52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (OCT 2018)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation.
Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
(i) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA Federal Supply Service Specifications Section, Suite 8100, 470 East L'Enfant Plaza, SW, Washington, DC 20407, Telephone (202) 619-8925, Facsimile (202) 619-8978.
(ii) If the General Services Administration, Department of Agriculture, or Department of Veterans Affairs issued this solicitation, a single copy of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained free of charge by submitting a request to the addressee in paragraph (i)(1)(i) of this provision.
Additional copies will be issued for a fee.

(4) Nongovernment (voluntary) standards must be obtained from the organization responsible for their preparation, publication, or maintenance.
(j) Unique entity identifier. (Applies to all offers exceeding $3,500, and offers of $3,500 or less if the solicitation requires the Contractor to be registered in the System for Award Management (SAM).) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation ``Unique Entity Identifier'' followed by the unique entity identifier that identifies the Offeror's name and address. The Offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Offeror to establish additional SAM records for identifying alternative EFT accounts (see subpart 32.11) for the same entity. If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Offeror should indicate that it is an offeror for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.
(k) Reserved.
(l) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:
(1) The agency's evaluation of the significant weak or deficient factors in the debriefed offeror's offer.
(2) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.
(3) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.

52.212-1 ADDENDA -- INSTRUCTIONS TO OFFERORS
1 General Instructions to Offerors
1.1 This is an all-electronic solicitation release. No hard copies will be mailed. Amendments to the solicitation will be posted to www.beta.sam.gov. It is the responsibility of each offeror to review the webpage for notice of amendments, updates, or changes to current information. The exclusive responsibility for the source selection will reside with the Government. Proprietary information submitted in response to this solicitation will be protected from unauthorized disclosure as required by Subsection 27 of the Office of Procurement Policy Act as amended (41 U.S.C. 423) as implemented in the FAR. The proposal and corresponding program will be unclassified and treated as Source Selection Sensitive Information.
1.2 All proposals must be complete, self-sufficient, and respond directly to the requirements of the solicitation.
Any commitments made in the proposal shall become part of the resultant contract. Any significant inconsistency, if unexplained, raises a fundamental issue of the offeror’s understanding and/or ability to perform under a contract.
This may be a basis for rejection of the proposal. In no case shall words like “we will comply with the requirements of the contract,” or equivalent statements, be acceptable to meet the requirements of this RFP. The proposal shall not simply rephrase or restate the Government’s requirements, but rather shall provide convincing rationale to address how the Offeror intends to meet the requirements. Use of documentation by reference, and not incorporated into the proposal, will not be allowed. Offerors shall provide separate responses to each technical evaluation sub-factor within the identified page limitations. Offerors shall not exceed the page limitation by cross referencing other sections of their proposals. Failure to comply with these instructions may result in an offeror’s proposal being excluded from further consideration for award. Offerors shall submit with their proposals a list of names and telephone numbers of persons authorized to conduct negotiations.
Question Submittal. Offerors may submit written questions during the proposal preparation period. All questions must be received no later than 5 May 2020 at 12:00 PM Pacific time to allow Naval Special Warfare Command (NSWC) adequate time to prepare and issue responses to all Offerors prior to the date and time set for receipt of proposals. Only written questions will receive a response. It is required that each question should include the document name, document date, specific page, paragraph, clause or other definitive citation requiring clarification.
All questions shall be emailed to traci.chiaro@socom.mil with the following in the subject line: QUESTIONS FOR H92240-20-R-0005.
Submission Instructions. Proposals shall be emailed to traci.chiaro@socom.mil with the following in the subject line: PROPOSAL FOR H92240-20-R-0005. Contractors are responsible for verifying receipt of their proposals to the identified inbox before the specified due date and time. Contractors are advised to plan ahead, ensuring enough time to account for any potential delays in email transmission. Email file size shall be limited to 3MB. If documents exceed 3MB, contractors shall submit documents via separate emails to ensure each email is no more than 3MB.
