About this file
This is a Project Manual issued by the West Virginia Department of Natural Resources for the Hawks Nest Upper & Lower Terminals bid package located in Anstead, West Virginia, issued for bidding on August 23, 2024 (AAI Project No. 2112149.00). The project involves the supply and construction of both an Upper Deck and Lower Deck for access to the Tramway at Hawks Nest State Park, including demolition plans, foundation work, framing, electrical work, and associated site improvements. The work includes structural, architectural, and electrical components for both terminal locations. Construction activities must be coordinated with park officials to minimize disruptions as the main facilities will continue to operate during construction. Work hours are restricted to 8 AM to 7 PM seven days a week.
The contract includes a 10% retainage on all work completed, which may be reduced at substantial completion if recommended by the engineer. The contractor must provide warranties, workmanship/maintenance bonds, and maintain required insurance coverage. The project requires coordination with potential other ongoing construction contracts at the site. Laydown areas will be coordinated with park officials and will be located in the main parking lot with limited laydown at the lower tram site. The contractor must employ and pay an independent agency or testing laboratory for required quality control services. Key submittals include construction schedules, shop drawings, product data, samples, warranties, and detailed record documents upon completion.

1.2 DESCRIPTION OF REQUIREMENTS
A. Without force and effect on the requirements of the Contract Documents, the description of the Work may be summarized as follows:
1. The Engineer has designed a Project which will be safe after full completion. The Engineer has no expertise in, and takes no re-sponsibility for, construction means and methods or job site safety during construction, which are exclusively the Contractor's respon-sibility. Processing and/or approving submittals made by the Con-tractor which may contain information related to construction meth-ods or safety issues, or participation in meetings where such issues might be discussed, shall not be construed as voluntary assumption by the Engineer of any responsibility for safety procedures.
2. The project consists of the supply and construction of both an Up-per Deck and Lower Deck for access to the Tramway at Hawks Nest State Park as Identified in the associated plans and specifica-tions. The contract documents identify the requirements of the pro-ject.

SECTION 01310 - SCHEDULES, REPORTS, AND PAYMENTS
PART 1 - GENERAL:
tary Conditions and other Division-1 Specification sections, apply to work of this section.
1.2 COORDINATION
PART 1 - Coordinate both the listing and timing of reports and other activities re-quired by provisions of this and other sections, so as to provide consistency and logical coordination between the reports. Maintain coordination and correlation between separate reports by updating at monthly or shorter time intervals. Make appropriate distribution of each report and updated report to all parties involved in the work including the Engineer and Owner. In particular, provide close coor-dination of the progress schedule, schedule of values, listing of subcontracts, schedule of submittals, progress reports, and payment requests.
1.3 PRELIMINARY PROGRESS SCHEDULE
A. Submittal Tabulation: With the bar-chart submittal, submit a tabulation, by date, of the submittals required during the first 15 days of Construction Time. This tabulation shall include both those submittals required during the initial 15 days of construction to maintain the orderly progression of the work, and those submittals required early because of long lead time for manufacture or fabrication. At the Contractor's option, submittal dates may be shown on the bar-chart schedule, in lieu of being tabulated.
1.4 FULLY-DEVELOPED PROGRESS SCHEDULE
A. Bar-Chart Schedule: Based on the preliminary development of the pro-gress schedule, if any, and whatever updating and feedback may have occurred during the project start-up, secure critical time commitments for performing major elements of the work. Within 10 days of the date estab-lished for "Commencement of the Work", submit a comprehensive bar-chart type Progress Schedule indicating, by stage-coded symbols, a time bar for each major category or unit of work to be performed at site; include minor elements of work which are, nevertheless, involved in overall se-quencing of work necessary for the completion of related elements of work. Arrange the schedule to show how substantial completion is sched-uled to allow for the Engineer's procedure for certification of substantial completion. Prepare and maintain the schedule on either a sheet of suffi-
SCHEDULES, REPORTS AND PAYMENTS 01310 - 2
cient width (or else a series of sheets) to show the required data clearly for the entire Construction Time. Prepare the schedule on sheets of stable transparency, or other reproducible stock, to permit reproduction for the required distribution.
