SECTION B: EVALUATION FACTORS

The Government will make an award representing the best value to the Government considering: (1) technical conformance to the specifications listed in the attached Statement of Work (SOW), (2) Past Performance and, (3) Price. The two (2) non-price factors, Technical Conformance and Past Performance, when combined will be more important than the Price Factor. However, as non-price factors become more equal the price factor will be become more important.

Vendors must submit a price quotation for ALL items listed in this procurement to be eligible for an award.

TECHNICAL CONFORMANCE

The technical conformance will be evaluated to determine capability of the vendor to provide the requirement in accordance with (IAW) the Special Packaging Instructions (SPI) listed in section “A” Schedule of Items of the RFQ and in accordance with the attached SOW. If a vendor is determined to meet the requirement by offering the requirement as specified, they will receive a “Pass”. However if they do not offer all products in accordance with the SOW or as listed in section “A” they will receive a “fail”, and no further evaluation will be conducted.

The Technical evaluation factor will be based on a Pass/Fail rating.

PAST PERFORMANCE

The Government is seeking to determine whether the vendor consistently delivers quality products in a timely and cost effective manner. GSA will use any credible information available for the vendor in evaluating their quote to include information obtained from the Past Performance Information Retrieval System (PPIRS) if a report exists. Website for PPIRS is (http://www.ppirs.gov/). A quotation with no past performance of the same general nature or for which no information is available will not be evaluated as favorably or unfavorably. They will receive a “neutral confidence” rating. For evaluation purposes a neutral rating will be considered equal to a “satisfactory confidence” rating.

PRICE FACTORS

Price does not have an assessment rating assigned to it. Each vendor shall submit firm fixed price for all items listed. The total aggregate destination price will be considered for award.

In-order for GSA to make a fair and reasonable price determination, additional market research may be conducted even if competitive quotes are received. The Contracting Officer may also request vendor’s to submit any available pricing data and/or relevant sales/invoice history in order to further substantiate the price reasonableness of the quote submitted to the Government.

SECTION C: INSTRUCTIONS FOR SUBMITTING QUOTATION

Response package Development Instructions

Any questions regarding this procurement shall be sent to e-mail: terri.darr@gsa.gov and kervin.dupart@gsa.gov simultaneously with the subject line “RFQ Questions on RFQ #ID07190016,” no later than 2PM Central Standard Time (CST) five (5) business days after the solicitation is released. No questions shall be entertained regarding this RFQ after January 22, 2019, 12PM CST. The GSA CO will compile all questions and responses and post them in ITSS via solicitation amendment for all vendors to view. It is the Government’s intention not to extend the RFQ beyond the original closing date of February 15, 2019 at 2PM CST.

The proposal closing date in ITSS is February 15, 2019 at 2 PM (CST). Extension to the RFQ closing date and time will not be granted due to a vendor’s late registration in ITSS. Any proposal received by GSA after the closing date/time is late and will not be accepted or considered for award.

The contractor must submit the response by the date and time established in the notice posted in GSA’s Electronic Ordering System, known as ITSS. If the submission cannot be uploaded to ITSS due to technical difficulty, immediately report the problem to the ITSS help desk and the CS, terri.darr@gsa.gov and the CO, Kervin Dupart kervin.dupart@gsa.gov simultaneously in sufficient time prior to closing to allow for the submission of the package via an alternative method at the CO’s discretion.

NOTE: Failure to register properly in GSA’s Electronic Ordering System (ITSS) is not an acceptable reason for the inability to submit a quote/proposal or to receive communications regarding this solicitation.

All interested offerors must submit their proposal via GSA’s IT Solution Shop (ITSS) web-based order processing system. Proposals will only be received and awarded via ITSS. The link is listed below and the ITSS Help Desk number is 1-877-472-4877. ITSS webpage is https://portal.fas.gsa.gov .

Vendors shall use IT Solution Shop (ITSS) to receive the RFQ and all amendments, as well as submit its proposal through the system. To receive the RFQ, and submit a proposal for consideration for award, all interested vendors must: send GSA an email identifying (1) vendor’s name, and (2) the name of an individual vendor employee who will act as the vendor’s GSA point of contact (POC) for this requirement that is “registered in IT Solution Shop (ITSS)”. VENDORS

MUST IDENTIFY THE COMPANY NAME OF THE VENDOR AND THE POC’S NAME

EXACTLY AS IT APPEARS IN ITSS. “Registered in ITSS” or “Registration in ITSS” means a vendor is successfully registered in ITSS such that the Government can select vendor’s designated POC in ITSS to receive the RFQ, view an order, and be able to submit a proposal. Some vendors have multiple company divisions and employees registered in ITSS making it difficult for GSA selection. Therefore, to ensure that all interested vendors receive the RFQ, prompt submission of the above ITSS vendor information (vendor’s name and POC) is requested. An email must be sent to terri.darr@gsa.gov in order to ensure registration.

F.3.3 FAR 52.209-5 Certification Regarding Responsibility Matters (Oct 2015) (a)(1) The Offeror certifies, to the best of its knowledge and belief, that—

(i) The Offeror and/or any of its Principals—

(A) Are □ are not □ presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(B) Have □ have not □, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks “have”, the offeror shall also see 52.209-7, if included in this solicitation);

(C) Are □ are not □ presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision;

(D) Have □, have not □, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied.

(1) Federal taxes are considered delinquent if both of the following criteria apply:

(i) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(2) Examples.

(i) The taxpayer has received a statutory notice of deficiency, under I.R.C. § 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. § 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the https://www.acquisition.gov/sites/default/files/current/far/html/52_207_211.html#wp1144964 taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability.

Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. § 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms.

The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).

(ii) The Offeror has o has not o , within a three-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.

(2) “Principal,” for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

This Certification Concerns a Matter Within the Jurisdiction of an Agency of the United States and the Making of a False, Fictitious, or Fraudulent Certification May Render the Maker Subject to Prosecution Under Section 1001, Title 18, United States Code.

(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.

(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror’s responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror non-responsible.

(d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.

(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.
