Performance Work Statement - IT Support Services

1. Introduction: The Federal Election Commission is an independent regulatory agency charged with administering and enforcing the Federal Election Campaign Act of 1971, as amended. The duties of the FEC are to disclose campaign finance information, to enforce the provisions of the law such as the limits and prohibitions on contributions, and to oversee the public funding of Presidential elections. The Commission enforces limitations and prohibitions on contributions and expenditures, investigates and assesses fines for violations, audits a limited number of campaigns and organizations for compliance, and administers the presidential campaign fund, which provides public funds to candidates for president.

The FEC also publishes reports filed by Senate, House of Representatives and Presidential campaigns and other political committees that disclose how much each committee has raised and spent and includes each donor's address, occupation , employer and job title. This database dates back to 1980. Private organizations are prohibited from using this data to solicit new individual donors, but Political Action Committees (PACs) may be solicited. The FEC is also charged to keep these exhaustive campaign finance resources available to the public. The FEC also offers a program of public education, directed primarily to explaining the law to the candidates, campaigns and political committees which it oversees. The FEC is responsible for ensuring the information it holds is readily available to the public.

The Commission investigates apparent violations and may assess fines and other civil penalties.

A limited number of campaigns and organizations may be audited for compliance. The FEC administers the Presidential Campaign Fund, which provides public funds to eligible Presidential candidates.

The six Commissioners, no more than three of whom may represent the same political party, are appointed by the President and confirmed by the Senate. The Commissioners serve full-time and are responsible for administering and enforcing the Federal Election Campaign Act. They generally meet twice every two weeks, once in closed session to discuss matters that, by law, must remain confidential, and once in a meeting open to the public. At these meetings, they formulate policy and vote on significant legal and administrative matters.

2. Purpose: To solicit proposals for services to augment FEC staff capacity with mastery of the unique Federal Election Regulations, the Disclosure Database and the major and minor Disclosure Systems and Programs. These include Data Capture, Information Management, the FEC Website, FEC Election Map, eReview, the Disclosure Systems such as Administrative Fines and others, Law Manager interfaces to eReview and the Searchable Applications, Alternative Dispute Resolution Office (ADRO), Office of Administrative Review (OAR) and ad hoc projects which are sometimes highly time sensitive. In addition to the above institutional and system knowledge, the contractor selected shall provide Project Management and software development across multiple technologies to the Information Technology Division across the full

software development lifecycle to perform enhancements, maintenance, bug fixes and new development on these mission critical systems and others as needed. These systems are used by hundreds of users including about two thousand Senate, House and Presidential candidates, thousands of political committees, watchdog groups, researchers, reporters and others.

It is vital that support staff is able to grasp the business rules and technologies as quickly as possible and to be able to maintain all components quickly and efficiently, often with very short turn-around times.

These systems gather data from internal and external sources, process it in numerous ways, load it into other systems for further processing and analysis and correlate it to produce various reports and correspondence used to enforce the laws and regulations the agency oversees. The systems are in various phases of the development lifecycle – some modules are in production, some in development and some are in design. They are in constant flux as Program rules, Commissioner requests and regulations evolve and the underlying suite of technologies sunset or are improved themselves.

All systems activities must be in alignment with the FEC’s enterprise architecture regarding security standards, project goals, strategies and client expectations and the strategies and goals of the FEC CIO.

3. Scope: The contractor should ensure, to the maximum extent possible, that personnel assigned possess multifunctioning capabilities across the following skills:

This resource will also have application and web server configuration and management responsibilities.

3.1.2.2 J2EE, J2EE, EJB, GWT, JDeveloper, Struts, Tiles, JavaScript, CSS, VC++, SQL, PL/SQL. Provides support for all of the Disclosure Systems, Data Capture, Searchable Applications, eReview, ADRO, OAR and Info Management. These resources will also perform application and web server configuration and management

3.1.2.3 Description of task – Government employee will work with contractor Program Manager to ensure all prioritized work is flowing smoothly through the queue. Shall have experience developing fully functional Java applications accessing an Oracle database. Communicates with end users and technical staff to gather and clarify requirements. Suggests process, data and application improvements.

