About this file

This is a Justification and Approval for Other Than Full and Open Competition document for an overseas contracting activity. The US Consulate General in Merida seeks to award a contract to Cesar Isidro Davila Teran for lawn maintenance and landscaping services at the Principal Officer's Residence (P-98) located at Calle 33 #378-A x 6 Montebello, Merida, Yucatan, Mexico. The estimated contract cost is $40,516.00 USD. Services include gardening, groundskeeping, lawn care, and complete maintenance of grass, shrubbery, garden areas, trees, plants, flowers, and related landscape elements to maintain the property's governmental and representational appearance. The work encompasses supplies, materials, equipment, tools, and labor.

The contracting justification invokes 41 USC 253(c)(2) and FAR 6.302-2 (Unusual and Compelling Urgency) as the statutory authority for sole-source procurement. Stated barriers to full and open competition include the lack of contractors accepting US government purchasing terms and payment conditions, insufficient RSO resources for security background investigations, staffing shortages across Post RSO, FAC, and GSO, and the inability to lose security certification of the current gardening staff. The contracting officer determined the price fair and reasonable, noting that alternative contractor quotes are approximately two times more expensive. No market survey was conducted, no other sources expressed interest in writing, and no competing quotes were solicited. The document was certified on 09/14/2026 by Mickey Ding, serving as both Management Officer and Contracting Officer.

(OVERSEAS CONTRACTING ACTIVITIES)

1. I recommend that US CONSULATE GENERAL MERIDA use CESAR ISIDRO DAVILA TERAN other than full and open competition for the acquisition of lawn maintenance services for the Principal Officer’s Residence in Merida. The estimated cost is $40,516.00 USD.

2. Nature and/or description of the action being approved.

4. An identification of the statutory authority permitting other than full and open competition. For example: 41 USC 253(c)(1), FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements; or 41 USC 253(c)(2), FAR 6.302-2, Unusual and compelling urgency.

41 USC 253(c)(2), FAR 6.302-2, Unusual and compelling urgency.

Image of a US government facility. Lack of contractors who accept the US government purchasing terms, payment times and conditions. Lack of RSO resources to perform security background investigations of new contractors.

Post RSO, FAC, GSO are understaffed and overwhelmed with the new facility, the hiring freeze, managing numerous preventive maintenance actions for critical building systems in order to maintain warranty compliance. Post cannot afford to lose the security certification of the current gardening staff for work inside the POR.

1. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited (for sole source acquisitions; also required for unusual and compelling urgency where more than one offer will not be solicited).

The contractor has a solid past performance and access to the required equipment, experience and knowledge.

Contractor has provided all requested information. Contractor price is reasonable.

2. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The description should include whether a FedBizOps notice was or will be publicized, as required by FAR 5.2, and if not, which exception under FAR 5.202 applies (e.g., blanket waiver provided in DOSAR 605.202-70).

Other contractor quotes are two times more expensive

3. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
