The Project’s environmental documents can be obtained from the United States International Boundary and Water Commission (USIBWC) and are available for the Contractor to review upon request.
Final Environmental Assessment Flood Control Improvements to the Rio Grande Canalization Project, December 2007.
1. Establishing and Acquisition Authorities. Various authorities include:
• Fish and Wildlife Act of 1956 [16 U.S.C. 742f (a) (4)], [16 U.S.C. 742f(b)(1)]
• An Act Authorizing the Transfer of Certain Real Property for Wildlife, or other purposes [16
U.S.C. 667b]
• Refuge Recreation Act, as amended [16 U.S.C. 460k-1], [16 U.S.C. 460k-2]
• Migratory Bird Treaty Act [16 U.S.C. 703]
• National Wildlife Refuge System Improvement Act of 1997
Abatement and Mitigation of Excessive or Unnecessary Noise. Minimize noise throughout all phases of the Contract. Exercise particular and special efforts to avoid the creation of unnecessary noise impact on adjacent noise sensitive receptors in the placement of non-mobile equipment such as air compressors, generators, pumps, etc. Place mobile and stationary equipment to cause the least disruption of normal adjacent activities.
All equipment associated with the work must be equipped with components to suppress excessive noise and these components must be maintained in their original operating condition considering normal depreciation. Noise attenuation devices installed by the manufacturer such as mufflers, engine covers, insulation, etc. must not be removed nor rendered ineffectual nor be permitted to remain off the equipment while the equipment is in use.
Preservation of Cultural and Natural Resources and the Environment. If the Contractor initiates changes to the Contract and IBWC approves the changes, the Contractor is responsible for obtaining clearances and coordinating with the appropriate regulatory agencies.
A. Cultural Resources. Cease all work immediately if a site, building, or location of historical, archeological, educational, or scientific interest is discovered within the right of way. The site, building, or location will be investigated and evaluated by IBWC.
B. New Mexico Environmental Department for the Pollutant Discharge Elimination System Permits and Storm Water Pollution Prevention Plans (SWP3). The contractor will file the Notice of Intent (NOI) and the Notice of Termination (NOT) for work shown on the plans in the right of way.
Adhere to all requirements of the SWP3.

C. Work in Waters of the United States. For work in the right of way, the contractor will obtain any required Section 404 permits from the U.S. Army Corps of Engineers before work begins. Adhere to all agreements, mitigation plans, and standard best management practices required by the permit.
When Contractor-initiated changes in the construction method changes the impacts to waters of the U.S., obtain new or revised Section 404 permits.
D. Project-Specific Locations. For all project-specific locations (PSLs) on or off the right of way (material sources, waste sites, parking areas, storage areas, field offices, staging areas, haul roads, etc.), signing the Contract certifies compliance with all applicable laws, rules, and regulations pertaining to the preservation of cultural resources, natural resources, and the environment as issued by the following or other agencies:
• Occupational Safety and Health Administration,
• New Mexico Environmental Department,
• New Mexico Department of Transportation,
• New Mexico Commission of Public Records (Historical),
• New Mexico Energy, Minerals, and Natural Resources Department,
• New Mexico States Parks Department,
• New Mexico Department of Fish and Game,
• New Mexico-NCRS Natural Conservation Resources Service,
• U.S. Army Corps of Engineers,
• U.S. Department of Energy
• U.S. Department of Transportation,
• U.S. Environmental Protection Agency,
• U.S. Federal Emergency Management Agency, and
• U.S. Fish and Wildlife Service.
All subcontractors must also comply with applicable environmental laws, rules, regulations, and requirements in the Contract. Maintain documentation of certification activities including environmental consultant reports, Contractor documentation on certification decisions and contacts, and correspondence with the resource agencies. Provide documentation upon request.
Obtain written approval from the Engineer for all PSLs in the right of way not specifically addressed in the plans. Prepare an SWP3 for all Contractor facilities, such as asphalt or concrete plants located within IBWC right of way. Comply with all permit requirements for portable facilities, such as concrete batch plants, rock crushers, asphalt plants, etc. Address all environmental issues, such as Section 404 permits, wetland delineation, endangered species consultation requirements, or archeological and historic site impacts. Obtain all permits and clearances in advance.

2. Other considerations. The Contractor is required to adhere to the following:
(a) Ensure that all Environmental Permits, Issues, and Commitments (EPIC), which are included within the PS&E are followed and implemental to ensure potential impacts are avoided.

1.3 PROVISIONS FOR MEASUREMENT AND PAYMENT
For Work performed by the Contractor under this Contract, the identified technical specifications (as shown in paragraph 1.1 herein) are those under which payment is to be made to the Contractor.
Measurement and payment of work shall be in accordance with SPECIFICATION 01 27 00 of this Contract.
1.4 SPECIFICATION / BID ITEM FORMAT AND CONVENTIONS
A. Specification Format. The technical specifications are organized into Divisions, and identified in
Level 2 title format, using the Construction Specifications Institute’s (CSI) "MasterFormat – 2004 Edition" numbering system. For this Contract, the Divisions are grouped in two categories: (1) Standard Divisions, which are Divisions identified and defined by CSI, and (2) Special Divisions, which are Divisions that have been developed using industry standards, for some unique items of Work under this Contract.
B. Bid Item Format. Bid Items under this Contract have been derived from the governing specifications identified in paragraph 1.1 herein. Bid Items are numbered in Level 3 title format, using CSI’s “MasterFormat – 2004 Edition" numbering system. All Bid Items are identified in Section B of the Contract Provisions.