Develops and tests and then works with users during User Acceptance Testing.

3.1.2.4 It is desirable that this resource is equally capable in .Net.

3.1.3 Mid Level Java Developer

3.1.3.1 Supports all of the Senior Java developer systems, cleaning up outstanding outstanding defects and providing extensive analysis and planning of conversion of .Net systems to Java over a period of several years. Of particular interest are the SERS (Searchable Applications). See Searchable Rulemaking system. This collection of applications has high visibility as they provide critical information about FEC rulemaking actions and decisions to the public.

3.1.3.2 These applications require a significant amount of attention or monitoring.

The first task will be to master the business rules that drive the systems and then begin to support enhancements and bug fixes and ad hoc tasks. Second would be to perform the required analysis to begin to architect the porting of the system from .Net and Visual C++ to Java. 1. A. 3.1.5 Senior Analyst/Senior Database Developer/Java Programmer/Crystal Reports Developer (Key Personnel Position)

3.1.5.1 QUALIFICATIONS: Bachelor’s degree in a related field, minimum of 5 years experience in developing similar systems.

3.1.5.2 Required to maintain, upgrade, revise, and support FEC business processes, FEC data, Disclosure Applications, eReview Reports, Law Manager Reports, Crystal Reports, Business objects Administration, PL SQL, FEC Website applications Provide analysis and support for data related requests, Searchable applications and general IT

3.1.6 Program Manager/Project Manager/Analyst (Key Personnel Position)

3.1.6.1 QUALIFICATIONS: Bachelor’s Degree in related field, minimum 10 years experience in project management of similar size projects.

3.1.6.2 In addition to excellent organization, planning, risk management, master communications, the preferred Project Management approach is one based however loosely on Agile methodology. It is vital that this role be very technical in some area.

Oracle, Informatica, PL/SQL or other technologies are very desirable.

3.1.6.3 Description of task –It is estimated that the Program Management function would consume about 75% of the PM’s time and that other technical activities would use about 25% of the resource’s time. Duties are Program Management, Project Management methodologies, Business Analysis, Requirements Analysis, Relational Databases, Database programming - SQL, PL/SQL, Miscellaneous Software Engineering tools, TOAD, Microsoft Project.

3.1.6.4 Teams with government Program Manager and various stakeholders as they assess and prioritize requirements, competing priorities and risk management.

Provides weekly and monthly status reports to government management and other updates as needed. Directs and coordinates technical effort on all supported applications. Performs analysis, coding, testing, documentation support as needed using above described technologies.

3.1.7 Senior Crystal Reports developer

3.1.7.1 Description of task – initial tasking will be the mastery of the Disclosure and eReview applications followed by rewriting a group of legacy reports that are underperforming. The legacy reports are underperforming because they were written long before many data integrity updates were performed and the reports were never brought current so that they would perform faster.

3.1.7.2 In addition to improving this group of reports, this developer will handle frequent requests for new or enhanced Crystal Reports and long waiting defects resolution and be the go to person for agency-wide Crystal Report requirements.

3.1.8 Senior Java Web programmer:

3.1.9 OpenText Enterprise Content Management Administrator.

The ECM Suite system is a multi-server enterprise platform. Core responsibility of the Administrator is in maintaining the ECM Suite content warehouse including production, test, and development environments. Duties include customer support, system configuration, data migration, performance tuning, and security assurance. Additional responsibilities include maintaining system documentation; troubleshooting; and leading technical implementations with database, email, and network administrators.

3.1.10 eReview Project Manager (Key Personnel Position)

3.1.10.1 QUALIFICATIONS: Bachelor’s degree in related field, minimum 5 years experience in managing similar projects.

3.1.10.2 The government anticipates this role being done in addition to development activities. In other words, there is no separate PM role to staff. The government anticipates that a developer or analyst will fulfill the role IN ADDITION to development and analysis. Requires a thorough knowledge of eReview and has technical skills in key technologies such as .Net, PL/SQL or Oracle or all for example.