1.3 Proposals shall not contain classified information.
1.4 Proposal Format. Format of the proposal volumes shall be as follows:
a. Text size shall be no smaller than Microsoft Word, Times New Roman, 10 point, uncompressed font, including in any tables, charts, graphs or figures.
b. Pages shall be one and one half spaced, with a minimum of one inch margins on all sides. Pages shall be dated and numbered sequentially by volume. A cover sheet (excluded from page count) should be included in each volume, clearly marked as to volume number, title, solicitation identification, and the offeror's name.
c. Elaborate format and color representations are not desirable.
d. Electronic copies must be provided via E-mail. Microsoft Office Word processing software and Excel spreadsheet software formats are required.

The Offeror shall either: (1) include statement on the offeror’s assent, without exception or imposition of condition, to the terms and conditions of the solicitation including addenda and any documents, provisions and clauses incorporated by reference; or (2) explicitly state any exceptions or assumptions to the terms or conditions of this solicitations from a technical or price perspective. Be advised that exceptions to any of the terms or conditions of this solicitation, additional conditions, or omission of material information required by this solicitation, may at the Government’s discretion, render the submission ineligible for award. Finally, include statement on the offer validity period, no less than one hundred and eighty (180) days after solicitation closing date.

ii. 52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS
ALTERNATE I
iii. 5652.204-9004 FOREIGN PERSONS
2.2 The Government will review Volume 1 for completeness and that the offeror indicated that it is eligible for a Government contract based on the offeror’s responses to the representations, certifications, all contract forms, and other statements required by the solicitation. The offeror shall ensure all Contract Forms, Representations, and Certifications have been completed as required. Incomplete proposals regarding such items may render the proposal ineligible for contract award.
3 VOLUME 2 – SECURITY QUALIFYING CRITERIA (PASS/FAIL). Proposal shall provide documentation evidencing that the offeror holds, at a minimum, an active Secret Facility Clearance as accredited by the Defense Security Service (DSS) at time of proposal submission.
3.1 Facility Clearance. The offeror must have, at a minimum, an active Secret Facility Clearance as accredited by the Defense Security Service (DSS) at time of proposal submission. The Government will review the offeror's submission and also verify the offeror’s clearance status and level in the DSS Industrial Security Facilities Database (ISFD) following proposal submission. This Security Qualifying Criteria will be evaluated on a pass/fail basis prior to completing the evaluation for Factors 1-3. Proposals which do not demonstrate the required facility clearances will NOT be further evaluated. Specifically, the Government will not evaluate the remaining Factors 1-3, and the Offeror will be ineligible for award as the Government considers a Fail rating in Security Qualification Criteria to be a material deficiency of the proposal.
4 VOLUME 3 – FACTOR 1 – Technical Capability. This section is limited to fifteen (15) pages. Cover sheet, Table of contents and/or acronym lists are not included in the fifteen (15) page count. While resumes are also outside the fifteen (15) page count, each resume is limited to two (2) pages.
4.1 The purpose of the Technical Capability Volume is to demonstrate an Offerors approach to meeting and/or exceeding the Technical Subfactor Requirements defined below, which are listed in descending order of importance:
a. Factor 1 Subfactor 1 Key Personnel. The Offeror shall submit a resume for each Key Personnel identified in Paragraphs 2.2-2.5 of Attachment 4 – Task Order 01 Requirement (TO1). The Offeror shall demonstrate the extent to which the proposed Key Personnel meet, or exceed, the qualifications identified for each position as defined in Paragraph 9.0 of Attachment 1 – Performance Work Statement (PWS). Resumes shall be limited to no more than 2 pages each and shall include name, proposed position under this contract, dates and description of work history (title of position and duties) and applicable certifications and experience. Per Paragraph 9.1.1, Attachment 1
– PWS, each Key Personnel shall possess at a minimum Lenel certification, and the collective Key Personnel group at each of the primary places of performances in Attachment 4-TO1 (4 total sites) shall possess certifications for all OEMs and products listed in Paragraph 3.2 of Attachment 1 – PWS. If certifications are not required in accordance with Paragraph 9.1.1 of Attachment 1 – PWS, the Offeror shall provide an affirmative statement to this effect and identify the specific OEMs and products for which certifications are not required in the Factor 1 proposal separate and distinct from trouble ticketing system and VAR information. If applicable, Key Personnel resumes shall include affirmative statements for any certifications in excess of minimum requirements, which may be evaluated more favorably.