PART 1 - GENERAL
1.1 RELATED DOCUMENTS

1.2 WORK COVERED BY THE CONTRACT DOCUMENTS
A. Project Identification. The Project to be constructed under this Contract is identified as follows:
(1) Name of Project - “UPPER RIO GRANDE FLOOD CONTROL PROJECT, REHABILITATION OF HATCH-TONUCO LEVEE SYSTEM” and,
(2) Location of Project –Doña Ana, New Mexico.
B. General Description of Work. The Work consists of the rehabilitation of the Hatch-Tonuco Levee System, for a total reach of 13.43 miles. The majority of the proposed improvements include reconstruction of the existing earthen levee system. Major construction efforts include:

(2) Proposed New Levee,
(3) Proposed Installing a Clay Cap to the Existing Levee,
(4) Proposed Floodgates, and floodwalls where shown on the plans,
(5) Various appurtenances to the levee (sluice gates, pipe crossings, connecting roadways, etc.)
are to be rehabilitated also, to accommodate the new height of the levee.
(6) New or Refurbished Road Signs.
1.3 SEQUENCE OF WORK / TIME FOR COMPLETION OF WORK
A. The Work is to be performed in sequence as shown on the plans.
B. The Work under this Contract shall be completed as follows:
All levee work, excluding maintenance of seeding shall be completed within 300 calendar days All maintenance of seeding shall be completed within 120 calendar days of completion of all other levee work.
1.4 WORK UNDER OTHER CONTRACTS
No work is anticipated to be performed at the Project site, under separate contract with other contractors, during the Contractor’s performance under this Contract.
1.5 MATERIALS AND EQUIPMENT
A. Materials Ordered in Advance. The Government has not negotiated any purchase orders in advance for suppliers of materials and equipment to be incorporated into the Work.
B. Other Government-Furnished Materials. The Government will not provide any materials for the Work.
C. Materials and Equipment to be Furnished by the Contractor.
(1) The Contractor shall provide all materials and equipment required to execute the Project.
(2) All materials provided by the Contractor for the Project shall be new or recycled, high grade, free from defects, meeting the specifications herein. Quality of the Work shall be in accordance with the specifications herein. The testing company will ensure that materials, equipment, and Work quality strictly adhere to the requirements of the Contract documents.
(3) Materials, equipment, and work quality not conforming to the requirements of these specifications shall be considered defective and will be subject to rejection. Defective

Work material, whether in place or not, or equipment shall be removed immediately from the site by the Contractor, at its expense, when so directed by the CO.
(4) If the Contractor fails to replace any defective or damaged work, materials or equipment after receiving notice, the CO may cause such work or materials to be replaced by other forces. The replacement expense shall be deducted from the amount to be paid to the Contractor. Defective equipment will not be allowed in the performance of any work.
1.6 USE OF RIGHT-OF-WAY
The Contractor shall limit use of the right-of-way to that which is indicated in the construction drawings, so as to allow for the USIBWC’s use and occupancy. Contractor operations shall be confined to the Project site and other areas permitted and identified by the construction drawings.
Portions of the site beyond areas on which the work is to be performed are not to be disturbed. Roads serving the facility, and identified as such, shall be clear and available to the USIBWC as indicated in the construction drawings.
1.7 OCCUPANCY OF RIGHT-OF-WAY
A. Partial Government Occupancy. The Government may need to occupy the right-of-way during the entire construction period, with the exception of areas under construction. The Contractor shall cooperate with the Government during construction operations to minimize conflicts and facilitate Government access. The Contractor needs to maintain existing access to the facility, unless otherwise indicated in the construction drawings. The Contractor shall provide not less than seventy-two (72) hours notice to the Government of construction activities that will affect any Government activities.
B. Government Occupancy of Completed Areas of Construction. The Government reserves the right to occupy and to place and install equipment in completed areas of the facility, before Substantial Completion, provided such occupancy does not interfere with completion of the Work. Such placement of equipment and partial occupancy shall not constitute acceptance of the total Work.
1.8 WORK RESTRICTIONS
A. On-Site Work Hours. The Contractor’s attention is directed to the Contract Provisions.
B. Irrigation Pipe. Irrigation structures are owned by others. The work to be performed on irrigation structures shall be performed in accordance with the irrigation owner’s restrictions.
C. Cutting the Levee for Structure Improvements. In some instances, the work may require cutting the levee. This Work may not be performed during hurricane season or periods of known heavy rains or flooding.

1.2 DESCRIPTION / PURPOSE
Pursuant to the Contract Clause H.10 entitled "Construction Program," the Contractor shall prepare a Progress Schedule (PS) of construction which shall reflect completion of all work under this Contract, and shall include allotted time for related construction activities by other agencies, within the allotted construction period. This schedule shall be prepared using the Critical Path Method (CPM). The PS is required to assure adequate planning and execution of the work and to assist the Government in appraising the reasonableness of the proposed schedule and evaluating progress of the Work both before and during construction. Jobsite mobilization will not be permitted to take place by the Contractor until the PS is compliance confirmed by the Government.
1.3 QUALIFICATIONS OF SCHEDULING PERSONNEL
The Contractor shall identify a Scheduler who will be dedicated to the Project for the duration of the

Project. The Scheduler shall have 4 years or more of verifiable experience with Primavera Project Planner (Primavera P3), and qualifications of the Scheduler shall be submitted to the COR for compliance-confirmation. Should the Contractor require a change in Scheduler during the duration of the Project, the Contractor shall notify the Government immediately and provide qualifications of a replacement Scheduler (with 4 years or more of verifiable experience with CPM Schedules using Primavera P3) to the COR for compliance-confirmation.
1.4 PROGRESS SCHEDULE:
The PS shall include all planned work activities and sequences and show Contract completion within the number of calendar days specified. Incorporate major material procurements, known utility relocations, and other activities (submittals, review confirmation of submittals, anticipated weather delays as defined in Section J, etc.) that may affect the completion of the Contract in the PS.
