Statement of Work for

Daily Commute

Student Transportation Services

Department Of Defense

Activity-Europe (DoDEA-E)

DoDEA- Europe East District

STO: BAUMHOLDER

REGULAR DAILY COMMUTE & SPECIAL NEEDS

STUDENT TRANSPORTATION SERVICES

STATEMENT OF WORK (SOW)

For

East District STO Offices, Germany

1.0 Scope

The Contractor shall provide all personnel, supervision, services, vehicles, and equipment necessary to safely transport students and other authorized individuals to and from their designated schools, to include services for

Daily Commute and Special Needs Runs, Career Practicum and Short Notice Runs, to include after-school activity runs on the route schedules as ordered by contract line item number and identified on route sheets provided by the Government. The SAFETY of the passengers is of highest priority in the performance of contract services.

2.0 Definitions

Accidents - Vehicle-related events in which a Contractor’s vehicle with student(s) on board is the cause or focus and results in property damage, however slight, or causes injury, however slight, to student(s) and/or other person(s).

Activity Run - A run that departs the school after 1700 hours to transport students who participate in co-curricular after-school activities from the school to housing areas or transportation terminals.

Adaptive Seat Device – tools that stabilize the disabled in an optimum position.

Alternate Contracting Officer Representative (ACOR) - An individual designated in accordance with (IAW) subsection 201.602-2 of the Defense Federal Acquisition Regulation Supplement and authorized in writing by the

Contracting Officer to perform specific technical or administrative functions.

Bus Security Attendant - An individual possessing specialized security training assigned to the bus, its route or run. Security attendants will be hired and managed under a separate DoDEA-Europe contract with a commercial security company.

Actual Rider - A student who is authorized to ride a DoDEA transportation vehicle and does so on a given day.

Authorized Passengers - Individuals authorized to be transported under the contract, to include students, DoDEA officials, military/Host Nation police, security personnel, and others specifically authorized by the Contracting

Officer or Contracting Officer’s Representative.

Career Practicum (CP) - A job education program requiring curricular transportation services on the military installation.

Child Safety Restraint System (CSRS) - A restraining device, conforming to Host Nation laws, used to supplement a seat belt to secure a child during transportation. The age or size of a child requiring such device is normally defined by Host Nation law, but generally applies to children less than twelve years of age, or who are smaller than 150 centimeters (60 inches) in height.

Commuting Area - A geographic area that determines a student’s eligibility for transportation.

Contract Discrepancy Report (CDR) DA Form 5479-R - A formal, written documentation used to document unsatisfactory Contractor performance. The CDR requires the Contractor to explain, in writing, why performance is unsatisfactory; how performance shall be returned to satisfactory levels, and how recurrence of the problem shall be prevented in the future. Final ruling/decision shall be made by the

Contracting Officer.

Contract Specialist (CS) – A Government employee working with the CO to perform a broad range of administrative duties, including preparation and processing of contractual documents, tracking funding, liaison between Contractor and Government personnel, and provision of accurate and appropriate information to the CO and other contractual parties.

Contracting Officer (CO) – A Government official assigned to the Contracting Office authorized by written warrant to enter into, administer, terminate and issue delivery orders under contracts. The CO is the only

Government official authorized to obligate funding. The CO provides written appointment of Performance

Assessment personnel and has the final responsibility for Performance Assessment IAW FAR Part 42. The CO is the final decision authority for any performance-based deductions or other adjustments levied on the Contractor for failure to perform.

Contracting Officer’s Representative (COR) - An individual designated IAW subsection 201.602-2 of the

Defense Federal Acquisition Regulation Supplement and authorized in writing by the Contracting Officer to perform specific technical or administrative functions.

Contractor - A commercial activity that provides school transportation services IAW this Statement of Work

(SOW).

Contract Manager (CM) - A person who is responsible for contract performance on behalf of the contractor and shall be designated in writing to the Contracting Officer (CO).

Danger Zone - The area around a student transportation vehicle at a stop where most student injuries occur. It is an area 1.83 meters (6 feet) to both sides of the vehicle and 3.05 meters (10 feet) in front of the vehicle. Particular care is required when a bus stop has less than 1.83 meters (6 feet) clearance between the road edge and the designated waiting area. The most critical areas are immediately to the front of the student transportation vehicle and at the right rear.

Day (DA) – On any given route, the period between the first stop on the first run of the day and the last stop on the last run of the day. The route schedules determine the exact service hours and number of runs. School make-up days are days. During heightened security, additional driving hours may be required beyond the day and will be negotiated on a case-by-case basis.

Department of Defense Education Activity (DoDEA) - An agency of the U.S. Department of Defense responsible for the operation of schools for eligible children of Government authorized personnel.

Duress – A situation involving control of the student transportation vehicle being taken over by someone other than the driver or Safety Aide, or similar serious incident that places the student transportation vehicle and its passengers in a critical, life-threatening situation.

