SECTION M
SECTION M: FAR 52.212-2 EVALUATION – Commercial Items (OCT
2014) “ADDENDUM”
1. BASIS FOR CONTRACT AWARD
The Government intends to award a single Blanket Purchase Agreement (BPA) from this solicitation to the Lowest Priced Technically Acceptable (LPTA) offer received in response to the solicitation. The Government is utilizing the LPTA source selection process. LPTA is appropriate when best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price. LPTA may be used in situations where the Government would not realize any value from a proposal exceeding the Government’s minimum technical or performance requirements. The Government will select the offeror that is evaluated to have an acceptable technical approach (technical specifications), an acceptable past performance record with the lowest price. Offerors must satisfy the requirements described in the Statement of Requirements (SOR), as well as other Request for Proposal (RFP) requirements. Proposals that take exception to any requirement shall be deemed unacceptable. Proposals are evaluated for acceptability but not ranked using the non-cost/price factors. The evaluation will be conducted in accordance with FAR 12, 13.3 and Section M (Clause 52.212-2 Evaluation Addendum) of the RFP.
Unless all offers are rejected, the Government intends to award a single, firm fixed price contract to the responsible Offeror whose offer, conforming to the solicitation, is determined to be the best overall value, price and other factors considered.
2. EVALUATION FACTORS
The evaluation will be based on a complete assessment of the Offeror’s proposal. Proposals shall be evaluated on the following factors and subfactors listed and rated as acceptable or unacceptable.
Factor 1: Technical - Proposal demonstrates how the Offeror’s proposed approach and capabilities will comply with Government requirements (SOR) throughout the entire ordering period. In addition, the Offeror’s technical approach shall address the following sub-factors:
• Subfactor 1: First Article Testing
• Subfactor 2: Website Testing
Factor 2: Past Performance
Factor 3: Price
• The Technical factor and subfactors (Factor 1) are of equal importance to the Past Performance factor (Factor 2). The offeror must be deemed acceptable under Factors 1 and 2 before the price will be evaluated. Low price will then be the determinative factor between the offerors deemed acceptable under Factors 1 and 2.
• Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
A. Factor 1: Technical: The Government will evaluate the adequacy of the Offeror’s approach and understanding of the requirements specified in the solicitation and all attached documents, as demonstrated by the proposed technical capabilities. The evaluation of the Offeror’s technical volume will assess whether its proposal will satisfy the Government’s minimum acceptability requirements. The Offeror shall provide its technical capability against the SOR. Offerors shall submit a sampling of its stock to demonstrate its quality standards which are due in accordance with as specified in Block 8 on page 1 of the SF-1449.
The Technical Evaluation Panel will assign a single rating that most accurately describes the Offeror’s proposal for Factor 1 and its subfactors using the adjectival scheme below. If any Subfactor is found to be unacceptable, Factor 1 will be rated unacceptable. If Factor 1 is unacceptable, the proposal will not receive any further evaluation and will be out of the competition.
Elements of this evaluation include:
1) Technical: The Government will evaluate the extent that the proposed technical approach/capability adequately meets the requirements throughout the entire ordering period. In addition, the technical evaluation will consider the following sub-factors:
2) Subfactor 1: First Article Testing Samples: Offeror shall submit samples of the following required items for First Article Testing with applicable Ratings and Requirements. Offerors shall submit each item as specified in Block 8 on page 1 of the SF-1449.
a. 70E Protective Clothing (Shirts: Item Number 0001 (Sizes - Men: (1) Large, and (1) 3XL) and Item
Number 0002 (Size - Women (1) 3XL)): Contractor shall provide Navy Blue shirts that are flame resistant with a minimum HRC2 ATPV (8 cal/cm2) lightweight flame resistant material with two chest pockets with flap. All buttons on the shirt must be Navy Blue. There will be two adjacent cuff buttons to allow for a fit adjustment. B. Factor 2: Past Performance: The Government will evaluate how well the offeror has performed on contracts that have been determined to be both recent and relevant to the SOR. The offeror’s past performance reference may submit past performance information on the attached past performance questionnaire (See attachment J-2). Each past performance questionnaire must correspond to an experience example submitted. The POCs identified on the questionnaire must be able to provide information on the quality of your performance.
