PART 1 – PROJECT OVERVIEW
1. Notices
1.1. Proposal Due Date
Proposals shall be due on June 5, 2010 at 3:00 pm Mountain Time. Full details on proposal submission requirements are located in attachment "Proposal Submission".
1.2. Additional RFP Copies
Additional copies of this RFP are not available through GSA. The Offeror is expected to reproduce all copies necessary to satisfy coordination needs and proposal development. Dissemination of sensitive but unclassified paper and electronic building information shall be made on a "need to know" basis in accordance with GSA Order PBS P 3490.1A.
1.3. References
Government issuances (handbooks, guidelines, regulations, etc.) are referenced in Part 2 Statement of Work, Paragraph 2.2 Performance Objectives, Subparagraph 2.2.1.2 Document List.
1.4. Schedules
All references to time periods in this RFP shall be considered calendar days/weeks unless otherwise specified. The schedule milestones are outlined in the Statement of Work, Paragraph 2.1 Project Milestones Schedule.
2. Introduction
2.1. Organization
This RFP is composed of three parts. One includes the Project Overview, Statement of Work, and Program of Requirements. Two contains proposal submissions instructions.
2.2. Involved Parties
This RFP is issued by the Public Buildings Service of the United States General Services Administration (GSA), Rocky Mountain Region, Denver, Colorado, hereinafter referred to as the "Government”, to obtain the services of a Design Builder (DB) (also referred to as Offeror or Contractor) who shall be singularly responsible to satisfy the terms of the resulting contract. (Refer to Project Overview, Paragraph 2.10. Roles and Responsibilities)
2.3. Services to be Provided
The DB shall provide professional, technical, administrative, and clerical personnel as needed to perform all required services including, but not limited to, those described in this Request for Proposal. The services described or specified shall not be deemed to constitute a comprehensive specification having the effect of excluding services not specifically mentioned.
2.4. Project History and Status
The project is the design, construction and interconnection of (at a minimum) a 1MW Wind Turbine at the Land Port of Entry Border Station located at Highway 29 just S of Canada/US boarder Pembina, ND.
The Pembina Border Patrol Station was first established shortly after 1924 and operated under the Officer in Charge of the port of entry until 1926. In 1926, it was designated as its own sector headquarters until August 1939 when the sector headquarters was moved to Grand Forks, ND. There are approximately 102 miles of land border that separates this station from the Province of Manitoba.
2.5. Contract Scope
The design-build scope of work includes all labor and materials required to provide architectural, engineering, construction, and other related services necessary to design and construct a wind turbine at the Land Port of Entry Border Station in Pembina, North Dakota compliant with applicable codes. Related services include, but are not limited to, permitting, testing, and inspecting during construction.
2.6. Program Requirements
Technical requirements are presented in this Volume of this RFP. Criteria/directions within these references shall be considered when developing project proposals.
The Design Stage services and Construction Stage work under this Statement of Work shall comply with GSA Program of Requirements documentation provided in Statement of Work. The Program of Requirements is provided as a general description of the project to begin initial design. The requirements set forth in the Program of Requirements apply to all stages and phases of the project as described in the Statement of Work.
2.6.1. Program Goals
The GSA Rocky Mountain Region wishes to conform to the directives of the Energy Policy Act 2005, as amended by and broadened by the Energy Independence and Security Act 2007 which amongst other goals instructs all federal agencies to consume 55% less fossil fueled energy by 2015 and 100 % less fossil fuel by 2030.
2.6.2. Code Compliance
Chapter 1 of PBS-P100 states the appropriate codes and standards as well as the GSA policy of compliance concerning local codes, which governs the design of this project. However, instead of the National Building Code this project shall follow the requirements of the latest edition of the Uniform Building Code (UBC), which is the basic building code for GSA’s Rocky Mountain Region.
2.7. Price Range
The primary goal of this RFP is to provide the maximum accommodation elements of the RFP Program Requirements that can be obtained within the estimated price range. The estimated range for the design and construction cost is $1,500,000 - $2,500,000.
