Performance Work Statement (PWS) Grounds Maintenance Services

USCG Sector San Diego, CA

1.0 INTRODUCTION

The United States Coast Guard is procuring Grounds Maintenance Services as described herein for the U.S. Coast Guard Sector San Diego and the Point Loma Senior Housing Quarters in San Diego, California. The Performance Work Statement (PWS) describes the attributes for a measurable and results-oriented performance standard.

1.1 Requirements Summary. The PWS defines the work and scope of the requirement so that the selected Contractor can identify and provide all personnel, management, supervision, materials, supplies, tools, transportation, and equipment (other than government furnished property identified specifically in subsequent section 10.0 of this PWS), to perform all grounds maintenance services in accordance with the terms and conditions of this Contract. The Contractor shall use the PWS, Exhibits and the QCP to perform the work of this contract as identified in Paragraph 7.0, Performance Requirements.

2.0 GENERAL

2.1 Mission. The U.S. Coast Guard Sector San Diego is the Southwestern-most Coast Guard Unit in the continental United States, located on San Diego bay. One of the Coast Guard's exemplary Sectors, Sector San Diego is responsible for all major Coast Guard operations south of Dana Point, including port safety and security, search and rescue, maritime law enforcement, environmental response, vessel inspections, and maritime aids to navigation.

The U.S. Coast Guard’s Point Loma Senior Housing Quarters are full time living quarters for locally stationed Coast Guard Senior Officers. Along with the 3 Housing units, there is a lighthouse and Fog Signal that is fully operational for the aid of Commercial, Recreational and Military navigation into the San Diego Bay Entrance.

2.2 Contract Objective. Sector San Diego and Pt. Loma Senior Quarters seek a Contractor that shall provide all personnel, equipment, tools, materials, supervision, and other items and services necessary to provide Grounds Maintenance Management and Services as defined in this Performance Work Statement (PWS). The Contractor shall be responsible for the management of the total grounds maintenance effort. This is to include the planning and programming of all services and compliance with all record and reporting requirements. The services to be performed will rely heavily on knowledgeable, experienced, individuals capable of maintaining the grounds in an orderly, clean, and healthy condition. The Contractor shall ensure that all services protect the integrity of the grounds, while protecting human health and the environment.

Grounds Maintenance Services shall include mowing, debris removal, edging, trimming, pruning, replacement of vegetation, weed control, fertilization, grounds clearing, service work, sprinkler maintenance and other efforts necessary to promote proper health, growth, color and appearance of ground cover and other vegetation.

2.3 Hours of Operation. All services for Sector San Diego shall be provided between 7:00 a.m.

and 3:00 p.m., Monday through Friday, unless otherwise directed by the Contracting Officer (KO) or Contracting Officer’s Representative (COR). All services shall be provided for Point Loma Senior Quarters between 7:30 a.m. and 3:00 p.m., Monday through Friday unless otherwise directed by the Contracting Officer (KO) or Contracting Officer’s Representative

COR).

2.4 Recognized Holidays. The Contractor is not required to provide Grounds Maintenance services on recognized Government holidays. The recognized Government holidays are: New Year’s Day, President’s Day, Martin Luther King’s Birthday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans’ Day, Thanksgiving and Christmas.

2.5 Location of Work. The Contractor shall be responsible for maintaining approximately twenty two (22) acres of grounds divided between two locations 8 miles apart.

2.5.1 U.S. Coast Guard Sector San Diego – Located at 2710 N. Harbor Drive. Sector San Diego is the Pacific Areas Southernmost Coast Guard Base, This Location is home to two 87’ Patrol Boats, four Jayhawk H-60 helicopters, a Joint Harbor Operations Center and multiple supporting units that are located on sixteen (16) acres of improved grounds.

2.5.2 Point Loma Senior Housing Quarters – Located at 2465 Cabrillo Rd. San Diego, CA 92106. There are 3 homes, including a Lighthouse and ancillary buildings that are documented as historical landmarks built in 1892 and are on located on six (6) acres, three (3) acres of which are improved grounds. This location is located within the Cabrillo National Park grounds.

2.6 Security and Parking: The Contractor, or representative, and all contractor employees entering Government property, shall abide by all security regulations that may be in effect during the contract period; and, shall be subject to such checks as may be deemed necessary. Prior to entering the base, the driver of the vehicle must provide the Base Security Guard with a valid vehicle registration, vehicle insurance and a valid California Driver’s License. The contractor’s employees or representative must provide the Base Security Guard with a valid picture identification card. An access list will be kept up to date at the front gate to validate current employees.

2.7 Point Loma Access and Gate Code. Point Loma Senior Quarters requires access to Cabrillo National Park and also requires a gate code to gain access to the Coast Guard Housing Property.

