SECTION I GENERAL
1.1 SCOPE OF WORK. The contractor shall furnish all labor, supervision, facilities, vehicles, equipment, tools, materials, and other items and services (except those identified as Government furnished) to perform logistics support services (LSS) primarily at Wright-Patterson Air Force Base (WPAFB), other locations throughout the state of Ohio and some locations in other states supported by WPAFB. The contractor shall perform in accordance with (IAW) the terms and conditions of the contract and the requirements and standards of this performance work statement (PWS) and contract.
Organizations supported, locations where services are to be performed, and estimated quantities of work are listed in this PWS. Logistics support services fall under the functional headings below. Services the contractor is to perform under each of these functional headings are specified in the corresponding subsections of this PWS.

1.2. HOURS OF OPERATION
1.2.1. Normal Working Hours. The normal working hours for each functional area are specified in the corresponding subsection of the PWS.
1.2.2. Expanded Hours. The contractor may be required to perform services after normal working hours up to 24 hours per day, seven days per week as requested to support mission requirements upon implementation of contingency plans and during surges, emergencies, disasters, deployments, exercises, or Continuation of Essential Department of Defense Contractor Services during crises. The contractor shall respond within one hour (or as otherwise specified in each functional subsection of the PWS) after notification of a requirement for after hours or expanded hours support. At its option, the Government may augment the contractor’s workforce during surges, emergencies, disasters, deployment, and exercises or upon implementation of contingency plans.
1.2.3. Recognized Holidays: The following Federal holidays are observed at Wright Patterson Air Force Base: New Year’s Day, Martin Luther King Day, Presidents’ Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veteran’s Day, Thanksgiving Day, and Christmas Day. The contractor is not required to provide services on Federal holidays, except as required to support mission requirements during expanded hours as described in paragraph 1.2.2.
1.3. CONTRACTOR PERSONNEL.
1.3.1. The contractor shall provide a person responsible for the performance of the work. This person shall be physically present at WPAFB during normal working hours and shall have the authority to act for the contractor on all matters relating to day-to-day contract performance and shall have the authority to make policy/procedural decisions. The contractor shall submit in writing to the Contracting Officer (CO) the name of the primary and an alternate. The contractor shall submit changes in writing to the CO and

Chief, Logistics Contract Management Branch as they occur. The contractor shall provide telephone numbers of these persons for contact outside of normal working hours. The contractor shall participate in all quality improvement initiatives, meetings, seminars, teams and training seminars as requested by the
CO.
1.3.2. Contractor Employees. The contractor shall not employ persons for work on this contract if such employee is identified to the contractor by the CO as a potential threat to the health, safety, security, general well being or operational mission of the installation and its population.
1.3.3. The contractor shall not employ any person who is an employee of the United States Government if the employment of that person would create a conflict of interest. Additionally, the contractor shall not employ any person who is an employee of the Department of the Air Force, either military or civilian, unless such person has received approval for such employment according to DoD 5500.7-R, Joint Ethics Regulations (JER). The contractor shall not employ any person who is an employee of the Department of the Air Force if such employment would be contrary to the policies contained in AFI 64-106, Air Force Industrial Labor Relations Activities.
1.3.4. The contractor is cautioned that off-duty active military personnel hired under this contract may be subject to permanent change of station, change in duty hours, or deployment. Military reservists and National Guard members may be subject to recall to active duty. The abrupt absence of these personnel could adversely affect the contractor’s ability to perform; however, their absence at any time shall not constitute an excuse for nonperformance under this contract.
1.3.5. The contractor shall not employ off-duty Quality Assurance Personnel (QAP) who are surveilling any contracts/subcontracts awarded to the contractor.
1.3.6. The contractor shall ensure that its employees have current, valid professional certifications and licenses, as required for contract performance, before starting work under this contract. The contractor shall obtain an AF Form 483, Certificate of Competency for all employees that will operate vehicles on the flight line. All contractor employees operating vehicles carrying hazardous material on and off base, in the performance of this contract, shall have a Hazardous Materials endorsement, in accordance with applicable Federal and state drivers licensing requirements.
1.3.7. All contractor employees operating Government vehicles and mechanized material handling systems shall maintain a current state driver’s license/certification for the type vehicle being operated, to include a valid Commercial Driver’s License and AF Form 2293, U.S. Air Force Motor Vehicle Operator Identification Card.