2.8. Anticipated Award Period
The Government anticipates award of the design build contract on or about July 1, 2010. The Government does not guarantee award within this period nor shall the Government be liable for any costs should award occur before or after this period.
2.9. Completion Date
The Notice to Proceed is anticipated to be July 23, 2010. Installation completion is desired by December 31, 2001, but no later than July 1, 2011. The Contractor shall identify a guaranteed delivery date within this timeframe. The guaranteed delivery date shall include a 30-day period for complete inspection and testing of all systems and improvements, which are to be paid for and conducted by the DB, including the correction of documented punch list items, and schedule contingencies.
2.9.1. Final Inspection
A final inspection of this project will be conducted and substantial completion will be established as of that date. Within ten (10) business days after inspection, the Government shall issue a written declaration specifically stating those unfinished items impacting occupancy that are required to be completed. The Contractor shall be expected, to complete the remaining punch list items within 60 calendar days from substantial completion.
2.10. Roles and Responsibilities
2.10.1. Design/Build Team Responsibilities
The Contractor shall provide experts in disciplines listed in PBS-P100, Facilities Standards for the Public Buildings Service, and as otherwise required, with credentials as indicated, as they apply to this project. The Contractor shall provide sufficient staff of project managers, architects, design engineers, field engineers, superintendents, inspection and testing engineers, scheduling specialists, cost engineers, clerical and accounting personnel to perform the required work.
During the performance of the services required under this contract, the Contractor shall obtain GSA written consent before making any substitution for subcontractors and outside associates or consultants specifically identified and agreed to during negotiations.
2.10.2. Government Responsibilities
The Government will provide:
· Review and comment of design submittals, including the Quality Control Plan
· Inspection and Test Witness to verify attainment of performance requirements
· Progress payments for design / construction shall be agreed upon after approval of the progress payment schedule.
· Maintenance, Services, and Utilities after project completion
2.10.2.1 General
· Site visits shall be coordinated with GSA project manager and GSA property manager.
· Since the property will be occupied and operational during the project, the contractor shall be a "team player" and work in coordination and cooperation with GSA and their tenants.
2.10.2.1.1 Government Provided Documentation

2.11. Contract Type
The contract will be a firm-fixed-price contract. The contract will be awarded for the design, construction and interconnection of the wind turbine.
2.12. Procurement Approach
This project is to be accomplished using the Design Build (DB) delivery method. All required work is included in a single fast-track design and construction effort. After award of the DB contract, the Contractor shall continue the development of the approved concept design and prepare construction documentation. The Contractor shall serve as the A-E of record and construct the project.
2.13. Government Construction Management
The Government will review all ongoing construction activities through government staff; the Contracting Officer (CO), and/or construction phase Contracting Officer’s Representative (COR), as well as through third party construction consultants as deemed necessary.
PART 2 – STATEMENT OF WORK
1. Project Description The GSA Rocky Mountain Region wishes to conform to the directives of the Energy Policy Act 2005, as amended by and broadened by the Energy Independence and Security Act 2007 which amongst other goals instructs all federal agencies to consume 55% less fossil fueled energy by 2015 and 100 % less fossil fuel by 2030. This project is funded through the American Recovery and Reinvestment Act to pursue the federal goal of energy independent federal buildings and will comply with all applicable Minimum Performance Criteria.
Key objectives are to provide secure, clean, on-site power to the Pembina LPOE while maximizing system payback by generating renewable energy. The contractor shall provide a total “turnkey” project including design, procurement, installation and provide O & M reference package including training on-site staff and facilitate turbine “handoff” to ensure ongoing efficient operation of the turbine system identified in the pre-engineering study. This project shall meet all technical requirements of this Statement of Work.

2. General Requirements The contractor shall perform all professional services as necessary to provide GSA with a complete design package including, but not limited by, the requirements outlined in this Statement of Work.
