Fixed Capacity Agile Delivery Methodology approach:

The delivery of the Illinois Labor Relations Board Case Management Solution services mentioned in the SoW will be based on a Fixed Capacity Agile Delivery Methodology which combines the principles of Agile Methodology with the concept of fixed capacity.

Based on the principles of Agile Methodology (which emphasizes iterative and incremental delivery, collaboration, and flexibility), the delivery team (consisting of Microsoft and Customer personnel) works to deliver towards the expected outcomes as defined in the SoW in a planned period of time as per the defined fixed capacity.

The parties understand and agree that due to the Fixed Capacity Agile Delivery nature of this engagement:

1. The scope areas and/or business objectives outlined in section 1 and section 2.1 of the SOW serve as the targeted scope to facilitate the establishment of initial backlog items.

However, it is important to understand that these scope areas or business outcomes do not constitute a fixed scope of work.

2. The cost of the project is represented in the planned delivery team capacity and is based on the understanding of the project requirements, timelines, and assumptions as represented in section 2.1 and section 3.2 of the SOW, as well as customers fulfillment of its obligations as per section 5.2.1 and 6.

3. The services delivered by the time of conclusion of the engagement may or may not cover the full scope and/or business outcomes and all product backlog items identified by the Customer Product Owner.

4. The Customer Product Owner is responsible for the prioritization of the product backlog and to ensure maximum utilization of the delivery capacity as defined in the Consulting Services Fees section 2 below.

5. Microsoft relies on the Customer Product Owner to prioritize the product backlog and doesn’t take responsibility for the completion of the scope areas and/or business outcomes.

6. Any change to above, including but not limited to changes to the delivery capacity, will be governed by the Change Management Procedure as defined in section 4.4 of the SOW and may have an impact on overall project cost and timelines.

7. Both the Customer and Microsoft, collectively referred to as the Parties, acknowledge that the nature of the services rendered does not necessitate a formal acceptance process.

Therefore, except as provided in the Statement of Work, the Parties expressly confirm that none of the Service Deliverables provided under this Work Order, if any, require formal acceptance from the Customer

2. Fees.

Customer will pay the following hourly rates and any reasonable out of pocket travel and living expenses (if any) for the individual assigned. Microsoft reserves the right to utilize whichever labor categories in whatever quantities Microsoft determines, in Microsoft’s sole discretion, are appropriate to perform the Professional Services. Any total fee stated is an estimate only. In order for Microsoft to continue providing hours of Professional Services beyond those funded in the table below, Customer and Microsoft must agree in writing to a new work order or amendment to this work order adding funding for the additional Professional Services and any other terms upon which Customer and Microsoft agree. The rates for any additionally funded hours of services will be the rates defined in the then current Microsoft published price list. The fees do not include fees for Products. Unless otherwise specified in the invoice, Customer agrees to pay Microsoft pursuant to the terms and conditions of the Contract (25-448DOIT-INFOT-P-84650)