b. Factor 1 Subfactor 2 Trouble Ticketing System. The Offeror shall identify its approach to implementing a trouble ticketing system in accordance with Paragraph 6.2 of Attachment 1-PWS. The Offeror shall demonstrate the extent to which its trouble ticketing system meets functionality requirements and shall describe the tools (e.g., Excel, Tableau, SPSS, Microsoft Project, etc.), technology (e.g., REMEDY, Service Desk, Zendesk, Workfront, TeamGantt, etc.) and processes (e.g., ISO, CMMI, ITIL, PMI, etc.) to be employed to enable the Government to effectively monitor cost, schedule, and performance under the IDIQ and perform data analysis for trends and other purposes. The Offeror shall describe instances where the named tools, technology and processes have been used successfully on similar requirements in the past.
c. Factor 1 Subfactor 3 Value Added Reseller (VAR). The Offeror shall submit an affirmative statement that it possesses Prime VAR status for applicable OEMs and products outlined in Paragraph 3.2 of Attachment 1 – PWS, as required by Paragraph 7.2 of Attachment 1 – PWS. If a VAR agreement is not required by the OEM or product in accordance with Paragraph 7.2 of Attachment 1 – PWS, the offeror shall provide an affirmative statement to this effect and identify the specific OEMs and products for which a VAR is not required. Any other deviations shall also be noted in the Offeror’s proposal along with an explanation as to how the proposed solution benefits the Government from a cost, schedule and perspective despite not meeting VAR requirements. If applicable, the Offeror shall include affirmative statements for any VAR status in excess of minimum requirements, which may be evaluated more favorably.
5 VOLUME 4 – FACTOR 2 – Past and Present Performance
5.1 Contents. The offeror shall submit a Past and Present Performance Proposal (Volume 4) containing the following:
1. Summary Page (limited to one (1) page) describing the role of the offeror and each major subcontractor, teaming partner, and/or joint venture partner during performance of this contract.
“Major subcontractor” is defined as performing 25% or greater of the total evaluated price.
2. Past and Present Performance Information Sheets providing POCs and describing the relevancy to this effort (Attachment 5).
3. Past and Present Performance Questionnaire (Attachment 6), where applicable.
5.1.1 Past and Present Performance Information Sheet (Attachment 5). Submit a maximum of four (4) recent and relevant past and present performance experiences, including associated CPARS where applicable.
a. The Government defines “recent” as contracts/orders that have been performed during the past three (3) years from the date of issuance of this solicitation, and have at least six (6) months performance within the last three
(3) years from solicitation issuance.
b. The Government requires at least one (1) information sheet from the prime contractor on this effort acting as a prime on the experience, and at least one (1) information sheet from each major subcontractor.
c. The Past and Present Performance Information Sheet for each experience is limited to three (3) pages, and shall reference only one contract/order per Sheet. The offeror shall complete the Sheet in its entirety, including current and accurate points of contact (POCs) for each contract/order identified. POCs could include contracting officer’s representatives (CORs), program managers, end users, contracting officers, other Government agency representatives and/or commercial customers.
d. Offerors are cautioned that the Government may use information obtained from other sources for the evaluation of past performance, including references and information not identified by the Offeror. The Government reserves the right to limit the number of references it decides to contact.
e. Offerors must clearly state in the proposal if they have no relevant prior past performance. If left blank, the proposal will be considered “not responsive” and may result in exclusion of the offeror’s proposal from consideration from award.