2.1 Project Milestones Schedule

Written acceptance of design development from GSA’s Contracting Officer is the basis for approval to start construction.
2.2 Performance Objectives
2.2.1Standards and Criteria Documents
2.2.1.1 Applicability
All contractual references – documents, codes, and standards – shall be used to measure compliance of the design completion and construction of the wind turbine with contractual expectations. All services shall be conducted in accordance with the documents listed below. The applicable version of each document shall be the version current at the time of award of this contract. In the event of a conflict between the requirements stated in these documents and requirements provided elsewhere in this Statement of Work, the requirements in the Statement of Work shall prevail.
Any conflicts or ambiguities within or among the referenced standards and criteria documents, or any deviations from requirements contained in the standards and criteria documents, shall be reported to GSA’s Contracting Officer in writing, for determination as to applicability.
2.2.1.2 Document List

2.2.1.3 Quality Control Plan (QCP)
Content:
For each performance and installation requirement, the QCP shall identify: item / system to be tested, exact test(s) to be performed, measured parameters, inspection/testing organization, and the stage of construction development when tests are to be performed. Each inspection/test shall be included in the overall construction schedule. The Contractor is not relieved from required performance tests should these not be included in the plan. The QCP is intended to document those inspections / tests necessary to assure the Government that product delivery, quality and performance are as required. It also serves as an inspection coordination tool between the Contractor, the Government, and the CM. Examples of these inspections/tests are concrete slump tests, the lightning control inspection, and the final test / inspection for overall performance compliance of the system. The contractor shall provide field measurements to compare to design calculations to determine turbine efficiency.
Submissions:
The QCP shall be prepared and submitted within (30) calendar days of the kick off meeting and prior to any construction on-site. The QCP may be rejected as incomplete and returned for resubmission if there is any performance, condition or operating test that is not covered therein.
Updating:
During construction, the Contractor shall update the plan if any changes are necessary due to any changes or schedule constraints. The Government's Contracting Officer's Representative (COR) shall be notified immediately of any schedule and/or procedural changes.
2.2.2 Fire Protection/Life Safety
Except as otherwise indicated in referenced programming documents, fire protection and life safety design requirements must comply with PBS-P100. As provided in PBS-P100, NFPA 101 is the primary applicable standard. In cases where NFPA is silent on an issue, and IBC addresses the issue, the IBC requirement will apply. The registered fire protection engineer is required to be a full participant in the Project Delivery Team throughout the Design and Construction Stages of the project. The Contractor’s fire protection engineer shall submit verification in writing that he/she has been involved at all phases of the design stage document preparation.
2.2.3 Accessibility
The Contractor shall design the project to afford full accessibility by disabled persons without having to add separate or special facilities except where specific exclusions from this requirement are provided in applicable standards and criteria documents.
2.3 Cost Management
2.3.1 Cost Estimating
The estimated cost of the work (ECW) as provided in the successful DB contract offeror proposal, including any modifications thereto as a result of final DB contract negotiation, shall serve as the baseline construction budget for the project at the time of award of the DB contract. The Contractor shall provide the following breakdowns of the baseline construction budget before any other DB Contractor work begins:
· A GSA uniformat level 3 breakdown of the baseline construction budget; and
· A preliminary plan for allocation of the construction work among subcontracts and that which is to be self-performed, with a corresponding breakdown of the baseline construction budget. (If the construction work allocation plan and cost breakdown provided in the Contractor’s proposal are still valid, they will serve this purpose.)
Before the start of the Design Concept Phase, the Contractor, the CMa, and GSA must agree on both DB Contractor breakdowns of the baseline construction budget. The CMa will conduct a meeting for this purpose and, after GSA approval, will record the baseline construction budget breakdowns.
If the construction work is to be accomplished in phases, the Contractor’s baseline construction budget breakdowns will be further broken out by phase at the time when the construction phasing plan is developed.