1.3.8. Contractor employees shall be able to read, write, speak, and understand English fluently.
1.3.9. Contractor personnel shall present a neat, clean, and professional appearance at all times, unless precluded by assigned work. All contractor employees shall be easily recognized as contractor employees by wearing contractor-provided name tags/badges depicting company name, employee’s name, and employee’s title and function. Name tags/badges shall be displayed on the outer clothing in such a way that they are visible at all times and do not pose a safety hazard. Office personnel performing duties under this contract shall not wear sweat suits, warm-up suits, halter-tops, shorts or other abbreviated

I-3 attire. During summer months, contractor personnel assigned to warehousing/back shop functions may wear walking or knee-length shorts. Contractor Transient Maintenance and Refueling Vehicle Maintenance personnel (not including branch supervisors or equivalent), as a minimum, shall wear anti-static uniforms (shirts and pants or coveralls). Clothing worn by contractor employees shall not present a potential Foreign Object Damage (FOD) hazard. Contractor personnel required to work outside between dusk and dawn shall wear reflective belts/vests IAW Occupational Safety and Health Act (OSHA) Standards.
1.3.10. Contractor personnel shall comply with WPAFBI 31-204, Installation Traffic and Parking Code, pertaining to operation of privately-owned vehicles on WPAFB.
1.3.11. Contractor personnel shall comply with the Air Force smoking policy as specified in AFI 40-102, Tobacco Use in the Air Force, and local directives.
1.3.12. The contractor shall provide, in writing to the Chief, Logistics Contract Management Branch, a single point of contact on the first day of the first performance period, for coordinating all plans, support agreements, memorandum of agreement (MOA), memorandum of understanding (MOU), and other similar documents. Additionally, this individual shall serve as the contractor’s point of contact for any other AF initiatives involving contractor supported equipment and/or facility requirements as it pertains to contractor responsibilities. The contractor shall comply with all agreements and plans as listed in Section IV, Appendix B. The contractor shall notify, in writing to the Chief, Logistics Contract Management Branch, any personnel changes.
1.3.13. Security Requirements.
1.3.13.1. The contractor shall comply with all security requirements imposed by the Base Commander and COMSEC requirements imposed by the Communications Squadron Commander at all times while its employees are on the installation.
1.3.13.2. The contractor shall provide sufficient information to obtain favorable National Agency Check (NACI) investigations for its employees requiring unescorted entrance to restricted areas or computer network access. Contractor employees requiring access to controlled areas must possess or obtain a favorable NACI. Within the first 30 days of contract award, the contractor shall identify to the QAP those employees that will require access to controlled areas and do not possess a current NACI. The Government will initiate the NACI and, pending its outcome, employees performing services in controlled areas must be escorted at all times by authorized personnel.
1.3.13.3. Prior to the start of the first operational performance period, the contractor shall ensure that personnel on duty have appropriate security clearances to meet and maintain contract security requirements.
1.3.13.4. The contractor shall possess a facility clearance at the classification level of SECRET. The contractor shall notify the Servicing Security Activity (SSA) 30 days before on-base performance of the contract in accordance with the DD Form 254.

1.3.13.5. Inventory of Classified Documents and Material. Not later than 5 calendar days after the start of the first operational performance period, the contractor and the QAP shall conduct a joint inventory of all classified documents and material. The contractor shall execute a receipt for all items on the inventory. Not later than 60 calendar days prior to completion of the contract period, the contractor and the QAP shall conduct a joint inventory of all classified documents/material. NOTE: This does not include classified material in warehouse stocks for which the Government Accountable Officer (GAO) is responsible.
1.3.13.6. The contractor shall appoint an on-site security Point of Contact (POC) for each function providing contractor employee training required by DoDM 5220.22, Chap 3. The contractor shall provide initial and follow-on training to contractor personnel who work in Controlled or Restricted Areas. The contractor shall conduct Controlled Area, Restricted Area, and Resource Protection training IAW AFI 31-101, The Air Force Installation Security Program.
1.3.14. Employee Training.
1.3.14. 1. The contractor shall ensure employees are fully trained and remain proficient and current in their areas of responsibility.
1.3.14. 2. At its own discretion, the Government may provide informal/formal training, including Computer Based Training (CBT), relative to the performance of the contract. The contractor shall complete/attend Government provided training as requested.
1.3.14. 3. The Government will provide technical training for new equipment or new technologies the Government specifies for use in the performance of the contract. This training will be provided to an initial cadre of contractor personnel requiring specialized training. Training will be provided to a minimum of one contractor employee, but will generally not exceed 10 percent of the target population.
