F. NOTICE FOR FILING AGENCY PROTESTS
It is the policy of the USCG to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO).
Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum, rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the contracting officer or Ombudsman.
INFORMAL FORUM WITH THE OMBUDSMAN: Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the cognizant contracting officer. If the contracting officer is unable to http://www.fbo.gov/ satisfy the concerns, the interested party is encouraged to contact the USCG Ombudsman for Agency Protests. Under this informal process, the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, contracting officer, and solicitation closing date (if applicable).
FORMAL AGENCY PROTEST WITH THE OMBUDSMAN: Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the contracting officer through open and frank discussions. If the protester’s concerns are unresolved, an independent review is available by the Ombudsman. The protester may file a formal agency protest to either the contracting officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103. If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed.
This will not preclude re-filing of the protest to meet the requirement. To be timely, protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be submitted to:

FAR 52.212-2 Evaluation – Commercial Items (Jan 1999)
(a) The Government intends to award a single-award fixed price IDIQ contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government will conduct a Best-Value Trade-Off analysis using the following evaluation factors (listed in descending order of importance):
Technical Capability Past Performance Price
When combined, Technical Capability and Past Performance (non-price factors) are significantly more important than Price.
(b) Evaluation Factors:
The Government will evaluate the proposals against the following three (3) factors:
Technical Capability: The Government will evaluate each proposal against the requirements in sections 3.2 – 3.13 of the SOR. The Government will evaluate the extent to which any software modifications necessary to meet the requirements in these sections of the SOR. A few simple modifications are preferred to many complex modifications. Failure of the offeror to comply with sequentially addressing the SOR requirements, simply restating or paraphrasing the SOR, or noncompliance with any of the RFP instructions may result in the proposal being downgraded or rejected and eliminated from further consideration. The Government will access the offeror’s software to draft, modify and display a sample incident action plan. The Government will evaluate the system’s efficiency, usability, and availability of technical support tools.
Past Performance: The Government’s intent is to determine whether the offeror consistently delivers quality products and services in a timely manner. The Government will consider questionnaires submitted by past performance references.
The Government reserves the right to consider data from the Past Performance Information Retrieval System (PPIRS) and other Government sources. An offeror’s lack of relevant past performance information will be evaluated by the Government as “Neutral” for this evaluation factor.
Price: The Government will not rate or score price, but will analyze each offeror’s proposed price for reasonableness. This analysis will substantiate the validity of the offeror’s approach to meet the requirements in the SOR.
Reasonableness. In evaluating reasonableness, the Government will determine if the offeror’s proposed prices, in nature and amount, do not exceed those which would be incurred by a prudent Contractor in the conduct of competitive business. The assessment of reasonableness will take into account the context of the SOR, including current market conditions and other factors that may impact price.
Ordering Periods. The Government may determine that an offer is unacceptable if the ordering period prices are significantly unbalanced.
Total Evaluated Price. In performing its Best-Value Trade-Off analysis, the Government will use total evaluated price. Applying unit prices from attachment (3), the Government will calculate total evaluated price as follows:
Quantity Unit Price for CLIN Extension
56 00001 1 00002 8 10001 56 10001A 8 10002 8 10003 8 20001 64 20001A 8 20002 8 20003 8 30001 72 30001A 8 30002 8 30003 9 40001 80 40001A 9 40002 9 40003
Total Evaluated Price: --- sum of this column
Offerors are not required to complete the above table. Offerors are required to complete attachment (3).
(c) The Government intends to evaluate proposals and award a contract without discussions. Therefore, each initial offer shall contain the offeror’s best terms from a technical and price standpoint. However, the Government reserves the right to conduct discussions if determined necessary by the Contracting Officer. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(d) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
