NOTICE FOR FILING AGENCY PROTESTS
It is the policy of the Coast Guard to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the General Accounting Office (GAO).
Interested parties are encouraged to seek resolution of their concerns within the Coast Guard as an Alternative Dispute Resolution (ADR) forum, rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the contracting officer or Ombudsman.
Informal forum with the Ombudsman. Interested parties who believe that a Coast Guard procurement is unfair or otherwise defective should first direct their concerns to the cognizant contracting officer. If the contracting officer is unable to satisfy the concerns, the interested party is encouraged to contact the Coast Guard Ombudsman for Agency Protests. Under this informal process, the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, contracting officer, and solicitation closing date (if applicable).
Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the contracting officer through open and frank discussions. If the protester’s concerns are unresolved, an independent review is available by the Ombudsman. The protester may file a formal agency protest to either the contracting officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth at FAR 33.103(d)(2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. This will not preclude re-filing of the protest to meet the requirement. To be timely, protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be forwarded to the address below:

SECTION C - DESCRIPTION AND SPECIFICATION
C.1
DESCRIPTION OF WORK:
PART 1 – OVERVIEW AND OBJECTIVES
The scope of this procurement is to accomplish planning and execution of scheduled maintenance and alterations on the U.S. Coast Guard’s POLAR class icebreakers, POLAR STAR (WAGB 10) and POLAR SEA (WAGB 11). These two vessels are home ported in Seattle, WA. The Maintenance and Logistics Command, Pacific, Vessels Division (hereinafter "MLC”), manages all vessel maintenance for the two ships.
The contractor’s efforts under the contract will be integrated into MLC’s A-Team process, outlined in the Naval Engineering Organization and Operating Procedures, MLCINST M9000 6E. As a member of the A-Team, the contractor will participate at specifically identified points in MLC’s planning process. Planning will be conducted during a discrete period of performance prior to a given vessel availability and will not run year-round. Most execution phase repair/alteration efforts will occur during the scheduled annual drydocking and dockside (DD/DS) maintenance availabilities. However, execution of work may also occur during other inport periods, depending upon need.
PART 2‑ CONTRACT LINE ITEM DESCRIPTION
The Contractor, under the written direction of the MLC, shall furnish the labor, material, technical resources and facilities (except those furnished by the Government under express provisions of this contract) necessary for the accomplishment of the following work on POLAR Class cutters.
ITEM 0001 AND (IF EXERCISED) OPTION ITEM(S) 0004, 0007, 0008, 0011, 0012, 0015, 0016, 0019 and 0020 - PLANNING FOR DOCKSIDE (DS) AND DRY DOCKING (DD) MAINTENANCE AVAILABILITIES FOR POLAR CLASS ICEBREAKERS
The Contractor shall accomplish planning within the performance period specified in Section F for the specific CLIN outlined in this Item. The Government reserves the right to perform these functions internally, or order these supplies and services elsewhere at its discretion.
The Contractor shall participate with other A-Team members in the 1st A-Team meeting to familiarize itself with the work and to offer technical recommendations. A Draft Worklist will be provided prior to the 1st A-Team meeting, and an Approved Work Package after the meeting. As assigned by the Contracting Officer via the Approved Worklist, and using existing standard MLC specifications as its baseline or by developing entirely new specifications, the contractor will accomplish initial planning and produce a draft specification for review at the 2nd A-Team meeting. Following that meeting, the contractor will incorporate all agreed changes, finalize the specification, complete document preparation and submit a cost proposal and production schedule for conduct of each scheduled DS/DD. In accomplishing its assigned planning role, the contractor shall to the maximum extent practicable, utilize existing standard MLC specifications. See Table C-1 for planning milestones. All work shall be coordinated with MLC to ensure that planning efforts previously performed by MLC or any other Government activity are not duplicated. Following are representative aspects of the planning function that the contractor shall be prepared to accomplish, subject to authorization by MLC.
a.
Accomplish assigned planning for the repair and alteration of the specific POLAR Class cutter in accordance with the contract schedule, work specifications, drawings, test procedures and other detailed data provided by the Government. The Contractor will be required to accomplish assigned planning functions including, but not limited to: specification development, identification of and procurement of materials, performance of ship checks, prefabrication and other work necessary to prepare for repair and alteration of the vessel in a timely manner. All work specifications generated must be in standard MLC format utilizing Attachment J.1 as a guide.
b.
