About this file

This is a Small Business Enterprise (SBE) Regular Dealer/Distributor Affirmation Form used by a state or local procurement agency to evaluate SBE participation in contract opportunities. The form establishes eligibility criteria for SBEs to receive credit for supplying materials, supplies, articles, or equipment under a contract. Metro, the administering agency, conducts a preliminary counting determination to assess whether each SBE qualifies for either 60 percent credit as a regular dealer or 40 percent credit as a distributor based on demonstrated capacity and intent to perform. The form requires SBEs to provide documentation of their business type, inventory maintenance capabilities, and sourcing methods through responses to a series of qualification questions. A bidder's quote, commitment, contract, or purchase order showing the materials the SBE will supply must be attached to the form.

Credit eligibility is determined based on the SBE's sourcing model and operational structure. Regular dealers who maintain on-hand inventory at their establishment and sell items of general character to the public in the ordinary course of business receive 60 percent credit. Distributors that engage in the regular sale or lease of specified items and assume responsibility for materials from the point of origin receive 40 percent credit, including for drop-shipped items. If an SBE provides less than 51 percent of items from inventory, only the reasonable cost of fees, commissions, and transportation charges can be counted, not the materials cost. The SBE owner and the bidder's authorized representative must affirm the accuracy of all information provided and acknowledge their respective responsibilities for verifying SBE participation counting and ensuring compliance with performance requirements.

SBE FORM – 6

SBE Regular Dealer/Distributor

Affirmation Form

Metro will make a preliminary counting determination for each SBE listed as a regular dealer or distributor to assess its eligibility for 60 or 40 percent credit, respectively, of the cost of materials and supplies based on its demonstrated capacity and intent to perform as a regular dealer or distributor, as defined in the Instructions to Bidders/Proposers of the solicitation and in the Contract Compliance Manual, under the Contract at issue. A SBE regular dealer is a firm that owns (or leases) and-operates, a store, warehouse, or other establishment in which the materials, supplies, articles, or equipment of the general character described by the specifications and required under the contract are bought, kept in sufficient quantities, and regularly sold or leased to the public in the usual course of business. Items kept and regularly sold by the SBE are of the ‘‘general character’’ when they share the same material characteristics and application as the items specified by the contract. A SBE distributor is an established business that engages in the regular sale or lease of the items specified by the contract. A DBE distributor assumes responsibility for the items it purchases once they leave the point of origin (e.g., a manufacturer’s facility), making it liable for any loss or damage not covered by the carrier’s insurance. A SBE distributor may receive 40% credit for drop-shipped items. The amount of SBE credit will be made on a contract-by-contract basis. A copy of the bidder's quote, commitment, contract, or purchase order showing the materials the SBE regular dealer or distributor is supplying must be attached to this form.