3.1.11 Business and Requirements Analysis

3.1.11.1 Business and Requirements Analysis are performed by the entire team in conjunction with FEC resources including the FEC Program Manager. 3.1.11.2 PL/SQL: As the data is rather complex and intricately inter-related and there is a great deal of logic in the database, the entire team works coding and tuning

PL/SQL.

3.1.12 Senior Informatica Programmer (Key Personnel Position)

3.1.12.1 QUALIFICATIONS: Bachelor’s degree in related field, minimum 5 years experience with Informatica.

3.1.12.2 Informatica plays a significant role in these systems; therefore, the FEC requires that at least two of the key proposed employees are able to tune and alter the Informatica schema and define new ones as needed.

3.1.13 QA Engineering

3.1.13.1 Quality Assurance is performed by the entire team using Test Driven Development techniques. There is no separate QA role.

3.1.13.2 DBA Oracle master and also competent in MS SQL

3.1.13.2 This task will begin with a study to locate multiple MS SQL databases scattered across multiple Database servers, and lead to a consolidation plan.

3.1.14 DBA Oracle/MS-SQL/MySQL Master

4. Tasks:

4.1 Enhance, update, develop, and maintain the FEC Disclosure applications – Candidates and political committees in Federal elections must meet specific filing and reporting regulations. The Commission's Disclosure database is the repository for campaign finance data and statements of candidacy and committee organization. There is a suite of applications that culls data from the Commission's Disclosure database. These applications provide Commission staff with tools for Administrative Fines, Compliance Tracking, Data Capture and much more. Technical oversight is performed by the IT Applications Team.

4.2 Enhance, update, develop and maintain the E-Review system – This system has five modules.

4.2.1 There are numerous trouble tickets open with varying priorities and new ones are added weekly. The COR (Contracting Officer’s Representative) and contractor will work with the users to ensure that the defects are prioritized appropriately and the contractor will provide start and estimated end dates for the resolution of the tickets.

4.2.2 This activity will be covered in weekly status reports and discussed in weekly status meetings. Technical oversight is performed by the IT Applications Team.

4.3 Work with the FEC team to continue to improve Data integrity – data coming in to the FEC is received in electronic and paper formats. Accurate reporting naturally depends on accurate data, so sensitivity to this in all systems is crucial. Technical oversight is performed by the eFiling and Disclosure Branches.

4.4 Update, complete development and maintain the FEC intranet – The intranet is estimated to be 15 – 20% complete and employees are using it. The outstanding 80% must be developed and published and the entire site studied for usability. Technical oversight is performed by the Purchased Applications / LOB Team.

4.5 Update, generate, maintain documentation for existing systems and for new development.

The team documents their work. The government does not anticipate a Tech Writer on the contract.

4.6 Maintain skill levels – Contractors are responsible for staying abreast of technical components as they evolve.

6. Estimated Period of Performance/Place of Performance:

The period of performance shall consist of a base year and four option years.

Contractor personnel shall be located on-site with the FEC; the current location is 999 E St., NW Washington, DC 20463, or as authorized by the COR.

7. Hours of Operation:

7.1 Work Hours: The FEC core work hours are between 6:30 am through 7:00 pm.

(EST) Contractor personnel are expected to work an 8 hour day, within these hours In coordination with the COR.

7.2 LEGAL PUBLIC HOLIDAYS: The following are designated as legal public holidays:

New Year's Day, Martin Luther King's Birthday, George Washington’s Birthday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veteran Day, Thanksgiving Day, and Christmas Day.

7.3 Continuity of Work:

7.3.1. Excused Absences: When the Federal Election Commission (FEC) grants excused absence to its employees, the Contractor agrees to continue to provide sufficient personnel to perform critical tasks already in operation or scheduled, and shall be guided by the instructions issued by the Contracting Officer or the COR (as applicable). Changes in employee work schedules shall comply with the terms and conditions of the contract.

7.3.2. Furlough/Shutdown: If Government personnel are furloughed, the Contractor shall contact the Contracting Officer or the COR to receive direction. It is the Government's decision as to whether the contract price/cost will be affected as a result of Government shutdown and/or furloughed Government employees. In the event that Government shutdown and/or furloughed Government employee's does impact contract price/cost, a negotiated settlement will be reached as deemed appropriate by the Contracting Officer.

