PWS | PWS | There are several references to ‘staging yard/areas’, ‘marshalling areas’, or ‘temporary resting areas’, etc. in the PWS. Are these spaces currently or intended to be set aside for Government/Contractor use as permanent or semi-permanent activity areas (such as lay-down or storage areas) for materials, dunnage, etc.? | Yes, when required. Currently not required at this time.
PWS | PWS | Will the Contractor have the option to install temporary/permanent facilities (such as containers) for storage of supplies, tools, dunnage, etc.? | The Contractor shall coordinate with the Port Authority for any temporary/permanent facilities, and they shall bear the Cost.
2.3 | PWS | PWS Section 2.3, page 3, second paragraph – states “only U.S. citizens (USNs) are allowed to bring cell phones with cameras”. Does this mean cell phone (without camera) use is permitted by OCN’s providing their stated information is provided? Do USN’s also need to submit this information prior to cell phone use on Camp As Sayliyah or within the Port area? | Contractor may not be required to visit Camp Asaliyah however when access may/if required Camp Asaliyah regulations will be applicable.
3.2.1 | PWS | PWS Section 3.2.1, page 7 – Please define the term “Master Driver” | Master Driver is the person identified as the Trainer to familiarize personnel to operate USG equipment.
3.2.2 | PWS | Are the “military cargo vehicles” described in this section included in the training provided in 3.2.1? Additionally, Qatar driver licenses have defining categories for ‘other than passenger car’ capabilities authorized (such as forklift, crane, etc.). Will Government provided training provide Qatar accepted certification for these license inclusions, where required? | Government will not provide any certified training but will provide only Familiarization training to drive all cargo.
3.2.3 | PWS | This section requires possession of an “approved HAZMAT” handling permit. While Qatar has a requirement to permit the storage of HAZMAT, there is not an equivalent “handling” permit in Qatar. That said, is a U.S. “handling” permit required or is HAZWOPER certification for workers sufficient for this purpose? | HAZMAT Certification shall meet either local Host Nation or US requirements..
4.4.1 | PWS | “Contractor shall provide sufficient qualified labor as required to support vessel loading or discharge operations and related terminal operations.” As this paragraph also mentions including workers during the conduct of “training and contingency operations” is it expected that the number of workers would be different during these periods than would otherwise be expected for similar operations outside of said “training and contingency operations”? | same labors to be used for vessel loading/discharge.
5.3.4 | PWS | This section indicates the Contractor is expected to provide cargo accountability documentation. However, PWS Section 6.3.2.2 states “The Government will provide all documentation to include customs documentation required for the movement and the clearance of the cargo to/from the port.” By definition, this should include any cargo documentation. Please clarify. | Section 6.3.2.2 states that documents that may be required from Government for clearing of the cargo. The Contractor shall provide Tally Sheets, Time Keeper and Reporting format for Cargo accountability.
6.2.8.3 / 6.3.2.2 | PWS | requires the Contractor to “obtain port removal/entry permits and necessary customs clearance for all cargo.” However, as stated in number 6 above, Section 6.3.2.2 indicates otherwise. Please clarify. | Government will provide necessary documents however contractor will get necessary clearance on behalf of the government.
6.2.8.5 | PWS | indicates that “time begins at the beginning of loading operations.” As an operation of this nature generally includes mobilizing vehicles, does the Government include this activity as part of the “loading operation” stated in this context? | No.
6.2.12 | PWS | Is the Contractor expected to negotiate berthing (location, tow, etc.) between the vessel and the Port/Harbor Master prior to vessel arrival? Is the Contractor to pay the associated fees and receive reimbursement by the Government? | No.
6.4 | PWS | states “Contractor will purchase fuel and be reimbursed under Schedule VIII-Out of Pocket not to exceed $3,000.” Is this cap of $3,000 per use, per month, per operation or other ceiling? Request clarification. | There are multiple parts to this answer… (1) The 'cap' of $3,000 is in reference to the amount which only requires COR approval. If you reference section 5.5, any amount exceeding $3,000 requires Contracting Officer approval; (2) Out of pocket costs are payable as substantiated by a third party invoice, so the appropriate measurement would be per invoice; (3) although this language related to fuel is included in the PWS as a contingency, the PWS and Pricing Schedule read as a whole should be interpreted as only in the rarest of circumstances would the Government ever pay for fuel because all commodities (Sch. 1), equipment (Sch. 4), and inland transportation (Sch. 9) are inclusive of fuel: fuel would essentially only be reimbursed to operate a peice of equipment that was required for performance of some operation outside those contemplated by the contract.