5.1.1.1 Past and Present Performance Questionnaire (Attachment 6). If there is no associated CPARS for the experience, the Offeror shall forward the Past and Present Performance Questionnaire (Attachment 6) to the offeror’s POCs. Offerors are to request their POCs to submit the completed questionnaire directly to the contracting officer prior to the closing of the solicitation. The Government retains discretion but is not required to consider Past and Present Performance Questionnaires received after the proposal submission due date. At its discretion, the Government may also use the Past Performance Questionnaire to contact sources for additional information, where appropriate.
6 VOLUME 5 – FACTOR 3 – Price
6.1 The offeror shall submit a fully completed Attachment 2 – Exhibit Line Item Number (ELIN) spreadsheet within the Microsoft Excel spreadsheet format provided by the Government. All proposed prices shall be provided as a Firm Fixed Price, therefore all proposed prices shall be inclusive of all direct and indirect rates (i.e., direct labor, material, travel, and other direct and indirect costs). ELINs are segregated by five (5) ordering periods lasting one year each, with pricing applicable based on the date of task order issuance. The total evaluated price will be automatically formulated by the Microsoft Excel spreadsheet provided by the Government, by calculating the offeror’s proposed pricing across the total life of Task Order 01 and all IDIQ ordering periods, to include the value of the option at FAR 52.217-8 calculated at 50% of the value of ordering period five. The Offeror shall not alter formulas in the Microsoft Excel spreadsheet provided by the Government. Failure to comply with this instruction may result in the offeror’s proposal no longer being considered for award. Pricing is required for all ordering periods as well as the entire Task Order 1 requirement. Note the Government intends to award Task Order 01 as a result of this submission.
(End of provision)
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
1 Introduction
1.1 This section outlines the criteria the Government will use in evaluating the offeror’s capabilities and proposals for the Integrated Electronic Security System contract. The Government will compare each offeror’s capabilities and proposal elements against the predetermined evaluation criteria related to the Government’s requirements defined herein. This is a competitive, best value tradeoff, source selection that will be conducted in accordance with
(IAW) Federal Acquisition Regulation (FAR) Part 15 and Defense Federal Acquisition Regulation Supplement (DFARS) Part 215 and applicable agency regulations.
1.2 Discussions. The Government intends to evaluate proposals and award a contract without discussions. Therefore, the Offeror’s initial proposal should contain the Offeror’s best terms and conditions from a technical, past and present performance and price standpoint. The Government reserves the right to make no award. The Government reserves the right to establish a competitive range and conduct discussions if the Contracting Officer later determines them to be necessary. The Government also reserves the right for efficiency purposes to only include the most highly rated proposals in the competitive range. Offerors may be asked to clarify certain aspects of their proposal. Exchanges conducted with regard to adverse past performance, or to resolve minor or clerical errors in any of the proposal volumes will not constitute discussions, and the Procurement Contracting Officer (PCO) reserves the right to award a contract without granting an opportunity to revise the original proposal.
1.3 While the Government Source Selection Evaluation Board (SSEB) and the Source Selection Authority (SSA) will strive for maximum objectivity, the source selection process, by its nature, is subjective, and therefore, professional judgment is implicit throughout the entire process. This may result in an award being made to a higher rated, higher priced Offeror where the decision is consistent with the evaluation factors and the SSA reasonably determines that the technical superiority, and/or superior past performance, of the higher priced Offeror outweighs the price difference. The SSA will base the source selection decision on an integrated assessment of proposals against all source selection criteria in the solicitation. The SSA will not qualitatively assess or compare Pass/Fail Security Qualifying Criteria, and will only verify whether an Offeror received a Pass for this Pass/Fail Item.
Proposals receiving a Fail will be ineligible for award.