7.3.3. Transition-In: The Contractor shall provide a Transition Plan outlining his plan to staff the contract while observing the incumbent, in preparation to assume full performance. The anticipated duration of the Transition-In period is 60 days.

7.3.4. Transition-Out: During the period between the date a follow-on contract is awarded and the date the contract begins, the incumbent contractor shall permit the successor to observe any operations as deemed necessary by the successor that will enable his personnel to become knowledgeable in and familiar with their assigned areas of responsibility. The successor Contractor shall fully cooperate with the Government and incumbent Contractor so as not to interfere with contract performance.

8. General Provisions:

8.1 CONTRACTING OFFICER’S REPRESENTATIVE (COR): The COR will be appointed at time of award.

8.2 Quality Control Plan: QUALITY CONTROL: Quality Control is the responsibility of the contractor. The contractor is responsible for the delivery of quality services/supplies to the Government (see FAR 52.246-1 Contractor Inspection Requirements).

8.2.1 The Contractor shall develop, implement and maintain an effective Quality Control System which includes a written Quality Control Plan (QCP).

The QCP shall implement standardized procedure/methodology for monitoring and documenting contract performance to ensure all contract requirements are met. The Contractors’ QCP shall contain a systematic approach to monitor operations to ensure acceptable services/products are provided to the Government. The QCP as a minimum shall address continuous process improvement; procedures for scheduling, conducting and documentation of inspection; discrepancy identification and correction; corrective action procedures to include procedures for addressing Government discovered non-conformances; The contractor shall upon request provide to the Government their quality control documentation. The Contractor shall deliver the QCP to the Contracting Officer as Technical sub-factor #3. A copy of any changes made to the QCP shall be delivered to the Contracting Officer within 5

business days of the change. After acceptance of the quality control plan the contractor shall receive the Contracting Officer’s acceptance in writing of any proposed change to their QC system.

8.3 Background check: Contractor personnel are required to submit fingerprints and pass an ENTNAC check.

9. Key Personnel: Key positions are indicated in Paragraph 3.1 Skills paragraph above. The names of the key personnel shall be designated in writing to the contracting officer. Prior to replacing any of the key personnel, the Contractor shall submit resumes/qualification of the replacements, to the Contracting Officer for approval.

10. Government Furnished Equipment (GFE) - The FEC will provide PC’s for all on-site personnel.

NONDISCLOSURE AGREEMENT FOR CONTRACTORS

1. I, , understand and acknowledge that I may be granted access to sensitive, protected, and confidential information related to the Federal Election Commission (FEC), including, but not limited to, information about individuals, including personally identifiable information, protected by the Privacy Act and other federal laws; information pertaining to the investigation, prosecution and conciliation of enforcement matters under the Federal Election Campaign Act, the unauthorized disclosure of which is a misdemeanor;

proprietary or otherwise confidential commercial information owned by other third parties, such as software vendors to the FEC; and information related to the business, personnel and security practices of the FEC. I agree to use such information only in the course of my official duties in connection with the provisions of the below referenced contract.

2. Disclosure of FEC information. I agree to hold the FEC’s sensitive, protected, and confidential information, including personally identifiable information, in whatever form or format, in strict confidence, and to take all reasonable precautions to protect against unauthorized use or unauthorized disclosure of such information, including but not limited to compliance with the Rules of Behavior and Acceptable Use Standards for Federal Election Commission Information and System Resources.

3. Duty to report. I agree to report immediately to an appropriate employee of the FEC any unauthorized use, unauthorized disclosure, or other breach of sensitive, protected, and confidential information of which I become aware, or which I suspect has occurred or may occur.

4. Return of FEC material and information. At the conclusion of my work under this contract, I will return to the FEC (or destroy, upon written approval of the Contracting Officer) all FEC material, including copies, and all records containing FEC material and information.

5. Deactivation of Access to FEC Information System Resources. Immediately at the conclusion of my work (no later than 1 business day) under this contract I agree to notify the FEC Information Technology HelpDesk, in writing, that I no longer require access to FEC Information Resources.

