SECTION SF 30 BLOCK 14 CONTINUATION PAGE

SUMMARY OF CHANGES

SECTION SF 1449 - CONTINUATION SHEET

The following have been modified:

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

a. Award will be made to the offeror whose proposal is determined to represent the overall best value to the Government using a Lowest Price Technically Acceptable (LPTA) evaluation process. The evaluation factors and subfactors identified below will be used in the determination of technical acceptability.

b. After receipt of proposals, the Government will first evaluate the lowest price proposal. If the lowest price proposal is determined to be technically acceptable and otherwise properly awardable, award will be made to that offeror. The Government reserves the right to evaluate only the lowest price proposal or to conduct further evaluations of additional proposals.

c. The standards for determining technical acceptability are below, as well as information concerning price proposals.

(1) Technical/Management Approach Factor: The Technical/Management Subfactors will be evaluated and rated either Acceptable or Unacceptable. In order for a proposal to be rated overall Technically Acceptable, each of the following subfactors shall be rated Acceptable. Technical/ management proposals should not exceed 15 pages.

(a) Subfactor 1: The offeror shall demonstrate and provide all aspects of Smart Net and SWSS support. To be deemed technically acceptable, the offeror shall be able to provide all aspects of Smart Net and SWSS support as defined in all the CLINs and Terms and Conditions.

(b) Subfactor 2: In order to be deemed technically acceptable, the offeror shall be the Original Equipment Manufacturer (OEM) or a certified Cisco Gold Partners/reseller of Cisco Smart Net and will continue through June 2021. If the offeror is not the OEM, the offeror shall submit with its proposal, a separate letter from Cisco, confirming that the offeror is a certified Cisco Gold Partner/reseller. This letter shall not be older than 30 days from the date proposals are due. In this letter Cisco shall confirm the offeror is a certified Cisco Gold Partner/reseller of Cisco Smart Net who is capable of providing Smart Net for all the agencies listed in the Terms and Conditions and will continue through June 2021. To be deemed technically acceptable, the offeror shall submit a recent letter (within the past 30 days) from Cisco that the offeror is an authorized certified Cisco Gold Partner/reseller for Cisco Smart Net through June 2021.

Technical Ratings

Rating
Description
Acceptable
Proposal meets the requirements of the solicitation.
Unacceptable
Proposal does not meet the requirements of the solicitation.

(2) Price Factor –

(a) The offeror’s price proposal will be evaluated to determine if they are reasonable and complete. The total evaluated price will consist of the contractor’s proposed price for ALL the base period CLINs, and the option period CLINs.

(b) Evaluation of options shall not obligate the Government to exercise such options.

(c) The offeror’s price proposal will be evaluated as defined in FAR 15.404.

(d) The Government will verify that all solicitation requirements have been priced, figures are correctly calculated, and prices are presented in a clear and useful format.

d. Past performance will be reviewed as part of a responsibility determination by the Contracting Officer but will not impact the technical evaluation. If overall past performance is found to be unacceptable, this may be cause for the offeror's proposal to be excluded from further evaluation. However, a prospective contractor shall not be determined responsible or non-responsible solely on the basis of a lack of relevant performance history

e. Options. The Government will evaluate offers for award purposes by adding the total price for the option year to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option year prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

f. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