Expanded School Transportation Security Inspection – A thorough, driver-conducted security inspection using the School Transportation Security Inspection Checklist before each run of any school transportation vehicle. This is to be performed only when directed by the COR to meet elevated security conditions.

Improvised Explosive Devices (IED) - Those devices placed or fabricated in an improvised manner incorporating destructive, lethal, noxious, pyrotechnic or incendiary chemicals, designed to destroy, disfigure, distract, or harass.

Incidents - Any events that occur on/around the school loading/unloading zone or during school transportation services that have an adverse effect on either the performance of this contract or passengers.

Installation Access Control Office (IACO) – The security office on the military Installation where contractor base passes are requested, processed, and issued.

Non-Service Day - This is a day on which no Student Transportation Services are required. The COR will identify such days. School make-up days are not non-service days.

Quality Assurance Surveillance Plan (QASP) - A plan used by the Government to inspect and evaluate

Contractor-provided services.

Quality Control - Those actions taken by the Contractor to control the performance of services so that the requirements of the contract are met.

Quality Control Plan - The contractor's system for controlling quality of performance to ensure quality services are provided to the government in accordance with the contract’s terms and conditions.

Registered Rider - A student who is authorized to ride a DoDEA transportation vehicle but who may choose not to ride on a given day.

Route - A route consists of one or more runs, scheduled in one day. Typically, a route consists of a run to the school in the morning and a run to the Commuting Area in the afternoon.

Run (RN) – There are 4 types of runs:

- Daily Commute/Special Needs Runs either originate in the Commuting Area and terminate at the school or originate at the school and terminate in the Commuting Area and consist of up to 15 stops in between;

Runs normally do not exceed one hour in length and are generally required Monday through Friday between 0600 and 1600 hours.

- Career Practicum Runs (CP) either originate at the school and terminate at the military or originate at a military installation and terminate at the school and consist of up to 10 stops in between; Career

Practicum Runs normally do not exceed one half hour in length, and will be required Monday through Friday between 0800 and 1430.

- Activity Bus Runs originate at the school and terminate in the Commuting Area and consist of up to 8 stops in between; Activity Bus Runs normally do not exceed one hour in length, and may be required

Monday through Friday between 1700 and 1900.

- Short Notice Runs (SNR) are identical to Daily Commute/SPED Runs except that they are ordered for emergency purposes or for inclement weather to originate at the school and terminate in the Commuting

Area; the contractor will have 2 hours from the time notice is provided by the Government to perform

Short Notice Runs.

Safety Aide - An individual trained specifically for assisting passengers with special-needs identified in the special instructions provided by the COR and IAW SOW requirements.

Safety Attendant - When ordered by the COR, the Contractor shall provide a safety attendant for routes or runs to assist Kindergarten through grade 2 students in entering and exiting the vehicle and riding safely IAW the requirements of paragraph 4.9.

School Bus Student Misbehavior Report - Identifies the student behavior standards on or around school buses and is used to identify and document violations of these standards by students.

School Student Transportation Services - These services are for the repetitive daily transportation of students

(and other authorized individuals) to and from their designated schools and other education sites.

Specialized Safety and Security Equipment – Transportation equipment including special or adapted devices, buses, lifts, and ramps used to facilitate the transportation of children with disabilities.

Sponsoring Official/Organization - A designated DoDEA-Europe individual and/or organization at the Student

Transportation Office, District Transportation Supervisor, or District-level that performs Installation Pass responsibilities or has oversight based on the relationship to the Installation Pass applicant.

Student - An individual who is officially enrolled for attendance at a DoDEA school, or at a non-DoDEA school if such attendance is approved by DoDEA.

Student Counts - A report of the number of actual riders on each school transportation run by each bus stop.

Unsatisfactory/Incomplete Service - A service output that does not meet the standards of performance detailed in this contract.

3.0 Government Responsibilities

3.1 Route Schedules. The Contracting Officer’s Representative (COR) will provide the Contractor a copy of each route schedule prior to the beginning of scheduled services each school year and will issue the

Contractor a new route schedule when a change to a service is made. Route schedules will include route number, all runs, stops, authorized passengers by location, school location(s), and departure/arrival times.

The COR will identify any services requiring a safety attendant, safety aide and/or special equipment.

3.2 Installation Passes. The local supporting military installation will issue all required installation /base passes to contractor employees at no cost to the contractor. To be eligible to perform work under this contract, the contractor shall meet all applicable European installation/base access requirements specific to each Military Installation as well as Army in Europe Regulation 190-16, and USAFE Instruction 31-208. The

COR will provide the contractor copies of the installation access forms as referenced above. Passes shall be in the employee’s possession at all times while on a military installation. The contractor shall return base passes to the appropriate office within one (1) business day upon termination of employment or completion of this contract.

3.3 School Unloading/Loading Zone Procedure. School staff will receive special needs passengers at the vehicle in the school unloading zone and bring authorized passengers to the vehicle in the school loading zone. Note: Applicable to Special Education student transportation only.

3.4 Student Ridership Counts. The COR will provide blank forms to the Contractor when a student count is requested under paragraphs 4.15.