This initial cadre shall provide the training to the remainder of the contractor’s employees as required.
Training will be provided at the Government’s expense.
1.3.14. 4. Conferences. The contractor shall submit requests to attend conferences to the QAP.
Attendance shall be at the contractor’s expense.
1.3.14. 5. Meetings. The contractor shall attend and participate in all scheduled and unscheduled meetings and/or briefings as requested/required.
1.4. (SS-1-1, SS-3-10) QUALITY CONTROL PLAN. The contractor shall establish and maintain a comprehensive Quality Control Plan (QCP), subject to acceptance by the CO, to ensure the requirements of the contract are satisfied. At a minimum, the QCP must contain the following:
1.4.1 Inspection System. A description of the inspection system covering all services listed in each functional-specific Subsection of the PWS. Specify areas to be inspected on either a scheduled or unscheduled basis, frequency of inspections and titles of the individuals who shall perform the inspection, their organizational placement and the location of inspection records.

1.4.2. Deficiency Prevention. A description of the methods used for identifying and preventing defects in the quality of service performed before the level becomes unacceptable.
1.4.3. Inspection Files. A description of the records that are to be kept that will document all inspections conducted by the Contractor, and the necessary corrective and preventive actions taken. This documentation shall be made available to the Government at all times during the term of the contract.
The records shall be maintained at the location designated in the Contractor’s Quality Control Plan. The inspection record’s format shall include, but is not limited to:
a. Date, time, and location of the inspection.
b. A signature block for the person who performed the inspection.
c. Ratings of acceptable or unacceptable work performance.
d. Areas designated for deficiencies noted and corrective action taken.
e. Total number of observations.
1.4.4. Key Control Procedures. A description of the methods, procedures and records the contractor will use to manage and account for keys issued by the Government, as required to satisfy the requirements of paragraph 1.6.1, Key Control, of the PWS.
1.5. QUALITY ASSURANCE. The Government will evaluate the contractor’s performance under this contract. The Government will record all surveillance observations. When an observation indicates defective performance, the QAP will require the contractor at the site to initial the observation indicating acknowledgment of the deficiency. Initialing of the observation does not constitute contractor concurrence with the observation, only acknowledgment that the contractor has been made aware of the defective performance. Any action taken by the CO as a result of surveillance will be according to the terms of this contract.
1.5.1. Performance Evaluation Meetings. The contractor may be required to meet at least weekly with the QAP and the CO during the first month of performance. Meetings will be as often as necessary thereafter as determined by the CO. However, if the contractor requests, a meeting will be held whenever a Contract Discrepancy Report (CDR) is issued. The written minutes of all performance evaluation meetings will be prepared by the Government and shall be signed by the contractor, CO, and QAP.
Should the contractor non-concur with the minutes, the contractor shall so state any areas of non-concurrence in writing to the CO within 10 calendar days of receipt of the signed minutes. The minutes will be included in the contract file.
1.5.2. Quality Assurance Personnel (QAP)
1.5.2.1. QAPs are technical representatives of the CO and will participate in the administration of this contract.
1.5.2.2. The QAP(s) or alternate(s) will inform the contractor in person when discrepancies are observed and will request corrective action be taken. The QAP(s) or alternate(s) will note the discrepancy with the date and time observed and request the contractor initial the entry and provide corrective action.

1.5.2.3. The contractor shall refer to the CO, not the QAP(s), any alleged change to the scope, prices, terms or conditions of the contract.
1.6. PHYSICAL SECURITY. The contractor shall safeguard all Government property provided for contractor use. The contractor shall comply with AFI 31-101, The Air Force Installation Security Program as it pertains to safeguarding Government-furnished facilities and material contained therein. At the close of each work period, the contractor shall secure all Government facilities, property, and materials.
1.6.1. Key Control. The contractor shall establish and implement methods to ensure accountability for all keys/key cards issued to the contractor by the Government are not lost or misplaced and are not used by unauthorized persons. NOTE: All references to keys include key cards. Keys issued by the Government to the contractor shall not be duplicated. Procedures shall be developed covering key control to include turn-in of any issued keys by personnel who no longer require access to locked areas. The contractor shall include these procedures in the QCP. The contractor shall return all keys to the Government at the conclusion of the contract.
1.6.1.1. The contractor shall report (not later than (NLT) the next duty day) any occurrence of lost or duplicated keys to the QAP.