The Contractor shall provide a separate uniformat level 3 cost estimate in support of each preliminary design concept scheme. The Contractor shall update the construction work allocation plan and both baseline construction budget breakdowns at the end of the Design Concept Phase, and again after completion of the Design Development Phase and before beginning work on the construction documents. With each such update, the Contractor shall provide supporting detailed cost estimates.
The Contractor shall be responsible to reconcile any significant differences between the updated baseline construction budget breakdowns and the previously agreed upon breakdowns. For the uniformat level 3 breakdowns, Contractor reconciliation shall include justification of any significant differences between the uniformat level 3 line items. For the construction work allocation breakdowns, DB Contractor reconciliation shall include justification of differences in the construction work allocation plans and/or in the amounts for self-performed work and subcontract work packages. The Contractor shall prepare and submit a cost estimating reconciliation report summarizing the reconciliation process and the justification for cost migration between the budget line items in both budget breakdowns.
2.4 Project Management Responsibilities
2.4.1 Communications Plan
The Contractor shall assist GSA in developing and complying with a project communications plan. The Contractor shall review and comply with GSA’s communication plan. This plan shall be used and maintained throughout the project and modified as necessary to suit each project phase.
The Contractor shall not release any oral, written, or graphic information regarding this project to outside sources without obtaining prior consent from GSA. All requests for information concerning the project shall be referred to GSA’s contracting officer for response.
All presentations to non-GSA entities must first be approved by GSA.
2.4.2 Detailed Project Schedule
GSA’s overall project schedule is provided in Part 2, Statement of Work, Paragraph 2, General Requirements, Subparagraph 2.1 Project Milestones Schedule.
The Contractor shall assist GSA in the development and maintenance of the master project schedule. The master project schedule shall conform to the milestones and durations provided in GSA’s overall schedule.
Before starting any other work, the Contractor shall develop and provide a detailed schedule in Microsoft Project® for completion of all Design Stage activities, tasks, and submissions required herein, leading up to and including the final design development submission(s). After the Contractor receives notice to proceed with the Construction Stage work, the Contractor shall provide and maintain a detailed schedule for completion of all Construction Documents Phase activities, tasks, and submissions required herein. The Contractor schedules shall itemize all required submission dates and review durations, and shall conform to the milestones and durations provided in GSA’s overall schedule, and in the Submission and Review Table provided below in the Administration section. The Contractor shall also provide and maintain the construction schedules as further described elsewhere. After approval by GSA, the Contractor schedules shall be incorporated into the master project schedule.
The Contractor shall provide monthly schedule updates to GSA, showing progress on and completion of all required Design Stage services and Construction Stage work. The Contractor immediately shall notify GSA of any anticipated delay in performance of the work.
2.4.3 Project Progress Meetings
During the Design Stage and the Construction Documents Phase, the Contractor (usually the A-E or the DB) shall attend project progress meetings with GSA. The meetings will keep all parties apprised of the design progress/status and impending activities. These meetings may coincide with meetings required below under the Scope of Services.
After construction begins, the Contractor (usually the CMa or the CMc) shall participate in weekly progress meeting(s) and weekly subcontractor meeting(s). The Contractor shall also attend construction oversight meetings with representatives from GSA on a monthly basis.
2.4.4 Design Quality Assurance
GSA requires that contractor design submissions and construction documents submissions undergo three general types of design review: owner’s review, codes and standards review, and constructability review.
2.4.4.1 Owner’s Review
The owner’s review ensures that established requirements of the project are satisfied, including but not limited to:
· The design is responsive to GSA program goals, objectives and priorities.
· The designed product can be efficiently operated and maintained.
2.4.4.2 Codes and Standards Review
The codes and standards review ensures that the proposed design complies with applicable regulations, codes, and standards referenced in the standards and criteria documents listed above under performance objectives. Such reviews shall not be construed as relieving the Contractor of any code compliance responsibilities.