The National Park Guard Shack requires familiarization with contractors accessing property and will be arranged by the COR. The access code for the electric gate accessing Coast Guard Housing property will be changed periodically for security reasons. The COR will communicate any changes of this code to the contractor as to not restrict access.

3.0 DEFINITIONS.

Whenever used herein or in other documents that invoke this performance work statement by reference, the following definitions of terms apply.

3.1 Acceptable Quality Level (AQL). The maximum number of defects that can be considered satisfactory. The allowable leeway or variance from a standard before the Government will reject a specific service. An AQL does not imply that the Contractor may knowingly perform in an unsatisfactory way. It implies that the Government recognizes that defective performance sometimes happens unintentionally.

3.2 Contracting Officer (KO). A person duly appointed with the authority to enter into and administer contracts on behalf of the Government. The only person authorized to delegate, change, waive, or negotiate any of the technical requirements or other terms and conditions of the contract.

3.3 Contracting Officers Representative (COR). The person(s) whom the Contracting Officer designates in writing by name to serve as the day-to-day-liaison between the Contractor and the Contracting Officer on technical matters pertinent to this contract.

3.4 Contractor. The term Contractor as used herein refers to both the prime Contractor and any subcontractors. The Contractor will be responsible for insuring that the subcontractors comply with the provisions of this contract.

3.5 Equipment. Personal property of a capital nature including tools, machinery, furniture, vehicles, accessory and auxiliary items for use in performing services, or for any administrative purpose.

3.6 Special Event. An event identified in paragraph 8.2 that will require additional services to supplement the Daily Service performed under this contract.

3.7 Government. The term Government as used herein refers to the U.S. Coast Guard.

3.8 Site Manager. The Contractor's representative and point of contact with the Government representatives who is responsible for contract management and coordination.

3.9 Manufacturers Recommendation. The technical information and user instructions provided by the manufacturer for the operation, use, and maintenance of their equipment.

3.10 Government Business Hours. Monday through Friday, 7:00am to 3:00pm, except Federal holidays. Hours may also be referred to as: Duty Hours, Normal Working Hours, Normal Duty Hours, Duty, Regular Working Hours, or Regular Duty Hours. These hours may not necessarily correspond with the Contractor's working hours.

3.11 Performance Requirement Summary (PRS). The PRS identifies the key service outputs of the contract that will be evaluated by the Government to assure that the Contractor meets the standards of contract performance.

3.12 Contract Discrepancy Report (CDR). Formal, written document of Contractor nonconformance or lack of performance for contracted work issued by the KO.

3.13 Quality Assurance (QA). Government actions that assure the Government that services performed meet the requirements of this contract.

3.14 Quality Control (QC). Those actions taken by the Contractor to evaluate and control service performed so that they meet the requirements of the contract.

3.15 Quality Surveillance Assurance Plan (QASP). An organized written document used to support the Government’s quality assurance surveillance efforts. The document contains specific methods to perform surveillance of Contractor performance.

4.0 APPLICABLE DOCUMENTS

4.1 The Contractor shall comply with all federal, state, local, environmental protection statutes laws, regulations, and requirements; all industry standards/references; all Government, and Coast Guard Regulations, technical exhibits and attachments as listed in the table below as applicable to the performance of the contract and to contractor personnel.

4.2 The Government will furnish to the Contractor all publications upon request. Supplements or amendments to listed publications may be issued during the life of the contract. The Contractor shall immediately implement those changes, which result in a decrease, or no change in the contract price. The Government will also provide the forms listed which are needed for daily operations. Upon completion of the contract, the Contractor shall return to the Government all issued publications and unused forms.

5.0 PERSONNEL REQUIREMENTS AND QUALIFICATIONS

5.1 General. The Contractor shall provide qualified personnel in order to effectively perform the services required herein. The Contractor shall not hire any Coast Guard military and civilian personnel, even on a part-time basis. All employees must be citizens of the United States or aliens who have been legally admitted for permanent residence in the United States. If aliens are hired, proof of legal residency in the U.S. shall be provided to the KO prior to their commencing work under this contract.

a. Qualified personnel shall be on board at the effective performance start date of the contract and shall be maintained throughout the period of this contract.

b. The contractor shall submit personnel documentation, to include a staffing plan and roster of names, phone numbers, Photo ID’s and schedule, as required herein, in accordance with Section 8.0 Deliverables, of this PWS; and with the Contractor’s Quality Control Plan. The staffing list shall also identify the contractor’s site manager, supervisor or lead that is responsible for overseeing the staff.

c. The Contractor shall provide contingencies for employees who are not able to perform their regular assigned duties due to dismissal or absenteeism during regular work hours. The Contractor shall have in place a suitable replacement for the absentee employee within two hours of initial notification to the COR.