B. Distribution: Following the initial submittal to and response by the Engi-neer print and distribute the Progress Schedule to the Engineer (3 copies), Owner, separate contractors, the principal subcontractors and suppliers or fabricators, and others with a need-to-know schedule- compliance re-quirement. Post copies in the project meeting room and temporary field office. When revisions are made, distribute updated issues to the same entities and post updated issues in the same locations. Delete entities from distribution when they have completed assigned work and are no longer involved in performance of scheduled work.
1.5 PROGRESS MEETINGS, REPORTING
(Not Used)
1.6 SCHEDULE OF VALUES
A. General: Prepare the schedule of values, as required by the General Conditions, in coordination with the preparation of the progress schedule.
Coordinate preparation of schedule of values and progress schedule.
Correlate line items with other administrative schedules and the forms re-quired for the work, including progress schedule, payment request form, listing of subcontractors, schedule of allowances, schedule of alternates, listing or products and principal suppliers and fabricators, and the sched-ule of submittals. Provide breakdown of the Contract Sum in sufficient de-tail to facilitate continued evaluation of payment requests and progress re-ports. Break down principal subcontract amounts into several line items.
Round off to the nearest whole dollar, but with total equal to Contract Sum.
1. Time Coordination: In coordination of initial submittals and other administrative "start-up" activities, submit the schedule of values to the Engineer at the earliest feasible date, but in no case later than 7 days before initial payment request is to be submitted.
2. Listing: Arrange the schedule with columns to indicate the generic name of item, related specification sections, the subcontractor, the supplier, manufacturer or fabricator, change orders (numbers) which have affected the value, the dollar value of the item, and the percentage of the Contract Sum to the nearest one-hundredth per-cent and adjusted to total 100 percent.
SCHEDULES, REPORTS AND PAYMENTS 01310 - 3
PART 2 - 3. Show Change Orders as a single line item for each
Change Order.
1.7 PAYMENT REQUESTS
A. General: Except as otherwise indicated, the progress payment cycle is to be regular. Each application must be consistent with previous applications and payments. Certain applications for payment, such as the initial appli-cation, the application at substantial completion, and the final payment application involve additional requirements. Each application for payment shall include a retainage of 10% of the total work completed to date. The retainage may be reduced at the time of substantial completion if recom-mended by the engineer.
1. Waivers of Lien: For each payment application, submit waivers of lien from every entity ( including Contractor) who could lawfully and possibly file a lien in excess of $100 arising out of the Contract and related to work covered by the payment. Submit partial waivers for the amount requested, prior to deduction or retainage, on each item. When the application shows completion of item, submit final or full waivers. The Owner reserves right to designate which enti-ties involved in the work must submit waivers.
2. Waiver Forms: Submit waivers on forms, and executed in a man-ner, acceptable to Owner.
B. Payment Application Times: The "date" for each progress "payment" is as indicated in Owner-Contractor Agreement. The period of construction work covered by each payment request is period indicated in Owner- Contractor Agreement.
C. Application Preparation: Except as otherwise indicated, complete every entry provided for on the form, including notarization and execution by au-thorized persons. Incomplete applications will be returned by Engineer without action. Entries must match current data of schedule of values and progress schedule and report. Listing must include amounts of change orders issued prior to last day of the "period of construction" covered by application.
D. Initial Payment Application: The principal administrative actions and sub-mittals which must precede or coincide with submittal of contractor's first payment application can be summarized as follows, but not necessarily by way of limitation:

tary Conditions and other Division - 1 Specification Sections, apply to Work of this Section.
A. General: Required inspection and testing services are intended to assist in the determination of probable compliance of the work with requirements specified or indicated. These required services do not relieve the Contrac-tor of responsibility for compliance with these requirements or for compli-ance with requirements of the contract documents.