2.4.4.3 Constructability Review
Constructability of the project as designed is the sole responsibility of the Contractor. To ensure that the design can be constructed within schedule and budget and that the sequencing of construction is planned for optimum efficiency, the Contractor shall ensure that:
· The level of design complexity is consistent with the project schedule and budget constraints.
· Building systems are compatible and viable.
· Existing conditions are shown correctly and adequately.
· Construction duration and phasing plans are reasonable and logical.
2.4.5 Design Review Procedures
The Contractor shall respond in writing to the design review comments within 14 calendar days after receipt of the design review report.
2.4.6 Electronic Project Management System
A secure, web-based, electronic project management (ePM) system will be provided by GSA or another Contractor to accommodate the information needs of all project participants. The ePM system will be implemented at the beginning of the Design Stage and maintained continuously through completion of the Design and Construction Stages. All communications among the major parties involved in the execution of the project are to be captured and recorded in the ePM system. User licenses and training will be provided for all Government and contracted members of the Project Delivery Team who will require access to the ePM system.
The Contractor shall use the ePM system for all necessary communications with other major parties involved in the project. Electronic storage and transmission of information via the ePM system shall be compliant with the provisions of the Document Security section of these General Requirements.
Further details regarding specific ePM involvement will be forthcoming.
2.5 Electronic/Print Media
2.5.1 (CAD) Standards
Starting with the design development submission, all drawing materials provided by the Contractor, including final as-built drawings, shall conform to GSA PBS computer-aided design (CAD) standards. Refer to http://www.gsa.gov/cifm for requirements.
2.5.2 Other Electronic Documents
In addition to any hardcopy submission requirements, all design submissions must also be submitted in electronic format. All electronic media must be in a form readable by standard office automation applications.
2.5.3 Plans and Specifications
Provide 4 hardcopy sets of plans and specifications at each required design development and construction documents submission. The size of prints (for example, full/half-size plans) will be as directed by GSA.
2.6 Personnel Security Requirements
All contract and subcontract employees are required to receive security clearance before work begins. All Contract employees including subcontract employees must were GSA worker passes at all times when performing work in Government controlled facilities. Security for one time visits can be handled by coordinating with GSA on-site staff to provide the contractor with an escort.

The required forms may be downloaded from GSA’s Web site at: www.gsa.gov/forms. The Contractor shall incorporate provisions in all applicable subcontracts as necessary to ensure compliance with all requirements provided in this Contractor Personnel Security Requirements section.
2.7 Document Security
Sensitive but unclassified (SBU) building information will be generated and/or must be disseminated to and stored by various parties in the course of executing this project. SBU building information is information that, if misused, poses a potential security risk to a building, its occupants and visitors, and/or its contents. The Contractor shall comply with the requirements regarding handling, disseminating, and storing SBU building information as described in GSA Order PBS 3490.1.A. (Refer to Volume 2, Attachment 2)-Safeguarding and Dissemination of Sensitive But Unclassified (SBU) Building Information).
2.8 Record Keeping
The Contractor shall prepare correspondence and other documentation and maintain accurate and detailed records of the project’s progress during each phase. The Contractor shall maintain records so as to facilitate document storage and retrieval.
3 Scope of Services The Contractor shall perform all services described in the Statement of Work, in accordance with applicable requirements and provisions set forth in Section 2 General Requirements section.
3.1 Design Stage
3.1.1 Program of Requirements (POR)
At each phase within the Design Stage, the Contractor shall assist GSA in reviewing and updating the program of requirements documentation for additional detail and clarity. The Contractor shall incorporate the results of the POR review in the design narratives accompanying each design submission.