6. Destruction of Personally Identifiable Information (PII). Prior to final payment on the contract, I will verify with the COTR and/or contracting officer that I have destroyed any and all FEC PII that has come into my custody while working for or at the FEC. The destruction method must be consistent with FEC IT Security Policies.

7. Exceptions. I understand that this Agreement shall not apply to: (1) Disclosures of sensitive, protected, and confidential information approved in advance in writing by the Contracting Officer or an FEC employee who is at the Senior Level and above; or (2) Information that is or was publicly available by means other than my disclosure; or (3) Compliance with a valid court order; provided, however, that I agree to inform the General Counsel of the FEC as soon as possible after, and in no event more than one business day after, my receipt of such a court order, and to provide the General Counsel with a complete copy of the order.

I. 1 FEC Local Provision/Clause

ORDER OF PRECEDENCE: The following clauses and provisions shall take precedence over any conflicting terms and conditions included within the Contractor's quotation or elsewhere.

1. System for Award Management (SAM): As part of doing business with the Federal government, it is mandatory that vendors/contractors providing supplies or services to the Federal government to register and maintain an active account for their business in the System for Award Management (SAM) database – http://www.bpn.gov. SAM validates the registrant information and electronically shares the secure encrypted data with federal agencies’ finance offices to facilitate payments through electronic funds transfer (EFT).

2. Release of Information: No FEC data shall be divulged to any unauthorized person for any purpose. The contractor shall clear with the Contracting Officer (CO) any public release of information on this contract/order, to include news stories, articles, sales literature, advertisements, radio-TV spots, etc. Any request for public release of information should be addressed to:

3. Handling of third-party requests for access to records. In the event that the Contractor receives a subpoena or any other request for access to data first produced under this contract, the Contractor shall immediately notify the Contracting Officer Representative (COR) and the CO, so that the Government may intervene or take action it deems necessary to protect its interests.

4. COR. If a COR is assigned, the contractor may only accept technical direction during the period of performance from the COR, providing such direction is within the scope of the contract/order.

A. The COR is not authorized to change the scope of work as stated in the contract/order or obligate the Government (FEC) in any way. The CO is the only agent for the FEC who has the authority to obligate the FEC or change the contract/order terms and conditions. Any such revision or obligation shall be authorized in writing only by the CO. Any monies incurred beyond the dollar amount specified in this contract/order or its modifications may not be paid and does not warrant interest payments as stipulated under the Prompt Payment Act.

B. COR Responsibilities: A COR has/has not been named herein. (Circle one).

The COR is responsible for the following:

(1) Monitoring the contractor’s technical progress, including the assessment of performance and recommending to the CO changes in scope of work, contract/order schedules and/or specifications to meet changes in requirement;

(2) Advising on technical matters within the scope of work;

(3) Performing technical evaluation as required;

(4) Performing technical inspections and acceptances required by this contract/order; and

(5) Assisting the contractor in the resolution of technical problems encountered during performance.

5. Payment: Original invoices are to be submitted to the billing office identified below via email to fecinvoices@fec.gov. For purposes of this contract/order the designated payment office mailing address is as follows:

6. Invoice Requirements: Contractor SHALL invoice via electronically sending the invoice to:

fecinvoices@fec.gov – when sending via email please request return receipt verification. All Invoices must include the following information:

A. Name and address of contractor.

B. Invoice Date.

C. FEC Contract/Order Number D. Line Item(s) being invoiced. [As shown on the actual FEC Order/Price Schedule and when applicable, Name, title, hourly rate and hours charged to each labor category for each contractor staff for the current month for the applicable sub-part.] E. Any corrections to previous month’s charges for an applicable sub-part will be reported separately and clearly with a narrative.

F. Any information or documentation required by provision of the contract/order. NOTE:

Contractor payment/financial information is obtained through the System for Award Management (SAM) Database by our payment operations center. It is the contractor's responsibility to ensure that the SAM Database contains accurate payment information and that the SAM account is in an active status. Invoices paid late because of inaccurate SAM information are not subject to interest payments under the Prompt Payment Act.

7. Inspection and Acceptance: Inspection and Acceptance will be accomplished by the COR for services performed and by a Point of Contact (POC) for products delivered.