4.0 Contractor Responsibilities

4.1 Contract Manager

The Contractor shall provide a Contract Manager who shall be responsible for the oversight of performance requirements. The name and phone number(s) of this person, and an alternate who shall act for the contractor when the primary Contract Manager is absent, shall be designated in writing to the Contracting Officer and

COR.

4.1.1 The COR and the Contracting Officer must be able to contact either the primary or alternate

Contract Manager 24 hours a day regarding emergencies, severe weather notification, or other urgent matters.

4.1.2 When requested by the COR or Contracting Officer, the primary or alternate Contract Manager shall be at the scene of an accident or other emergency within sixty (60) minutes of notification.

4.2 Contractor Personnel Standards/Requirements

4.2.1 Removal of Contractor Personnel. The Contracting Officer reserves the right to remove any

Contractor employee from performance of duty under this contract for cause (especially in cases where student safety is concerned). In all such cases, the contractor shall be notified of the occurrence, and shall provide their written course of action to include the continued suitability or non-suitability of the employee performing under this contract going forward. reserves the right to ban any driver, Safety

Attendant, or Safety Aide for cause.

4.2.2 Age and Health.

a) In keeping with the responsibilities of the positions, DoDEA-E’s standard is that bus drivers and safety attendants and safety aides should be at least 21 years old.

b) Drivers, Safety Attendants, and Safety Aides shall be free of communicable diseases and physical or mental impairment that would affect the ability to perform duties under this contract.

4.2.3 Language Ability

a) The Contract Manager and alternate shall be able to speak, read and write the English language when communicating with the COR, school officials and Contracting Officer.

b) The drivers shall be capable of communicating in the Host Nation language.

c) Safety Attendants and Safety Aides shall be able to communicate in the English language sufficiently to converse with student passengers and parents, COR/ACOR, and school officials.

4.2.4 Citizenship

a) Contractor employees performing on this contract shall be German, U.S. citizen or Third Country national; resident German citizens are preferred.

b) U.S. citizens, whether German residents or dependents of U.S. military members or U.S.

Government civilian employees, are also acceptable, subject to German labor laws.

4.2.5 Education Contractor employees performing on this contract shall possess, at a minimum, a U.S.

High School diploma or the German equivalent; proof shall be furnished. (EXCEPTION: Bus drivers will not be required to provide a diploma).

4.2.6 Employment Contractor employees performing on this contract shall a stable work history, with no terminations for cause.

4.2.7 Restrictions A Bus Security Attendant, Safety Attendant and Safety Aide shall not perform security-related duties on a bus (vehicle) whose driver is a family member and/or is ridden by a student family member.

4.3 Safety and Security Training

4.3.1 The primary and alternate Contract Manager shall attend an annual Government-sponsored Safety and Security Training Session. Sessions are normally held in July or August as coordinated with the

COR. The Contractor may substitute the firm’s training manager for the Alternate Contract Manager.

4.3.2 Prior to starting the school year, the Contractor shall provide dispatchers, drivers, replacement drivers, safety attendants a minimum of seven (7) hours safety and security training covering the topics presented in the annual Safety and Security Training Session. The Contractor training shall include a minimum of one (1) hour of the Security/Force Protection Module.

The Contractor shall also provide the Safety and Security Training to new drivers and replacement drivers that are employed after the conduct of the Contractor’s Safety and Security Training Session. The

Contractor shall prepare a memorandum that identifies the date, time, location, names of instructor(s) and trainee(s), and a brief statement, summary, or synopsis of the topics and content of material presented

(e.g., instruction syllabus) to document the Safety and Security Training Session. The contractor shall provide a copy of the attendance record to the COR upon completion of training.

4.3.3 As a part of the seven hours safety and security training, a security contractor shall provide the following training courses to identified bus Contractor personnel either in conjunction with the annual bus

Contractor training session or during separate session(s):

4.3.3.1. Security/Force Protection Module (i.e., vehicle security inspection, surveillance detection, and emergency response). When ordered by the COR or Contracting Officer during the school year, a security contractor shall provide a three-hour Security/Force Protection Module training course to new drivers, replacement drivers, and new Contractor trainer(s) that have not completed the formal security training.

4.3.3.2. Training session will be completed prior to the beginning of each school year to cover force protection, accident/incidents, student management, use of child safety seats, handling students with disabilities, safety procedures, loading zone familiarization and operations, emergency evacuations / reporting procedures, safe havens, safety precautions at loading zone and bus stops. The contractor is responsible for training new employees hired after the annual training is completed. The Government shall also provide software and administrative process training to the contractor’s customer service employees.

4.3.3.3. Prior to starting the school year, all drivers, replacement drivers, and the bus Contractor trainer(s) shall attend the initial three-hour security/force protection training course or a one and one-half hour, refresher security training course covering the Security/Force Protection Module. For new drivers and replacement drivers that are employed after the conduct of the security contractor’s training, the bus Contractor trainer shall provide interim security/force protection training presented in the security contractor’s training session until a security contractor is scheduled during the school year to conduct the formal training and must successfully complete an end-of-course examination.