1.6.1.2. In the event the contractor loses or duplicates Government provided keys, other than master keys, the Government at its option may replace or re-key the affected lock(s). If the Government opts to replace or re-key the affected lock(s), the total cost of re-keying or replacing the lock(s) will be deducted from the monthly payment due the contractor. In the event the contractor loses or duplicates a master key, the Government will replace all locks and keys for that system and deduct the total cost from the monthly payment due the contractor.
1.6.1.3. The contractor shall prohibit use of Government issued keys by any persons other than the contractor's employees. The contractor shall prohibit its employees from opening locked areas to permit entrance by anyone other than contractor's employees engaged in the performance of assigned work in those areas or personnel authorized entrance by the CO.
1.6.2. Lock/Cipher Combinations. The contractor shall establish and implement procedures to preclude lock/cipher combinations from disclosure to unauthorized persons. The contractor shall ensure that lock/cipher combinations are changed when personnel having access to the combinations no longer have a need to know such combinations. The QAP/CO shall be notified of any change. The contractor shall include these procedures in the QCP.
1.6.3. The contractor shall identify, in writing, a single point of contact for each logistics function, to manage issues related to the maintenance/serviceability of the Government-furnished facilities per WPAFB Pamphlet 32-2, paragraph 1.2.
1.7. RECORDS. All records, files, documentation, working papers, and software provided by the Government or generated in the performance of this contract become and remain Government property.
All such records, files documentation, and working papers, which this contract requires the contractor to maintain, shall be maintained in accordance with AFI 33-322, Records Management Program;

AFI 37-138, Records Disposition-Procedures and Responsibilities; AF Electronic Records Management (ERM) Solution, AFRIMS, Records Disposition Schedule on-line at https://afrims.amc.af.mil; and all other pertinent directives, as supplemented. At the time of disposition, the contractor shall box, label contents, and turn them over to the QAP or the CO If requested by the Government, the contractor shall provide the original record or a reproducible copy of any such record within five working days of receipt of the request. The contractor shall ensure Level 1, General Records Awareness Training, is completed annually by all of its employees. The contractor shall ensure that its employees who are designated as the Chief of Records and Records Custodian complete Level II, AF CBT, Records Management as well, and that its designated Functional Area Records Manager additionally complete Level III, AF CBT, and Advanced Records Management (to include Electronic Records Management). The contractor shall provide one copy of the required training certificates to the QAP at the completion of the training.
1.8. ENVIRONMENTAL CONTROLS.
1.8.1. Compliance with Laws and Regulations. The contractor shall be knowledgeable of and comply with all applicable laws, regulations, permits, and requirements regarding environmental protection. In the event environmental laws/regulations change during the term of this contract, the contractor shall comply with such laws as they become effective.
1.8.2. Notification of Environmental Spills. If the contractor spills or releases any substance contained in 40 CFR 302 (or other applicable environmental statutes or regulations) into the environment, the contractor or its agent shall report the incident by dialing 911 or 257-9111 by cell phone. Additionally, the contractor shall call 88 ABW/CEV, Environmental Management Division, at 257-7152 and contact the QAP. The contractor shall provide a written report within 24 hours to the QAP. The liability for the spill or release of such substances rests solely with the contractor and its agent.
Environmental Management shall make the final determination for acceptable clean up levels. If the spill occurs off base, the contractor shall immediately contact environmental regulators, follow Department of Transportation (DOT) regulations and accomplish appropriate base notification.
1.8.3. If the contractor detects spills or releases of any substance in paragraph 1.8.2 above that they did not spill or release, still complete the reporting requirements as defined in paragraph 1.8.2.
1.8.4. The contractor shall have on hand kits and other items necessary for hazardous material spill containment and cleanup. These kits and items shall be appropriate for the substances they will be used to absorb or contain. Sufficient quantities of these kits or items shall be on hand as required to absorb or contain spills from the largest container of a hazardous material stored by the contractor.
1.8.5. Material Storage and Use. The contractor shall follow the manufacturer’s guidelines and professional recommendations for control of humidity, temperature, cleanliness, and material handling, to include hazardous materials (HM). The contractor shall procure, use, handle and store all HM IAW all Federal, State, local, and Air Force laws, policies, regulations and procedures.