2 Best Value Evaluation. The Government intends to issue a single IDIQ award and Task Order 01 as a result of this solicitation; however, the Government reserves the right to not make any award based upon the results of the proposal evaluations.
2.1 The evaluation will consist of an evaluation of the Security Qualifying Criteria and Factors 1-3; Technical Capability, Past and Present Performance, and Price, which are outlined below.
2.1.1 Security Qualifying Criteria will be evaluated on a pass or fail basis. A Fail rating will render the proposal ineligible for award and the Government will not further evaluate the remainder of the proposal.
2.1.2 Factor 1: Technical Capability will be evaluated using a combined Technical/Risk rating using the DOD Source Selection Guide adjectival rating technique.
2.1.3 Factor 2: Past and Present Performance will receive an overall Performance Confidence Assessment rating.
2.1.4 Factor 3: The Price Factor will not be given an adjectival rating or scored.
Technical Capability (Factor 1) and Past and Present Performance (Factor 2) are of equal importance and when combined are significantly more important than Price (Factor 3). The Technical Capability (Factor 1) subfactors are in descending order of importance.
The importance of price as an evaluation factor will increase with the degree of equality of the proposals in relation to the remaining evaluation factors. When the Offerors are considered essentially equal in terms of technical capability and/or past performance, or when price is so significantly high as to diminish the value of the technical or past performance superiority to the Government, price may become the determining factor for award. In summary, price/technical trade-offs will be made, and the extent to which one may be sacrificed for the other is governed only by the tests of rationality and consistency with the established evaluation factors.

3 SECURITY QUALIFYING CRITERIA (PASS/FAIL). The Government intends to verify in the DSS Industrial Security Facilities Database (ISFD) whether the Prime offeror possesses, at a minimum, an active Secret Facility Clearance at time of solicitation closing. If the offeror lacks such clearance, the offeror will receive a “Fail,” and will not be evaluated further.
4. FACTOR 1: Technical Capability. Under the Technical Capability Factor, the Government will evaluate the extent to which the Offeror meets or exceeds the requirements within the technical subfactors defined below, which are listed in descending order of importance.An Unacceptable Factor 1 – Technical Capability rating may result in proposal rejection without further evaluation (i.e. Factor 2 – Past and Present Performance and Factor 3 – Price) at the Government’s discretion.:
a. Key Personnel. The Government will evaluate the extent to which Key Personnel meets or exceeds the qualifications identified for each Key Personnel position identified in Paragraphs 2.2-2.5 of Attachment 4 – Task Order 01 Requirement as defined in Paragraph 9.0 of Attachment 1 – Performance Work Statement (PWS).
Offerors who propose Key Personnel with more extensive experience and/or certifications in the OEMs or products identified in paragraph 3.2 of the Attachment 1 - PWS may be viewed more favorably than Key Personnel who have lessor experience and/or certifications. The Government will evaluate whether Key Personnel as individuals and as a collective group possess required certifications through affirmative statements in resumes, and/or if applicable, whether the Offeror clearly identified OEMs and products that do not require certifications in the Factor 1 proposal.
In the event of conflicting information, the Government reserves the right to evaluate proposed Key Personnel less favorably. The Government may view more favorably those Offerors that possess certifications for identified OEMs and products in Paragraph 3.2 of Attachment 1 – PWS, in excess of the minimum requirements. For example, if Hanwha meets the circumstances for not requiring certification in Attachment 1, Hanwha certification is not a minimum requirement; however, the Government may see such certification as a benefit regardless. Note, any recency experience requirements are from date of solicitation issuance.