Past performance is a measure of the degree to which the Offeror satisfied its customers in the past and complied with Federal, State, and local laws and regulations, as identified as the Prime Contractor or direct employee or consultant. The Government may contact some, all or none of each Offeror’s customers past performance reference as identified in its Volume III submission.
The Government may also use other information available from other sources to evaluate an Offeror’s past performance, which may include, but not limited to: Past Performance Questionnaire, Federal, State and local Government agencies, Better Business Bureaus, published media, electronic databases such as the Contractor Performance Assessment Reporting System (CPARS) and the Past Performance Information Retrieval System (PPIRS). Interviews with other Government or commercial personnel contacts not provided by the offeror may also be utilized. The Government reserves the right to limit or expand the number of references it decides to contact and to contact references other than those provided by the Offeror.
In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR13.106- 2(b)(1)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.” Offerors with an unacceptable past performance rating will be afforded an opportunity to address alleged deficiencies.
C. Factor 3: Price: In accordance with FAR 15.404-1, Proposal analysis techniques, proposals will be evaluated to determine if they are fair and reasonable, and reflect a clear understanding of the requirements.
The Offeror shall provide its proposed firm-fixed prices in the provided Excel spreadsheet (J-1 Pricing Spreadsheet), which will be used to evaluate cost for the basic agreement. Offeror shall provide a firm fixed unit price for each garment on “Total Price All Years” Tab, which shall be multiplied by the quantity to result in the final total price for each order. All tabs of the attachment J-1 Pricing Spreadsheet must be completed for the offer to be evaluated. To be considered complete, the submitted bid schedule shall not have missing or incomplete pricing data. If offeror proposes an item as “no cost”, offeror shall put “$0” for the price of that item.
For evaluation purposes only, the total evaluated price is the sum of the total prices submitted for the base ordering period and all additional option periods. In addition, the prices submitted for each of the pricing spreadsheet tabs, will be evaluated as the total overall price. In addition, one half the final option year price (for the potential FAR 52.217-8 extension) will be considered part of the total evaluated price. The Government may determine that a proposal is unacceptable if one of the additional ordering period’s prices are significantly unbalanced. Evaluation of additional ordering period pricing will not obligate the Government to exercise the option.
3. RATING METHODS
A. FACTOR 1 – TECHNICAL:
The Evaluation Process for Factor 1 is specified below and applies to the non-price factor/subfactors; First Article Testing and Website Testing. The rating reflects the assessment on whether the proposed first article samples and website sample meets or does not meet the minimum requirements of the solicitation.
The evaluation of the Offeror’s proposal against these minimum requirements shall be determined “acceptable” or “unacceptable” and shall utilize the technical ratings listed below:
Technical Acceptable/Unacceptable Rating Method
Acceptable Proposal meets the requirements of the solicitation indicates an adequate approach and under standing of the requirements.
Unacceptable Proposal does not meet requirements of the solicitation and, thus, contains one or more deficiencies and is un-awardable.
B. FACTOR 2 – PAST PERFORMANCE:
There are three steps performed when evaluating the past performance factor: recent, relevant, and quality (how well the offeror performed on the prior contracts).
1) Step 1 – Recent. The first step is to evaluate the recency of the offeror's past performance. Recency is generally expressed as a time period during which past performance references are considered relevant, and is critical to establishing the relevancy of past performance information. If a reference is outside/before the timeframe listed below, then that reference will be rated “not recent” and will not be further evaluated as a part of the past performance factor. Each of the contract references must pass the “recent” step in order to proceed to step 2 – relevant.