1.8.5.1. Notification Requirements. The contractor shall notify the Hazardous Materiel (HAZMAT) Cell, through the Hazardous Material Management System (HMMS), of all hazardous material it will use in the performance of this contract regardless of procurement method IAW procedures outlined in the Installation HAZMAT Management Program (IHMP) Plan and WPAFBI 32-7002, Hazardous Material

Management. The contractor shall obtain prior approval from the HAZMAT Cell before any container of HM is brought on to WPAFB. Additionally, the contractor shall report within 2 workdays through HMMS to the HAZMAT Cell when a HM container is empty or removed from the installation. These requirements do not apply to hazardous material stored by base supply and accounted for on the
SBSS/ILS-S.
1.8.5.2. Hazardous Material Purchases. The contractor shall route and coordinate all customer requests for the purchase/use of hazardous materials/supplies to the CEV HAZMAT CELL; the only exception being items purchased for HM stock replenishment requirements. The contractor shall not purchase or store hazardous material on WPAFB (except for HM accounted for on SBSS/ILS-S records and stored in the supply operated HAZMAT warehouse) without prior acknowledgement of the HAZMAT CELL IAW the WPAFB IHMP Plan including all policy statements contained therein.
1.8.6. Environmental Coordinator (EC) Person. Within 15 days after the start of the operational performance period, the contractor shall appoint in writing an EC and alternate. The contractor shall provide a copy of the appointment to the CO and QAP and updates within 15 days of any changes. The EC shall manage all environmental activities performed by the contractor and support the 88 MSG/LGR Unit Environmental Coordinator as required. The EC shall serve as the liaison to Environmental Management for issues concerning the management of HM/Hazardous Waste (HW), water quality, air quality, tanks, PCBs, mercury lamps, natural resources, used oil, and Environmental Impact Analysis Program. Attend the installation Hazardous Substance Steering Committee (HSSC) to provide feedback from the meeting and implement any changes introduced there. Participate in quarterly Hazardous Waste Site Inspection Team (HWSIT) audits and other inspections as directed by the HSSC Chairperson.
1.8.7. Issue Point (IP). The contractor shall establish, through the CEV HAZMAT Cell, a centralized location to store, receive, transfer and issue hazardous materials IAW WPAFBI 32-7002, Hazardous Material Management.
1.8.7.1. Within 15 days after the start of the operational performance period, the contractor shall appoint in writing an individual and an alternate responsible for management of the IP. A copy of the appointment shall be provided to the CO and QAP and a copy to Environmental Management. The IPM shall update and maintain accurate data in the HAZMAT database (HMMS). The IPM shall ensure all HM items are labeled and stored IAW OSHA Standards and the WPAFB HM Management Plan.
1.8.8. Environmental, Safety, and Occupational Health Compliance Assessment and Management Program (ESOHCAMP). The contractor shall support and participate in external and internal ESOHCAMP inspections (at least one per year). If notified by the QAP, the contractor shall provide a knowledgeable person to augment the ESOHCAMP team for the period specified in the notification – usually one workweek. The contractor shall ensure that representative(s) completes ECAMP/ ESOHCAMP training provided by the Air Force Institute of Technology.
1.8.9. Hazardous, Toxic, or Special Waste Disposal. The contractor shall comply with all Federal, State, local and Air Force environmental laws, policies, regulations and procedures specified in, but not limited to: 40 Code of Federal Regulations (CFR) Parts 260 through 268; 40 CFR Part 761; 40 CFR Part 279; 49 CFR Parts 170 through 177; Ohio Administrative Code (OAC) 3745-50 through 3745-58;

AFI 32-7042, Solid and Hazardous Waste Management and Compliance, AFMC Standard Hazardous Waste Operating Procedures; and WPAFB Instruction 32-7001, WPAFB Hazardous Waste Management, including all policy statements contained therein for hazardous, toxic, or special wastes which cannot be disposed of as solid waste in a “Subtitle D” landfill generated as a result of performance of work under this contract.
1.8.9.1. Waste Streams. The contractor shall report new waste streams and any changes to existing waste streams to Environmental Management, including any changes made to processes that could change the characteristics of the wastes being generated in order to determine whether a specific waste is hazardous.
The HW generating site supervisor shall ensure that all waste streams are reported directly to Environmental Management and the appointed Environmental Coordinator (EC)/Unit Environmental Coordinator (UEC) in accordance with the WPAFBI 32-7001.
1.8.9.2. Initial Accumulation Point (IAP) Management. The contractor shall establish, as required, and operate all necessary IAPs/Satellite Accumulation Points for the temporary storage of hazardous and other regulated wastes as defined in the WPAFBI 32-7001 and 40 CFR 262.