During the planning process the contractor shall utilize standard specifications from MLC’s library of recurring maintenance items as its baseline. The contractor shall furthermore submit for review recommendations that may improve the quality of repairs and alterations. Reliability and service life improvements shall also serve as a basis for making such recommendations. To the extent possible, the contractor shall provide condition-based recommendations in generating the specification package.
c.
The contractor shall complete assigned planning functions and produce a draft specification for review at the 2nd A-Team meeting, which will normally be conducted at the vessels’ homeport in Seattle, WA.
d.
As authorized, the Contractor shall provide limited ILS support during the conduct of work under this contract. Such Logistics support includes but is not limited to the following items, and specifics of the support will be clearly identified in the CLIN execution document:
Provisioning Technical Documentation
Technical Documentation
Redline markups of Selected Drawings e.
Apply stringent change control procedures to ensure timely identification and incorporation of additional work (beyond that generated from the Approved Worklist). Growth work is work identified after authorization of a given CLIN (whether planning or execution). Growth work will stem directly from an approved worklist item. New work is work unrelated to an approved worklist item, and shall be incorporated into planning separately.
(1) GROWTH WORK - The contractor shall include an anticipated amount of growth work in its execution phase (DS/DD) cost proposal. The parties shall negotiate a Growth Pool into the execution CLIN to process growth requirements. The incorporation of these negotiated Pools into DS/DD sub-Line Items will result in changes to the negotiated CLIN contract values (Target Cost, Target Fee, Minimum and Maximum Fees). MLC representatives will evaluate growth work requirements during the execution phase. The Contracting Officer will authorize Growth Pool expenditures only after the growth work in question has been negotiated. Growth work will be subject to the Limitation of Cost clause. During the execution phase, decreases in funding requirements due to cost underruns, and increases in funding requirements due to cost overruns (or to accommodate growth work beyond the negotiated Growth Pool amount), shall result in no change to negotiated CLIN contract values (Target Cost, Target Fee, Minimum and Maximum Fees).
(2) NEW WORK – The contracting officer has sole authority to engage the contractor with new work requirements (whether for planning or execution phase). Upon authorization, the Contractor shall develop and price the new work before submitting it for MLC review. The parties may then negotiate a change in CLIN contract values. Only the contracting officer shall grant authorization to proceed with new work. Once authorized, such work will be subject to the Limitation of Cost clause.
f.
When authorized, develop specifications for growth and new work. These specifications shall be written in a format similar to the basic specifications, describing the additional work to be accomplished.
g.
Engineering drawings requiring correction shall be brought to the attention of MLC. Written notification of drawing problems with proposed solutions shall be provided via a Condition Found Report.
h.
Identify, procure, receive and store Long Lead-Time Material (LLTM) as authorized by the contracting officer.
i.
Provide an integrated milestone plan for the planning and execution phases of the availability. These milestones will include a schedule of key events necessary to meet the dates specified for the execution phase performance period.
j.
Develop and utilize a progress measurement system to determine the physical progress of the planning and execution phases. The progressing system shall permit a direct comparison of the physical progress of completed work to the integrated milestone plan that is to be developed in subparagraph i. above.
k.
Apply internal quality assurance procedures and those required by the Naval Engineering Manual to ensure that procured material, engineering and production work meets required quality standards.
l.
The Contractor cannot modify the basic design features of the engineering data provided by the Government. If the Contractor deems modifications necessary, the Contractor shall submit a Condition found Report with a detailed problem identification and proposed solution. The Condition found Report will be reviewed by MLC and may be incorporated into the authorized planning effort.
m.
Work specifications shall be based on a cutter’s Long Range Maintenance Plan (LRMP), Cutter Class Maintenance Plan (CCMP), submitted Current Ship’s Maintenance Projects (CSMP), completed work specifications previously developed by MLC, and other data derived from ship checks and technical information provided by MLC. If authorized, specifications created by the Contractor or reapplied from previous maintenance efforts shall be examined prior to submission to ensure applicability and compliance with technical and format requirements specified herein. In preparing the specifications and in accomplishing the work, it is mandatory that repairs be based on the ships’ actual material condition. Work specifications shall be stored and organized electronically so as to permit re-use.
n.