b. Trouble Ticketing System. The Government will evaluate the extent to which the Offerors proposed trouble ticketing system meets the functionality requirements of Attachment 1 - PWS Paragraph 6.2. In addition the Government will evaluate the extent to which the proposed tools, technology and processes the Offeror will employ will allow the Government to effectively monitor, cost, schedule, and performance under the IDIQ and perform data analysis for trends and other purposes to meet Attachment 1 - PWS Paragraph 6.2. Offerors who propose a fully functional trouble ticketing system that has been used with success on like efforts in the past may be viewed more favorably than fully functional systems with no demonstrated success. Proven and mature tools (e.g., Excel, Tableau, SPSS, Microsoft Project, etc.), technology (e.g., REMEDY, Service Desk, Zendesk, Workfront, TeamGantt, etc.), and processes that have the required functionalities and are capable of producing real time and reliable data required by Attachment 1 - PWS Paragraph 6.2 may be viewed more favorably. Additionally, offerors who are certified in and have employed industry recognized business processes such as ISO, CMMI, ITIL, PMI, etc.
on like efforts in the past may be viewed more favorably than those operating without such certifications.
c. Value Added Reseller. The Government will evaluate whether the Offeror provided an affirmative statement that it possesses Prime VAR status for applicable OEMs and products outlined in Attachment 1 - PWS Paragraph 3.2, as required by Attachment 1 - PWS Paragraph 7.2. The Government will also evaluate whether the Offeror clearly identified the specific OEMs and products for which a VAR is not required. If the Offeror proposes any deviations from VAR requirements, the Government will evaluate how the proposed solution benefits the Government from a cost, schedule and performance perspective despite not meeting VAR requirements. The Government may view more favorably those Offerors that possess VAR status for identified OEMs and products in Paragraph 7.2 of Attachment 1-PWS, in excess of the minimum requirements. For example, if Lenel does not require VAR status, VAR status for Lenel is not a minimum requirement; however, the Government may see such VAR status a benefit regardless.
4.1 Evaluation of this factor shall focus on the strengths, weaknesses, significant weaknesses and deficiencies, of the offeror’s proposal. Evaluation of risk associated with the offeror’s proposal is inherent in the evaluation. Note that if an offeror’s proposal demonstrates a material failure to meet a Government requirement, it is a deficiency in the offeror’s proposal. The Government will compare each offeror’s Technical Capability proposal against the Government’s requirements identified within this solicitation and assign a single Combined Technical/Risk Rating to Factor 1 - Technical Capability, as shown in the Table 1 below. Subfactors will not be individually rated (i.e.
will not receive a color rating).
Table 1. Combined Technical (Color) and Risk Ratings Color Rating Description Blue Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.
Purple Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.
Green Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.
Yellow Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.
Red Unacceptable Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is unawardable.
Table 2. Definitions
STRENGTH
An aspect of an offeror’s proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.
WEAKNESS A flaw in the proposal that increases the risk of unsuccessful contract performance.
SIGNIFICANT WEAKNESS A flaw that appreciably increases the risk of unsuccessful contract performance.
DEFICIENCY A material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.
4.2 Regarding evaluation ratings and findings listed above, since it is impossible to anticipate the nature of each Offeror’s proposal in advance or to describe all the qualities and considerations that could result in one of the above definitions, these definitions should be looked upon as examples of typical characteristics, and will be used as a guide or reference rather than a rigid measure to be followed word-for-word. Evaluators will be instructed to select the rating/definition that most closely fits the value or desirability of the Offeror’s proposed performance.
5 FACTOR 2: Past and Present Performance. In assigning a single overall performance confidence rating for Factor 2 as shown in Table 5 below, the Government will evaluate the Offeror’s probability of meeting the contract requirements considering recency, relevancy and quality of the Offeror’s record of past performance. The Government will consider the holistic nature of the offeror’s record in assessing an overall Performance Confidence Assessment rating at the Factor level. More relevant performance will have a greater impact on the Performance Confidence Assessment than less relevant effort. A strong record of relevant past performance may receive a higher confidence rating and be considered more favorably than a less relevant record of favorable performance. The performance evaluation will be based on the data in the Offeror’s proposal, Past and Present Performance
Information Sheets (Attachment 5), Past and Present Performance Questionnaires (Attachment 6) and CPARS reports as available through the Past Performance Information Retrieval System, and any other information the Government finds appropriate to consider. The Government is not limited to these resources.
