The purpose of this amendment is to incorporate the following changes:

2. Add clause 52.219-4 Notice of Price Evaluation Preference for HUBZone Small Business Concerns.

3. Amend sections L.04 Technical Proposal Instructions and M.01 Evaluation Factors for Award as attached.

L.04 Technical Proposal Instructions

A. General. The technical proposal shall be identified as Volume II of the Offeror's proposal and shall be an orderly, specific, and complete document in every detail. It shall be presented in a manner which allows it to “stand alone” without the need to refer-ence other documents. It shall convincingly describe the capability of the Offeror's organization to participate in this project and ef-fectively demonstrate a thorough understanding of the work statement contained in Section C of this solicitation.

a. The proposal shall be organized and written so that it can be easily read and meaningfully evaluated by USIBWC personnel from a variety of different functional and technical disciplines.

b. It shall be a coherent document free of internal inconsistencies as well as inconsistencies with other volumes of the proposal.

c. The technical proposal shall not contain any cost or pricing information.

B. Use and Disclosure of Proposal Information. In accordance with the Use and Disclosure of Proposal Information provision of this solicitation, Offerors shall mark trade secret or confidential commercial or financial information contained in the proposal with the restrictive legends specified. The Offeror shall also clearly and separately mark all proprietary information (as defined in FAR 3.104-3) contained in the proposal with the restrictive legend “Proprietary Information.”

C. Technical Proposal. The technical proposal shall contain the following factors (a., b., c., etc.) and subfactors (1., 2., 3., etc.). All factors and subfactors will be evaluated.

a. Format and Content.

1. Proposals shall be legible, clear, and easy to read. To assist in the uniform evaluation of proposals, the following format shall be utilized in preparing the technical proposal:

(a) Table of Contents. The Table of Contents shall list all sections of the technical proposal. Any future amendments, additions and/or revisions to the proposal shall be included in an updated Table of Contents.

(b) Index. The index shall cross reference the work statement to the terms of the proposal and indicate how the proposal con-forms to the evaluation factors contained in Section M.

(c) Enclosures. The enclosures shall include a list of any tables, drawings, charts, and any other enclosures which summarize data or information.

(d) Executive Summary. The Executive Summary shall include a brief discussion of how the required work will be performed and important highlights of the proposal.

(e) The technical proposal shall not exceed 30 double-sided pages in length (60 single-sided), excluding cover page, table of con-tents, resumes, and references.

(f) Technical information shall be submitted in both hard copy and electronic format (pdf). Pdf shall be high quality scan or document produced directly to pdf.

(g) Page Numbering. All pages in the cost proposal shall be consecutively numbered (including pages with tables and exhibits).

The Offeror shall clearly identify all exhibits and supporting information.

b. Technical Plan for Construction - The technical plan will be evaluated on the extent to which the Offeror demonstrates technical sufficiency in the proposed technical and management approach to perform and support the requirements of the Solicitation.

1. Ability. Offerors shall provide detailed information relating to each proposed task area(s) which demonstrates their ability to satisfactorily meet the work requirements.

(a) Examples of demonstrated ability include providing a narrative summary of relative experience that explains how such exper-ience related to the required task(s) and the Offeror’s ability to satisfy the requirements.

(b) General statements made by the Offeror such as “We have reviewed the requirements and can meet the stated requirements,” shall NOT be considered a demonstration of Offeror’s ability to perform.

(c) Examples of how to approach the work, especially problem areas, adds to the depth of the technical plan.

2. Members. For all proposed teaming and/or joint venture arrangements (more than one contractor), the Offeror shall submit the name, address, and primary point-of-contact for each team member or subcontractor, as well as a copy of any signed agreements.

The Offeror shall also list all proposed subcontractors, major vendors, and engineering QC laboratories. Company name, address, phone number, and the name of a point-of-contact are required for each.

3. Resources. The Technical Proposal shall also include details of available resources to handle unforeseen problems and delays in order to maintain the schedule and completion date.

c. Past Performance

1. Offerors shall distribute signed Client Authorization Letters and Past Performance Questionnaires (see Section J Attachments for the sample letter and questionnaire) to current or past customers for projects completed within the past five (5) years that were sim-ilar in scope, magnitude, relevance, and complexity to this requirement.

(a) If an official partnership or joint venture agreement exists, then past performance questionnaires are required for all compan-ies in the agreement.

(b) Include copies of all Client Authorization letters in this section of the Technical Proposal.