Performance of each reference must be on-going or completed within the previous two (2) years of the date of this solicitation (not before March 1, 2015). If performance is ongoing, the offeror must have completed at least 6 months of performance to be considered recent for evaluation purposes. Past performance not considered recent will not be evaluated or considered.
2) Step 2 – Relevant. The second step is to determine how relevant a recent effort accomplished by the offeror is to the effort to be acquired through the source selection. The relevancy rating evaluates the aspects of an offeror's history of contract performance that would provide the most context and give the greatest ability to measure whether the offeror will successfully satisfy the current requirement.
Relevancy Ratings and Definitions:
• Relevant: The past performance contract reference involved similar scope and magnitude of effort and complexities this solicitation requires.
• Not Relevant: The past performance contract reference does not involve similar scope and magnitude of effort and complexities this solicitation requires.
Relevant Project is defined as:
1. Three (3) contract references for the purchase and delivery of Arc Flash Uniforms.
2. The total contract value is a minimum of $15,000.00.
3. The offeror must be the prime contractor. (Note: Subcontractor contract references will NOT be rated relevant).
3) Step 3 – Quality. The third step is to determine how well the offeror performed on the prior contracts. This step will assess how well the contractor performed to determine the ability of the contractor to successfully perform the proposed contract requirements based on its performance on similar contracts in the past.
NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “Neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable”.
The Technical Evaluation Panel will assign an adjectival rating that indicates its past performance assessment of the contract references as indicated below.
Past Performance Acceptable/Unacceptable Rating Method
Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
C. FACTOR 3 – PRICE:
The price factor will not receive a rating, but the evaluated price must be found to be fair and reasonable in order to be eligible for award. The pricing evaluation will be based on price analysis techniques found in FAR 15.404-1 to determine if they are fair and reasonable. Price analysis will be used to determine the total evaluated price to support the selection of the lowest priced, technically acceptable offeror. For evaluation purposes, the total evaluated price will be:
1. The total prices submitted for the base ordering period and all additional ordering periods (Attachment J-1 Pricing Spreadsheet), and
2. An amount equal to one-half the final option year price (6 months) to cover the cost of the potential option under FAR 52.217-8.
STATEMENT OF REQUIREMENTS
Statement of Requirements Washington Headquarters Services
Uniform Program Arc Flash Rated and Non-Arc Flash Uniforms
Date: 20 April 2017
Part 1: General Information.
1.1 Scope: This Statement of Requirements (SOR) defines the effort required for the purchase, manufacture, and distribution of Arc Flash Rated and Non-Arc Flash Personnel Protective Equipment (PPE) Uniform Components, and the design/and maintenance of a web-based ordering system for the Washington Headquarters Services (WHS)/Federal Facilities Division (FFD) Uniform Program. The uniform components shall be either purchased or manufactured in accordance with the garment specifications, various textiles specifications and quality requirements contained in Attachment 1 Pentagon Uniform Components List and Attachment 2 Raven Rock Mountain Complex (RRMC) Uniform Components List and this SOR.
1.2 Description of Product: The contractor shall provide all services including labor, equipment, tools, materials, and facilities to manufacture and distribute National Fire Protection Association (NFPA) 70E compliant and the Berry Amendment Act compliant uniform components for the FFD employees in an efficient and accountable manner.
These products includes, but is not limited to the purchase, manufacture and distribution of all Arc Flash Rated and Non-Arc Flash uniform components, and the design and maintenance of a web-based ordering system. A complete list of uniform components required by the employees is set forth in Attachments 1 and 2.
The Berry Amendment is outlined in the Defense Federal Acquisition Regulation Supplement (DFARS) Procedures, Guidance, and Information (PGI) 225.7002 “Restrictions on food, clothing, fabrics, and hand or measuring tools” section and clauses 252.225-1 and 252.225-12.
1.3 Background: The requiring agency, WHS/FFD, has a requirement for its Wage Grade employees to wear uniforms that are in compliance with the regulations of the NFPA standard 70E.