All required engineering, drawing modifications and other illustrative material shall be prepared to interpret and define the repair and alterations to the ship.
o.
When authorized by MLC, all drawings and other data developed by the Contractor shall represent a practical engineering solution based on the best trade‑off between total cost, reliability, maintainability, availability of material, labor skill and industrial capability, state‑of‑the‑art, and timely accomplishment of the task. Such design work will meet the requirement of the General Specifications for Overhaul of Surface Ships, NAVSEA S9AA0-AB-GOS-010, and be formatted as indicated in the Naval Engineering Manual (085).
p. The Contractor shall develop and submit test procedures in support of work specifications as applicable in accordance with GSO Section 092 and shipyard procedures.
q.
The Contractor shall provide material required for the availability only upon authorization by MLC.
r.
Upon DS/DD option award, the notional specification contained in Section J for the specific availability will be superseded by the specification identified in the option award document. Likewise, the Section B costs and fees for the specific CLIN will be superseded by the costs and fees negotiated for the actual work package.
s.
The following documents or their subsequent revisions in effect at time of contract award and/or option exercise, as well as applicable current instructions, general specifications, type plans, naval ship technical manuals and directives from the Naval Sea Systems Command shall be used in the technical requirements of work under the Contract:

SECTION H – SPECIAL CONTRACT REQUIREMENTS
H.1 EARNED VALUE MANAGEMENT (ANSI/EIA Std 748-98)
Based upon the inability to correct adverse cost performance trends within the narrow performance periods outlined in Section F, MLC considers that the cost to establish and maintain an approved EVM system (under ANSI/EIA Std 748-98) would not provide the government favorable return on investment.
As an alternative, the contractor at a minimum, and to the satisfaction of the contracting officer, shall accomplish the following to manage and report on integrated cost and schedule performance for each CLIN.
Organization of EVMS for Execution CLINs
a. Utilize a work breakdown structure (WBS) to identify each authorized work item in the CLIN. Tailor an appropriate amount of indenture and size of control accounts for effective internal management control.
b. Define the CLIN organizational breakdown structure (OBS) for controlling the authorized work items at the control account level.
c. Integrate the CLIN WBS and OBS in a manner that permits cost and schedule performance measurement by elements of either or both structures.
Planning, Scheduling and Budgeting
d. Schedule the authorized work in a manner which describes the sequence of work and identifies significant task interdependencies required to meet the requirements of the CLIN.
e. Identify physical products, milestones, technical performance goals, or other indicators that will be used to measure progress.
f. Establish budgets for authorized work with identification of significant cost elements (labor, material, subcontracts, etc.) at the control account level, against which program performance can be measured. Budgets established for performance measurement will be the negotiated target cost.
g. Identify and control level-of-effort activity by time-phased budgets. Only those efforts that are unmeasurable or for which measurement is impractical may be classified as level-of-effort (i.e. CLIN project administration).
Accounting Considerations
h. Record direct costs in a manner consistent with the budgets estimated and established for the WBS element. Ensure that direct costs from a given control account are not allocated to two or more WBS elements (duplication).
i. Record and distribute to the CLIN all allowable and allocable indirect costs.
j. Identify unit costs, equivalent units costs, or lot costs when needed.
k. The material accounting system will:
Provide accurate cost accumulation and allocation to control accounts consistent with the manner in which such budgets were estimated and established.
Permit performance measurement at the point when most suitable for the category of material involved (for material, when discrete portions of material are installed/used, or in the case of subcontracts, when discrete segments of the subcontract work are accomplished).
Permit accountability of all material/subcontracted work procured for the CLIN.