4.3.3.4 As part of the annual training session a one (1) hour refresher safety and security training session will be conducted during the month of January to refresh contract employees of safety and security procedures as mentioned above in paragraph 4.3.3.2.

4.4 Expanded School Transportation Security Inspection Training

4.4.1 When Directed by the COR or Contracting Officer, each Contractor driver, replacement driver, Safety Attendant, and replacements, and the designated Contractor trainer(s) that provides interim training to new drivers, shall attend a training block on the proper conduct of the Expanded School Transportation

Security Inspection either in conjunction with the annual Contractor Safety and Security Training Session or during separate session(s). The duration of the training will be four (4) hours for Drivers and seven (7) hours for Safety Attendants.

4.4.2 The Contractor shall prepare a memorandum that identifies the date, time, location, and names of trainee(s) to document the Safety and Security Training and the Expanded School Transportation Security

Inspection Training and provide it to the COR within five (5) days after completion of the training session.

4.5 First Aid, Cardiopulmonary Resuscitation (CPR), and Special Needs Training

4.5.1 Drivers and safety attendants shall have current first aid and CPR certifications either by receiving training in German Red Cross First Aid (Erste Hilfe) or American Red Cross First Aid equivalent. The certifications shall be no more than three (3) years old and shall be made available for review upon request by the COR.

4.5.2 Drivers and Safety Aides shall be trained in assisting special needs students as prescribed by Host

Nation laws to include proper fastening/securing of harnesses, wheelchairs, and other special equipment.

4.6 Background Check

Drivers, Safety Attendants, Safety Aides, and other personnel that may come in contact with student passengers shall be cleared biennial by a Host Nation background check.

4.6.1 Initially, in the base contract year, the check shall be completed within the first 30 days following the date of award. Thereafter, in each contract option year if exercised, the check shall be completed within the first 30 days following the effective date of option exercise.

4.6.2 Because they have direct contact with student passengers, drivers, Safety Attendants, and Safety

Aides shall be cleared by background check before they begin performance of duty under this contract

IAW paragraph 3.2. All new hires during the course of a contract year shall also be cleared by background check before they begin performance of duty under this contract.

4.6.3 The Contractor shall maintain the most current background checks on file and shall make them available to the COR when requested.

4.7 Criminal Offense

The Contractor shall not hire anyone with a criminal record to perform under this contract. The Contractor shall immediately inform the COR when it is learned that an employee under this contract has been arrested for a criminal offense. A past criminal offense of any nature shall be grounds for removal, as determined by the Contracting Officer. The Contractor shall also immediately inform the COR when any action is taken to suspend or revoke the driver’s license of any driver performing under this contract.

4.7.1 The Contractor shall not assign any person to perform duty under this contract whose background or criminal record includes both an arrest and a conviction for any of the offenses enumerated below;

a. Assault and battery, domestic abuse, or homicide;

b. Child abuse, child neglect, child sexual molestation, pedophilia, or child pornography;

c. Public indecency, sexual assault, or rape;

d. Use, possession, or distribution of any illegal drug or controlled substance;

e. Reckless driving or driving while under the influence of alcohol or drugs;

4.7.2 When a person’s background or criminal record includes arrests and convictions for criminal offenses not listed in paragraph 4.7.1 above, the Contractor shall provide their written determination to the Contracting Officer regarding the suitability / non-suitability of the employee’s performance of duty under this contract.

4.7.3 The Contractor shall immediately inform the Contracting Officer when a past criminal offense of any nature by an employee performing duty under this contract is discovered after-the-fact. In such cases, the Contractor shall provide a written determination to the Contracting Officer regarding either the continued suitability or non-suitability of their employee’s performance under this contract.

4.7.4 The Contractor shall immediately inform the Contracting Officer when an employee performing duty under this contract is arrested for a criminal offense. In such cases, the Contractor shall provide a written determination to the Contracting Officer regarding either the continued suitability or non-suitability of their employee’s performance under this contract. Furthermore, The Contractor shall also immediately inform the Contracting Officer when the driver’s license of any driver performing under this contract is suspended or revoked.

4.8 Installation Background Checks

As part of the requirement for contracted personnel to gain access to installations (see paragraph 4.14), a background check will be conducted. Because this contract requires unsupervised contact with students and/or unescorted access to school facilities, contracted employees will go through a rigorous background check. All allegations, arrests and/or convictions discovered as a result of the background check will be scrutinized and may be cause to deny access.

4.9 Safety Attendant / Safety Aide

The Contractor shall provide a Safety Attendant/Safety Aides for runs as ordered by the COR to assist small students in entering and exiting the vehicle, and riding safely. If no Safety Attendant/Aides are assigned, the driver shall assume these responsibilities.