The NFPA 70E Standards for Electrical Safety in the Work Place outline the requirements for employees to use proper Personal Protective Equipment (PPE). The PPE must protect the employees to NFPA 70E standard PPE category 2 (minimum ARC rating of 8 cal/cm2) and category 4 (minimum ARC rating of 40 cal/cm2) for specialized operations. The PPE including all accessories (patches, name tapes, Velcro strips shirts and jackets must contain ARC flash (flame resistant) material). The PPE should include long sleeved shirt and long pants or long sleeved coveralls.
Each employee is required to be in uniform everyday therefore; this contract will be put in place to provide the employees with the ability to meet their uniform requirements. This will be accomplished by purchasing the aforementioned requirements via a web-based ordering system that will track all transactions.
An ARC flash is an undesired electric discharge that travels through the air between conductors or from a conductor to a ground. The resulting explosion can cause fires and serious harm to people and equipment.
1.4 Purpose: The purpose of this contract is to purchase, manufacture, and warehouse/maintain a small inventory, and distribute uniform components to employees of the FFD and the RRMC in an efficient and accountable manner for initial and emergency issuances. This requirement is Firm Fixed Price (FFP). The intent is to procure this requirement under the terms of a blanket purchase agreement (BPA).
1.5 Period of Performance: The basic BPA period will be from the date of award for five years (60-months).
1.6 Objectives: FFD has the following objectives of the Uniform Program:
1.6.1 Project a distinctive and professional image to DOD’s workforce and visitors.
1.6.2 Provide adequate safety and protection against Arc Flash hazard. Provide the employees with functional, durable, economical and comfortable clothing that will allow the employees to accomplish their assigned duties. Provide the PPE as required by the union agreement between WHS/FFD and the International Brotherhood of Electrical Workers Local 26.
1.6.3 Promote employee distinction between supervisors and non-supervisors employees.
Ensure the highest possible degree of consistency in uniform appearance in order to provide visible evidence of the agency’s continued success as a High Performance Organization (HPO).
1.6.4 Maintain a uniform distribution system which provides quality uniforms in a timely manner and is financially accountable and cost effective.
All uniforms will be Berry Amendment Act compliant (including the material, threads, dyes, and the Velcro attachments) and will be made in the United States of America from American raw materials.
1.6.5 FFD places great emphasis on professional appearance and considers the uniformed employee as one of the most visible symbols of the division here at the DOD. Uniforms that are safety compliant, comfortable, durable, economical, easily maintained, and professional in appearance are important to the image of a HPO and the ability of its employees to perform their duties.
1.7 Key Personnel: The contractor shall staff professional, skilled, and efficient key personnel identified below to support the FFD Uniform Program:
1.7.1 Program Manager: The contractor shall provide a Program Manager (PM) as a single point of contact to coordinate primarily with the Contracting Officer’s Technical Representative (COR) and the Contracting Officer (CO), if needed. This person shall be responsible and knowledgeable regarding the uniform contract and its components.
1.7.2 Teleconferencing: The contractor’s PM, and the COR shall participate in teleconferences as required throughout the term of the contract. The CO will be available, if needed. Dates and times must be mutually agreed upon. The COR will designate Government personnel prior to teleconference to record the minutes. For the first quarter of the contract, there will be a weekly teleconference. After the first quarter, it will be a monthly requirement for the reminder of the first year. After the first year, teleconferences will be held as needed for problem resolution.
Part 2: Deliverables.
2.1 Status Report: The contractor shall maintain and update on a bi-weekly basis a work matrix that identifies all ongoing and proposed work items. The matrix shall include, at a minimum, the task name, status, suspense date, point-of-contact and any anticipated problems. The contractor may expand the matrix to contain any information deemed necessary to help the Uniform Purchasing Process. The contractor shall provide an updated matrix electronically within the web-based system that is only accessible by the COR with a copy to the Contracting Officer.