Analysis and Management Reports
l. Two weeks after negotiation of the CLIN, submit the Performance Management Baseline (PMB), containing the following independent variables for each top-level WBS item (work item): BCWS, BCWP, ACWP, BAC, EAC, SPI, CPI, CV, SV
m. On a biweekly basis during performance of the CLIN, generate reports containing the independent variables for each top-level WBS item (work item): BCWS, BCWP, ACWP, BAC, EAC, SPI, CPI, CV, SV in the following report formats:
Direct cost report by top level WBS (segregate labor hours, direct labor cost, raw material costs and raw subcontract costs)
Total cost report by top level WBS (fully burdened costs)
Revisions and Data Maintenance
n. Develop revised EAC estimates based on performance to date, commitment values for material, and estimates of future conditions. Compare this information with the PMB to identify variances at completion important to company management and any applicable customer reporting requirements including statements of funding requirements.
o. Incorporate authorized changes in a timely manner, recording the effects of such changes in budgets and schedules.
p. Reconcile current budgets to prior budgets in terms of changes to the authorized work and internal replanning in the detail needed by management for effective control.
q. Prevent revisions to the program budget except for authorized changes.
r. Document changes to the performance measurement baseline.
H.2
EMERGENT WORK
a. If the need for emergent work develops, either under a planning or execution CLIN, the Contractor must obtain authority in writing from the Contracting Officer before proceeding with such work.
b. To the extent requested by the Contracting Officer, the Contractor shall prepare and submit electronic proposals for proposed changes that will include:
(1) A complete breakdown of labor hours and costs by labor category and phase of work;
(2) A complete breakdown of material costs showing material required, source (with point of contact), part number, unit price, extended cost and contractor's material handling charge/profit; and
(3) A complete breakdown of labor and material as described above for each proposed subcontractor.
c. The contractor shall submit electronic proposals and breakdowns to the Contracting Officer via email.
H.3
INSURANCE REQUIREMENTS
a.
The contractor shall be required to procure and thereafter maintain the following insurance:

2) Comprehensive general liability insurance to insure the risks described in HSAR 3052.217-95 Liability and Insurance (DEC 2003), in the amount of $300,000.00 on account of any one accident or occurrence with respect to each vessel, boat and barge upon which work is to be performed under this solicitation and the contract resulting there from:
3) Full insurance coverage in accordance with the applicable State Workmen's Compensation law; and
4) Full insurance coverage in accordance with the United States Longshore and Harbor Workers' Compensation Act.

Such certificate shall be furnished before commencement of work. Each certificate shall state that (NAME OF INSURER) has insured (NAME OF CONTRACTOR), in accordance with the Liability and Insurance clause and the Insurance Requirements clause contained herein. Each certificate shall set forth that each policy of insurance represented thereby will expire on (DATE) and that each such policy contains the following clause:
"It is agreed that in the event of cancellation, or any material change in the policy adversely affecting the interest of the Government in this insurance, thirty (30) days' prior written notice will be given to the Contracting Officer."
c.
An Offeror who proposes to self-insure for any of the risks set forth in the Liability and Insurance clause and in the Insurance Requirements clause contained herein shall submit satisfactory evidence to permit the Contracting Officer to determine that the Offeror's assets are sufficient for the risks set forth in such clauses. The Offeror shall submit with his Offer two (2) certified copies of documents listing his assets and liabilities and such other information as deemed necessary by the Offeror or as required by the Contracting Officer. For approval of self-insurance under the State Workmen's Compensation Law and the United States Longshore and Harbor Workers' Compensation Act, evidence of qualifications as a self-insurer under the applicable compensation statute must be furnished to the contracting officer.

All such above personnel shall comply with all contractor rules and regulations governing personnel at its facility, including those relative to safety and security.
b.
The contractor further agrees, as authorized by the Contracting Officer, to afford to a reasonable number of officers, employees, and associates of other offerors when inspecting contemplated work, the same privileges of admission to the contractor’s facility and access to the cutter on a noninterference basis, subject to all contractor rules governing personnel at its facility, including those relating to safety and security.
H.5

The Contracting Officer may unilaterally exercise any or all of the options specified in Section B at any time after contract award. Pricing for Option Items 0002 though 0022 will be subject to negotiation on the basis of up-to-date planning and execution packages as established by MLC. The negotiated pricing shall supersede pricing of the notional requirements in the awarded contract.
The Contract award will be made for Item 0001. All Option Items shall be exercised at the sole discretion of the Government. The evaluation of Option Items does not guarantee that the Government will authorize any Option Items.
H.6
