a. Successful offeror will be responsible.

Q: What is the limit of financial responsibility for Designer/Space Planner errors or cost of quality issues due to customer confusion, customer concessions, etc.?

a. Is the Designer/Space Planner’s responsibility limited to the value of the Design fee’s paid?

Q: The definition of a “major revision” states that anything that affects, changes position or location adds, subtracts, or substitutes product of over 25% of the product components and less than 50% of the product components.” If the change is greater than 50%, is this to be considered a “restart” of the project?

F3. 52.211-11 Liquidated Damages - Supplies, Services, or Research and Development (SEP 2000) If the Contractor fails to deliver the supplies or perform the services within the time specified in this contract, the Contractor shall, in place of actual damages, pay to the Government liquidated damages in the amount of $500.00 per day. However, the Government reserves the right to charge for actual damages in lieu of liquidated damages. UNICOR will issue purchase orders with pricing according to the assigned contract terms. If contractor fails to provide installation services in a timely manner, the contractor will be charged liquidated damages in accordance with paragraph above. Liquidated damages will begin to accrue at the moment of a delay caused by the offeror. The amounts will be tracked by project manager and contract specialist and submitted to offeror prior to invoicing. Offeror(s) are required to invoice minus the liquidated damage charges. Failure to submit a proper invoice with liquidated damages will result in an invoice being short paid or rejection and return of the invoice to the offeror(s) with nonpayment.

Q: Please confirm Alaska, Puerto Rico, and Hawaii are considered OCONUS. Alaska and Hawaii are currently listed under the western region in the solicitation.

A: Puerto Rico will remain in the Southeast region, categorized under “All Other Regions”.

Alaska and Hawaii shall be considered OCONUS.

Q: The solicitation has a paragraph about the facilities management CAD system (FMCS) that OEI/KI developed and currently utilizes.

This FMCS AutoCAD-based program allows for all the set up and data management for design and quoting services. It is currently utilized to support KI, OEI’s state correctional industry programs and UNICOR OFG for projects drawing, quoting, installation manuals, etc.

This software product was developed by us over 25 years ago and is owned and managed by

KI/OEI.

a. Does this paragraph imply it is available from UNICOR to other possible bidders?

b. Please clarify this to potential bidders that they will need to source and manage their own CAD and specifying tools.

A: Page 12 of FN1511-21 FACILITIES MANAGEMENT CAD SYSTEM (FMCS) is amended from:

The Facilities Management CAD System (FMCS) software was developed and is supported by Engineering to assist in developing modular office systems layouts. The software is designed to work as an overlay to a designer’s CAD software incorporating the standard AutoCad commands as well as specialized ones specific to systems and freestanding furniture. The AutoCad platform was chosen because of its wide acceptance as an industry standard for Architectural and Facilities Planning. AutoCad's other advantage is that it easily customized, and can be adapted to handle unique possibilities. The AutoCad and FMCS is PC based.

Page 12 of FN1511-21 FACILITIES MANAGEMENT CAD SYSTEM (FMCS) is amended to:

Each offeror is responsible to have their own CAD system and specifying tools.

Q: Do the following items need to be included as part of the Statement of Work?

a. Does the successful Bidder need to source iPads to access the OFG app for all staff?

b. Does the successful Bidder need to provide a scope of work in a format required for the installation process (i.e. for OFG installation contract holders to bid from)?

A: a. Yes, the successful offeror shall source iPads.

b. The successful offeror shall provide the statement of work (SOW) once the design and space planning services are finalized and a final bill of material has been sent to the customer. The format of the SOW shall be agreed upon at a later time.

Q: The solicitation states that site visits and initial plan packets for 5 workstations or less will be free of charge. OFG doesn’t need to offer free of charge design services and have resources consumed doing site visits for small projects nationwide. This is very administrative and operationally expensive not only to UNICOR; but the successful bidder.

It states the site visit and initials plan packet are free of charge but not revisions, final drawings, bill materials, etc. How will those services be charged for?

Please clarify if UNICOR will revise or remove the free 5 workstation or less requirement. As an option - can this be revised to include just DC area DOJ/BOP projects?

A: The service of providing design and space planning services at no additional cost to UNICOR or its customers for 5 workstations or fewer shall remain.
