DEFENSE LOGISTICS AGENCY
DLA CONTRACTING SERVICES OFFICE - PHILADELPHIA
700 ROBBINS AVENUE
PHILADELPHIA, PENNSYLVANIA 19111-5092
JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. REQUIRING AGENCY AND CONTRACTING OFFICE:
Contracting Activity:
DLA Contracting Services Office, Philadelphia (DCSO-P) 700 Robbins Avenue Philadelphia, PA 19111
2. NATURE/DESCRIPTION OF THE ACTION BEING APPROVED:
Pursuant to Federal Acquisition Regulation (FAR) 6.302-1, this justification authorizes the use of other than full and open competition for the procurement of brand-name specific “NetScout” maintenance renewal for DLA’s existing NetScout nGenius InfiniStream Hardware, Software, and Inside Service Engineer (ISE) Services. As discussed in detail below, brand-name NetScout maintenance services are essential to the Government’s requirement. Brand-name NetScout services are only available from a limited number of responsible sources – NetScout Systems, Inc. and its authorized resellers – and no other services will satisfy agency requirements. Market research indicates other companies’ similar services do not meet, or cannot be modified to meet, the Agency’s needs.
Maintenance for DLA’s existing NetScout Hardware and Software is currently being provided under Contract # SP4701-19-F-0074. The solicitation will be issued via Open Market procedures as a Combined Synopsis/Solicitation – Request for Proposal (RFP) posted to the Contract Opportunities (beta.sam.gov) system. An award of a firm-fixed-price (FFP) contract is contemplated.

4. IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER
THAN FULL AND OPEN COMPETITION:
The statutory authority permitting other than full and open competition is Title 10, U.S.C 2304 (c)(1), as implemented by FAR 6.302-1, “Only one responsible source and no other supplies or services will satisfy agency requirements.”
5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE
QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF
THE AUTHORITY CITED:
In accordance with FAR 6.302-1, brand-name NetScout services are essential to the Government’s requirement to continue monitoring DLA network traffic, provide retrospective analysis of DLA network connectivity problems, and troubleshoot in response to real world cybersecurity threats and tasks from U.S. Cyber Command. The services required by the Agency are only available from a limited number of responsible sources – NetScout Systems, Inc. and its authorized resellers – and no other type of services will satisfy the Agency’s needs.
A brand-name product, whether available on one or more contacts, is an item or service peculiar to one manufacturer and may be procured by brand-name specification if essential to the Government’s requirements. Here, DLA requires the procurement of brand-name NetScout maintenance renewal services for the Agency’s NetScout nGenius InfiniStream Hardware, Software, and ISE Services because these commercial support services are essential to DLA’s mission requirements to ensure cybersecurity and safeguard the integrity of the DLA network.
The Inside Service Engineer (ISE) Services provide direct support for the DLA NetScout architecture to include, but not limited to patches, upgrades, migrations, installations, health checks, deployments, vulnerability mitigations, ticketing and escalations. It also provides configurations for proactive monitoring, baselining, alarming and reporting of network and application performance. Additionally, the ISE Services are essential to maintaining J64-DBBB and the network monitoring of the DLA mission critical applications and the rapidly changing cybersecurity requirements. This service is only provided by NetScout and their authorized resellers.
Brand-name NetScout nGenius support services provide network monitoring capabilities that are essential to DLA. NetScout nGenius InfiniStream Hardware, Software, and ISE Services are used in monitoring network traffic and provide a retrospective analysis capability of network connectivity problems by providing data playback of reported issues. This capability provides DLA the ability to monitor and troubleshoot in response to real world cybersecurity threats and tasks from U.S. Cyber Command. Without this capability, DLA will not be able to effectively monitor and troubleshoot DLA networks, critical applications and cybersecurity threats.
Additionally, without the ISE, DLA would not be able to timely resolve any technical issues or mitigate any new found cybersecurity threats.
Only NetScout Systems, Inc., the original equipment manufacturer (OEM), and its authorized resellers can meet the Government’s needs because NetScout software code is proprietary;
therefore, maintenance, including patches and updates required for DLA’s existing NetScout
Page 5 of 7 Pages infrastructure, is not available from any source other than the OEM and authorized providers of these services. Demonstrably, the NetScout brand-name specification is essential to the Government’s requirements, thereby precluding consideration of maintenance services provided by an alternative source.
6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE:
The current action will be issued on an unrestricted basis. A Combined Synopsis/Solicitation – Request for Proposal (RFP) will be posted to the Contract Opportunities (beta.sam.gov) system in accordance with FAR 5.201(b). All responsible parties will be given an opportunity to submit an offer.
7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE:
As the Contracting Officer, I hereby determine that pricing will be fair and reasonable based on pricing analysis in accordance with FAR 15.404-1. It is anticipated that the Government will use various prices analysis techniques including, but not limited to: 1) comparison of proposed prices received in response to the solicitation (reference FAR 15.404-1(b)(2)(i)); 2) comparison with competitive published price lists (reference FAR 15.404-1(b)(2)(iv)); and/or 3) comparison of proposed prices with prices obtained through market research of the same or similar items (reference FAR 15.404- 1(b)(2)(vi)), in order to obtain a fair and reasonable price.
8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT
CONDUCTED
Based on current market research conducted February 19, 2020, it has been determined that only the aforementioned maintenance services can fully meet the Government’s need. No competitor functional replacement services exist in the market at this time to meet the Government’s need.
The Government will continue to conduct market research to determine if there are changes in the marketplace that would enable future competitive action, i.e. whether there are similar product support services in the marketplace that provide the same functionality, whether the original equipment manufacturer releases ownership rights of the product, and/or whether it is economically feasible to procure a new system.
Market research actions were conducted amongst the OEM and authorized resellers of the required NetScout services. These actions included a Request for Information (RFI) posted to both the NASA SEWP System and GSA eBuy, and a Sources Sought announcement created under Open Market procedures and posted to the Contract Opportunities (beta.sam.gov) system.
The findings from this market research confirmed that concerns were capable of providing the required support via Open Market procedures. A decision was made to issue the requirement on an unrestricted basis as a Combined Synopsis/Solicitation – Request for Proposal under Open Market procedures and posted to the
Page 6 of 7 Pages
Contract Opportunities (beta.sam.gov) system in an effort to disseminate the requirement to the maximum number of potential sources.
9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND
OPEN COMPETITION:
N/A
10. LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN
INTEREST IN THE ACQUISITION:
The following vendors have expressed interest in this requirement:
11. STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY
SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED:
At this time, the required NetScout maintenance services provided by the OEM and its authorized resellers are the only services that will support DLA’s requirements and satisfy the Government’s needs. However, DLA has exercised, and continues to exercise, competition as often as possible and is required to conduct ongoing reviews to keep abreast of new technology, both in industry and in the Government. DLA utilizes a variety of vendors, manufacturers, and contracts to fulfill its requirements and will continue the practice of surveying the market to ensure full and open competition to the maximum extent practicable.
