Indian Health Service Buy Indian Act Indian Economic Enterprise Representation Form

This is a self-certification form issued by the Indian Health Service (IHS), Office of Management Services, Division of Acquisition Policy, for use in response to Sources Sought Notices, Requests for Information (RFI), or Solicitations. The form establishes eligibility requirements for offerors seeking to qualify as an "Indian Economic Enterprise" (IEE) under the Buy Indian Act (25 U.S.C. 47) and HHSAR 326.601.

Offerors must certify that they meet the IEE definition with Indian ownership at three critical time periods: when submitting an offer, at contract award, and throughout the full contract performance period. Any changes in eligibility status require immediate written notification to the Contracting Officer. The form requires submission of basic business information including the Federally Recognized Tribal Entity affiliation, 51% owner name, business name, DUNS number, and a certifying signature. Contracting Officers may request documentation of eligibility prior to awarding set-aside or sole source contracts under the Buy Indian Act, and awards are subject to protest if offeror eligibility is questioned. Successful offerors must be registered with the System of Award Management (SAM). The form warns that false or misleading information is punishable under 18 U.S.C. 1001, with false claims during contract performance subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287.
