About this file
This is an Invitation to Bid (ITB) Terms and Conditions document issued by the Alabama Department of Public Health (ADPH) for the procurement of Luxel+ PA Dosimeter Badges. The ITB seeks to establish a 12-month contract with options to extend for four additional 12-month periods at the same pricing, terms, and conditions, with written approval required from both parties no later than 30 days prior to expiration of each period. The exact quantities of items to be purchased are not predetermined, and the state makes no guarantee regarding purchase volumes. All delivery must occur within 30 days of the supplier's receipt of a purchase order. Questions must be submitted through the Alabama Buys Portal by Friday, August 21, 2026, and any requested additional information from suppliers must be provided within five business days of receipt.
Award will be made on an "all or none" basis to the lowest responsible bidder meeting all specifications. All equipment must be new and unused, acceptable by the original equipment manufacturer, and include a one-year standard warranty plus a three-year extended warranty from the date of installation. Bidding on alternate items requires submission of complete descriptive and technical literature with the bid; failure to provide such documentation may result in bid rejection. The bid is F.O.B. destination with all freight charges included in bid prices. A price escalation clause permits increases only if documented and approved in writing by both parties, with increases capped at the Consumer Price Index rate for the same period; any price de-escalations must be passed to the state immediately. Defaulting suppliers may be subject to procurement of goods from alternate sources at the supplier's expense, plus potential suspension or debarment under Alabama law.

BID SUBMISSION INSTRUCTIONS:
Beginning on the alabamabuys supplier portal page, select the desired sourcing project.
Once project is opened make sure the left panel is expanded. If not, click on small double arrows to expand. Be sure to review each tab for necessary information and enter bid amounts on item grid as needed. After you have checked and completed each tab, you can validate and submit your bid.
Delivery time frame:
All items ordered must be delivered to the "ship to" address shown on the P.O. within thirty
(30) days of supplier's receipt of order.
Quantity:
The exact quantity of purchases for each item listed is not known. The Division of Procurement does not guarantee that the state will buy any amount.
Descriptive Literature:
The brands and model numbers referenced provide a level of quality, and unless otherwise specified, are not restrictive. Suppliers bidding alternate items must provide complete descriptive/technical literature for consideration and evaluation with their bid, as required by the ITB submission instructions. Reference to literature with a previous bid will not satisfy this requirement. Failure to provide the required literature may result in the rejection of the bid response.
New equipment:
All equipment must be new and unused and acceptable by the original equipment manufacturer for their maintenance.
PRICE ESCALATION CLAUSE:
If, during the performance of this contract, the price of the material or cost of the labor involved significantly increases through no fault of the supplier, a price increase may be considered. Documentation of a price increase for materials is required from the manufacturer. Documentation of a price increase for labor is required from the supplier.
Any proposed increases in labor and/or materials may not exceed increases in CPI (Consumer Price Index) for the same time-period. All price increases must be approved by both the state and the supplier in writing. Any de-escalation in price shall be passed onto the state immediately while still meeting all specifications, terms and conditions of the contract.
Warranty:
Must include (1) year standard warranty and additional (3) year extended warranty from date of installation.
Freight:
Bid is F.O.B. destination. Any freight charges must be included in the bid prices.
Default:
When a supplier defaults on a contract and/or purchase order, the State may procure the goods or services under the contract from other sources and the defaulting supplier shall be responsible for any additional costs incurred by the State for the procurement from other sources. The defaulting supplier may also be subject to suspension and/or debarment in accordance with the Code of Alabama or the State of Alabama Department of Finance Administrative Code.
Contract period:
Establish a 12-month contract with an option to extend for a second, third, fourth, and fifth 12-month period with the same pricing, terms, and conditions. The second, third, fourth, or fifth 12-month period, if agreed by both parties, would begin the day after the first, second, third, or fourth 12-month period expires. Any successive extension must have written approval of both the state and supplier no later than 30 days prior to expiration of the previous 12-month period.