5.2 Supervision. The Contractor shall, at all times, provide supervision of his/her employees to assure compliance and satisfactory performance. All supervisors shall have knowledge of the ground maintenance requirements, equipment, and materials needed to train and direct personnel.

The Site Manager or designated personnel shall be the primary point of contact with the Government, conduct overall management coordination for performance of all work under this Contract and be authorized to receive any communications or notices of deficiency in contract performance. These notices may include, but are not limited to, the following: nonperformance

6 of 16 Attachment (1) of work, deficiencies in work performed and notices of proposed payment deductions due to performance deficiencies. In addition, the site manager or designated personnel shall be available to meet with the COR. The site manager or alternate shall conduct regular inspections to ensure conformance with the Contractor’s Quality Control Plan as outlined in paragraph 11.2 of this PWS. The Site Manager shall be available within the workday between 8:00 a.m. and 4:00 p.m.

to receive any such notices or to address contract performance issues.

5.3 Uniforms and Identification. Contractor personnel shall present a neat appearance and be easily recognized as contractor employees. The contractor shall provide each employee with an identification badge that shall include the employee’s name, employee’s photograph, and contractor’s name. Identification shall be available prior to employment and shall be worn or attached to the outer garment at all times.

5.4 Language Requirements. The Contractor or qualified representative on site must be able to read, write, speak and understand English. They must be able to fulfill, completely and clearly, the reporting requirements of the contract.

5.5 License, Insurance and Registration. A current driver's license is required for all personnel who operate vehicular equipment within the boundaries of Sector San Diego and Point Loma Senior Quarters. Contractor vehicles shall be insured and are required to be registered.

5.6 Conduct of Personnel. The Contractor shall require their employees to comply with the instructions pertaining to the conduct, safety, health and building regulations forming a part of this contract. Contractor personnel shall not smoke or consume food or drink while performing work on this contract. During breaks, eating or smoking is permitted in designated areas only.

Each Contractor employee is expected to adhere to standards of conduct that reflect credit on themselves, their employer, the U.S. Coast Guard, and the Federal Government. The Government reserves the right to direct the Contractor to remove an employee from the work site for failure to comply with the standards of conduct. To maintain continuity of services, the Contractor shall initiate immediate action to replace such an employee, at no additional cost to the Government.

5.7 Employee Training/Operation of Equipment. The contractor shall ensure that each employee is adequately trained to perform the requirements of this contract and instructed to safely and competently operate the equipment used to perform the work under this contract.

5.8 Damages. The Contractor shall be responsible for any damage caused to government property by the Contractor’s employees during the course of this contract.

5.9 Environmental Controls. The Contractor shall ensure policies and procedures are established that protect the health and safety of employees and the community to minimize or eliminate the risk of environmental pollution.

5.9.1 Herbicides and Pesticides. Selective herbicides and pesticides shall be applied in strict compliance with the products EPA or State of California registered labeling. All manufacturers’ instructions and recommendations for the preparation and application of herbicides and

7 of 16 Attachment (1) pesticides shall be strictly followed. In addition, the Contractor shall comply with all other applicable federal, state, and local laws and regulations concerning the application, storage and disposal of such hazardous material. Pesticides used at Base Los Angeles Long Beach and PT Vicente and storm sewers, etc. shall be approved in advance and in writing by the CO and Base Los Angeles Long Beach Hazardous Material Specialist through the requirements. The Contractor shall not illegally dump or dispose of any pesticides. The Contractor shall follow pesticide label directions and shall not spray pesticides if the wind is exceeding 10 MPH.

5.9.2 Notification of Environmental Spills. If the contractor spills or releases any substance listed in forty (40) CFR 302 into the environment, the Contractor shall immediately report the incident to the COR. The contractor shall be liable for the containment and environmental clean-up of the spill or release of such substance.

5.9.3 Hazardous Material Handling Procedures. The Contractor is responsible for advising his employees of all Environmental and Hazardous Materials Handling Procedures. The Contractor is required to have and maintain Safety Data Sheets (SDSs) for all materials used in the day to day operations. All materials shall be handled in accordance with federal and state laws and/or regulations and the Occupational Safety and Health Administration (OSHA) requirements. In the event of a spill of hazardous substances/materials, the Contractor shall immediately contain, clean-up and remove all hazardous substances/materials in accordance with all applicable federal, state, and local regulations. The contractor shall ensure that his operations do not expose any personnel (government or contractor) to any hazardous conditions (i.e. noise, chemicals, etc.) as covered by all applicable federal, state and local regulations.

