2. Schedule of Assemblies, Materials, and Estimated Quantities. For this Project, the schedules of assemblies, material specifications and associated estimated quantities are identified on the Contract Drawings and Technical Specifications (Divisions 01, 31, 34, 35, 50, 60, and 90). Estimated quantities for each Bid Item are shown on Plan Sheet No. 4.01; and estimated quantities are also summarized by plan sheet on Plan Sheet Nos. 5.01-5.03.

EXISTING CONDITION INFORMATION
The existing condition of the levee has been evaluated by the Government, and is included in a report entitled “Condition Assessment of U.S. International Boundary & Water Commission, Texas and New Mexico Levees” by the US Army Corps of Engineers (USACE) dated June 2004, and the “Flood Simulation Study of Rio Grande Levees Near Las Cruces, New Mexico, Using Seismic and Electrical Geophysical Methods” dated May 2007.The applicable sections of this report are available to the Contractor for the purposes of understanding the existing condition of the levee within the project limits of this Contract. Additionally, geotechnical investigations were performed during the final design of the project, and the associated geotechnical data and reports are identified in 00.31.32 Geotechnical Data herein.

SURVEY INFORMATION
For these Contract Drawings, surveying and data collection was performed as follows:
(1) Light Detection and Ranging (LIDAR) was obtained from the Government and used for preliminary information.
(2) Control was performed in April / May 2009 by Frank X. Spencer & Associates., who developed and provided the following (at .01-foot accuracy):
(a) Control. The surveyor established points at cross-roads to establish horizontal and vertical control; control sheets were developed for each control point set, signed and sealed by a New Mexico Registered Professional Land Surveyor (RPLS). The control sheet includes a drawing of the control point with a 3-point tie to existing physical features, description of the control point, X,Y & Z coordinates and the coordinate system. Plan Sheet No. 2.08- 2.09, within the Contract Drawings includes the control information data for all the control points set for the project, signed and sealed by the RPLS.
(b) Benchmarks. The surveyor established bench marks along project limits; vertical benchmarks were set at 1000-foot intervals at the right of way (ROW) line of the levee reach. A tabulation of the benchmarks is shown on the Plan Sheets within the Contract Drawings.
(3) Ultimately, an aerial survey (at 0.1-foot accuracy) was performed in April / May 2009 by Martinez Corporation who developed and provided the following, which was used as the basis of design:
(a) Field Control for Photogrammetry. The surveyor set panels for aerial photogrammetry along the levee reach for a low-level flight (1500 feet). Panels were set along the flight path at 800-foot intervals and wing panels were set at cross-roads or 2400-foot intervals.
The surveyor performed a global positioning (GPS) survey to establish x-y-z coordinates of the panel points.
(b) Aerial Photogrammetry. The aerial photogrammetry was developed as follows:
1. Black and white photography at a 1-inch = 250-foot photo scale (1500 feet above ground level (AGL))
2. Data Processing. The aerial photography was scanned at 12 microns to produce 0.25-foot pixel resolution; aerial triangulation process was performed to orient individual stereo pairs.

3. Planimetric and Topographic Data Compilation. Planimetric and topographic data was compiled (suitable for 1-inch = 50-foot map scale showing 1-foot contours.
4. Digital Orthophotos. A digital elevation model (DEM) or digital terrain model (DTM) was created for the project area to support the orthophoto rectification; rectified mosaic digital images to hold 0.25-foot ground pixel resolutions suitable for a 1-inch = 50-foot map scale.
(4) Supplemental ground surveys were performed by SLI Engineering Inc., and Frank X. Spencer & Associates. Data as follows:
(a) Voids. A topographic survey was performed by the surveyors to fill-in the voids of the aerial planimetrics; additionally, the surveyor performed topographic survey on existing structures, including bridges, inlets, culverts and irrigation structures.
(b) ROW Verification. The surveyors recovered and staked ROW points from available ROW maps supplied by the Government. This ROW information is shown on the plan / profile sheets of the Contract Drawings.
(c) Utility Survey. The surveyors coordinated with utility notification companies to get utilities marked in the field; the surveyor performed field location of underground utilities as marked by utility companies along the levee reach and intersecting streets. These locations are shown on the plan / profile sheets of the Contract Drawings. NOTE: IT IS THE