(c) Past performance questionnaires shall be evaluated on the extent they show relevant performance, safety, and the likelihood of success in meeting the Government’s requirements as identified in the Solicitation. The information shall specifically include the following:

(i) Name of Agency or Company

(ii) Name and location of each project.

(iii) Original completion time and date, and actual dates and duration of each project.

(iv) Name, address, and telephone number of owner.

(v) Form of contract and contract number used on each project.

(vi) Company's association with owner (i.e. prime contractor, subcontractor, joint venture sponsor).

(vii) For subcontract or joint venture, indicate the percentage of work actually performed by the company on the project.

(viii) Original contract value of each project.

(d) A minimum of five (5) past performance questionnaires (for each Offeror and for each company identified in (a) above) shall be provided to the CO.

(e) Do not include copies of the past performance questionnaires in the Technical Proposal.

d. Experience - This applies to the Prime Contractor/Joint Venture and all subcontractors who are being proposed to perform at least 15 percent of the work.

1. Organizational Structure - Furnish a narrative description of the organizational structure and function of the jobsite manage-ment and home office.

(a) Indicate the capabilities and experience of project management in the areas of engineering, environmental remediation, con-tract administration, construction scheduling, estimating, design, purchasing, safety, quality control, and equipment management.

2. Corporate Experience - Furnish complete and detailed information regarding construction contracts for past projects which show your company's experience in work matching the requirements of this Solicitation. Include experience of any teaming partners or joint venture companies.

(a) Do not simply provide a project list.

3. Onsite Project Management - Include complete data sheets or resumes and jobsite responsibilities for the onsite project man-ager, the foreman/supervisor, the site safety officer, the quality control system manager, and other key positions. Review the Technic-al Specifications for qualification requirements for all other positions.

(a) Include a statement of assurance that the proposed personnel will be available for work on this contract, and a list of alternat-ive personnel sources to be utilized in the event proposed personnel are not available as planned (Include full resume by name of all alternative personnel listed).

(b) Data sheets or resumes shall contain as a minimum the following information:

(i) Name

(ii) Educational background.

(iii) Qualifying experience covering at least the minimum experience periods:

(1) Project name, locations and dates of assignment.

(2) Description of primary project features.

(3) Name, address, and phone number of project owner.

(4) Name, address, and phone number of employer on each project.

(5) Name, address, and phone number of superior.

(6) Position(s) occupied on each assignment, and the time assigned to each position, including current position.

(7) Description of duties and responsibilities of each position occupied.

e. Safety

1. The Technical Proposal shall include a project specific analysis of the hazards expected to be encountered. The hazard ana-lysis shall be in sufficient detail to indicate the Offeror’s understanding of the safety issues of the work involved at this worksite as well as hazards specific to the worksite itself.

(a) The Offeror shall become familiar with and use specific references from the US Army Corps of Engineers EM 385-1-1 Safety and Health Requirements.

(b) Attachment of an Activity/Job Hazard Analysis (AHA/JHA) is not appropriate.

f. Construction Schedule

1. Schedule - The Offeror shall provide a realistic, logical construction schedule. The schedule shall include a bar/Gantt chart and shall include the principal components of the work including any critical paths and milestones.

(a) The schedule shall show durations of the principal components of the work and anticipated start and finish dates. The sched-ule shall include time for submittals and Government approvals.

(b) The construction schedule shall be in such detail as to show the sequencing of the principal components of work contained in the schedule and other activities or information required to accurately portray the Offeror’s proposed construction schedule.

(c) Provide list or narrative detailing assumptions made when creating schedule.

(d) For purposes of preparing the schedule, Offerors shall assume a notice to proceed date of October 17, 2017.

2. Resources - A resources description shall cover all major activities, be directly correlated to the schedule, and shall take the form of a written or tabular supplement to the schedule.

(a) It shall include specific information identifying the Offeror’s assumptions including but not limited to: access, time of year, unforeseen problems, and periods of non-work.

(b) The description shall describe resources including assumed production rates, material lead time, equipment types, capacities, sizes, shifts, and crew sizes.

g. Resource/Value Information

1. To permit objective evaluation of the technical proposal, no cost or price information shall be included in the technical pro-posal. However, the proposal shall include:

(a) Breakdown - A breakdown of unpriced labor hour estimates for each labor category as well as equipment hours estimates for each type of equipment proposed to accomplish each task or phase of the work (as indicated on your Schedule of Values) and the basis for each estimate. Also include an identification of the types and quantities of proposed materials and equipment necessary to perform the work.