Safety Attendants/Aides shall be at least 21 years old. When ordered for a run, the Safety Attendant/Aide shall:

a) Assist student passengers in boarding and disembarking safely, and in securely fastening seat belts, Child Safety Restraint System (CSRS), and/or specialized equipment when specified by the COR or required under Host Nation law.

b) Ensure students remain seated with securely fastened seat belts, CSRS (if applicable), or wheelchair-occupant restraint system when required.

c) Communicate with passengers to encourage safe student behavior and to intervene whenever there is a serious or life threatening situation. Ride in the passenger compartment with passengers and communicate with passengers to encourage safe student behavior. Passenger behavior that requires corrective action shall be identified on a School Bus Misbehavior Report and provided to the COR.

d) Ensure students disembark the vehicle at their proper stops and assist the driver in ensuring there are no passengers or student personal articles/items remaining in the vehicle at the end of the run. At the school, release students only to the school staff at the loading zone. During the school-to-home run, do not release certain younger students (as identified by the COR, i.e. KDN- 2 nd

Grade) from the vehicle without the parent or designated caregiver present to take charge of the child. In the event the parent or caregiver is not at the stop the bus driver will notify the contract manager whom shall notify the COR for instructions. The bus driver will wait for a response from the contract manager before continuing the bus route.

e) Use English with positive words and a respectful tone when speaking to students.

f) In the event of an accident or incident, assess each passenger for injuries and provide first aid and/or

Cardiopulmonary Resuscitation (CPR) to passengers as required until either emergency rescue personnel arrive on the scene; and take control of the situation until the vehicle reaches a medical facility.

g) The safety attendant/safety aide is expected to correct observed unsafe actions by students, especially to prevent an accident or injury, and to assist the driver, if requested, to restore good order and discipline when unruly student behavior interferes with the driver's ability to operate the bus safely.

In such cases, the safety attendant/safety aide may assist the driver in preparing the School Bus

Student Misbehavior Report, but the driver shall remain responsible for reporting the incident.

4.10 Bus Security Attendant Program

4.10.1 The BSAP assigns security-trained adults to regular daily commute school buses, primarily to oversee student security and secondarily to further student safety. Security attendants are managed under a separate DoDEA-Europe contract with a commercial security company and are considered authorized riders by the Government.

4.10.2 Security attendants will work closely with drivers, forming a professional, mutually supportive relationship. However, they operate independently of drivers and their presence on the bus does not relieve the driver of any responsibilities and duties specified within the school transportation contract.

Drivers continue to be responsible for the bus’s safe operation.

4.10.3 Security attendants, primarily observe the exterior environment of the bus route and the school bus stops to detect and report indicators of suspicious or other unusual activity directed at the bus and its occupants, and also perform the following security-related duties and procedures.

4.10.4 From the beginning of and throughout the run, maintain security awareness of the external environment of the route and its stops to detect and report indicators of surveillance and/or criminal activities. In connection with this requirement, the Bus Security Attendant will know the characteristics of the route, including its runs, schedule, stops, traffic patterns and geography.

4.10.5 When directed by the COR, meet the driver before the bus is put into service and conduct an external walk-around and internal walk-through visual security check of the vehicle for indicators of tampering and/or the presence of explosive or incendiary devices. Additional inspection parameters are described in paragraph 5.6 in the event that the COR directs the contractor to perform an Expanded

School Transportation Security Inspection.

4.10.6 Assess the situation for threat indicators when a student or other person boarding a bus is not recognized by the driver or attempts to board without displaying proper identification or authorization, and assist the driver to request the individual boarding to show his/her identification card and/or bus pass.

4.10.7 During emergencies that affect the bus’s security and its occupants, the security attendant responds and takes charge of the bus’s movement. Examples of emergencies include reacting to an attempted hijacking or forced takeover, hostage taking, responding to small arms weapon’s fire, etc.

When the security attendant determines an emergency response is necessary, the security attendant may direct the driver to divert from the route or drive to a medical, fire department, or police facility, or to a designated safe haven. The driver shall comply promptly with the security attendant's directions.

4.10.8 Do not conduct physical searches of student possessions, for example book bags or backpacks, nor physically search the person of a student.

4.10.9 Perform all duties in a manner that does not call public attention to their presence or purpose.

4.11 Contractor Employee Conduct

During performance of this contract, to include in and around the contracted vehicles and on school grounds:

4.11.1 Contractor Employee shall not use verbal assault, foul language, personal or racial insults, or threats of personal violence, or comment on the personal appearance of students in any language.

4.11.2 Contractor Employee shall not engage in any conduct of a sexual nature, verbal or physical, to include reading or display of nudity or pornographic material.

4.11.3 Drivers and Contract Employees shall not engage in physical contact with students, except as required for reasons of safety, first aid or CPR, or show verbal or physical affection toward students, or take photographs of them.

4.11.4 Drivers and Contract Employees shall not use tobacco products, eat or drink, or report for work under the influence of or impaired by alcohol, drugs, or medications which may affect the ability to perform safely under this contract.

4.11.5 Drivers and Contract Employees shall not sell, give to or accept from students any beverage, food or tobacco product, or any gift or item, irrespective of monetary value.