5.9.4 Fuel/Pesticide Storage. Sector San Diego will not provide storage areas for fuel or pesticides.

5.9.5 Debris. The Contractor shall ensure that transportation of debris or policed materials from the site shall be accomplished in a manner preventing particles from becoming airborne: such as covered vehicles or enclosed dumpster boxes. The Contractor shall ensure that vehicles used for pesticide applications will carry an approved spill containment kit capable of containing any spill until first responders arrive. Burning of any material by the Contractor is prohibited.

5.9.6 Drainage. The contractor will ensure that drainage ways, sanitary and storm sewers, etc.

shall not be polluted by fuels, acids, pesticides or other harmful materials. If any of these materials are inadvertently spilled into these areas, the Contractor shall immediately notify the COR or the Sector San Diego Hazardous Material Specialist (619-571-8020) if COR is unavailable.

5.9.7 Pesticide/Herbicide Permits Regulatory Compliance. The Contractor shall obtain any Federal, State and Local permits required for the use of any pesticide and/or herbicide used under this contract at no additional expense to the Government. All pesticides/herbicides shall be procured, possessed, and labeled as registered with the Environmental Protection Agency and the State of California pursuant to the Federal Insecticide, Fungicide and Rodenticide Act as applicable. Each product shall be so registered for use under the particular environmental conditions under which it is applied as directed by Federal, State or Local agencies. The

Contractor shall possess all State of California Licenses required by law. The Contractor shall possess a current Commercial State of California Pesticide License. All Contractor personnel that apply pesticides shall have a current Commercial State of California Applicator’s License.

Bio-based products are preferred.

5.10 Conservation of Utilities. The Contractor shall make sure contractor employees practice utilities conservation. The Contractor shall operate under conditions that prevent the waste of utilities to include turning off lights when not in use and turning off water faucets or valves when not in use, and using nozzles on water hoses to prevent the waste of water.

5.11 Personnel Security. The Contractor shall maintain a current listing of all employees, including sub-contractors. The list shall include employee’s names and social security numbers.

This list shall be validated by the contractor’s manager and provided to the KO and Sector San Diego Security Officer at the contract start date. The listing shall be updated provided upon change of employee(s). Contractor personnel not listed may be denied access to the Coast Guard facility.

5.12 Fire Prevention and Protection. The Contractor and his employees shall comply with Sector San Diego’s Fire Protection Plan. A copy of this plan may be obtained from the COR.

Base fire prevention personnel may make periodic routine inspections for regulation compliance.

Burning of any material on Coast Guard property by the contractor is prohibited.

6.0 CONDUCT OF OPERATIONS

6.1 Superintendence by Contractor. The Contractor shall, at all times, provide supervision of his/her employees to assure compliance and satisfactory performance. The Contractor, or a minimum of one site supervisor/shift leader, will be on base and available when work on the contract is being conducted.

6.2 Coordination. The Contractor shall coordinate operations with the COR in order to avoid any interference with work of other Contractors and Government personnel performing other work in the areas involved in this PWS. The Contractor shall expect to cooperate with other such Contractors and Government employees and fit his/her own work to such additional work as it may be directed by the KO. United States Coast Guard personnel will not cause unnecessary delays during grounds maintenance needs are required. If problems arise contact the COR.

6.3 Schedule. The Annual Grounds Maintenance Plan shall be prepared by the Contractor and submitted to the COR, with a copy to the KO, for review and approval prior to the contract start date and shall cover the first contract performance period. This schedule shall be updated annually only if the Contractor makes changes. Updates shall be prepared by the Contractor and submitted for review and approval fifteen (15) days before option start date, when needed. As a minimum, the plan shall list the location of each task for each parcel and the proposed frequency for accomplishing each task. The plan shall be tailored to the Requirements for local conditions, types of vegetation and climate factors. Material specifications (e.g. weed control, fertilizer, etc.) shall also be included in the plan. Changes to the plan shall be requested in writing and submitted to the Sector San Diego COR prior to implementation. Extensive planned construction projects require Maintenance Plan flexibility.

6.4 Safety. The Contractor shall comply with all Federal, State, or Local regulations, laws, codes, relating to safety. The Contractor shall be responsible for adhering to and instructing his/her employees on all Occupational Safety Hazard Administration (OSHA) regulations as well as other local base requirements related to safety. The Contractor shall provide appropriate warning signs for slippery floor areas caused by cleaning or inclement weather conditions

6.5 Emergencies and Repairs.

6.5.1 Inoperative Irrigation or Pests. The Contractor shall notify the COR of any inoperative Sprinklers, Valves, and damage caused to buildings within one (1) working day. The Contractor shall also notify the COR of the presence and location of pest such as white fly’s etc. within one

(1) working day.

6.5.2 Accidents. The Contractor shall report all accidents in which there is any injury to personnel or damage to property to the KO within 24-hours of the occurrence.

