About this file

This document is a Justification and Approval for Other Than Full and Open Competition (JOFOC) for the U.S. Consulate General in Merida. The procurement is for spare parts for active roadway barriers at the New Consulate Compound, with an estimated cost of $17,500 USD. The U.S. Consulate intends to sole-source the contract to RSSI Barriers, LLC, the original manufacturer and installer of the barriers, due to the critical nature of the parts and the need to maintain system integrity and warranty coverage.

The justification emphasizes that the active roadway barriers are a mission-critical infrastructure component requiring specific, proprietary parts. Multiple requests for quotation were issued to U.S. and local vendors, but no alternative sources could provide compatible parts. The procurement is urgent, with a requirement to complete the purchase before the end of the fiscal year to obligate FY25 funds. The sole-source determination is based on FAR 6.302-1, citing RSSI Barriers, LLC as the only responsible source capable of meeting the Department of State's unique equipment specifications and maintaining the system's operational standards and warranties.

JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION

(OVERSEAS CONTRACTING ACTIVITIES)

1. I recommend that US CONSULATE GENERAL MERIDA uses RSSI Barriers, LLC, other than full and open competition for the acquisition of Merida Spare Parts for Active Roadway Barriers.

The estimated cost is $17,500 USD.

2. Nature and/or description of the action being approved.

Procurement of recommended spare parts—specifically active roadway barriers. This action is based on guidance from OBO/Construction and findings from the Facilities (FAC) team’s inspection of all active roadway barriers equipment to ensure optimal performance, system integrity, and compliance with Diplomatic Security and maintenance standards.

3. A description of the supplies or services required to meet the agency’s needs.

This procurement is for spare parts for active roadway barriers at New Consulate Compound (NCC) in Mérida. The active vehicle barriers system is a mission-critical infrastructure component that supports secure and safe access to the compound and must meet the operational standards set by the U.S. Department of State’s Bureau of Overseas Buildings Operations (OBO) and Diplomatic Security. The system requires parts of specific dimensions that are compatible with the design specifications and mechanical configuration of the equipment. These parts are essential for maintaining system integrity, operational performance, and compliance with manufacturer warranties. The use of non-compatible or substitute parts could lead to incorrect operation or failure of the barriers, reduced efficiency, equipment damage, and loss of warranty coverage. The objective of this procurement is to establish an on-site inventory of critical spare parts, enabling prompt replacement, reducing system downtime, and ensuring uninterrupted operations. Due to the complexity and proprietary nature of the active roadway barriers, only parts from manufacturer RSSI Barriers, LLC are currently viable to ensure system compatibility, preserve warranties, and maintain system integrity. The manufacturer emphasizes that the use of non-OEM components will disqualify warranty coverage.

4. An identification of the statutory authority permitting other than full and open competition.

For example: 41 USC 253(c)(1), FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements; or 41 USC 253(c)(2), FAR 6.302-2, Unusual and compelling urgency.

FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

Post issued multiple Requests for Quotation (RFQs) directly to U.S. based and local vendors, capable of supplying Department of State spare parts. However, no other vendor was able to provide a quote for the items specifically requested in a reasonable time-frame. Most of the vendors were not able to identify the items.

RSSI Barriers, LLC is the manufacturer and installer during construction. It is known as a an OBO reliable vendor capable of meeting U.S. government contract standards, making them the only responsible source.

Further delays in procuring these filters would risk the roadway barriers failure and negatively impact building operations and compound security.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited (for sole source acquisitions; also required for unusual and compelling urgency where more than one offer will not be solicited).

RSSI Barriers, LLC is OBO Construction provider and installer for over 100 OBO projects worldwide. RSSI barriers, LLC supplied and installed Merida active roadway barriers.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The description should include whether a FedBizOps notice was or

(OVERSEAS CONTRACTING ACTIVITIES)

will be publicized, as required by FAR 5.2, and if not, which exception under FAR 5.202 applies (e.g., blanket waiver provided in DOSAR 605.202-70).

Due to the urgent need and the custom nature of the parts, Post issued multiple Requests for Quotation (RFQs) directly to U.S. based and known local vendors, capable of supplying Department of State specific parts. A synopsis was not posted to SAM.gov (formerly FedBizOpps) due to the urgency of the requirement and in accordance with the blanket exception provided in DOSAR 605.202-70, which waives the requirement to publicize for overseas contracting actions conducted under FAR 6.302-2. Given the time-sensitive nature of the need, further delay to allow public notice would be contrary to the public interest.

7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

I have determined the cost to be fair and reasonable.

8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.

Post solicited quotes from U.S. based and local vendors for the required parts. However, no other vendor was able to provide a quote for the specific parts listed. In addition, the manufacturer emphasizes that the use of non-OEM components will disqualify warranty coverage.

9. Any other facts supporting the use of other than full and open competition.

The Facility Management section urgently requires these spare parts to support post (Security and Motorpool) operations across the entire compound. The procurement must be completed before the end of the fiscal year to ensure timely obligation of FY25 7115 funds, which will expire after September 30th and will not be available in the next fiscal year. Any delay in procurement would result in a loss of critical funding, hinder preventive maintenance efforts, and potentially impact building systems essential to security, safety, and post operations.

10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition.

None

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

Merida active roadway barriers use parts that are not common in the commercial market, due to the building unique and specific design by OBO and DS. Post is unable to change equipment design for warranty purposes. If post alters equipment, the warranty by the construction company will be void.