3.1.2 Design Development (DD) Phase
3.1.2.1 Construction Work Sequence Planning
In coordination with GSA and the tenant agencies, develop, maintain and update a construction work sequence plan addressing:
· Construction phasing approach
· Use of any fast tracking or multiple construction document packages to achieve best value for the Government
· Schedules for award of subcontract construction packages, including procurement cycles, submittal approvals, construction delivery, and testing/commissioning
· Possible labor and/or material shortages
· Ordering of long-lead delivery materials
3.1.2.2 DD (50% Design) Submission
Provide a DD submission in accordance with the submission requirements listed in PBS-P100 and the following additional requirements:
Provide a draft construction specification, including Division 1 General Requirements for DB Contractor self-performed work and subcontracts, emphasizing project phasing, subcontractor requirements and preliminary project-specific construction management issues. The construction specification shall be prepared following GSA MASTERFORMAT 2004 Version and shall include Division 1 General Requirements developed to a level corresponding to the level of completion of design. Coordinate Division 1 requirements with GSA.
3.1.2.3 DD Reviews
Reconcile DD review comments, and provide GSA with written responses to all comments.
3.1.3 Construction Documents (CD) Phase
Upon receipt of Notice to Proceed with the Construction Documents Phase work, the Contractor shall perform all services described in the Statement of Work, Paragraph E Scope of Construction work.
3.1.3.1 Baseline Construction Budget Cost Breakdowns
Before beginning work on the construction documents, the Contractor shall provide an updated construction work allocation plan with corresponding budget breakdown, a uniformat level 3 budget breakdown, and supporting cost estimates, all as prescribed under the General Requirements, Cost Management section above. The Contractor shall perform cost estimate reconciliation and prepare and submit a cost estimating reconciliation report. The Contractor shall coordinate with GSA as necessary to reach agreement on both budget breakdowns.
3.1.3.2 Construction Work Sequencing and Coordination Plan
Based on the updated construction work allocation plan, the Contractor shall prepare and submit a detailed breakdown of the planned construction work sequencing, timing, and required coordination among all trades. The Contractor shall provide a corresponding schedule of planned in-progress and final CD submissions for all work packages. The Contractor shall update the construction work sequencing plan and submission schedule periodically throughout the CD phase.
3.1.3.3 In-Progress CD (50% Design) Submissions
For each construction work package, the Contractor shall prepare and submit separate in-progress CD submissions in accordance with PBS-P100 construction document submission requirements as they pertain to the scope of the construction work. The submission shall consist of plans, specifications, cost estimates, and related design narrative, including calculations.
For each construction work package, the Contractor shall provide an in-progress construction specification, including Division 1 General Requirements sections emphasizing project phasing, Contractor requirements, and preliminary project-specific construction management issues. The construction specification shall be prepared following GSA MasterFormat 2004 version and shall include Division 1 General Requirements developed to a level corresponding to the level of completion of design. The Contractor shall coordinate Division 1 requirements with GSA.
3.1.3.3.1 In-Progress CD Reviews
The Contractor shall reconcile review comments and provide GSA with written responses to all comments.
3.1.3.4 Pre-Final CD (90% Design) Submissions
For each construction work package, the Contractor shall prepare and submit separate pre-final CD submissions in accordance with PBS-P100 construction document submission requirements as they pertain to the scope of the construction work. The submission shall consist of plans, specifications, cost estimates, and related design narrative, including calculations.
For each construction work package, the Contractor shall provide a pre-final construction specification, including Division 1 General Requirements sections emphasizing project phasing, Contractor requirements, and project-specific construction management issues. The construction specification shall be prepared following GSA MasterFormat 2004 version and shall include Division 1 General Requirements developed to a level corresponding to the level of completion of design. The Contractor shall coordinate Division 1 requirements with GSA.
3.1.3.4.1 Pre-Final CD Reviews
The Contractor shall reconcile review comments and provide GSA with written responses to all comment.
3.1.3.5 Final CD (100% Design) Submissions
For each construction work package, the Contractor shall prepare and submit separate final CD submissions in accordance with PBS-P100 construction document submission requirements as they pertain to the scope of the construction work. The submission shall consist of plans, specifications, cost estimates, and related design narrative, including calculations.