B. Definitions: The requirements of this section relate primarily to custom-ized fabrication and installation procedures, not to the production of standard products. Quality control services include inspections and tests and related actions including reports, performed by independent agencies and governing authorities, as well as directly by the Contractor. These services do not include Contract enforcement activities performed directly by the Architect/Engineer.
1. Specific quality control requirements for individual units of work are specified in the sections of these specifications that specify the in-dividual element of the work. These requirements, including in-spections and tests, cover both production of standard products, and fabrication of customized work. These requirements also cover quality control of the installation procedures.
2. Inspections, tests and related actions specified in this section and elsewhere in the contract documents are not intended to limit the Contractor's own quality control procedures which facilitate overall compliance with requirements of the contract documents.
3. Requirements for the Contractor to provide quality control services as required by the Architect/Engineer, the Owner, governing au-thorities or other authorized entities are not limited by the provisions of this section.
QUALITY CONTROL SERVICES 01400 - 2
1.3 RESPONSIBILITIES

Contractor Responsibilities: Except where they are specifically indicated as being the Owner's responsibility, or where they are to be provided by another identified entity, inspections, tests and similar quality control services are the Contractor's responsibility; these services also include those specified to be performed by an independent agency and not directly by the Contractor.
Costs for these services shall be included in the Contract Sum. The Contrac-tor shall employ and pay an independent agency, testing laboratory or other qualified firm to perform quality control services specified. The owner re-serves the right to approve the contractor’s independent testing agency and require replacement if the not supplied the required information in a timely manner.
1. The Contractor shall engage and pay for the services of another in-dependent agency to perform inspections and tests.
2. All test reports shall be submitted concurrently to the Archi-tect/Engineer with all failing tests denoted.
B. Retest Responsibility: Where results of required inspections, tests or simi-lar services prove unsatisfactory and do not indicate compliance of related work with the requirements of the contract documents, then retests are the responsibility of the Contractor, regardless of whether the original test was the Contractor's responsibility. Retesting of work revised or replaced by the Contractor is the Contractor's responsibility, where required tests were performed on original work.
B. Responsibility for Associated Services: The Contractor is required to cooper-ate with the independent agencies performing required inspections, tests and similar services, including but not limited to the West Virginia Division of Highways and the Department of Environmental Protection. Provide such auxiliary services as are reasonably requested. Notify the testing agency suf-ficiently in advance of operations to permit assignment of personnel. These auxiliary services include but are not necessarily limited to the following:
1. Providing access to the work.
2. Taking samples or assistance with taking samples.
3. Delivery of samples to test laboratories.
4. Security and protection of samples and test equipment at the project site.
D. Coordination: The Contractor and each independent agency engaged to perform inspections, tests and similar services for the project shall coordi-nate the sequence of their activities so as to accommodate required ser-vices with a minimum of delay in the progress of the work. In addition the

SPECIFIC WARRANTIES 01640 - 1
SECTION 01640 - SPECIFIC WARRANTIES
A. Categories of Specific Warranties: It is recognized that warranties on the work are in several categories, including those of the General Conditions, a one (1) year warranty on all work, products, materials, etc.; and, includ-ing (but not necessarily limited to) the following specific categories related to the individual units of work specified in the technical specifications as written in the contract drawings.
1. Special Project Warranty (Guarantee): A warranty specifically writ-ten and signed by Contractor for a defined portion of the work; and, where required, countersigned by sub-contractor, installer, manu-facturer or other entity engaged by Contractor; formerly generally recognized as (and sometimes specified in contract documents as) a "guarantee".
2. Specified Product Warranty: A warranty which is required by con-tract documents, to be provided for a manufactured product which is incorporated into the work; regardless of whether manufacturer has published the warranty without consideration for specific incor-poration of product into the work, or has written and executed the warranty as a direct result of contract document requirements.