6.5.3 Fires. The Contractor's employees shall report fires at: Sector San Diego to the Facility Officer of the Day at (618) 666-7448

6.5.4 Hazardous Conditions. The Contractor’s employees shall report all hazardous conditions to the COR. If after normal working hours the Contractor’s employees shall contact the San Diego Facility Officer of the Day or Duty Watch Stander as identified in Paragraph 6.6.3.

6.6 Weather. Times of inclement weather might produce fallen trees branches or heavy debris.

The contractor shall ensure that after this type of weather clean up is done within 3 days after inclement weather subsides.

6.7 Re-Work. When directed by the KO or the COR the contractor shall perform any work not performed or re-perform any work which was performed in an unsatisfactory manner. The quality requirements as set forth in this contract shall apply to these rework actions. The Government may issue a Contract Discrepancy Report (CDR) if the Contractor fails to perform any work or re-work under this PWS as outlined in paragraph 11.5.

6.8 Lost and Found. All articles found by Contractor’s employees shall be turned in to the

COR.

7.0 PERFORMANCE REQUIREMENTS

7.1 General. The frequency of mowing will be designated in the Annual Grounds Maintenance plan. Adjustment of dates due to holidays and inclement weather shall be coordinated by the Contractor with the Sector San Diego’s Contracting Officer’s Representative (COR) (designated by the Contracting Officer (KO)). Ground cover areas are to be maintained in a manner that promotes proper health, growth, rich natural green color and neat appearance. Lawn areas are to be free of broad-leafed weeds, weedy grasses that present an unsightly appearance, dead vegetation, and debris. All surface disruptions (i.e., mounds and depressions, etc.), are to be

10 of 16 Attachment (1) raked level and any resulting holes filled prior to mowing. Grass cutting is to be accomplished in a manner such that it is free of scalping, rutting, bruising, and uneven and rough cutting. If any bare ground within the limits of an area included in this contract becomes populated with grass or weeds through natural spread, i.e., not artificially planted, the Contractor shall maintain such area(s) as a part of the basic contract. Areas of Sector San Diego and Point Loma Senior Housing Quarters that are covered with grass are indicated in Technical Exhibit 4 (a) through (d) and Technical Exhibit 2.

7.2 Mowing. For Improved Grounds, the Contractor shall maintain a uniform height range of 2” to 4”. Each successive mowing shall be at approximated right angles to the previous mowing where practical. Clippings may be mulched and left in place as long as not clumping is apparent.

7.3 Edging. For Improved Grounds Areas all edging and trimming will be completed to coincide with lawn cutting operations as required. The edges of all paved surfaces, including curbs, walks, driveways, concrete pads, and any other paved surfaces shall be edged so that there is no vegetation closer than ½ inch to the concrete or paved area. Edging shall be accomplished in a manner such that it is free of scalping, rutting, bruising and uneven or rough cutting. After edging, all cuttings and debris shall be removed, sidewalks and paved areas cleaned, and all trash from the Contractor’s operations shall be removed from the site.

7.4 Trimming. Trim ground cover from around the trees, shrubs, fences, utility poles, signs, buildings, structures, sprinklers, parking log bumpers and similar fixed objects to the height of the adjacent ground cover. Damage to trees and shrubs from trimming shall be repaired by the contractor. If a plant should become unhealthy due to damage, the contractor will be responsible for replacing the damaged plant with a plant of same size and type. Plant replacement shall occur within 15 days of reported damage.

7.5 Maintain Trees/Shrubs/Hedges. Contractor shall prune trees, as identified by the COR, in improved and semi-improved areas on an annual pruning cycle. The pruning schedule shall be included in the Grounds Maintenance Plan. Pruning shall be accomplished in accordance with industry (ANSI Z1331 – 1994) standards. Class II medium pruning shall be used in general on all trees. Class IV pruning shall be used only for lifting, removal, and/or cutback of branches that conflict with normal traffic or safety in the vicinity of the trees. Minimum safety clearance is 14 feet over streets, 12 feet over driveways, 8 feet over walk areas, and 4 feet from buildings.

Other trees shall be pruned on an as required basis to provide safety, clearances and/or to prevent structural damage. Topping and de-horning shall not be permitted.

7.5.1 Shrubs inside the fence line shall be pruned as required to maintain their natural growth characteristics. New growth above the specified sizes shall not be allowed to exceed 8 inches.

Minimum clearances from buildings, utilities and other obstructions shall be six inches.

7.5.2 Hedges shall be maintained at their natural mature height and shape. No informal hedges or screen plantings shall be converted to formal shapes.

7.5.3 Broadleaf evergreens and flowers shall be pruned as required to maintain a minimum of 3 inches of clearance from buildings, sidewalks, or other obstructions.