For each construction work package, the Contractor shall provide a final construction specification, including Division 1 General Requirements sections emphasizing project phasing, Contractor requirements, and project-specific construction management issues. The construction specification shall be prepared following GSA MasterFormat 2004 version and shall include Division 1 General Requirements.
3.2 Construction Stage
The Contractor shall construct the project in accordance with the requirements of this Scope of Work, other portions of the contract, and the construction documents prepared by the Design-Build contractor, reviewed and approved by GSA. The Contractor shall purchase and install all materials, related services, and other items, as well as the means and methods of construction for all aspects of the project.
Upon receipt of Notice to Proceed with the Construction Stage work, the Contractor shall perform all services described in this section as a part of the Construction Stage work.
3.2.1 Construction Start Coordination
3.2.1.1 Pre-Construction Conference
The Contractor shall participate in a pre-construction conference.
3.2.1.2 Construction Progress Photographs
At intervals during construction, the Contractor shall take photographs of the project’s progress from different points of view documenting progress of the work. The Contractor shall take photographs weekly.
3.2.2 Construction Administration
In order to administer the construction of the project properly and efficiently, the Contractor shall provide the following services and deliverables.
· Schedule of Values – The Contractor shall prepare and submit a schedule of values for GSA approval, as required in Division 1 of the contract performance specifications.
· Construction Safety Program – Refer to Division 1 of the contract performance specification for requirements.
· Project Progress Meetings – GSA shall participate with the Contractor in progress meetings. Refer to Division 1 of the DB contract performance specification for requirements.
· Construction Schedules – The Contractor shall provide and maintain construction schedules in accordance with the requirements provided in Division 1 of the contract performance specifications.
· Submittal Processing – The Contractor shall prepare and submit a submittal schedule in accordance with Division 1 of the contract performance specifications. In the submittal schedule, the Contractor shall identify all submittals requiring review by GSA. The Contractor shall transmit copies of all submittals to GSA. All submittals shall be processed using the ePM system in accordance with the procedures developed and approved by GSA. The Contractor shall expedite the processing of submittals to minimize approval times. The Contractor shall ensure that all subcontractors understand, agree to, and conform with their respective roles, responsibilities, and timeliness requirements for submittal processing. The Contractor shall promptly correct and resubmit any submittals returned unapproved, allowing sufficient time for re-review in order to maintain the project schedule. Upon receipt of the submittal approvals, the Contractor shall coordinate as necessary with all involved subcontractors.
· Inspections and Testing – The Contractor shall develop an overall field inspections and testing plan. The Contractor shall conduct inspections and tests as required by the construction specifications.
· The Contractor shall conduct construction safety (OSHA) inspections as required.
· Clarifications / Requests for Information / Change Orders – Using ePM, and in accordance with procedures developed and approved by GSA, the Contractor shall promptly submit to GSA a written request for information (RFI) to request clarification of any owner-related issues, apparent conflicts, ambiguities, or omissions in the DB contract requirements. The Contractor shall ensure that all subcontractors understand, agree to, and conform with their respective roles, responsibilities, and timeliness requirements for RFI processing.
· Each RFI shall include a specific description of the issue requiring clarification, citing the specific related contract documents requiring clarification. RFIs shall only be submitted after performing due diligence to confirm that the contract requirements in question are in fact unclear or otherwise inadequate.
· Upon receipt of the response to each RFI submitted, the Contractor shall coordinate the response with all involved subcontractors to ensure understanding and appropriate action.
· Contractor As-Built Drawings and Specifications – The Contractor shall update the CAD drawings (as-built drawings) and electronic specifications at least monthly in order to document the changes that occur during construction.
Liquidated Damages (see FAR 52.211-12)
· If the Contractor fails to complete the work within the time specified in the contract, or any extension, the Contractor shall pay to the Government as liquidated damages the sum of $300.00 for the first day and $200.00 for each additional calendar day of delay.
· If the Government terminates the Contractor’s right to proceed, the resulting damage will consist of liquidated damages until such reasonable time as may be required for final completion of the work together with any increased costs occasioned the Government in completing the work.