3. Coincidental Product Warranty: A warranty which is not specifically required by contract documents (other than as specified in this Sec-tion); but which is available on a product incorporated into the work, by virtue of the fact that manufacturer of product has published the warranty in connection with purchases and uses of product without regard for specific applications except as otherwise limited by terms of the warranty.
B. Definition; Manufactured Product: A physical item for incorporation into the work, which has been produced from raw or natural materials by a manufacturing process, and which is purchased from a manufacturer ei-ther specifically for the work or for Contractor's/Sub-contractor's/Fabricator's/Installer's stock for which it is drawn for incorpora-tion into the work.
SPECIFIC WARRANTIES 01640 - 2
C. Explanation: This section specified general requirements for special pro-ject warranties, specified product warranties, and coincidental product warranties. It is recognized that required "certifications" and other com-mitments and agreements for continuing services to Owner, flowing out of Contract, are similar to requirements of this section, and are specified elsewhere in contract documents.
D. Refer to individual sections of technical specifications for determination of units of work which are required to be specifically or individually warrant-ed, and for specific requirements and terms of those warranties.
E. Refer to the General Conditions for terms of Contractor's general warran-ties.
F. General Limitations: It is recognized that specific warranties are intended primarily to protect Owner against failure of work to perform workmanship, regardless of sources. Except as otherwise indicated, specific warranties do not cover failures in work which result from:
1. Unusual and abnormal phenomena of the elements,
2. The Owner's misuse, maltreatment or improper maintenance of the work,
3. Vandalism after the time of substantial completion, or
4. Insurrection or acts of aggression including war.
G. Although manufacturers' commitments in product warranties on products used in the work are generally written to exclude product failures which result from failure of other work (such as failure of substrate supporting product), such limitations in product warranties do not relieve Contractor of the more general warranties on work which incorporates use of such products. Except as otherwise indicated, this same relationship applies to units of work performed by other entities (other than manufacturers), such as fabricators, installers and sub-contractors who are required to counter-sign special project warranties with Contractor for such units or work.
H. Related Damages and Losses: In connection with Contractor's correction of warranted work which has failed, remove and replace other work of pro-ject which has been damaged as a result of such failure, or must be re-moved and replaced to provide access for correction of such warranted work.
I. Consequential Damages: Except as otherwise indicated or required by governing regulations, specific warranties are extended to cover damage (other than work of Contract) which occurs as a result of failure of such
SPECIFIC WARRANTIES 01640 - 3
warranted work.
J. Reinstatement of Warranty Period: Except as otherwise indicated, when work covered by a special project warranty or specified product warranty has failed and has been corrected by replacement or restoration, reinstate such warranty by written endorsement for a period of time equal to original warranty period of time, starting on date of acceptance of replaced or re-stored work.
K. Replacement Cost, Obligations: Upon determination within warranty peri-od that a unit of work covered by a special project warranty or a product covered by a specified product warranty has failed, proceed promptly to replace or restore work or product to acceptable condition complying with requirements of contract document. Except as otherwise indicated herein, cost of replacing or restoring such failing work or product is Contractor's obligation, without regard for whether Owner has already benefited from use of failing work or product through a portion of its anticipated useful service life.
L. Owner's Recourse: Except as otherwise indicated, specific warranties do not diminish implied warranties, and shall not deprive Owner of actions, rights and remedies otherwise available for Contractor's failure to fulfill re-quirements of contract documents, nor shall periods of warranties by in-terpreted as limitations on time in which Owner can pursue such actions, rights or remedies.
M. Rejection of Warranties: Owner reserves the right, at time of substantial completion or thereafter, to reject coincidental product warranties submit-ted by Contractor, which in sole opinion of Owner tend to detract from or confuse interpretation of requirements of the contract documents. Limit selections and purchases to products where coincidental product warran-ties are not in conflict with the requirements of the contract documents.