7.5.4 Trimming of the tall assorted Palm Trees (28 each), assorted Ficus Trees (11), Juniper trees (28), Pine Trees (1), Cypress Trees (3 each), Magnolia Trees (3), Unknown Trees (4 each) mapped in (Technical Exhibit 1 & 2) shall be included in the contract price. All palms shall be trimmed in a “Y” method leaving only the healthiest branches while all other trees will be trimmed as needed in accordance with 7.5. Expected dates for trimming shall be included in the Grounds Maintenance Plan.

7.6 Replacement of Vegetation. For Improved Grounds Areas, the Contractor shall reseed all bare ground cover areas to obtain ground cover growth equal to the level of ground cover growth in the adjacent area. Use the necessary amount of topsoil to level off any ground being reseeded prior to seeding. Use the same warm season grasses as the existing ground cover. The Contractor shall replace/add decorative lava rock to all flower boxes, at signs, or other public areas and flower/shrub areas around the buildings to provide an attractive, neat appearance. The contractor shall provide labor and materials to restore any vegetation and/or lawn areas damaged during Coast Guard operational or morale activities. The Contractor shall repair damaged turf and replace flowers, shrubs, trees, and sprinkler heads damaged during either mowing operations or Coast Guard operations and events.

7.7 Irrigation. The Contractor shall work closely with the Sector San Diego COR to ensure adequate irrigation to meet the requirements of improved areas. All improved grounds in Technical Exhibits 1, 2, 3 & 4 have installed irrigation systems. Areas of poor coverage should be identified with recommended improvements on a continuing basis. The Contractor shall use both installed irrigation and manual methods to keep the grounds irrigated. The government will provide sufficient amounts of water, to present a uniform green color without browning or barren areas resulting from lack of water. The contractor shall be responsible for the maintenance, repair, replacement and upkeep of all irrigation systems components, including but not limited to valve boxes, timers, sprinkler heads, sprinklers and branch lines and associated electrical connections. No watering between 0630 - 1600 (6:30am- 4:00pm). Water shall not run off into gutters or sidewalks in large volume or create standing water in areas watered. No water shall be sprayed onto buildings, doorways, windows, or onto roadway or sidewalk.

7.8 Weed Control. For Improved Grounds Areas, the Contractor shall prevent the encroachment of weeds into established landscapes, including lawn areas and around trees, shrubs, signs, flower beds, etc. Plant beds and special landscaped areas shall receive weed control to eliminate unsightly and/or noxious weeds. Additionally, weed control shall be performed to eliminate grass and weeds in cracks and joints within or along sidewalks, curbs, parking lots, storage lots, runways, and taxiways and other paved surfaces within or adjacent to the maintenance area. All chemicals shall be applied in strict accordance with the product’s EPA or State registered labeling. All instructions or recommendations by the COR and manufacturer shall be accurately followed. The chemicals to be used and the rate and method of application shall be specified in the Annual Grounds Maintenance Plan.

7.8.1 Flight Line Weed Control. All work on or around the flight line including Spraying of the flight line for weeds requires communication and planning with Maintenance control (619- 278-7154) to ensure flights are not scheduled for departure/arrival. The COR will assist with

12 of 16 Attachment (1) meeting this requirement. Maintenance Control is located in the Southwest corner of Hanger 2 and shown on Exhibit #3. The schedule of weed control on the flight line shall be specified in the Annual Grounds Maintenance Plan.

7.9 Fertilization. The Contractor shall apply a balanced commercial fertilizer to all improved ground cover areas. The Contractor shall perform fertilization in a manner that promotes proper health, growth, color and appearance of cultivated vegetation. The method of application, fertilizer type, and dates of fertilization shall be identified in the Annual Grounds Maintenance Plan. The fertilizer shall be applied in accordance with the product manufacturer’s recommendations and applicable Federal, State and Local laws and regulations.

7.10 Debris/ Police Grounds. The contractor shall perform general litter patrol in all areas identified in Technical Exhibit 2. Responsibilities shall include, but not limited to the removal of all natural debris, tree limbs, dry brush, rodent habitats, dead animals, and man-made debris.

7.11 Debris Removal. After trimming, all cuttings and debris shall be removed, sidewalks and paved areas cleaned, and all trash from the Contractor’s operations shall be removed from the site. The Contractor shall dispose of all debris resulting from clearing work in accordance with Federal, State, and Local regulations.

7.12 General Maintenance of Non-Vegetation Areas. The Contractor shall provide general debris removal and maintenance of non-vegetation areas. Non-vegetation areas include those areas covered by red lava rock, or other decorative material around buildings, hedges, planters or in garden areas. The requirement is that all of these non-vegetation areas are maintained at all times in a clean, neat and pleasant appearance. General debris removal shall require removal of all dead vegetation, garbage, trash, etc. from all non-vegetation areas. Maintenance may require the addition of required decorative material (of like composition) to provide a neat, fresh and well-groomed appearance. Decorative material will be filled to a minimum depth of 2 inches.

