About this file

This is a Justification for Other Than Full and Open Competition (JOTFOC) document for the U.S. Coast Guard's requirement to repair seven Blower Assemblies (part number 23511026). The document justifies a sole-source procurement under 10 U.S.C. § 3204(a)(1), citing that only a certified MTU/Detroit Distributor can perform the specialized repair work. The estimated contract value is $15,662.78, and the justification emphasizes that using a non-MTU/Detroit dealer would negatively impact the Coast Guard due to required special tooling and technician certification.

The Coast Guard argues that only an authorized MTU/Detroit Distributor can properly disassemble, replace parts, reassemble, and return the reconditioned blower to the Surface Forces Logistics Center (SFLC). The justification highlights that the Coast Guard lacks the proprietary data, drawings, and performance rating criteria needed to solicit full and open competition, as these are patented by the manufacturer. The document indicates that the blower repair is critical for maintaining mission capability of the CG 47' MLB vessel, and the support system does not currently accommodate using non-original equipment manufacturer (OEM) parts or services.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SIMPLIFIED ACQUISITION PROCEDURES (SAP) FAR 13.106-1(b)

SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY

ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE

ITEM IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT’S REQUIREMENT. STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE INADEQUATE TO

SUPPORT A SOLE SOURCE PURCHASE.

BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE.

The SBPL has a requirement for the repair of SEVEN Blower Assemblies, part number (23511026). This requirement is for an authorized Detroit/MTU Distributor to receive the blower at their repair facility, disassemble, replace necessary parts, reassemble, and return reconditioned blower to SFLC.

UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER

SUPPLIES OR SERVICES CAN BE USED.

The use of a non MTU/Detroit Dealer distributor for this service will have a negative impact on the Coast Guard due to the special tooling and technician certification required to perform this service. Due to the nature of the blower damage, the MPDE is rendered Non-Mission Capable. Only a MTU distributor can provide the correct parts and repairs needed to ensure the blower and engine is functioning properly and accurately to new factory specifications. Using only a certified MTU/Detroit Dealer Distributor ensures and validates the engine will be functional and reliable when blower is installed in the CG 47' MLB vessel.

A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY

POTENTIAL SOURCES AS PRACTICABLE (INCLUDE YOUR MARKET RESEARCH EFFORTS HERE).

Research indicates that the needed parts and services are not available except for a certified MTU/Detroit distributor. COR continues to research the available market for qualified MTU/Detroit technicians that work for a distributorship which provides parts and service that are in accordance with OEM manufacture requirements.

REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES.

The Coast Guard takes a huge risk by having a non MTU/Detroit distributor perform work on these engines and their associated components.

EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL

AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE.

The Coast Guard does not have the proprietary data or drawings or the performance rating criteria programming to apply to the dynamometer system. It is impossible to acquire this information, as it is patented by the manufacturer and not sold or available to the public.

PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY

BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED.

In this particular case, the Coast Guard support system for these assets does not accommodate the opportunity to reorganize its logistical support and asset standardization to utilize non-OEM parts or services on these engines and their associated components.
