Justification and Approval For Other Than Full and Open Competition

1. Contracting Agency: Defense Human Resource Activity- Procurement Support Office 4800 Mark Center Drive, Alexandria, Virginia, 22350.

2. Authority Cited: 10 U.S.C. 2304(c)(2), FAR 6.302-2 -- Unusual and Compelling Urgency.

3. Description of Supplies and Services: The Defense Manpower Data Center required emergency water extraction from the DoD Center located at 400 Gigling Rd, Seaside, CA, due to flooding caused by torrential rains.

4. Description of Action: A Firm fixed price contract is planned with a period of performance of two days from date of award. FY15 Operating and Maintenance (O&M) funds are available in the total estimated amount of $27,452.

5. Reason for Authority Cited:

a. On December 11, 2014 the weather service warned of a weather front coming through Seaside, CA. In a short period of time the area was devastated with 8-12 inches of rain. The drainage system of the facility located at 400 Gigling Road could not handle the excessive rain flow and caused flood conditions in the data center. The heavy rains caused over 50,000 gallons of water to flood the facility. The threat of the facility roofs collapsing and flooding the DMDC data center created an unusual and compelling urgency. It is estimated that if the facility roof had collapsed the cost of building damages would have reached $500,000 and the cost of data center equipment damage to be $10,000,000. Due to the potential for severe damage to the facility and personnel injury there was no time to provide full and open competition.

b. Competition was limited because this was an emergency required action. The entire county received flooding and there were limited companies available to provide the water extraction service.

c. Market research revealed there were other companies in the local area who could normally respond immediately after hours but they were all busy on other jobs related to emergency-services at the time. Disaster Kleenup Specialists was the only company that could respond immediately and mitigate the emergency situation and preserve the facility and prevent personnel injury.

6. Effort to Obtain Competition: There was not time to make this procurement competitive.

DMDC utilized its known list of vendors who could perform the cleanup. The company used was the only one available for immediate response for the emergency. This was the first time in years where a natural disaster warranted emergency response to remove water caused by torrential rain. The synopsis waiver comes from FAR 5.202 (a)2.

7. Effort to remove barriers to/increase competition: This is a one-time acquisition for water extraction.

8. Market Research: Although there were other qualified sources, the Government had an emergency situation. Disaster Kleenup Specialist was the only company able to respond immediately and mitigate the urgent situation. Market Research revealed other companies that perform these tasks but were unavailable due to region-wide flooding.

9. Interested Sources: Disaster Kleenup Specialists
