SECTION I SCHEDULES
I.1 OVERVIEW
U.S. Customs & Border Protection (CBP) is soliciting proposals for supplies and services related to Mobile Reflective Imaging Systems (MRIS) for the Non-Intrusive Inspection (NII) Program.
CBP intends to award a single Indefinite Delivery, Indefinite Quantity (IDIQ) contract with a single, five-year ordering period. While the IDIQ contract will not have options, CBP anticipates that delivery orders may include optional lines for additional systems or maintenance services options when considered to be in the Government’s interest to do so.
Specifications for the supplies and services can be found in the attached Statement of Work.
The IDIQ will use a firm-fixed price schedule. Any order based on this IDIQ will be firm-fixed priced.
I.2 PERIOD OF PERFORMANCE
The contemplated contract has a five-year period of performance, with no option periods. The ordering period under this IDIQ will be five years from the date of award. The effective period of this IDIQ, however, will begin on the date of award and will continue until completion of the final delivery order on the contract. Orders issued from this contract could have performance periods that extend up to ten (10) years from the Government’s acceptance of the final unit under that order, if all possible options are included on that order and are exercised.
I.3 CONTRACT PRICING
Prices for the MRIS and other deliverables shall be FOB Destination for locations in the in the contiguous United States (CONUS). Vendors will be required to deliver units to locations specified at the order level. This price must include shipping charges, set-up costs and factory test representation. Additional shipping charges may be bid at the order level for any units outside of the contiguous United States (OCONUS). By the same token, warranty and maintenance prices are for CONUS units. A warranty or maintenance price differential may be quoted at the order level for any OCONUS destinations, once known.
Prices for the below schedule shall be listed as a single, fixed price for each item during the entire ordering period.
I.4 INDEFINITE DELIVERY INDEFINITE QUANTITY CONTRACT – SINGLE AWARD
The contracting officer has determined that a single award IDIQ contract is in the best interest of the Government.
Therefore, only one vendor will be selected for award.
I.5 INDEFINITE QUANTITY LIMITS
The Government has determined that the minimum buy for this IDIQ will be one (1) MRIS to be awarded concurrently with the IDIQ. The vendor is not obligated to fulfill requirements (singly or in the aggregate) that exceed $76.4 million under this IDIQ.
I.6 ORDERS
The IDIQ permits option lines at the order level. If options are included in subsequent Delivery Orders, FAR clauses 52.217-7 and/or 52.217-9 will be included on the order. Orders may contain option clauses for increased quantities, systems, training, and maintenance.
The authorized activity for initiating orders is the Non-Intrusive Inspection Program Management Office. RFQ’s and order awards will be issued by the CBP Procurement Directorate on behalf of the program office.

Warranty and Maintenance Services Options
PLEASE NOTE: The services below are for commercial warranties beyond the first year and for preventative and corrective maintenance. Base unit pricing should not include any maintenance beyond what is in the base system warranty. Warranties should not include preventative maintenance.
Corrective and preventative maintenance are severable services. Therefore, to the extent that maintenance will be purchased, it will be acquired through options using available funds during each fiscal year.
Corrective maintenance options and Warranty (base and extended) cover the same services. Since the base unit pricing includes a one-year base warranty, there is no first year corrective maintenance option below.
Finally, in the Extended Warranty section below, the line description indicates the total warranty period including the base year. So “Two Years of Warranty” is one year of extended warranty plus the base year warranty.

However, pursuant to 41 U.S.C. 4703, the following procedures shall apply prior to canceling or ignoring the markings.
(i) The Contracting Officer will make written inquiry to the Contractor affording the Contractor 60 days from receipt of the inquiry to provide written justification to substantiate the propriety of the markings;

If the Contracting Officer determines that the markings are authorized, the Contractor will be so notified in writing. If the Contracting Officer determines, with concurrence of the head of the contracting activity, that the markings are not authorized, the Contracting Officer will furnish the Contractor a written determination, which determination will become the final agency decision regarding the appropriateness of the markings unless the Contractor files suit in a court of competent jurisdiction within 90 days of receipt of the Contracting Officer’s decision. The Government will continue to abide by the markings under this paragraph (e)(1)(iii) until final resolution of the matter either by the Contracting Officer’s determination becoming final (in which instance the Government will thereafter have the right to cancel or ignore the markings at any time and the data will no longer be made subject to any disclosure prohibitions), or by final disposition of the matter by court decision if suit is filed.
(2) The time limits in the procedures set forth in paragraph (e)(1) of this clause may be modified in accordance with agency regulations implementing the Freedom of Information Act (5 U.S.C. 552) if necessary to respond to a request thereunder.