(b) Schedule of Values - Since the Contract is based on a lump sum bid price, the Offeror shall prepare and submit a breakdown work estimate covering the lump sum portion of the project. The breakdown estimate shall show the estimated percentage value of each kind or item of work. The sum of the lump sum items listed in the breakdown estimates shall equal 100%. This breakdown shall be referred to as the Schedule of Values. The Schedule of Values shall be consistent with the baseline progress schedule.

Section M- Evaluation Factors for Award

Clause M.01 Evaluation Factors for Award was deleted or updated.

M.01 Evaluation Factors for Award

A. Basis for Award

a. Award will be made to the responsible Offeror submitting a proposal which conforms to the solicitation and is most advantage-ous to the Government considering the factors and any significant subfactors listed in this provision.

b. The relative importance to be placed on the evaluation factors in relation to each other is listed below under "Factors for Award." If a proposal is determined by the Contracting Officer to be "technically unacceptable" as a result of evaluating all factors other than cost or price, the proposal may be rejected from further consideration. The Contracting Officer reserves the right to make award to either a lower cost/price, lower-scored Offeror or a higher-rated, higher-cost/price Offeror based on a rational tradeoff between evaluation factors other than cost or price and cost or price. Since technical proposals are being solicited to obtain informa-tion to be used in the evaluation, the Government reserves the right to use information outside of the proposal to evaluate the capabil-ity of Offerors and the value of offers.

c. Pursuant to FAR 15.305, a cost or price evaluation may be performed to determine the reasonableness of costs/prices proposed and the Offeror's understanding of, and ability to perform, the prospective contract.

B. Factors for Award - The following factors and subfactors, will be considered in evaluating proposals and making the source selection:

a. Technical Factors - A Technical Proposal Evaluation Committee will evaluate the technical proposals according to the criteria listed in this provision. Subfactors are evaluated independently to arrive at an evaluation of the factor. Subfactors are not part of the order of importance. Subfactors are only used to determine the rating of the associated factors. The following technical evaluation factors and subfactors are listed.

3. Price & Business Factor 2 shall be reviewed by the Contracting Officer for adherence to solicitation requirements.

4. All non-price evaluation factors, when combined, are considered to be approximately equal to cost or price.

C. Offer Evaluation

a. General Instructions for Evaluation Plan. Proposals received in response to this Request for Proposal (RFP) will be evaluated in accordance with the process as established in this solicitation and applicable Federal Acquisition Regulations (FAR).

b. Review of Proposals. An adjectival rating system has been established prior to the issuance of this solicitation. Before this system will be applied, however, all proposals received will undergo an initial review to determine if any proposals are nonrespons-ive. A nonresponsive proposal is defined as a proposal that neglects to contain mandatory information or documents requested in the solicitation. A nonresponsive proposal is also one that does not follow the requested format as stated in the Evaluation Approach sec-tion below. Firms submitting nonresponsive proposals will be notified upon the determination of such non-responsiveness.

c. Proposal Evaluation. Careful, full, and impartial consideration will be given to all proposals received prior to the closing date/ time of this solicitation.

d. Evaluation Approach

1. Proposals shall be subject to evaluation by a team of Government personnel. Proposals must demonstrate:

(a) Understanding of the Government’s requirement and the means required to fulfill those requirements.

(b) Completeness of the Offeror's analysis of each evaluation factor and subfactor.

(c) Feasibility of performing to all terms and conditions of the Offer within the Government’s requirements.

2. All submissions shall have a separate section for responding to each factor.

3. A complete set of proposals will be provided to each member of the evaluation team. Only after the evaluation team has completed the evaluation on the non-price factors, will the price be reviewed. Price is not a scored factor.

4. The evaluation team will rank each proposal in terms of the evaluation factors and subfactors listed in this section. Each proposal will be evaluated in accordance with its written content; the evaluation team will not assume that the Offeror’s performance will include areas of investigation or development not specified in the Offeror’s written proposal, but pertinent information available to the evaluation team outside of the proposal may also be used to evaluate the proposal. Each member of the evaluation team will make an independent evaluation of each proposal. The evaluation will proceed as follows:

(a) The evaluation team will evaluate each proposal in terms of the Evaluation Factors listed in this Section.

(b) Each team member will independently review the proposal as it relates to each individual evaluation factor noting strengths, weakness, and deficiencies. Subfactor and factor ranking are individual while proposal ratings are based upon team con-sensus.

