SUBJECT: USC-9 Pre-Solicitation Conference Date: 13 September 2018
Summary of Items discussed:
Topic: RDD Construction
- Historical EDI data analyzed from a 5 year period. More than 600k lanes of data were analyzed.
The output of the analysis is an excel data table, providing estimate times for end-to-end moves and for major checkpoints along the way. These times were then averaged across all shipments on the same route. Standard deviation was also calculated for the averages. This table is the basis for revising the current Customer Advisory to reflect updated travel times.
- This will be used as a planning tool for the Government when setting RDDs. It’s not a guarantee or entitlement for setting RDDs. Carriers will still have the ability to counter an RDD if they can’t meet it.
- The Government will review updated data sets when needed; next review after 6 months to determine if the transit times have changed.
- The goal of analyzing this data and setting updated transit times was to avoid unrealistic RDDs.
Topic: Performance Measures and Composite Score
- The BVN calculation for the composite score will change to 90% lane score and 10% world score. The goal of this change is to reward better performance on specific lanes. Shippers are concerned with performance on the lane they use and carriers don’t want a difficult lane to affect their high volume lanes.
- Within the EDI factor, the weight for submission and timeliness is changing to 50/50, from 80/20.
With more emphais on timeliness, the timeline to submit EDI is changing to 48 hours.
- Industry had a concern with timeliness credit when a TCN needs to be corrected due to Government fault. The Government is looking into how to address this issue in the system.
- Industry wanted the Government to look at weighting price and performance differently in the BVN calcuation. However, the Government analyzed the data and determined that this would not change the outcome and felt that the current calculation demonstrates the Government’s desire to have price and performance equal in importance.
- One-Time-Only evaluations will include BVN. The Government will look to include a requirement for vessel sharing agreements, when applicable.
Topic: D-RAP
- D-RAPS should be submitted as delays occur for visibility of delays and invoicing purposes.
They will be processed by the Ordering Officers. For missed RDD credit, requests are to be submitted through CPP for COR review.
Topic: Claims Timeline
- Moving to a 3 year claims timeline for both Government and Carriers. Timeline is the only change we are making; all other processes will remain as they are today.
- Industry was concerned with the events that qualify to start the 3 year timeline. The Government response is that case law governs this and it’s unnecessary to put additional language in the contract.
Topic: Period of Performance
- Moving to a one-year base plus four one-year unpriced options with potential industry days as needed.
Topic: Small Business
- Subcontracting plan will be required in the solicitation. Difference from last time- FAR 19.704 requires you to address 15 elements (MUST ADDRESS)
Topic: Invoicing and Payment
- Discussion of invoicing issues. Additional meetings will be necessary to further investigate the problems relating to TIPP/BRT/invoices.
Topic: Milestones
- Due to waived OSD Peer Reviews, TCAQ is giving the carriers additional time to submit proposals in CARE. Deadline moved from November to January. More updates regarding the outcome/status of the VOLPE study will be given as they become available.
Topic: Government-Set Accessorials
- If carriers are able to provide documentation to support an increase in these rates, the Government will look at the data and consider an increase

- Potentially developing a customer advisory with a listing of the container pool locations
Topic: Shipment Liability
- Carriers interested in language mirroring the Multimodal language by incorporating a liability cap. The Government will look into this further.
Topic: Government Terminal Working Hours
- Carriers request removal of the language as it is not currently enforced. Government is looking at this.
Topic: Enhanced In Transit Visibility Pings
- Government looking at giving partial credit for 48 pings
