CONTRACT ALLOWANCE FOR CONSTRUCTIOWORKS APPRENTICES (Illinois Tollway)
Effective: January 22, 2019 Revised: August 27, 2020
Description. In addition to the Contractor's equal employment opportunity efforts undertaken as elsewhere required by this Contract, the Contractor is encouraged to participate in this Special Provision for reimbursement of qualifying ConstructionWorks (CW) Eligible Apprentices. This incentive will provide wage reimbursement to contractors who employ ConstructionWorks (CW) participants within the following skilled trades: (i.e., Operating Engineers, Electricians, Iron workers, Carpenters, Cement Masons, etc.) The CW wage reimbursement Incentive promotes the employment and retention of CW Eligible Apprentices in their acquisition of the prerequisite skills needed to achieve journey worker status in the top skilled trades predominately utilized within Tollway heavy highway and related transportation construction industries. CW encourages retention and utilization of historically underrepresented individuals such as minorities, women, veterans, ex-offenders and economically disadvantaged individuals on Tollway projects.
CW Eligible Apprentices are defined as a CW program participant placed into a USDOL-registered apprenticeship and/or other suitable construction related employment for not less than 160 hours within a 12 consecutive month period with the objective of gaining the necessary on-the job experiences to fulfil the task competency requirements of an apprenticeship program to achieve journey worker status as evidenced by certified payroll.
The Contractor shall submit each CW Eligible Apprentice for Tollway approval through the Tollways web-based project management system. The Contractor is not eligible for the incentive payment until the CW Apprentices are approved by the Tollway through the web-based project management system.
Prior to payment, the Contractor shall submit to the Tollway the CONSTRUCTIONWORKS COMMUNITY HIRING INITIATIVE ALLOWANCE REPORT detailing the hours which the Contractor is requesting reimbursement incentive for CW Eligible Apprentices. This report shall be submitted to the Engineer with every pay estimate that the ConstructionWorks wage reimbursement is applied.
A SAMPLE REPORT is included as part of this Special Provision. The Contractor will also need to provide records documenting hours worked by each CW Eligible Apprentice to the engineer.
The Contractor will be reimbursed at $15 per hour worked by a Tollway approved CW Eligible Apprentice. This reimbursement will be made even though the Contractor may receive additional Tollway incentives such as the CW Bid Credit incentive. However, the hourly incentive payment in this special provision may not be combined with the hourly incentive payment in the Special Provision for Community Hiring Initiative, if applicable, for any one individual.
For purposes of this Special Provision, the Contractor is not relieved of requirements under the Illinois Prevailing Wage Act or other applicable laws and regulations.
The Tollway’s CW Administrator, Chicago-Cook Workforce Partnership upon request, will provide the Contractor with assistance via a network of CW service providers serving the project area in order to facilitate the Contractor’s hiring of CW Eligible Apprentices.
The initial maximum contract allowance is specified within the contract quantities. During the course of performance of the Contract, the Contractor may request that the Tollway provide additional funds to increase the maximum allowance for the incentive and the Tollway may do so under its sole
ADDENDUM 3 J-162B March 2 , 2026 discretion. The Contractor shall also ensure that this Special Provision is made applicable to each subcontract if CW Eligible Apprentices are to be employed by a subcontractor and that the incentive payment earned by such subcontractor is passed on to each participating subcontractor.
Method of Measurement. This work will not be measured for payment.
Basis of Payment. Should the Contractor qualify for such a wage rate reimbursement; payment will be made under item number 999ADJ45. A corresponding adjustment amount will then be made to CONTRACT ALLOWANCE FOR CONSTRUCTIONWORKS APPRENTICES. Payment for this work will not exceed the costs incurred by the Contractor and approved by the Engineer as described elsewhere in the Special Provision.

DBE Program Goal Setting and Administration – Request for Clarification
The Tollway has determined that the DBE goals for this contract will remain at 23%.
The DBE goals for this contract were set based upon review of the scope of the work involved, estimated availability of DBE firms for those scopes of work from the current disparity study, the location of the work and history with similar projects, and other factors. The special provisions provide for award of contracts to bidders who either meet the established DBE goals or demonstrate good faith efforts to do so. If a potential bidder cannot obtain sufficient DBE participation to meet the contract goals, the bidder must document its efforts via the DBE Form
2023 Demonstration of Good Faith Efforts. For further assistance, please refer to the DBE
Special Provisions regarding the good faith efforts/waiver process. Note that the Tollway’s DBE
Program is separate from the Federal DBE Program and separate from the IDOT DBE Program.

Small Business Administration. Only firms certified by the ILUCP, the City of Chicago, the