4.11.6 Contract Employees shall not play music tapes, CDs, or videos unless approved by the COR.

4.11.7 Contract Employees shall not wear clothing with insignia reflecting religious, political or social messages or slogans, but shall dress in a neat, professional manner.

4.11.8 Contract Employees shall not wear shoes with open toes and/or heels while performing under this contract.

4.11.9 Drivers must not use mobile devices, such as mobile phones, for the duration of the run.

4.12 Personnel List

Not less than thirty (30) calendar days before services begin, the Contractor shall provide the COR a typed list of all personnel to perform services under this contract. The Contractor shall provide a dated, revised personnel list to the COR as changes occur. The list may be in whatever format is most suited to the

Contractor’s operations, but shall list each person in alphabetical order in the following manner: full name

(last name, first name, middle initial), date of birth, job title (Driver, Safety Attendant, Safety Aides, etc.), country of citizenship, and identification document number/passport number.

4.13 Driver’s License/Professional Certifications

Not less than thirty (30) calendar days before services begin; the Contractor shall certify, in writing, that all drivers have the correct licenses and certifications for the type vehicles they are to operate. The Contractor shall maintain and, upon request by the COR, make driver’s licenses and certifications available for the type vehicles they are to operate.

4.14 Installation Passes

The Contractor shall obtain the necessary installation passes to allow Contractor personnel operating, servicing, or managing DoDEA-E school transportation to enter U.S. Government installations. The

Contractor shall identify personnel requiring installation passes on the Personnel List provided to the COR and shall be responsible for completing all necessary paperwork, to include processing each request through the Student Transportation Office (STO) and the IACO. The Contractor is responsible for controlling U.S.

installation passes issued to Contractor personnel.

4.14.1 As part of the personnel security vetting process, Contractor drivers shall possess either a

Temporary or a Permanent Installation Pass prior to operating a vehicle on a school transportation run.

4.14.2 Installation Passes shall only be used in performance of duties under this contract. Installation passes remain the property of the U.S. Government; passes shall be returned to the COR upon expiration of the pass or student transportation contract, when a Contractor employee is no longer employed by the

Contractor or requires access, or when requested by the COR.

4.14.3 The Contractor shall ensure that Installation Pass applicants shall include a copy of the Police Good

Conduct Certificate, which is valid for 12 months only from the date of issue, and a copy of the residence and work permit with their application, if required, when submitting the application to the DoDEA-E sponsor for approval, and the IACS office for processing, unless exempted by USAFE Instruction 31-208 or Army Regulation AR 190-16 and AE 190-16.

4.14.4 Contractor personnel who are denied an Installation Pass shall be removed from performing service(s) under this contract immediately upon Contractor's receipt of such notification from the U.S.

Government.

4.14.5 Applicants shall submit a copy of the following documents with the application:

a) Passport or personal ID card, issued by the country of citizenship.

b) A copy of all required background-check (Good Conduct Certificate) results.

c) A copy of the residence permit and a work permit, if required.

4.14.6 Contractor personnel shall always keep the installation pass and other government-issued documents secure to prevent loss or theft, and never leave them unattended in the contractor’s vehicle.

If an Installation Pass is lost or stolen, the Installation Pass holder shall report the loss or theft to the

COR, the local U.S. Military Police or Security Forces station, and the IACO immediately. The sponsoring organization shall submit a new application to the same IACO where the original Installation

Pass was obtained. If requested by the sponsoring official in the application, the expiration date of the

Installation Pass may be extended to show a full registration period for that individual's category.

4.15 Student Ridership Count Reports. The Contractor shall provide counts of actual ridership upon request to ensure accuracy regarding the number of students transported. Student counts may be required up to three times each school year and shall be performed for three to five consecutive days each time they are required. The Contractor shall submit written Student Count Reports to the COR on computer-generated forms provided by the COR (see paragraphs 3.9 and 8.5).

5.0 Contractor Operations

The Contractor shall adhere to applicable Host Nation laws, installation regulations, and safety procedures. The

Contractor shall provide vehicles and equipment that meet all standards required by Host Nation laws as well as the vehicle requirements at paragraph 5.7.

5.1 Route Schedule Adjustments

5.1.1 Severe Weather. The COR will notify the contractor of severe weather or hazardous driving conditions that result in cancellations or delays (to the greatest extent 2 hours prior to services).

Furthermore, the Contract Manager shall advise the COR of any specific weather conditions that warrant a schedule change. The COR must approve any change to the schedule.

5.1.2 Early Dismissal. When school(s) is dismissed earlier than normally scheduled for an emergency or adverse weather conditions, the Contractor shall have vehicles at the school(s) and ready for services within two (2) hours of notification by the COR for performance of an Short Notice Run.

5.1.3 Other Adjustments. The COR may reschedule transportation services when unforeseeable events

(e.g., suspension of school or change in school program) require adjustment. In such an event, the COR will advise the Contractor of required adjustment(s) to the student transportation schedule(s) to the greatest extent possible, at least 2 hours prior to services being performed.

