About this file

This is an Indian Health Service Buy Indian Act Indian Economic Enterprise Representation Form, a template used by the Department of Health & Human Services to verify contractor eligibility for set-aside or sole source contract awards under the Buy Indian Act authority.

The form requires offerors to self-certify that they meet the definition of an "Indian Economic Enterprise" (HHSAR 326.601) with Indian ownership as defined in 25 U.S.C. 47. Contractors must maintain eligibility at three critical points: when submitting an offer, at the time of contract award, and throughout the full contract performance period. Any loss of eligibility during these periods requires immediate written notification to the Contracting Officer. The form also requires successful offerors to register with the System of Award Management (SAM). Offerors must indicate whether they do or do not meet the Indian Economic Enterprise definition and provide the name of the federally recognized tribal entity, the 51% owner of the Indian Economic Enterprise firm, business name, certifying signature, printed name, and Unique Entity ID (UEI). The form warns that false or misleading information submitted is a violation of law punishable under 18 U.S.C. 1001, and false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. Contracting Officers may require documentation of eligibility before award, and awards are subject to protest if the successful offeror's eligibility is questioned.