There shall be no bare spots or plastic lining exposed. Raking shall be done to give the area a freshly turned appearance and all weeds shall be removed.

7.13 Special Event Services. Upon notification by the government, the contractor shall perform special event grounds maintenance services. The required tasks to be performed in this section will be within the scope of the contract. The contractor may request the COR to reestablish priorities and to reschedule tasks that are delayed due to special event service. For advanced planning proposes, the KO or COR will notify the contractor a minimum of twenty-four (24) hours prior to the event.

8.0 DELIVERABLES

8.1 The Contractor shall comply with all federal, state and local environmental protection statutes and regulations, as well as applicable US Coast Guard instructions, directives, attachments and exhibits listed in the table below pertaining to the services required herein and to the conduct and qualifications of personnel in performance of this contract. The Contractor shall utilize safe products and equipment and qualified personnel to ensure the health and safety of all are in compliance with Environmental Protection Agency (EPA) and Occupational Safety

Hazard Administration (OSHA) regulations.

8.2 The Government will provide all publications listed that are not readily available to the contractor upon request of the Contractor. Supplements or amendments to listed publications may be issued during the life of the contract. The Contractor shall immediately implement those changes, which result in a decrease, or no change in the contract price. The Government will also provide the forms listed which are needed for daily operations. Upon completion of the contract, the Contractor shall return to the Government all issued publications and unused forms.

9.0 GOVERNMENT FURNISHED PROPERTY, FACILITIES AND UTILITIES

9.1 Electricity and water. The Government will furnish all electricity and water.

9.2 Dumpsters. Dumpsters are provided and are used jointly by the Contractor and the Coast Guard for accomplishment of required work in accordance with the contract requirements.

10. CONTRACTOR FURNISHED ITEMS AND SERVICES

10.1 General Information. The following mentioned requirements are not all inclusive of the contractor-furnished items and services required in the performance of this contract.

10.2 Chemicals. Material Safety Data Sheets or EPA Certification Labels will be submitted to the COR for all chemical products to be used for approval at least 15 days prior to use. Chemical products refer to, but are not limited to, such items as herbicides, pesticides, fungicides, fertilizers, etc. The contractor shall also submit a copy of the manufacturer’s recommendations for all chemical, seed and plant products used under this contract 15 days prior to any application.

10.3 Hazardous Debris Removal. All hazardous debris and policed items shall be transported off Sector San Diego/Point Loma Housing grounds on a daily basis and disposed in accordance with applicable federal, state, and local regulations. Debris and policed items shall be transported in tarp covered or closed vehicles. Any materials dripped or blown off the vehicles shall be immediately picked-up by the contractor. All scrap materials and debris shall be disposed of daily in accordance with all applicable federal, state and local regulations.

10.4 Contractor Furnished Vehicles. Contractor provided vehicles shall meet all local, state, and federal safety requirements. Each Contractor vehicle entering Sector San Diego or Point Loma Housing Quarters shall have the name of the contractor neatly exhibited on each side of the cab. The contractor shall operate vehicles to comply with base traffic regulations. Vehicle mounted communication equipment shall conform to all applicable base and federal frequency regulations. Vehicles shall be maintained clean to present a professional appearance.

10.5 Contractor Furnished Equipment and Tools. The contractor’s equipment, including, but not limited to mowers (push, riding and tractor), edger’s, trimmers, etc., shall be of commercial quality, size, and type suitable for accomplishing the work specified. All equipment used by the contractor shall meet all safety requirements. The Government will not provide electricity to operate contractor equipment. The contractor’s equipment shall be in good repair, with all safety guards in place and able to operate efficiently and safely. Equipment shall be maintained clean to present a neat, professional appearance.

11.0 CONTRACTOR QUALITY CONTROL (QC) REQUIREMENTS

11.1 Quality Control Program. The quality control program is the driver for quality performance. The Contractor is required to develop a program of inspections and monitoring actions which comprise a Quality Control Plan (QC).

11.2 Contractor Quality Control Plan. (QC). The Contractor shall develop and maintain a (QC) plan describing the Contractor’s QC Program Inspection System to ensure services are performed in accordance with commonly accepted commercial practices and the performance of service as required by the PWS. The plan should encompass all functions identified in the PWS and implement procedures to identify, prevent and ensure non-recurrence of defective services.

In addition, the QC Plan must explain how the Contractor shall sustain the quality of services required. At a minimum, the Contractor shall develop quality control procedures addressing the areas identified in the Quality Control Program Inspection System below. This plan shall be submitted in accordance with the schedule of Deliverables in section 8.0 of this PWS.