6.4.1.1 | PWS | is this area permanently set aside for specific use by the Contractor/Government or is it a (are they) common use area(s) near berthing? | Neither. It would be a temporary set aside for Government cargo until such time that area is no longer required for Government use.
6.4.1.2 | PWS | are the areas for these structures within set-aside areas specific to Government/Contractor use for this contract? Or is the Contractor expected to locate/negotiate for appropriate space within or near the port for this purpose? | No. Contractor needs to coordinate with respective authorities.
6.4.2.1.1 | PWS | this section indicates a need for “airport transportation.” Does this include airfare/flight coordination, or just transportation to/from the Qatar airport? | airport transportation relates to drop/pick up personnel from airport to camp asalaiyah.
6.4.3.5 | PWS | indicates the potential for Contractor supplied equipment to be operated by “Third Party contracted drivers.” Who then retains liability for this equipment for misuse/damage/accident, etc.? | Liability would fall on the Government for damage caused by the misuse, damage, or accidents of Government Third-party contracted drivers. That said, liability for the equipment remains with the contractor.
6.7 | PWS | how often is this service expected to be used and what is the estimated time for this operation? | Every US Army Watercraft and MSC Contracted vessel to be berthed in the port.
6.12 | PWS | indicates work “may be required to perform the services described in this PWS 24 hours per day, seven (7) days per week, 365 days per year to include all official holidays.” Could you provide an estimated average of expected monthly work hours? | No.
PRS #22 | PWS | Performance Objective No. 22 references PWS Section 6.2.2.11 but the PWS does not have a section with this number. Is this intended to reference Section 6.2.12 Berthing Facilities instead? | The correct reference is 6.2.11, Planning Operations. (PWS)
Sch. 2 | Pricing Schedule | Attachment 2, page 2, section titled “Man Hour Schedule”, column IIA, IIB, etc. – are the numbers under the “quantity” description intended to show the average man-hours? Is this per week or other? | Per year.
3.0 | PWS | Please provide a copy of the SDDC Transportation Battalion safety and fire regulations. | Will be shared with potential awardee.
3.0 | PWS | Please provide a copy of the Port of Mesaieed/595th Deliberate Risk Management Plan | Contractor responsibility to get from the port.
6.2.2.2/6.12.5 | PWS | As per the Port Tariff: Normal Shift is 0600 to 2000 and Overtime is 2000 to 0600. Appreciate if you can clarify and correct. | Will be as stated in PWS.
6.2.3.4 | PWS | As per the Port Tariff: Normal Shift is 0600 to 2000 and Overtime is 2000 to 0600. Appreciate if you can clarify and correct. | Will be as stated in PWS.
6.2.5.2 | PWS | At the port, once the cargo has been loaded/lashed onto the truck for onward movement, the contractor has to obtain a transit Bayan for cargo going to AUAB. Hence this performance objective cannot be met. To reflect the current state of operations, suggest this be changed to: "When loading cargo onto the land transport, no time shall lapse between completion of the exit documentation from the port and the onward movement of the truck." | No changes will be applied to PWS. BLUF: It is contractors responsibility to obtain necessary customs clearance in a timely manner so no time is lapsed.
6.2.8.5 | PWS | Once trucks report at the gate (at Port/Base), the USG personnel need to escort the truck from the gate to the loading area. This time period varies from 2 to 4 hours based on various factors like timings at the port during which escort is available, security checks at the base. Please advise how the contractor is to be compensated for these additional hours if time begins at beginning of loading operations. | Contractor has to quote built in prices.
Sch. 4 | Pricing Schedule | Please confirm that equipment listed under this schedule needs to be provided only at the port. | No.
6.4.1.1 | PWS | Please note it is the prerogative of the port to assign areas where cargo is staged. If any commercial cargo needs to be moved, the port will charge for it. It is not within the control of the contractor to dictate these terms to the port. In view of this, please advise how the USG will compensate the contractor for any such charges levied by the port. Further there is no CLIN item under Schedule 6 as mentioned in the PWS. Please advise. | Will be applied as per Port stipulations/actual charges.
6.4.1.2 | PWS | The office space is not available in the port. During the pre-proposal conference it was clarified that the preference is that office space be on the port, but should be at least within the vicinity. Please define vicinity in terms of distance. Does this means that the office space can be outside the port limits but as close to the port as possible? | Preferable office location will be on Port. Next alternative will be in close proximity (2km) to the Port.