1. Establishing and Acquisition Authorities. Various authorities include:

Abatement and Mitigation of Excessive or Unnecessary Noise. Minimize noise throughout all phases of the Contract. Exercise particular and special efforts to avoid the creation of unnecessary noise impact on adjacent noise sensitive receptors in the placement of non-mobile equipment such as air compressors, generators, pumps, etc. Place mobile and stationary equipment to cause the least disruption of normal adjacent activities.
All equipment associated with the work must be equipped with components to suppress excessive noise and these components must be maintained in their original operating condition considering normal depreciation. Noise attenuation devices installed by the manufacturer such as mufflers, engine covers, insulation, etc. must not be removed nor rendered ineffectual nor be permitted to remain off the equipment while the equipment is in use.
Preservation of Cultural and Natural Resources and the Environment. If the Contractor initiates changes to the Contract and IBWC approves the changes, the Contractor is responsible for obtaining clearances and coordinating with the appropriate regulatory agencies.
A. Cultural Resources. Cease all work immediately if a site, building, or location of historical, archeological, educational, or scientific interest is discovered within the right of way. The site, building, or location will be investigated and evaluated by IBWC.
B. New Mexico Environmental Department for the Pollutant Discharge Elimination System Permits and Storm Water Pollution Prevention Plans (SWP3). The contractor will file the Notice of Intent (NOI) and the Notice of Termination (NOT) for work shown on the plans in the right of way.
Adhere to all requirements of the SWP3.
C. Work in Waters of the United States. For work in the right of way, IBWC will obtain any required Section 404 permits from the U.S. Army Corps of Engineers before work begins. Adhere to all agreements, mitigation plans, and standard best management practices required by the permit.

Maintain documentation of certification activities including environmental consultant reports, Contractor documentation on certification decisions and contacts, and correspondence with the resource agencies. Provide documentation upon request.
Obtain written approval from the Engineer for all PSLs in the right of way not specifically addressed in the plans. Prepare an SWP3 for all Contractor facilities, such as asphalt or concrete plants located within IBWC right of way. Comply with all permit requirements for portable facilities, such as concrete batch plants, rock crushers, asphalt plants, etc. Address all environmental issues, such as Section 404 permits, wetland delineation, endangered species consultation requirements, or archeological and historic site impacts. Obtain all permits and clearances in advance.
2. Other considerations. The Contractor is required to adhere to the following:
(a) Ensure that all Environmental Permits, Issues, and Commitments (EPIC), which are included within the PS&E are followed and implemental to ensure potential impacts are avoided.

A. Project Identification. The Project to be constructed under this Contract is identified as follows:

B. General Description of Work. The Work consists of the rehabilitation of the Hatch-Tanuco Levee System, for a total reach of 14.34 miles. The majority of the proposed improvements include reconstruction of the existing earthen levee system. Major construction efforts include:

are to be rehabilitated also, to accommodate the new height of the levee.

1.3 SEQUENCE OF WORK / TIME FOR COMPLETION OF WORK
A. The Work is to be performed in sequence as shown on the plans.
B. The Work under this Contract shall be completed within the contract calendar days.
1.4 WORK UNDER OTHER CONTRACTS
No work is anticipated to be performed at the Project site, under separate contract with other contractors, during the Contractor’s performance under this Contract.
1.5 MATERIALS AND EQUIPMENT
A. Materials Ordered in Advance. The Government has not negotiated any purchase orders in advance for suppliers of materials and equipment to be incorporated into the Work.
B. Other Government-Furnished Materials. The Government will not provide any materials for the Work.
C. Materials and Equipment to be Furnished by the Contractor.
(1) The Contractor shall provide all materials and equipment required to execute the Project.
(2) All materials provided by the Contractor for the Project shall be new or recycled, high grade, free from defects, meeting the specifications herein. Quality of the Work shall be in accordance with the specifications herein. The testing company will ensure that materials, equipment, and Work quality strictly adhere to the requirements of the Contract documents.
(3) Materials, equipment, and work quality not conforming to the requirements of these specifications shall be considered defective and will be subject to rejection. Defective Work material, whether in place or not, or equipment shall be removed immediately from the site by the Contractor, at its expense, when so directed by the CO.

The replacement expense shall be deducted from the amount to be paid to the Contractor. Defective equipment will not be allowed in the performance of any work.
1.6 USE OF RIGHT-OF-WAY
The Contractor shall limit use of the right-of-way to that which is indicated in the construction drawings, so as to allow for the USIBWC’s use and occupancy. Contractor operations shall be confined to the Project site and other areas permitted and identified by the construction drawings.
Portions of the site beyond areas on which the work is to be performed are not to be disturbed. Roads serving the facility, and identified as such, shall be clear and available to the USIBWC as indicated in the construction drawings.
1.7 OCCUPANCY OF RIGHT-OF-WAY
A. Partial Government Occupancy. The Government may need to occupy the right-of-way during the entire construction period, with the exception of areas under construction. The Contractor shall cooperate with the Government during construction operations to minimize conflicts and facilitate Government access. The Contractor needs to maintain existing access to the facility, unless otherwise indicated in the construction drawings. The Contractor shall provide not less than seventy-two (72) hours notice to the Government of construction activities that will affect any Government activities.
B. Government Occupancy of Completed Areas of Construction. The Government reserves the right to occupy and to place and install equipment in completed areas of the facility, before Substantial Completion, provided such occupancy does not interfere with completion of the Work. Such placement of equipment and partial occupancy shall not constitute acceptance of the total Work.
1.8 WORK RESTRICTIONS
A. On-Site Work Hours. The Contractor’s attention is directed to the Contract Provisions.
B. Irrigation Pipe. Irrigation structures are owned by others. The work to be performed on irrigation structures shall be performed in accordance with the irrigation owner’s restrictions.
C. Cutting the Levee for Structure Improvements. In some instances, the work may require cutting the levee. This Work may not be performed during hurricane season or periods of known heavy rains or flooding.