N. Contractor's Procurement Obligations: Do not purchase, subcontract for, or allow others to purchase or sub-contract for materials or product war-ranty, certification or similar commitment is required, until it has been de-termined that entities required to countersign such commitments are will-ing to do so. Refer seemingly irresolvable instances to Engineer for ad-ministrative or procedural consultation before proceeding.
1.3 SPECIFIC WARRANTY FORMS
A. General: The required general forms for special project warranties and specified product warranties are included at end of this section. Prepare a written document to contain terms as required, ready for execution by re-

PROJECT CLOSEOUT 01700 - 1
SECTION 01700 - PROJECT CLOSEOUT
A. Definitions: Project closeout is the term used to describe certain collective project requirements, indicating completion of the work that are to be ful-filled near the end of the Contract time in preparation for final payment to the Contractor and the normal termination of the Contract.
1. Specific requirements for individual units of work are included in the appropriate sections in technical specifications and notes as found in the contract drawings..
2. Time of closeout is directly related to "Completion"; therefore, the time of closeout may be either a single time period for the entire Work or a series of time periods for individual elements of the Work that have been certified as complete at different dates. This time variation, if any, shall be applicable to the other provisions of this

K. Touch-up and otherwise repair and restore marred exposed finishes.
L. Inspection Procedure: Upon receipt of the Contractor's request for inspec-tion, the Architect/Engineer will either proceed with inspection or advise the contractor of unfilled prerequisites.
1. Following the initial inspection, the Architect/Engineer will either prepare the certificate of substantial completion, or will advise the Contractor of work that must be performed before the certificate will be issued. The Architect/Engineer will repeat the inspection when requested and when assured that the Work has been completed.
2. Results of the completed inspection will form the initial "punch-list" for final acceptance.
1.4 PREREQUISITES TO FINAL ACCEPTANCE

1. Upon completion of re-inspection, the Architect/Engineer will either prepare a certificate of final acceptance, or will advise the Contrac-tor of work that is incomplete or of obligations that have not been fulfilled, but are required for final acceptance.
2. If necessary, the reinspection procedure will be repeated.
1.5 RECORD DOCUMENT SUBMITTALS
A. General: Specific requirements for record documents are indicated in the individual sections of these specifications. Other requirements are indi-cated in the General Conditions. General submittal requirements are indi-cated in the various "submittals" sections.
1. Do not use record documents for construction purposes; protect from deterioration and loss in a secure, fire-resistive location; pro-vide access to record documents for the Architect/Engineer's refer-ence during normal working hours.
B. Record Drawings: Maintain a record set of blue or black line white-prints of contract drawings and shop drawings in a clean, undamaged condition.
Mark-up the set of record documents to show the actual installation where the installed work varies substantially from the work as originally shown.
Mark whichever drawing is most capable of showing the actual "field" con-dition fully and accurately; however, where shop drawings are used for mark-up, record a cross-reference at the corresponding location on the
PROJECT CLOSEOUT 01700 - 4
working drawings. Give particular attention to concealed work that would be difficult to measure and record at a later date.
1. Mark record sets with red erasable pencil and where feasible, use other colors to distinguish between variations in separate catego-ries of work.
2. Mark-up new information which is known to be important to the Owner, but for some reason was not shown on either contract drawings or shop drawings.
3. Note related change-order numbers where applicable.
4. Organize record drawing sheets into manageable sets by trade
(e.g., Civil, Architectural, Structural, etc.), bind with durable paper cover sheets, and print suitable titles, dates and other identification on the cover of each set.
C. Record Specifications: Maintain one complete copy of the Project Manual, including specifications and addenda, and one copy of other written con-struction documents such as change orders and similar modifications is-sued in printed form during construction. Mark these documents to show substantial variations in the actual work performed in comparison with the text of the specifications and modifications as issued. Give particular at-tention to substitutions, selection of options and similar information on work where it is concealed or cannot otherwise be readily discerned at a later date by direct observation. Note related record drawing information and product data, where applicable.
