Bidding Procedures

CMAR shall include:

• A list of proposed trade packages;

• A list of trade subcontractors that will be invited to bid on each such package; and

These allowances are to be listed as separate line items on the Schedule of Values. Any unused portions of the allowances shall be reallocated to a line item in the Schedule of Values noted as "buy out savings".

Funds allocated to "buy out savings" shall remain within the GMP, but are for the sole use of Metro. Any "buy out savings" remaining after Final Completion shall be credited to Metro via deductive change order amending the final

GMP.

Construction Contingencies

A construction contingency mutually acceptable to Metro and the CMAR shall be included in the GMP as provided for in the Contract article 2.6.3. The CMAR shall inform Metro of their intent to use Contingency Funds prior to reallocating those funds to a particular expense. Contingency usage shall be tracked in a log submitted with each application for payment. Contingency usage shall include a description of the expense and any related backup documentation.

The CMAR shall provide assistance and input, if and as requested by the Metro, for all such permits through the review process.

The CMAR shall update Metro with the status of each permit that is under the CMAR's responsibility. The CMAR shall engage permit expediters as the CMAR deems necessary or appropriate considering the project's schedule.

The CMAR shall work with the A/E team and the expediter to ensure the necessary building permits (including, but not limited to building permit, foundation to grade permits, superstructure permits, utility permits, public space permits, and any other permits required for the execution of the Work) are received in a timely manner.

Self‐Performed Work

The CMAR and its affiliates may not carry out trade work with its own forces without Metro's written permission, which permission may be withheld or conditioned by Metro in its sole and absolute judgment.

Construction Phase

Based on the approved plans and specifications, the CMAR shall construct the project. During the construction phase, the CMAR shall be required to cause the work to be completed in a manner consistent with the design documents approved by the Department and/or by the authorities having jurisdiction and shall provide all labor, materials, insurance, bonds and equipment necessary to fully complete the Project in accordance with the drawings, specifications, schedule and budget that are issued for the project. The CMAR shall be responsible for obtaining and payment of trade permits necessary to complete the work.
