PROVISIONS AND CLAUSES INCORPORATED BY FULL TEXT
52.215-20 REQUIREMENTS FOR COST OR PRICING DATA OR INFORMATION OTHER THAN COST OR PRICING DATA (Oct 1997)
(a) Exceptions from cost or pricing data.
(1) In lieu of submitting cost or pricing data, offerors may submit a written request for exception by submitting the information described in the following paragraphs. The Contracting Officer may require additional supporting information, but only to the extent necessary to determine whether an exception should be granted, and whether the price is fair and reasonable.
(i) Identification of the law or regulation establishing the price offered. If the price is controlled under law by periodic rulings, reviews, or similar actions of a governmental body, attach a copy of the controlling document, unless it was previously submitted to the contracting office.
(ii) Commercial item exception. For a commercial item exception, the offeror shall submit, at minimum, information on prices at which the same item or similar items have previously been sold in the commercial market that is adequate for evaluating the reasonableness of the price for this acquisition. Such information may include—
(A) For catalog items, a copy of or identification of the catalog and its date, or the appropriate pages for the offered items, or a statement that the catalog is on file in the buying office to which the proposal is being submitted. Provide a copy or describe current discount policies and price lists (published or unpublished), e.g., wholesale, original equipment manufacturer, or reseller. Also explain the basis of each offered price and its relationship to the established catalog price, including how the proposed price relates to the price of recent sales in quantities similar to the proposed quantities;
(B) For market-priced items, the source and date or period of the market quotation or other basis for market price, the base amount, and applicable discounts. In addition, describe the nature of the market;
(C) For items included on an active Federal Supply Service Multiple Award Schedule contract, proof that an exception has been granted for the schedule item.
(2) The offeror grants the Contracting Officer or an authorized representative the right to examine, at any time before award, books, records, documents, or other directly pertinent records to verify any request for an exception under this provision, and the reasonableness of price. For items priced using catalog or market prices, or law or regulation, access does not extend to cost or profit information or other data relevant solely to the offeror’s determination of the prices to be offered in the catalog or marketplace.
(b) Requirements for cost or pricing data. If the offeror is not granted an exception from the requirement to submit cost or pricing data, the following applies:
(1) The offeror shall prepare and submit cost or pricing data and supporting attachments in accordance with Table 15-2 of FAR 15.408.
(2) As soon as practicable after agreement on price, but before contract award (except for unpriced actions such as letter contracts), the offeror shall submit a Certificate of Current Cost or Pricing Data, as prescribed by FAR 15.406-2.
(End of Provision)
52.216-1 TYPE OF CONTRACT (APR 1984)
The Government contemplates the award of a firm fixed price contract resulting from this solicitation. (End of clause)
52.222-5 DAVIS-Bacon Act—Secondary Site of the Work (July 2005)
(a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Davis-Bacon Act, of this solicitation.
(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.
(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.
(2) The due date for receipt of offers will not be extended as a result of an offeror’s request for a wage determination for a secondary site of the work.
(End of provision)
52.225-22 Notice of Required Use of American Iron, Steel, and Other Manufactured Goods—Buy American Act—Construction Materials (Mar 2009)
(a) Definitions. “Construction material,” “domestic construction material,” “foreign construction material,” “manufactured construction material,” “steel,” and “unmanufactured construction material,” as used in this provision, are defined in the clause of this solicitation entitled “Required Use of Iron, Steel, and Other Manufactured Goods—Buy American Act—Construction Materials” (Federal Acquisition Regulation (FAR) clause 52.225-21).
(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of section 1605 of the American Recovery and Reinvestment Act of 2009 (Pub. L. 111-5) (Recovery Act) or the Buy American Act should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-21 in the request. If an offeror has not requested a determination regarding the inapplicability of 1605 of the Recovery Act or the Buy American Act before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers.
(1) If the Government determines that an exception based on unreasonable cost of domestic construction material applies, the Government will evaluate an offer requesting exception to the requirements of section 1605 of the Recovery Act or the Buy American Act by adding to the offered price of the contract—
(i) 25 percent of the offered price of the contract, if foreign iron, steel, or other manufactured goods are used as construction material based on unreasonable cost of comparable manufactured domestic construction material; and
(ii) 6 percent of the cost of foreign unmanufactured construction material included in the offer based on unreasonable cost of comparable domestic unmanufactured construction material.
(2) If two or more offers are equal in price, the Contracting Officer will give preference to an offer that does not include foreign construction material excepted at the request of the offeror on the basis of unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign construction material not listed by the Government in this solicitation in paragraph (b)(2) of the clause at FAR 52.225-21, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer and a separate cost comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-21 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) f the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-21 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—
(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.