Notification to the Contractor: For all above adjustments, in the event that the contractor is notified less than two hours prior to a scheduled run, the contractor will be paid the full cost of the adjusted/canceled run.

5.2 Runs and Changes. The Contractor shall have two (2) working days from the time of receipt to implement a run change, except in cases of unforeseen events (e.g., severe weather). The Contractor is encouraged to suggest route changes that contribute to safety or efficiency of services.

5.3 Installation Access under different Force Protection Conditions for Contractor Personnel

5.3.1 Security/Force Protection Conditions

In the event security threats increase, the Government may require:

a) The Contractor to implement alternate runs or schedules.

b) Inspection of Contractor vehicles and/or parking areas by U.S. military and/or Host Nation security personnel.

c) The Contractor to park vehicles used in performance of this contract in a secure installation/site identified by the Government.

d) The Contractor to perform security inspections as directed by the Government.

5.3.2 The Contracting Officer shall handle any resulting cost or schedule adjustments equitably by adjusting contract task orders in the event of increased security measures.

5.4 Security of Route Signs and School Transportation Documents

When not in use on a DoDEA run:

a) If the vehicle is parked unattended on the street or other non-secure parking area between DoDEA student transportation runs, the driver shall remove the route signs and school transportation documents (e.g., route sheet, route numbers, student passengers list, safety/security inspection checklist, etc.), and store them in a secure location.

b) If the vehicle is immediately recommitted to a run/service that is outside of the scope of the contract after completing a DoDEA run, the driver shall remove the route signs and protect school transportation documents from disclosure to unauthorized personnel.

c) If the vehicle is parked in a secured parking area (e.g., Contractor’s fence-enclosed motor park, garage, secured U.S. military installation, etc.), the Contractor shall ensure the protection of school transportation documents.

5.5 Accidents or Incidents

If an accident or incident occurs, the Driver, Safety Attendant, or Safety Aide, shall check each passenger for injuries, and shall provide first aid and/or call for medical assistance immediately after the accident or incident. The driver shall notify the Contract Manager within ten (10) minutes of the accident or incident occurring. The Contract Manager shall notify the COR within five (5) minutes of the driver’s notification.

The Contractor shall provide telephonic updates to the COR at least every thirty (30) minutes thereafter until the accident scene is clear and service starts again. Procedures to report a Serious Emergency during the run are below.

5.5.1 Reportable Accident. A reportable accident is an event in which a Contractor’s vehicle with students on board is involved in an event that results in property damage, however slight, or causes injury, however slight, to student(s) and/or other person(s). Examples of accidents include but are not limited to:

a) Collision with another vehicle.

b) Hitting a pedestrian, cyclist, or large animal.

c) Leaving the roadway and striking any object, and/or overturning.

d) Evasive driving or emergency actions that injure any passenger on board.

e) Equipment malfunction or mechanical breakdown that results in injuries to those on board.

5.5.2 Reportable Incident. Any event that occurs on/around the school loading/unloading zone or during school transportation services that has an adverse effect on either the performance of this contract or passengers, such as:

a) Any event causing the driver to take evasive action (e.g., swerving, slamming on brakes, etc.)

which could cause injury to a passenger or to a pedestrian, or which could cause damage to a vehicle or other property.

b) Security problems (e.g., student transportation vehicle is being followed by suspicious vehicles;

strangers approaching students at bus stops or on/around school grounds; strangers questioning the driver or students about routes, schedules or passengers; bomb threat; etc.).

c) Passenger misbehavior with severe impact (e.g., weapons/prohibited items, assault or battery, vandalism of the vehicle, etc.).

d) An individual health-related emergency requiring professional medical attention (e.g., epileptic seizure, etc.).

5.5.3 Response to a Serious Emergency during the Run. In a serious emergency as identified below, the driver, or if he/she is incapacitated, the Bus Security Attendant, Safety Attendant, or Safety Aide, if one is assigned, shall immediately contact the Host Nation Emergency Services and subsequently contact the Contract Manager who shall immediately contact the COR:

a) Hijacking of the school vehicle or hostage-taking of a student passenger(s).

b) Gunfire directed at the school vehicle, or in its immediate vicinity.

c) Rocks, bottles, or other objects being thrown at the school vehicle.

d) Person or persons, or another vehicle(s) surrounding the school vehicle, or impeding its movement.

e) Attempts to force the school vehicle from the road or street.

f) An unauthorized person(s) board the school vehicle and refuse to leave.

g) Assault by a person(s) causing grievous harm or injury to a vehicle passenger(s).

h) Major vehicle accident that seriously injures a student passenger(s) requiring immediate help from first-responders (police, medical, etc.).

i) Fire aboard the school vehicle that causes evacuation of a student passenger(s).

5.5.4 Accident or Incident Reporting.

The Contractor shall comply with the following procedures in the event of an accident or incident, providing the COR initial telephonic reports and following up with a written Accident or Incident Report.