· If the Government does not terminate the Contractor’s right to proceed, the resulting damage will consist of liquidated damages until the work is complete or accepted.
3.2.2.1 Payment Requests
The Contractor shall update the construction schedules monthly prior to each payment request and provide an advance copy of the construction progress report to the CMa. The Contractor shall provide documentation evidencing the cost of work performed to be included in the payment request. Allowability of costs shall be in accordance with FAR 31.105 and 31.2.
Before submitting each payment request, the Contractor shall meet with the CMa and GSA to review the advance copy of the construction progress report. The Contractor shall ensure that the CMa and GSA are in agreement as to the progress of the construction work and the value of the work completed.
Based upon agreed value of work completed, the Contractor shall submit monthly payment requests to GSA.
3.2.3 Turnover Process
3.2.3.1 Substantial Completion
Prior to substantial completion, the Contractor shall assist GSA in conducting a pre-final walk-through with tenant agencies.
3.2.3.2 Punch-List
After GSA certification that the work or each designated portion thereof is substantially complete, the Contractor shall assist GSA in conducting a final inspection and preparing a punch-list documenting remaining work.
The Contractor shall participate with GSA in conducting follow-up inspections to administer resolution of punch-list items.
3.2.3.3 Operation and Maintenance (O&M) Manuals Submittals
The Contractor shall prepare and submit complete and properly organized O&M manuals as required in accordance with Division 1 of the contract performance specification and the final construction specifications.
3.2.3.4 Warranties, Guarantees and Certificates
The Contractor shall prepare and submit warranties, guarantees, and certificates, ensuring that GSA rights and responsibilities are clearly defined.
3.2.3.5 Preparation for Occupancy
The Contractor shall coordinate the planning and scheduling of property management training with GSA property management staff, allowing sufficient lead time for GSA to prepare for the training and to ensure that the appropriate personnel will be available.
The Contractor shall conduct training of operating staff in optimal operation and maintenance of the delivered facility as required in accordance with Division 1 of the DB contract performance specification and the final construction specifications. The training shall be conducted on-site in the completed and fully operational facility using the actual equipment in place.
The Contractor shall include any available and suitable video material from manufacturers and suppliers in the training sessions.
3.3 Project Closeout Stage
3.3.1 Final Record Documents
The Contractor shall update the CAD construction drawings (as-built drawings) and electronic specifications (as-built specifications) to document changes that occur, or unforeseen conditions impacting delivered work during construction. The Contractor shall produce final record documents, based on as-built drawings and specifications, to reflect all contract modifications and noted field conditions.
Preparation for Final Inspection and Tests.
The following steps shall be taken to assure the project is in a condition to receive inspections and tests.
Record Drawings.
A final set of as-built drawings shall also be provided to the Government. These submissions shall be delivered to the Government based on the schedule laid out in attachment 1
Record Drawings:
The Contractor shall maintain on site the working record drawings of all changes/deviations from the original design. Notations on record drawings shall be made in erasable red pencil or other color to correspond to different changes or categories of work. Marked-up drawings shall always be maintained at the Contractor’s on site construction office, available for Government and/or CM to review. Record drawings shall note related change order designations on impacted work. When shop drawings indicate significant variations over design drawings, shop drawings may be incorporated as part of Record Drawings. Review of record drawings may be required before monthly payments can be processed.
As-Built Drawings and Specifications:
The Contractor shall provide "As-Built Drawings" and documents based upon actual site installation. Should the Government determine that variations exist between finished construction and the As-Built Drawings; the Contractor shall correct drawings to the satisfaction of the Government.
The contractor shall submit two (2) hard copies and two (2) CDS containing the “as-built” drawings and specifications as CAD and pdf files. The As-Built drawings in CAD shall comply with GSA National CAD Deliverables Policy.
Warranties and Guarantees:
Submit specific warranties and guarantees, final certifications and similar documents upon substantial completion and prior to final payment.