L. 111-5) (Recovery Act) or the Buy American Act should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of FAR clause 52.225-23 in the request. If an offeror has not requested a determination regarding the inapplicability of section 1605 of the Recovery Act or the Buy American Act before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

SECTION 00110 – PROPOSAL PREPARATION
PROJECT DESCRIPTION
The project includes the design and construction of renovations and improvements to modernize the Jackson Federal Building into an economically and operationally efficient high-performance green building. This modernization project will include replacement and upgrades to building systems (electrical, heating, ventilation, and air/conditions (HVAC), windows, and lighting). LEED Existing Building (LEED-EB) Gold certification will be pursued by the Design/Build (D/B) Team as the goal, with LEED-EB Silver being the minimum certification level required if LEED-EB Gold cannot be reached. The specific activities, tasks, and deliverables required of the D/B Team will be further delineated in the Statement of Work (to be issued in Phase Two of this D/B competition).
The project shall include the performance of architectural/engineering services based on an approved set of scopes of work during the Request for Proposal (RFP) stage of the acquisition process and in accordance with GSA quality standards and requirements. As required by law, the facility will meet federal energy goals and all federal accessibility requirements and standards.
SCOPE OF WORK
This project includes the design and construction of renovations and improvements to modernize the Jackson Federal Building into an economically and operationally efficient high-performance green building. This modernization project of an approximately 865,141 square foot building will include replacement and upgrades to building systems (electrical, HVAC, windows, and lighting). The scope of professional services will require at a minimum: Professional architectural, engineering, and related consulting services for technical solution design documents, design development documents, specifications, cost estimates, schedules, value engineering services, LEED EB services, computer-aided design and drafting (CADD). The project is also to include conformance to the P-100 (Facility Standards for Public Buildings), including LEED certification of at least Silver (with LEED EB Gold being the project goal). All design work will be required to comply with the National Environmental Policy Act.
A draft Scope of Work (SOW) has been incorporated into this RFQ for offerors information only. NOTE: The final SOW is subject to change and will not be issued in final form until issuance of the Phase Two RFP.
GSA has contracted separately for Construction Management as assist (CMa) services. The CMa will be involved in the design process to provide construction expertise, estimating and cost information, and functionality and constructability reviews on behalf of the Government. There will be an informal partnering process throughout the design and construction phases to promote successful project development and execution including an enhanced project kick-off meeting. The CMa will a lso perform Commissioning Agent services.
The estimated cost for the design-build delivery of the modernization of the Jackson Federal Building is between $30,000,000 and $50,000,000.
Opportunities for other than Large Businesses: This procurement will be open to large and small business firms. Any qualified responsible firm, including small business, veteran-owned small business, service-disabled veteran owned small business, HUBZone small business, small disadvantaged business, and women-owned small business is encouraged to participate as a prime contractor or as a member of a joint venture with other small businesses, or as a subcontractor Pursuant to Section 8(d) of the Small Business Act (15 U.S.C. 637(d), FAR subpart 19.702 and FAR subpart 19.12. An Offeror that is not a small business concern, offering to perform a contract that has subcontracting possibilities, must submit a Subcontracting Plan that is acceptable to the Contracting Officer which provides subcontracting opportunities to small businesses to the maximum extent practicable. In this procurement, GSA intends to promote contractors’ and subcontractors’ use of registered Apprenticeship Programs.
NOTICE TO OFFERORS
GSA intends to award a Firm Fixed Price Design-Build Construction Contract based upon an approved technical solution during the acquisition process for this procurement pursuant to the Federal Acquisition Regulation (FAR) Two-Phase Design-Build Selection Procedures, FAR Subpart 36.3, Source Selection Procedures, and FAR subpart 15.3. For this contract award process, GSA will issue two Solicitations in sequence: 1) Phase One (RFQ), and 2) Phase Two (RFP). The Phase One procedure (which is analogous to a Request for Qualifications (RFQ) is designed to select a “short list” of the most highly qualified Offerors who will be requested to submit Phase Two proposals. All responsible sources may submit a Phase One Proposal. A maximum of up to five (5) firms will be short listed unless the contracting officer determines that a number greater than five (5) is in the Government’s best interest.