1.2 MEASUREMENT OF QUANTITIES
The Government will measure all completed work using US standard measures. The method of measurement for each Bid Item is identified under the applicable technical specifications and the unit of measure is identified in the Summary of Quantities in the plans sheets in the contract documents.
1.3 SCOPE OF PAYMENT
Payment to the Contractor shall be at the Unit Price for each Bid Item, and shall, in general, be considered full compensation for all materials, equipment, labor, tools, supplies, and incidentals necessary to complete the Bid Items and the Work under the Contract. The method of payment for each Bid Item is further identified under the applicable technical specifications and the Unit Price set forth in the Bid Schedule of the Contract Documents. Payment of the Unit Price for each Bid Item will be payment in full for this Contract. All costs and expenses for which no specific Unit Price is set forth in the Bid Schedule shall be considered subsidiary, and included in the Unit Prices that are applicable and specifically set forth in the Bid Schedule, and no additional payment will be made therefore.

1.4 MEASUREMENT AND PAYMENT FOR CHANGES IN WORK
Measurement and payment to the Contractor for extra work directed and incorporated by Construction Change Directive, performed by the Contractor, and compliance-confirmed by the Government or COR, will be made in accordance with the provisions of the Contract.

1.2 COORDINATION
In general, construction operations shall be coordinated to ensure efficient and orderly installation of each part of the work. In addition to a Project Superintendent, the Contractor shall provide other administrative and supervisory personnel as required for proper coordination and administration of the work. The Contractor’s Project Superintendent shall be available to the Government during business hours, as well as emergency contact. Other coordination responsibilities and activities required to be provided by the Contractor includes the following:

USIBWC Contract No.: IBM05D0001 Page 01.31.00 - 2 collateral, and essential work by others. The Government, its workers and contractors, and others, shall have the right to operate within or adjacent to the Construction site to perform such work.
B. In accordance with the provisions and time frames stated in SPECIFICATION 01 32 00, the Contractor shall submit to the COR a proposed Schedule of Work. This Schedule of Work shall be in the form as described in SPECIFICATION 01 32 00, and shall reflect all coordination efforts of the Work under this Contract.
1.3 PROJECT MEETINGS
All meetings, unless otherwise directed shall be scheduled and conducted at the locations requested (Most meeting will take place at the US-IBWC American Dam Field Office in El Paso, Texas). The COR shall inform participants and others involved, and individuals whose presence is required, of date and time and location of each meeting. The COR shall prepare the meeting agenda, and distribute to all invited attendees. The “Government’s Construction Management Contractor” shall record significant discussions and agreements achieved, and distribute the meeting minutes to everyone concerned, within seven (7) calendar days of the meeting. The following meetings are anticipated, and the Contractor shall identify them in the Schedule of Work:
A. Preconstruction Conference. A preconstruction conference shall be scheduled by the CO prior to the start of construction, but no later than fifteen (15) calendar days after Government receipt of acceptable payment and performance bonds and proof of insurance. The preconstruction conference will be held at the American Dam Field office in El Paso, Texas (located at 2616 W.
Paisano Drive, El, Paso, Texas) unless otherwise specified on the letting/bidding documentation.
The purpose of the meeting is to introduce project personnel and review responsibilities and procedures. The Contractor shall provide a copy of his Draft Schedule of Work as specified under SPECIFICATION 01 32 00, Construction Progress and Documentation.
(1) Attendees - Authorized representatives of the Government (including the COR), the Engineer, the Contractor’s Superintendent, major subcontractors, suppliers; and other concerned parties shall attend the conference. All participants at the conference shall be familiar with the Project and authorized to conclude matters relating to the Work.
(2) Agenda – Discussion of items of significance that could affect the Work and project, including the following: introduction / designation of key personnel and their duties; review of the Draft Schedule of Work, phasing, critical work sequencing and long-lead items; review of procedures for handling and processing field decisions, Change Orders, RFIs, testing and inspection, applications for payment, and submittals; preparation of record documents; use of right-of-way; work restrictions; USIBWC and others occupancy requirements; responsibilities for temporary facilities and controls; construction waste management and recycling; field office, parking, Work, and storage areas; equipment and materials deliveries and priorities;