5.5.4.1 In addition to the telephonic reporting required in paragraph 5.5, the Contractor shall submit to the COR a written Accident Report or Incident Report by close of business the next duty day. The written report shall include at a minimum:

a) The contract number and the date and time of the accident or incident.

b) The location of the accident or incident.

c) The route number and name of driver involved in the accident or incident.

d) The make, model, manufacture year, and size of contractor vehicle(s) involved in the accident.

e) The names of personnel and passengers involved in the accident or incident, plus the names of all students on board the vehicle when the accident/incident occurred.

f) The names of all personnel and passengers injured and type of injury, if known, involved in the accident or incident.

g) A chronological narrative of the events leading up to the accident or incident.

h) Whether police were on the scene and any citations or findings made by the police concerning the accident.

i) Any recommendations or comments by the Contractor concerning the accident or incident.

5.5.4.2 The Government may also require follow-up reports on an as needed basis.

5.6 Vehicle Safety/Security Inspections. The Contractor shall have a procedure to conduct and document daily vehicle safety/security inspections prior to performing services. The contractor shall provide the COR with a copy of their contractor-created daily safety/security checklists not more than ten (10) calendar days after contract award.

5.6.1 The daily safety/security inspection conducted by the driver shall include a search for suspicious objects (e.g., improvised explosive devices) and indicators of tampering with the vehicle (e.g., anything out of the ordinary that could cause harm to student passengers or damage the vehicle). If something unusual or suspicious is found, the driver should not touch anything but should evacuate the area around the vehicle, and shall immediately notify the Contract Manager of the findings. The Contract Manager shall determine if the German Police should be notified and/or if a replacement vehicle should be dispatched, then immediately notify the COR.

5.6.1.1 Bus Run with Assigned Bus Security Attendant. When a bus security attendant is assigned to a bus run, the security attendant will conduct a detailed vehicle security inspection with the driver’s assistance (i.e., opening bus compartment doors, etc.). During the walk-around security inspection of the bus, the bus driver shall ensure the bus doors remain secured or closed to preclude unauthorized individuals from entering into the bus’ interior while the security attendant and driver are occupied outside. The exterior-access compartments (i.e., luggage, storage, engine, etc.) will be opened and inspected one-by-one consecutively (i.e., a compartment will be opened, inspected, closed and secured before opening the next compartment) until all storage/luggage compartments and the engine compartment have been inspected. The security attendant will complete the exterior inspection prior to inspecting the bus’ interior. The bus driver must identify all items or objects

(e.g., backpacks, bags, baskets, bottles, boxes, toolkits, etc.) observed during the exterior and interior inspection as belonging on or to the bus.

5.6.1.2 In the event a bus security attendant is not assigned to the bus route the bus driver shall conduct the security inspection as described in paragraph 5.6.1.1).

5.6.1.3 When the route sheet has identified an off-post location for inspecting the bus, the bus

Contractor shall ensure the bus is at the inspection location at the time prescribed on the route sheet to allow the security attendant to inspect the bus. If the route sheet does not have an identified off-post location for inspecting the bus, a Bus Security Attendant Program (BSAP) supervisor will coordinate in advance through the COR with the bus Contractor to establish the off-post location for inspecting the bus and to ensure that there is ample time to conduct the inspection; the bus

Contractor shall ensure sufficient time, approximately 15-20 minutes, is allowed to inspect the bus.

The Contracting Officer will resolve any operational disagreements between the bus Contractor and

BSAP managers on the IED inspection location or inspection times.

5.6.2 Expanded School Transportation Security Inspection. When the COR orders an Expanded

School Transportation Security Inspection to be performed before each run of a day, the driver shall, as prescribed below, inspect the vehicle's exterior and interior using the Transportation Security Inspection

Checklist at SOW Attachment A, and shall annotate the checklist IAW the instructions to document the detailed inspection. Attachment A provides a courtesy German translation of the Transportation Security

Inspection Checklist (in case of a translation discrepancy, the English version governs). The Contractor shall establish the off-post location for inspecting the vehicle or as coordinated with the COR.

5.6.2.1 For a Home-to-School run (e.g., AM) or the first run of the day, the driver shall conduct the

Expanded School Transportation Security Inspection in conjunction with the Host Nation vehicle safety/security inspection requirement prior to performing services.

5.6.2.2 For a School-to-Home run (e.g., PM), the driver shall conduct an Expanded School

Transportation Security Inspection of the vehicle prior to entering the installation where the school is located.

5.6.3 The Contractor driver's daily safety/security inspection record, and when an Expanded School

Transportation Security Inspection is ordered, the School Transportation Security Inspection Checklist, shall accompany the driver during the Day, and subsequently be maintained on file with the Contractor for thirty (30) calendar days. During quality assurance surveillance of the vehicle during the run, the COR or other government officials may ask to review the completed forms (e.g., driver's daily inspection record or Expanded School Transportation Security Inspection Checklist) to validate that inspections were properly performed.