A best value concept will be applied for evaluation of offers and selection of the successful Offeror for this procurement. The best value approach provides the opportunity to select an Offeror who is not necessarily the lowest-priced or the highest technically-ranked. GSA will select the proposal that represents the best value based on the evaluation of technical factors and price, with technical factors being weighed more heavily than price. Therefore, the Offeror's proposal should contain the Offeror's best terms.
In Phase One, the Government shall identify the evaluation factors other than cost or price that will serve as the basis for the determination of the most highly qualified Offerors. Interested Offerors will be required to submit their responses to the RFQ by the due date established in this RFQ. The Government will evaluate all the responses to the RFQ in accordance with the criteria in the RFQ, and advise each Offeror in writing whether it will be invited to participate in the Phase Two process. Offerors that do not submit a timely RFQ response in Phase One will not be allowed to participate in the remaining phase of the procurement.
In Phase Two, the Government will issue the RFP to the most highly qualified Offerors from Phase One that are short-listed into Phase Two (up to a maximum of five), and request that they submit Phase Two proposals. Phase Two of the solicitation shall be prepared in accordance with FAR Part 15 and include Phase Two evaluation factors, developed in accordance with FAR 15.304. Phase Two of the solicitation shall require submission of technical and price proposals, which shall be evaluated separately in accordance with FAR Part 15. The Government will reserve the right to make an award upon the basis of the initial Phase One and Phase Two offers without discussions.
GSA is hereby requesting Phase One Proposals only. This Phase One RFQ provides Offerors with instructions regarding the submission of their complete Phase One Proposals and the evaluation thereof. Utilizing the format prescribed within, Offerors are to provide the requested information and demonstrate their qualifications. Responses shall be as complete and accurate as possible and present data relative to the specific Project under consideration. Offerors shall make every effort to present information clearly and concisely in accordance with the formats described herein.
GENERAL Proposal Preparation Instructions
1. Offerors are advised that the following proposal preparation instructions are applicable to Phase One RFQ requirements only. Phase Two proposal preparation instructions will be provided at a later time following selection of the most highly qualified firms during Phase One.
2. This is an all-electronic solicitation release including amendments. All documents will be posted on the Federal Business Opportunities (FBO) website at: www.fbo.gov. Hard copies will not be made available.
3. This solicitation does not commit the Government to pay any costs incurred in the preparation and submission of the initial and any subsequent proposals or for any costs incurred prior to execution of a formal contract. Stipends for proposal costs incurred during Phase Two shall not be paid by the Government.
4. SITE VISIT: A pre-proposal site visit will be conducted at the Jackson Federal Building, Seattle, Washington, on October 8, 2009, between 10:00 a.m. – 1:00 p.m. GSA PBS Region 10 will conduct a pre-proposal conference with the intent of the meeting to discuss offerors' response to the Phase One Request for Qualifications. A brief (no more than one half hour) tour of the facility will follow immediately after. During the tour of the facility only one representative from each company attending the pre-proposal conference shall be permitted to attend the site visit walk through. (NOTE: Due to limited space within the occupied facilities, no more than six (6) individuals per design-build team will be permitted on the tour, regardless of company affiliation.) More than one representative from each company (as well as more than six individuals per design-build team) may attend the initial pre-proposal conference discussion in the morning. All parties interested in attending the pre-proposal conference and/or site visit shall submit, in writing, to the Contract Specialist, at kimberlee.wallentine@gsa.gov (with copy to the Project Manager at chris.helmer@gsa.gov) a list of attendees, noting which attendee shall attend the facility tour if more than one attendee from any given company is registering. Information submitted shall include the following:
· Attendee Name (First, Middle, Last)
· Attendee Email
· Company Name and Designation if Prime or Sub (if Sub, indicate to which Prime)
· Company Address
· Company Phone Number

2. PHASE ONE EVALUATION FACTORS: For Phase One, all factors are listed in descending order of importance. Factor 1 is significantly more important than Factors 2 and 3 when combined. Factor 2 is equal in important to Factor 3. Sub-factors 1(A) and 1(B) under Factor 1 are equal in importance to one another. See below for detailed evaluation factor and rating criteria information.
Factor 1:
Relevant Specialized Experience
Sub-factor 1(A):
Relevant Construction Experience of the Proposed Builder
Sub-factor 1(B):
Relevant Design Experience of the Proposed Designer
Factor 2:
Past Performance
Factor 3:
Technical Approach Including Qualifications of Proposed Key Project
Personnel
a. FACTOR 1 – Relevant Experience.