(c) The team members will keep careful notes on their evaluation sheet, indicating the supporting reasons for the evaluation given. The net results of the individual determinations will be reported on the consensus evaluation sheet by the chairperson of the evaluation board.

(d) Upon completion of the evaluation of all proposals, each member will sign and date the team report. Each member’s ex-hibits will be attached as a backup to the consensus evaluation sheet prepared by the Chairperson.

e. Any proposal having an overall rating of “Marginal” (see below) or any factor rating of "Unacceptable" (or "Unsatisfactory" in past performance) will not be considered for award. The justification for assigning these ratings will be provided in a narrative format in the team report.

f. Technical Scoring Adjectives. The following adjectives will be used in evaluating the all technical factors and significant sub-factors, except for past performance, and the technical proposal as a whole:

Excellent: The offeror exceeds the solicitation requirements and exemplifies an understanding of all aspects of the requirement to the extent that timeliness and the highest quality performance is anticipated. The offeror illustrates understanding of the scope and depth of the requirements as well as the offeror’s understanding at the highest technical level. There are no deficiencies and one or more sig-nificant strengths. Strengths far outweigh any weaknesses. The Government has a high degree of confidence and no doubt that the of-feror can successfully achieve the requirements of the solicitation. Response exceeds a “Good” rating.

Good: The offeror exceeds some of the solicitation requirements. The offeror may have one of more strengths. Strengths outweigh any weaknesses. The areas in which the offeror exceeds the requirements are anticipated to result in a high level of efficiency, pro-ductivity, or quality. The Government has a high degree of confidence that the offeror can successfully achieve the requirements of the solicitation. Response exceeds an “Acceptable” rating.

Acceptable: The offeror meets the solicitation requirements. Demonstrates a competent understanding of all solicitation requirements.

The offeror has no deficiencies. The Government has reasonable confidence that the offeror can successfully achieve the requirements of the solicitation.

Marginal: The offeror does not clearly meet the solicitation requirements. The offeror has one or more weaknesses that are not offset by strengths. The Government is not confident that the offeror can meet the requirements of the solicitation. Response is less than “Acceptable.”

Unacceptable: The offeror does not meet the specified the solicitation requirements. There are significant weakness and deficiencies which indicate a failure to understand much of the solicitation requirements. The Government has no confidence that the offeror can meet the requirements of the solicitation. Response is less than “Marginal.”

g. Past Performance Scoring Adjectives. The following adjectives will be used in evaluating past performance:

Exceptional: Performance meets contractual requirements and exceeds many requirements. The contractual performance of the ele-ment being assessed was accomplished with few minor problems for which corrective actions taken by the contractor were highly ef-fective. The Government has a high degree of confidence and no doubt that the offeror can successfully achieve the requirements of the solicitation.

Very Good: Performance meets contractual requirements and exceeds some requirements. The contractual performance of the ele-ment being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

The Government has a high degree of confidence that the offeror can successfully achieve the requirements of the solicitation.

Satisfactory: Performance meets contractual requirements. The contractual performance of the element being assessed contains some minor problems for which corrective actions taken by the contractor were, or appear to be, satisfactory. The Government has reason-able confidence that the offeror can successfully achieve the requirements of the solicitation.

Marginal: Performance does not meet some contractual requirements. The contractual performance of the element being assessed re-flects a serious problem for which the contractor has not yet identified corrective actions or the contractor’s proposed actions appear only marginally effective or were not fully implemented. The Government is not confident that the offeror can meet the requirements of the solicitation.

Unsatisfactory: Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contrac-tual performance of the element being assessed contains serious problem(s) for which the contractor’s corrective actions were, or ap-pear to be, ineffective. The Government has no confidence that the offeror can meet the requirements of the solicitation.

Neutral: Pursuant to FAR 15.305(a)(2)(iv) - In the case of an offeror without a record of relevant past performance or for whom in-formation on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance.

h. Definitions

“Significant Strength” is an aspect of the proposal that appreciably increases the likelihood of successful contract performance.

“Strength” is an aspect of the proposal that increases the likelihood of successful contract performance. Note: Simple adherence to the requirements of the solicitation is compliance and shall not be listed as a strength.

“Deficiency” is a material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.

“Weakness” means a flaw in the proposal that increases the risk of unsuccessful contract performance. Failure to provide items listed in respective proposal instructions will be considered a weakness.

“Significant Weakness” is a flaw in the proposal that appreciably increases the risk of unsuccessful contract performance. Failure to provide items listed in respective proposal instructions that results in an inability to evaluate factors and/or subfactors will be con-sidered a significant weakness.