11.3 Quality Control Program Inspection System. The QC system shall encompass all functions of the contract. It must specify areas to be inspected, on either a scheduled or unscheduled basis, or list the title(s) of the individual(s) conducting the inspection. The contractor shall develop and implement quality control procedures addressing the areas identified in the PWS and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The QC program/inspection system shall designed to keep the Contractor’s management and the Coast Guard informed of all issues affecting quality to include timely and effective corrective actions. The Contractor shall ensure that QC includes timely and effective corrective action for all deficiencies identified by the Government.

11.3.1 Contents of the QC Program Inspection System, shall include, but are not limited to description of the methods to be used for identifying and preventing defects in the quality of service performed and the following:

A. Introduction

1. Objectives in using Quality Control

2. Successes with and updates for the System

B. Grounds Maintenance Quality Control Process for the Various Tasks identified herein:

1. Steps and Flow Diagram (includes checklist used in inspecting contract performance during regularly scheduled/unscheduled inspections/testing; method of documenting and enforcing quality control operations).

2. Inspection Procedure (to include the attached weekly Quality Control Checklist and Inspection Sheets, or a checklists used by the contractor), identifying the items, frequency, indicators and actions taken if nonconformance is found covering all service requirements of the contract.

3. Means of Identifying and Resolving Problems.

4. Roles and Responsibilities

C. Specific Quality Control Functions:

1. Supervision of Services covering all the service requirements of this contract (to include staffing and schedules for all necessary assignments; submissions and completion reports; and, availability of project manager/supervisor/shift-team leader and any substitutes/alternates with the flexibility to realign staff for certain events; a training plan outlining names, topics, and completion dates; and, the name(s) of the individual(s) who will perform the inspections.

2. Contingencies-– Procedures to be used; obtaining additional employees in Special Events/Emergency Situations

3. Response to Contract Discrepancy Reports (CDR)

4. Contractor identified service work procedures

11.3.2 The records of inspections shall be kept and made available to the Government throughout the contract performance period and for the period after contract completion until final settlement of any claims under the contract.

11.4 Performance Evaluation Meetings. The Contractor or Contractor’s representative, or alternate, may be required to meet at least weekly with the COR during the first month of the contract. Meetings will be scheduled, thereafter, as determined by the COR. Time and place of the meetings will be mutually agreed upon between the Coast Guard and the Contractor. The minutes of the meetings shall be prepared by the COR, and signed by both the COR and the Contractor or Contractor’s representative or alternate. If the Contractor does not concur with the minutes, they shall state, in writing, any areas of non-concurrence, and submit to the COR, within five (5) calendar days of receipt of the signed minutes.

11.5 Contract Discrepancy Report (CDR). When the number of discrepancies exceeds the allowable number of defects designated in the Performance Requirements Summary (PRS), the COR will record the discrepancy in a CDR. The CDR will then be issued to the Contractor by the Contracting Officer after review. The Contractor shall be required to complete block 4 of a CDR and return to the Contracting Officer. The Contracting Officer will evaluate the contractor’s explanation and determine the next course of action. The Contractor may request a

16 of 16 Attachment (1) meeting whenever a Contract Discrepancy Report (CDR) is issued. Payment deductions may be taken in accordance with the (PRS) as indicated in Attachment 3 of the Contract.

12.0 GOVERNMENT QUALITY ASSURANCE (QA) REQUIREMENTS

12.1 Quality Assurance Surveillance Plan. The Government’s Quality Assurance Surveillance Plan (QASP) is independent of the Quality Control Program Plan managed by the Contractor.

All findings of unsatisfactory or non-performed work will be administered under the terms and conditions of this contract. To facilitate the Government’s (QASP), the COR will verify contractor compliance with designated performance requirements. With this intent, the surveillance approach may not be one that stays the same throughout the duration of the contract.

The COR will periodically update the surveillance approach when the need arises. In addition, for noncompliance or untimely corrective action to deficiencies of specific tasks, the contractor is subject to re-performance. All costs associated with rework are the responsibility of the Contractor.

12.2 Fundamental Government Responsibilities. The COR is responsible for representing the KO for all facets of quality for the services required. The COR may observe the Contractor’s operations but shall not interfere with Contractor performance. The COR has authority to point out discrepancies with the contract requirements, but does not have authority to alter the terms or conditions of the contract without written authority from the KO.

The COR performs these other qualitative and evaluative functions:

a. Report any findings resulting from periodic or random inspections to the Contractor or designated representative.

b. If discrepancies are discovered as a result of the periodic inspections, or any other means, conduct discussions and issue Contract Discrepancy Reports (CDR) to ensure discrepancies are corrected.

c. Meet with the Contractor’s representative as agreed to or as often as necessary.

d. Perform annual and final Performance Evaluations.
