UNITED STATES MARINE CORPS
CHERRY POINT SATELLITE CONTRACTING OFFICE
MARINE CORPS INSTALLATIONS EAST
PSC BOX 8018
CHERRY POINT, NORTH CAROLINA 28533-0018
J&A No. 16-MCASCP10001
JUSTIFICATION AND APPROVAL FOR
USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity. Marine Corps Installations East (MCIEAST) Cherry Point Satellite Contracting Office, MCAS Cherry Point, North Carolina
2. Description of Action Being Approved. This Justification and Approval (J&A) authorizes and approves the award of a firm-fixed priced contract for an AVAYA brand name Telecommunications Switch System as required by the Fleet Readiness Center (FRC) East, MCAS Cherry Point, North Carolina.
3. Description of Supplies/Services. This brand name requirement is for an AVAYA Telecommunications Switch System to include Voice-Over-Internet-Protocol (VOIP) capability, Voice Messaging, Network Service Integration, and Conference Bridge equipment integration and installation at an FRC East leased location. A single vendor shall design, deliver, and install all components and perform related programming to successfully implement the system.
The total estimated dollar value for this effort is with a required completion date within six (6) weeks or sooner after contract award.
4. Authority. This acquisition is being made under the authority of 41 U.S.C. §253 (c), 10 U.S.C. 2304 (c) & (g), as implemented by the Federal Acquisition Regulation (FAR) 13.5, Simplified Procedures for Certain Commercial Items. Pursuant to FAR 13.501 (a)(ii), , this justification follows the format at FAR 6.303-2.
5. Rationale Justifying Use of Cited Authority. The Department of Defense (DoD) and Department of Navy (DoN) mandates use of Joint Interoperability Test Command (JITC) certified and approved communications systems. Specifically, AVAYA Telecommunications is one of the few JITC certified and approved manufacturer’s that provide these types of systems to the DoD and DoN. The AVAYA brand Telecommunications Switch Systems are the only Telephone Switch Systems utilized by and throughout the FRC East and no other manufacturer’s offering will meet the Government’s requirements. All newly procured Telecommunications Systems must be capable of interoperability with the current AVAYA systems within the FRC East. All telephone communications systems must be capable of directly connecting and interfacing to the systems within the FRC East.
Additionally, as the FRC East is a tenant aboard Marine Corps Air Station Cherry Point, there is a Marine Corps Air Station Telecommunications (G6) mandate and requirement for all Telecommunications systems to be interconnected to its main telephone switch system. The main telephone switch for the station is AVAYA and therefore further substantiates the prerequisite for this brand name requirement.
By issuance of a number of delivery / task orders over the last few recent years, the FRC East has invested substantial amount of funding and time into implementation of AVAYA hardware, software, and training of Government telecommunications maintenance personnel in an approximate amount of around for these types of systems and support to ensure
J&A No. 16-MCASCP10001 continuity of operations, systems integration, and system integrity. If another manufacturer’s hardware, software, and training were attempted to be implemented, it would result in a significant duplication of cost, time, and effort due to initial setup costs in excess of at the start for procurement, installation, interface, and training; additional costs that the Government cannot accept or entertain at this time and for which funding budgeted for.
Therefore, it is truly cost prohibitive to attempt to pursue having multiple telecommunications systems incorporated within the FRC East.
This above mentioned system is required to maintain essential mission operations at the FRC East, Government leased location. The new system is required to integrate into the current telecommunications system and will minimize the total costs of ownership.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Possible. This Justification and Approval is for a brand name only requirement, which does not provide for full and open competition. The solicitation will be posted at FedBizOpps along with a copy of this justification in accordance with FAR 5.102(a)(6) and FAR 5.2. However, as there are multiple distributors for these brand name items, the government anticipates the receipt of multiple quotes for this requirement.
7. Determination of Fair and Reasonable Cost. The Contracting Officer will determine the anticipated cost to the Government of the supplies/services covered by this J&A to be fair and reasonable in accordance with FAR 13.106-3(a), based on the receipt of competitive quotations.
8. Actions to Remove Barriers to Future Competition. For the reasons set forth in Paragraph 5, the FRC East has no plans at this time to solicit other brands for the types of supplies/services covered by this J&A.
