete the Unit Price and Max Amount entry located at the top of the stepladder CLINS. Offerors are hereby notified that the CLIN pricing submitted in their respective proposal will be evaluated in accordance with the criteria delineated in Section M of the RFP.
SECTION M - EVALUATION FACTORS FOR AWARD

EVALUATION FACTORS
M-1.0 EVALUATION SUMMARY
The Government will evaluate each Offeror’s proposal, received before the RFP closing date and time established for this solicitation, and use the results in the contracting source selection decision. The source selection process will determine the overall merits of each proposal in terms of its potential to best satisfy the needs of the Government. Proposals received before the RFP closing date and time established, for this solicitation will be evaluated by a team of Government personnel. The employment and exercising of subjective judgment by the
Government evaluators is implicit in the source selection process. NOTE: Should conflicts arise between the material presented in any volumes and the CD-ROM submitted, the precedent for consideration of the proposal shall be with the written word contained in the proposal. However, if contradictory information is found in the CD-ROM, such as to discredit the claim in the paper proposal that the requirements of the PERFORMANCE DESCRIPTION can be met, then the
CD-ROM information may lead to a finding of technical unacceptability.
Basis for Contract Award. The Government reserves the right to award more than one contract against Solicitation No. M67854-13-R-5029. The Government anticipates awarding one (1) contract resulting from this solicitation to the responsible Offeror (s) using "Best Value" criteria per FAR 15.101. Award will be made to the responsible Offeror:
Whose proposal is technically acceptable;
Whose offer is deemed responsive to the solicitation requirements;
Whose overall offer represents "Best Value" to the Government.
In making its "Best Value" determination, the Government will consider overall technical merit
(i.e. non-price evaluation criteria) to be of significantly greater importance than evaluated price.
However, the importance of price as a factor in the final determination will increase with the degree of equality in the overall technical merit of the proposals.
M-4.0 PRICE.
Price will be evaluated, but not rated. The Government will calculate an “Evaluated Price to the
Government” for each Offeror’s proposal by adding together the following:
a. The Government will establish a, “Total Evaluated Price to the Government” for each offeror by multiplying the offeror’s proposed price for each CLIN listed in Section B and a randomly selected number not to exceed the maximum quantity of each CLIN; the sum of these will determine the total evaluated price to the Government.
b. The Government will evaluate each offeror’s proposed price to determine reasonableness and will award to a single awardee.
