CLAUSES INCORPORATED BY FULL TEXT

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the lowest-priced technically acceptable vendor who demonstrates satisfactory past performance.

The following factors shall be used to evaluate quotes:

(i) Price. Evaluation of price will be done on a comparative basis without examining the specific cost elements of the vendor’s quote. However, if necessary, the Contracting Officer may use alternate price analysis techniques to make a determination that quoted prices are fair and reasonable.

(ii) Technical Capability. This factor will evaluate:

(1) the vendor’s ability to provide a product that meets or exceeds the minimum salient physical, functional, or performance characteristics specified in the Purchase Description/Specification (AVAYA brand name only);

(2) the vendor’s ability to complete performance by the required delivery date; and,

(3) that the vendor demonstrates at least five (5) years of relevant corporate experience.

(iii) Past Performance. Past performance on other contracts, both private and government may be evaluated based on information provided by the vendor in accordance with the Addendum to FAR 52.212-1 and any other information available to the Government, to include evaluation of the vendor’s past performance history in the Past Performance Information Retrieval System –Statistical Reporting (PPIRS-SR) system. If the contracting officer has knowledge of the vendor’s past performance based upon on-going or previous contracts with the vendor, the government may choose not to obtain and evaluate the past performance information from a vendor’s references. Instead, the Contracting Officer may evaluate the vendor’s Past Performance using any of the methods set forth at FAR 13.106-2(b). If a vendor has no relevant past performance, the vendor must affirmatively state so. A vendor who has no relevant past performance will receive a neutral rating on past performance, which is neither positive nor negative. Vendors that fail to provide relevant past performance information, or that fail to provide the required statement confirming that they possess no relevant past performance history, will receive a past performance rating of unsatisfactory.

(b) All quotes will be evaluated for conformance with the solicitation requirements. QUOTES THAT DO NOT INCLUDE ALL OF THE INFORMATION LISTED IN THE INSTRUCTIONS FOR THE PREPARATION OF QUOTES (SECTION L) MAY BE EXCLUDED FROM EVALUATION. In addition, the Contracting Officer may reject quotes that do not meet all the material terms and conditions set forth in the request for quotes. Further, unreasonably high prices may be rejected and unrealistically low prices may be considered as evidence of the vendor’s lack of understanding of the requirement.

(c) All quotes will be evaluated by price and technical acceptability. The lowest price technically acceptable vendor will then be evaluated for past performance. If the vendor’s past performance is determined to be satisfactory, and the price is determined fair and reasonable, award will be made to that vendor without further evaluations.

(d) The Government intends to evaluate quotes and award a contract without conversations with vendors. Vendors should not expect requests for clarification or additional information from the government. Therefore, the vendor’s initial quote should contain the vendor’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct conversations with vendors if later determined by the Contracting Officer to be necessary. The Government may reject any or all quotes if such action is in the public interest, and may waive informalities and minor irregularities in quotes received.
