The contractor shall provide all labor, tools, materials, equipment, permits and supervision necessary for the completion of the work listed below.

Work shall be performed in accordance with the Scope of Work (SOW) which is attached hereto and incorporated by reference.

The Contractor shall comply with the provisions of the Davis Bacon Act General Decision Number ND100015, dated 4/02/2010, which is attached hereto and incorporated by reference.

Project Description: Design/Build Wind Turbine

Location: Land Port of Entry Border Station, Pembina, ND

1001 The design will include site specific civil engineering tasks including the turbine foundation. Also included in the design will be mechanical and structural engineering tasks.

Construction - Wind Turbine

1002 The construction will include all materials, labor and permitting required to deliver a "turn key" wind turbine project to GSA.

Service Roadway

1003 A service road way will need to be constructed allowing access to the site. The road will be required to accomodate light, medium and heavy duty vehicles associated with construction of a 1.0 MW wind turbine.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(a) The Contractor shall be responsible for the professional quality, technical accuracy, and the coordination of all designs, drawings, specifications, and other services furnished by the Contractor under this contract. The Contractor shall, without additional compensation, correct or revise any errors or deficiencies in its designs, drawings, specifications, and other services.

(b) Neither the Government's review, approval or acceptance of, nor payment for, the services required under this contract shall be construed to operate as a waiver of any rights under this contract or of any cause of action arising out of the performance of this contract, and the Contractor shall be and remain liable to the Government in accordance with applicable law for all damages to the Government caused by the Contractor's negligent performance of any of the services furnished under this contract.

(c) The rights and remedies of the Government provided for under this contract are in addition to any other rights and remedies provided by law.

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of section 1605 of the American Recovery and Reinvestment Act of 2009 (Pub. L.

00700. 106 52.204-11 AMERICAN RECOVERY AND REINVESTMENT ACT REPORTING REQUIREMENTS (MAR 2009)

(a) Definitions. As used in this clause-- "Contract" as defined in FAR 2.101, means a mutually binding legal relationship obligating the seller to furnish the supplies or services (including construction) and the buyer to pay for them.