6.4.1.2 | PWS | Please define the type of internet connection required in the office. | High speed Internet connection. (PWS)
6.4.1.3 | PWS | Please advise the notice period that will be provided to the contractor for arranging latrines. Also please advise the minimum durations these would be on hire for at one instance. | Minimum will be a day.
6.4.1.3 | PWS | Please advise where these latrines will be placed if requirement is activated, what the minimum daily consumption would be for toilet paper and paper towels. | Will be determined based on the mission/vessel berthing.
Sch. 6/LI 1&2 | Pricing Schedule | Please clarify on the UOM for the office space. The UOM mentions SQM. Does the contractor need to quote per SQM space per day or per month or per annum? | The quote should be made per SQM per annum.
Sch. 6/LI 1&2 | Pricing Schedule | Further office space is only available for at least 6 months to a year and very rarely available on a monthly basis. Please advise what will be the minimum period of rental if this requirement is activated. | Rental period to be coordinated with the COR, as in the best interest of the Government.
Sch.6/LI 2 | Pricing Schedule | Please advise, if the requirement for a portable office space is activated, the location where the portable office be placed as this will affect the mob/demob costs for the same. | It should be a all inclusive cost.
Sch.6/LI 2 | Pricing Schedule | Please advise if the contractor can quote only for the rental and the mob/demob can be charged basis the out of pocket expenses | No. (Schedule)
Sch.6/LI 2 | Pricing Schedule | Please confirm that the necessary permissions/permits/access will be provided by the client if the portable office space is required to be placed within a military installation/base. | Yes.
Sch. 6/LI 3-6 | Pricing Schedule | Please clarify if we need to provide daily rental rates or purchase price? | Monthly rental rates. (Schedule)
Sch. 6/LI 3-6 | Pricing Schedule | If we need to provide rental rates, please advise the minimum hire periods for these items. | No minimum guaranteed period.
Sch. 6/LI 3-6 | Pricing Schedule | Please provide the specs for the cell phones and fax machine. | New generation Smart Phone with internet and email capabilities. Fax machine will be basic. (PWS)
Sch. 6/LI 3-6 | Pricing Schedule | Please advise if the cell phone is to be provided with a SIM card or without. | SIM card to be provided. Actual call charges will be paid on actuals. (PWS)
6.5.1/6.5.2/6.6 | PWS | Our understanding of the PWS is that these requirements are for people who would be dedicated to this contract. Basis this, the rate that the contractor should provide is a per month rate instead of a per hour rate. Please confirm. | Labor cost is incorporated within commodity rates. Extra labor if requested will be paid on hourly basis and as required.
6.11 | PWS | Demurrage can be a substantial amount based on the volume of the cargo. If the contractor is required to pay this to the port and then invoice to the client, there is a potential working capital cost that the contractor will incur. Due to delays in the approval of the invoice by the USG personnel. Please advise how the USG intends to compensate the contractor for the same or will the USG consider prefunding demurrage charges to the contractor? | Demurrage rates under schedule 5 will include contractor admin cost which should cover working cost compensation.
6.12.2 | PWS | Please note that certain regulations by the port wrt timelines make the 72 hour notice period ineffective. E.g. the port requires containers to be placed for customs inspection 3 days (72 hours) prior to operation. In this case notifying the contractor only 72 hours before the operation will not meet the port timelines. It is recommended that this timeframe be increased to 5 working days. | Contractor will be responsible to coordinate with respective customs official in a timely manner so no time lapse takes place.
PRS #22 | PWS | The objective refers to covered storage. Please note that covered storage is not provided by the port. Does the USG require covered storage outside the port area to fulfill this performance objective? | No. Covered storage is not required. (PWS)
PRS #22 | PWS | Also, there is no CLIN in the pricing schedule to compensate for covered storage. | No. Covered storage is not required.
Sch. 5 | Pricing Schedule | Please confirm that the storage envisaged under Schedule 5 is at the port and not outside the port. | On Port.
Sch. 5 | Pricing Schedule | Please note that under line items 1-17, the description includes reefer containers whereas the port has a different rate for a standard container and a reefer container. Request that these line items be amended to align the line items with the CT7 port tariff (Ref: Section D Storage/Section E Transshipment storage). A courtesy copy of the port tariff is attached for reference. | Different rates requested for regular containers and reefer containers. (Schedule)
52.252-1 | Please advise if an A3 page can be used for charts and illustrative material. | The only acceptable paper size is letter, 8.5" x 11" (216cm x 279cm). |
Sch. 1/Comm. 40A | Pricing Schedule | Please note that Quadcons are considered as 20ft containers by the port and charged accordingly. Request the Quadcons be separated from the other general cargo in the definition of commodity 40A. | As per SDDC/USG standards Quadcons will be under general cargo.