Description: This factor considers the extent of the Offeror’s past experience on projects of similar size (building square feet and dollar value), scope and complexity. The Offeror shall submit information on at least three (3), but no more than five (5), relevant projects of similar size, scope and complexity. “Relevant” is defined as projects similar to the project in this solicitation in size (i.e. square feet and dollar value) and that have a logical connection with the requirements of this solicitation by including similar scope elements and demonstrate equal or greater overall project complexity associated with them. For purposes of determining “similar size, scope and complexity”, experience that is considered especially relevant include: 1) similar building facility projects such as renovation of existing multi-story office buildings; 2) design-build/collaborative approach projects; 3) federal construction and 4) construction projects in occupied buildings, with a cost range of $30,000,000 - $50,000,000 and an average square footage of 500,000 – 900,000 sq ft. An explanation of each of the four types of especially relevant experience is as follows:
Similar Building Facilities. For the purpose of this RFP, projects submitted for this area of experience should demonstrate the builder’s relevant experience with building facilities of similar size (square feet and dollar value) to the project in this solicitation. Examples include, but are not limited, to such buildings as multi-story office buildings, projects involving major mechanical work, lighting upgrades, work in occupied facilities, and critical phasing and coordination efforts necessary for success.
Design Build Projects. For the purpose of this Solicitation, projects submitted for this area of experience should show the builder’s experience working with a design firm on relevant design-build projects of similar size (square feet and dollar value) to the project in this solicitation. The experience does not need to be with the same design-build team as proposed for this project, however, offerors that demonstrate previous relevant experience with the same D/B team members as proposed for this project may be afforded a higher rating.
Federal Building Construction. For the purpose of this Solicitation, projects submitted for this area of experience should demonstrate the builder’s experience constructing on and for relevant federal construction projects of similar size (square feet and dollar value) to the project in this solicitation as well as the builder’s knowledge of federal construction contracting procedures.
Occupied Facilities Construction. For the purpose of this Solicitation, projects submitted for this area of experience should demonstrate the builder’s experience constructing relevant projects of similar size (square feet and dollar value) to the project in this solicitation in buildings that were occupied during construction.
Relevant Experience for this project is comprised of two parts, each of which must be submitted separately:
Factor 1(A) Relevant Construction Experience of the Proposed Builder; and
Factor 1(B) Relevant Design Experience of the Proposed Designer
Standard for Evaluation: This criterion will be evaluated for the quality of experience demonstrated. The greater the relevancy of the Offeror’s construction and design project experience, the more likely Offerors will receive a higher rating during evaluations. Projects similar in scope, size and complexity to the project identified in this Solicitation in which the D/B Project Team has worked together will likely receive a higher rating during evaluations. In addition, Offerors that demonstrate a higher degree of relevant experience will be evaluated more favorably. The minimum submission requirements for this factor are defined below. NOTE: the Offeror shall provide the required information for both the proposed builder AND the proposed designer:
1) A list of at least three (3), but no more than five (5), similar projects completed or substantially underway. Only relevant projects at least 75% complete or completed within the past six (6) years from the date proposals are due may be submitted; proposals shall clearly state the year of completion or percentage of completion for each project submitted. Offerors shall explain how the information provided is relevant to the proposed acquisition.
2) Narrative summaries of the submitted projects that demonstrate the Offeror’s capabilities, technical expertise, and experience managing complex projects with reference to considerations of timeliness and technical success. Limit the summaries to one (1) page each using the Project Experience Form attached (Exhibit 2). Include for each project submitted the following information:
1. Project Title & Location
2. Description of the Project including square feet (should address how the project relates to the solicited project and an explanation of how the project pertains to the noted area of experience)
3. Project Type (i.e. Design/Build; Athletic Training Center, School, etc.)
4. Dollar Value (award amount and final contract amount)/Size of Contract (sq ft)
5. Contract Start & Completion Dates (Month/Year) or Percentage of Completion
6. Customer Point of Contact (include name, address, electronic address, telephone and facsimile numbers, customer’s relationship to project, customer’s agency/firm affiliation)
(i) Sub-Factor 1(A) – Relevant Construction Experience of the Proposed Builder.
Submittal Requirements for Sub-factor 1(A): For Construction Experience of the Proposed Builder, the Offeror shall submit at least three (3) but no more than five (5) project examples demonstrating relevant experience.
The Offeror must clearly identify for which, if any, of the four especially relevant types of experience area(s) (as defined above under “Description”) each project example pertains for the proposed builder (e.g., Project A may qualify and be listed for similar building facilities, design build project, federal construction and occupied building construction while Project B may qualify and be listed only for similar building facilities and federal; construction). A sample project experience matrix for the proposed builder is as follows:
