SECTION B - SUPPLIES OR SERVICES AND PRICES - CONTINUED
B.1. DESCRIPTION OF SERVICES
General Services Administration (GSA), Public Building Service’s Mission is to provide superior workplaces for federal customer agencies at good economies to the American taxpayer. GSA's Southeast Sunbelt Region, Region 4 located in Atlanta, GA, provides value-added products and services to federal agency clients located in Alabama, Florida, Georgia, Kentucky, Mississippi, North Carolina, South Carolina and Tennessee.
The landlord for the civilian federal government, Public Buildings Service (PBS) acquires space on behalf of the federal government through new construction and leasing, and acts as a caretaker for federal properties across the country. PBS owns or leases assets, maintains an inventory of workspace for federal employees, and preserves historic properties.
A wide variety of factors can result in the need for tenant agency relocations in this space.
These office relocations of GSA and its tenant agencies will occur under the direction of GSA.
The requirement for move services can be precipitated by timetables on projected purchases of existing buildings or sites for new buildings, completion of construction; consolidations of agencies, agency expansion, emergency relocations, funding and construction schedules for major repairs and renovations to buildings, and/or lease expirations.
The contractor shall provide the management, supervision, manpower, equipment and supplies necessary to provide moving and related services as described herein.
Work under this contract is expected to commence on or after _______________________, 2016.
Hazardous materials or hazardous substances are not authorized to be moved under this contract.
NOTE: To be considered in the evaluation of this RFP, an offeror shall propose an all-inclusive per square foot rate in the schedule of services. Prices must include all cost and expenses such as expenses for travel time, parking, overhead, overtime, General and Administrative (G&A) and profit. Thus, no separate allowance will be applied when services are required.
B.2. TYPE OF CONTRACT
This is an indefinite quantity, indefinite delivery contract for Moving Services. A GSA Form 300, Order for Supplies or Services will be used by GSA ordering officials to initiate Delivery Orders against this contract.
https://easi.pbs.gsa.gov/suite/tempo/records/type/sol/item/ikBinLDeHJegYbgj8oIiQ_cSejdwaN62dR0geScIkdOqGzsGpIh0XRgPQ/view/summary
The Government intends to award eight (8) (one per state) Indefinite Delivery, Indefinite Quantity (IDIQ) contracts. Eight (8) contracts will be awarded for the following states: 1.)
Tennessee, 2.) Kentucky, 3.) North Carolina, 4.) South Carolina, 5.) Alabama, 6.) Mississippi 7.)
Georgia and, 8.) Florida.
Each contract awarded establishes a base year and four option years. The maximum dollar amounts for the base year and each option year for each state within the region should not be considered in any way a projection of the actual dollar value of the orders that might be placed under this contract.
For the states of Alabama, Kentucky, Mississippi, North Carolina, South Carolina, and Tennessee, the total estimated dollar value is $2,750,000.00; $550,000.00 per option year.
For the states of Georgia and Florida, the total estimated dollar value is $15,000,000.00;
$3,000,000.00 per option year.
Each contract will guarantee a fixed minimum dollar amount of $1,000.00. The Government is not obligated to place orders beyond this guaranteed dollar amount.
Orders of $2,500.00 or less may be processed using either direct pay procedures or the Government wide commercial purchase card, which is the preferred method to purchase and to pay for micro-purchases. No work shall be performed under this contract prior to issuance of GSA Form 300 to the Contractor.
B.3. PRICING OF OPTIONS
Offerors shall price the option requirements for the four (4) additional one year periods by assuming the minimum hourly wages and fringe benefits established by the Administrator, Wage and Hour Division, U.S. Department of Labor, for the initial 12 month period will apply to the four (4) additional 12 month option periods.
In the event the option(s) are exercised by the government the contract price(s) will be adjusted upward or downward at the time the option is exercised in accordance with the Federal Acquisition Regulation (FAR) clause entitled: 52.222-45, Fair Labor Standards Act and Service Contract Act-Price Adjustment (Multiyear and Options Contracts).
B.4. FAR 52.222-43 -- Fair Labor Standards Act and Service Contract Labor Standards -- Price Adjustment (Multiple Year and Option Contracts) (May 2014) https://easi.pbs.gsa.gov/suite/tempo/records/type/sol/item/ikBinLDeHJegYbgj8oIiQ_cSejdwaN62dR0geScIkdOqGzsGpIh0XRgPQ/view/summary
(a) This clause applies to both contracts subject to area prevailing wage determinations and contracts subject to collective bargaining agreements.
(b) The Contractor warrants that the prices in this contract do not include any allowance for any contingency to cover increased costs for which adjustment is provided under this clause.
(c) The wage determination, issued under the Service Contract Labor Standards statute, (41 U.S.C. chapter 67), by the Administrator, Wage and Hour Division, Employment Standards Administration, U.S. Department of Labor, current on the anniversary date of a multiple year contract or the beginning of each renewal option period, shall apply to this contract. If no such determination has been made applicable to this contract, then the Federal minimum wage as established by section 6(a)(1) of the Fair Labor Standards Act of 1938, as amended, (29 U.S.C.
206) current on the anniversary date of a multiple year contract or the beginning of each renewal option period, shall apply to this contract.
(d) The contract price, contract unit price labor rates, or fixed hourly labor rates will be adjusted to reflect the Contractor’s actual increase or decrease in applicable wages and fringe benefits to the extent that the increase is made to comply with or the decrease is voluntarily made by the Contractor as a result of:
(1) The Department of Labor wage determination applicable on the anniversary date of the multiple year contract, or at the beginning of the renewal option period. For example, the prior year wage determination required a minimum wage rate of $4.00 per hour. The Contractor chose to pay $4.10. The new wage determination increases the minimum rate to $4.50 per hour. Even if the Contractor voluntarily increases the rate to $4.75 per hour, the allowable price adjustment is $.40 per hour;
(2) An increased or decreased wage determination otherwise applied to the contract by operation of law; or
(3) An amendment to the Fair Labor Standards Act of 1938 that is enacted after award of this contract, affects the minimum wage, and becomes applicable to this contract under law.
(e) Any adjustment will be limited to increases or decreases in wages and fringe benefits as described in paragraph (d) of this clause, and the accompanying increases or decreases in social security and unemployment taxes and workers’ compensation insurance, but shall not otherwise include any amount for general and administrative costs, overhead, or profit.
(f) The Contractor shall notify the Contracting Officer of any increase claimed under this clause within 30 days after receiving a new wage determination unless this notification period is extended in writing by the Contracting Officer. The Contractor shall promptly notify the Contracting Officer of any decrease under this clause, but nothing in the clause shall preclude the Government from asserting a claim within the period permitted by law. The notice shall contain a statement of the amount claimed and the change in fixed hourly rates (if this is a time-https://easi.pbs.gsa.gov/suite/tempo/records/type/sol/item/ikBinLDeHJegYbgj8oIiQ_cSejdwaN62dR0geScIkdOqGzsGpIh0XRgPQ/view/summary and-materials or labor-hour contract), and any relevant supporting data, including payroll records, that the Contracting Officer may reasonably require. Upon agreement of the parties, the contract price, contract unit price labor rates, or fixed hourly rates shall be modified in writing.