Sch. 1/All Commodities | Pricing Schedule | Please confirm that the labour which is to be included in the commodity rates is only for work during normal port working hours and the overtime for this labour (whether during week day/weekend/holiday etc) will be compensated under Schedule 2. | Weekday overtime hours will be paid on differential hour basis. Weekend/Holiday overtime labor rates will be applicable.
Sch. 5/LI 1&6 | Pricing Schedule | The unit price cell is not activated. As these line items include reefers, which has no free time, this cell needs to be activated. | No changes will be applied to schedule of rates.
Sch.5/LI 23-32 | Pricing Schedule | Please note that UOM for these items is per CBM per day as charged by the port. Request this to be amended accordingly. | UOM will be unchanged.
Sch. 8/LI 10 | Pricing Schedule | For all the out of pocket expenses, reimbursing the contractor at a cost does no allow the contractor to be compensated for either the finance cost or for the efforts/labour/time expended on arranging those services. It is requested that the contractor be allowed to charge for out of pocket expenses at a cost plus agreed % to compensate him appropriately. | Out of pocket expenses are generally for routine supplies and services that do not require much, if any, meaningful effort for the contractor to arrange. This request will not be incorporated into the contract at this time.
Sch. 8/LI 10 | Pricing Schedule | Out of pocket expenses refer to payments to third parties. Please clarify if a service is provided by the contractor using his own resources/equipment will the contractor invoice be considered for payment of out of pocket expenses? | Out of pocket expenses must be substantiated by a paid third party invoice, so contractor provided services using its own resources would not qualify for out of pocket reimbursement.
6.2.2.4 | PWS | Please confirm that the USG will provide the lashing material and dunnage for vessel loading operations. | Lashing Material shall be provided by the Vessel. Dunnage when required, will be purchased under Schedule 6. (Schedule)
3.6.1 | PWS | Contractor is required to carry out inspection of all cargo before Unlashing / Unloading and Lashing / Loading. (PWS)
5.3.3 | PWS | Compensation for Timekeeping is stated as being inclusive of Commodity Schedule 1. Please clarify as Attachment 2 does not contain a “Schedule 1” specifically. | References to Schedule 1 without the sub-schedule designation (A, B, etc.) indicates that compensation will be in accordance with the applicable Schedule 1 sub-schedule. E.g. Costs for timekeeping related to the loading vessels commodity should be included in your pricing for Schedule 1A because that rate should be all-inclusive of costs related to loading that specific commodity.
6.1 | PWS | Can you please be more specific as to what services are required during “Ammunition Exercises?” (Storage / Transportation / Load / Discharge / Inventory / Disposal?). | Any services required for movement of cargo.
6.2.1.1 | PWS | Compensation for Vessel Operations is to be recharged under Schedule 1. Please clarify as Attachment 2 does not contain a “Schedule 1” specifically. | References to Schedule 1 without the sub-schedule designation (A, B, etc.) indicates that compensation will be in accordance with the applicable Schedule 1 sub-schedule. See #73.
6.2.2.7 | PWS | Staging and Segregation of Cargo. Please confirm that Contractor supplied, Supervision, Labor and MHE can be recharged under Schedules 2 and 4 respectively. | Will be compensated for yard operations under schedule 2 and 4. (PWS)
6.2.3.1 | PWS | Move / break-out of cargo from place of rest on Vessel to temp resting area is all-inclusive of any Load / Lash to mode of transport (and subsequent Unlash / Unload) under Schedule 1B. | Yes.
6.2.8.2 | PWS | Inland Transport. Contractor is required to include unloading Equipment at inland destination, inclusive of rates in Schedule 9. However Cargo units involved will vary in size / type / weight / quantity so please clarify how Contractor is to calculate requirement. | Unloading of inland transport outside port/base will be compensated as extra equipment schedule 4. | 85 | 6.3.3.1 | PWS | GFE. Contractor is to repair or replace any items of GFE towards mission capable status. Assuming the Contractor is not directly responsible for causing the damage or destruction to GFE, does Contractor recharge the repairs / replacement of GFE under Schedule 8 – Out of pocket expense? | There is no GFE provided under this contract, so this issue is basically moot.
| 86 | 6.4.1.1 | PWS | Staging Area. Are there any specific dimensions required or is it agreed on a mission by mission basis? Also re-charge for Staging Area / Sweeping is supposed to be under Schedule 6, but there is no corresponding field for rate entry. | Staging area will be charges if required as per actuals from Port.
