About this file

This is a Faithful Performance and Payment Bond Template document for the City of Long Beach, Los Angeles County, California, establishing bonding requirements for contractors undertaking public improvement projects. The template consists of two separate bond forms: a Faithful Performance Bond guaranteeing that the principal contractor will complete designated public improvements and maintain them for one year post-acceptance, and a Payment Bond ensuring payment to subcontractors, laborers, material suppliers, and other claimants involved in the construction work. Both bonds require corporate surety approval and must be notarized. The bonds are structured as penal sum obligations, with penalty amounts and contract terms to be specified during individual project award. The surety waives notice of any changes, extensions, or alterations to the underlying agreement and retains full obligation regardless of modifications. Both instruments authorize recovery of enforcement costs, reasonable expenses, and attorneys' fees incurred by the City in successfully compelling bond performance, to be taxed as court costs and included in any resulting judgment.

These bond templates apply to the City's Naval Architecture and Marine Engineering Services contract opportunity, which is seeking qualified professional consultants to support waterfront and marine infrastructure projects within the Capital Improvement Program. The contract will be awarded for an initial two-year period with three optional one-year renewals for a maximum five-year term, with work performed on an on-call basis under a fully burdened hourly rate structure by job title. Minimum insurance requirements include $2 million professional liability coverage, $1 million commercial general liability per occurrence with $2 million aggregate, and workers' compensation with LHWCA and Maritime Employer's Liability endorsements. Contractors must comply with California prevailing wage requirements and the Equal Benefits Ordinance if the contract exceeds $100,000. Monthly invoices are paid within 30 calendar days of approval, with Other Direct Costs reimbursed at actual cost with itemized receipts.