5.1 With respect to Recency, the Government will assign a rating of Recent or Not Recent to each contract/order in accordance with the Recency ratings in Table 3 below. The Government will not evaluate past performance submissions that are not recent.
Table 3. Recency Ratings
Recent
Contracts/orders performed within the last three (3) years from date of solicitation issuance, and have at least six (6) months of performance within the three (3) years since solicitation issuance.
Not Recent
Contracts/orders performed outside the last three (3) years since solicitation issuance, or has less than six (6) months of performance within three (3) years since solicitation issuance.
5.2 With respect to Relevancy, the Government will assign a Relevancy rating to each contract/order in accordance with the Relevancy ratings in Table 4 below. Relevancy will be determined based on the degree to which the submitted experiences are relevant to this effort concerning scope (e.g., PWS 5.0 sections, specific work with each type of IESS system and PWS 6.2 management of such efforts), magnitude (e.g., dollar amount, approximately $2M or more per year), and complexity (e.g., support provided for multiple buildings in multiple geographically dispersed locations). The more the overall effort is similar in all areas, the more relevant it becomes. In determining relevancy for experiences involving work performed by the prime and/or proposed subcontractors on this effort, the Government may (but is not required to) consider the area of expertise the prime or subcontractor is projected to actually perform under this effort. The Government considers in descending order of relevancy, (1) experience performing repair, maintenance and upgrades on the Naval Special Warfare IESS systems, (2) experience performing repair, maintenance and upgrades on Navy or DoD IESS systems, and (3) experience performing repair, maintenance and upgrades on IESS systems in other non-DoD federal organizations. The Government does not assume the duty to search for data to cure any problems it finds in the past performance information provided by the Offeror; the burden of providing thorough and complete relevant past and present performance information remains with the Offeror.
Table 4. Relevancy Ratings
Very Relevant (VR)
Present/Past Performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant (R)
Present/Past Performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Somewhat Relevant (SR)
Present/Past Performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.
Not Relevant (NR)
Present/Past Performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
5.3 With respect to quality, the Government will assess quality as part of assessing an overall confidence rating.
The Government will not assign a separate quality rating to each contract/order.
5.4 With respect to Performance Confidence, the Government will assign an overall Performance Confidence Assessment rating to each offeror in accordance with Table 5 below.
5.5 Neutral Rating: Offerors without a record of relevant past performance or for whom information on past performance is not available will not be evaluated favorably or unfavorably on past performance and as a result, will receive a “neutral” rating. A strong past performance record may be considered more advantageous to the Government than a neutral/unknown confidence past performance rating. Offerors are advised that the Source Selection Authority may determine, that a "Substantial Confidence" or "Satisfactory Confidence" past performance rating is worth more than a "Neutral Confidence" past performance rating in a best value tradeoff.
5.6 Regarding evaluation ratings and findings listed above, since it is impossible to anticipate the nature of each Offeror’s proposal in advance or to describe all the qualities and considerations that could result in one of the above definitions, these definitions should be looked upon as examples of typical characteristics, and will be used as a guide or reference rather than a rigid measure to be followed word-for-word. Evaluators will be instructed to select the rating/definition that most closely fits the value or desirability of the Offeror’s proposed performance.
5.7 ADVERSE PERFORMANCE INFORMATION: Adverse past performance is defined as past performance information that supports a less than satisfactory rating on any evaluation aspect or any unfavorable comments received from sources without a formal rating system. When relevant performance records indicate performance problems, the Government will consider the number and severity of the problems, the appropriateness and/or effectiveness of any corrective actions taken (not just planned or promised), and the Offeror’s overall work record. Prompt corrective action in isolated instances may not outweigh overall negative trends.