1.8.9.3. The contractor shall ensure that its IAP person, alternate, and their direct supervisors (or equivalent) attend the installation Hazardous Material/Waste Management Training Course conducted by Environmental Management. The contractor shall attend the first available training session either on the first day of the transition period or the first available training session thereafter and shall complete the annual training requirement as scheduled by 88 ABW/CEV. This training is provided as a briefing on WPAFB specific procedures and does not replace any training the contractor is required to provide its employees.
1.8.9.4. HW Turn-In. The contractor shall properly complete a Hazardous Waste Pick-up Form, manually or electronically, for each type of hazardous waste/special waste when the waste container is ready for pick-up IAW the WPAFBI 32-7001. The contractor shall obtain signature/coordination on this form by the EC/UEC and forward the form to Environmental Management.
1.8.9.5. Hazardous Waste being Sent for Recycling. Certain hazardous wastes (i.e. Safety Kleen solvent waste being sent for recycling or wipers being sent for laundering) may be handled outside of the normal CEV/ Defense Reutilization Marketing Office (DRMO) turn-in channels. The contractor shall obtain approval in writing from CEV prior to commencing any such operations. The contractor shall obtain the signature of a representative of CEV for any required Uniform Hazardous Waste Manifests and other accompanying documentation associated with the shipment of these wastes.
1.8.9.6. Used Oil and Waste Liquid Petroleum Products (WLPP). The contractor shall comply with the Used Oil and Waste Liquid Petroleum Management Policy.
1.8.9.7. Mercury-Containing Light Bulbs. The contractor shall comply with Spent Mercury-Containing Lamp Management Policy and WPAFB Specification Section 02083D, Removal of Mercury-Containing Lamps.

1.8.9.8. Polychlorinated Biphenyl (PCB) Fluorescent Light Ballasts. The contractor shall comply with WPAFB Specification Section 02083C, Removal of Lighting Ballasts and Small Capacitors Containing
PCB.
1.8.9.9. PCB Containing Items. The contractor shall comply with WPAFB Specification Section 02083, Removal of PCB and PCB-Contaminated Transformers and Other PCB Items.
1.8.10. Solid Waste Disposal and Recycling. The contractor shall comply with all Federal, State, local, and Air Force environmental laws, policies, regulations, and procedures specified in, but not limited to:
40 CFR Part 240-259, OAC 3745, AFI 32-7080, Executive Order 12873, 20 Oct 93, Policy for DoD Recycling, 28 Sep 93 AFMC Qualified Recycling Program Guidance and the WPAFB Qualified Recycling Plan (QRP) for solid, or special wastes which can or cannot be disposed of as solid waste in a “Subtitle D” landfill generated as a result of performance of work under this contract.
1.8.10.1. The contractor shall monitor all solid waste to insure that no regulated medical waste or hazardous waste is disposed of into the solid waste. The contractor shall monitor all solid waste to insure that all recyclables are removed and recovered for pick-up by the installation Qualified Recycling Program organization (mix office paper, computer paper, plastics, glass, cardboard, newspaper, metals, tires, and aluminum cans). The custodial contractor is responsible for the removal of all paper collected for the Recycle Program from centralized collection areas inside the building to appropriate designated locations outside the building.
1.8.11. Wastewater/Storm Water. The contractor shall comply with the Federal Water Pollution Control Act, commonly known as the Clean Water Act (CWA), as amended. In addition, fully comply with all applicable federal, state, local, Air Force, and WPAFB regulations.
1.8.12. Air Quality. The contractor shall comply with the Clean Air Act, as amended, and all implementing federal, state, and local regulations pertaining to air quality. In addition, the contractor shall fully comply with all permit terms and conditions for any Ohio Environmental Protection Agency (OEPA) permits issued for emission sources at their facilities. The contractor shall submit any required record keeping logs quarterly to the QAP and to the base Air Quality Program Manager (PM), Environmental Management. Format for required logs must be approved by Environmental Management.
The contractor shall identify all base air emission sources with a yellow sticker with a unique four-digit Source ID number. If any existing air emission source is moved or if a new emission source is to be added, the contractor shall notify the Air Quality PM in advance. If a new source requires a Permit to Install (PTI) from OEPA, it may take six months to obtain it, and installation cannot occur until the PTI is in hand. Therefore, the contractor shall provide sufficient advance notice.
1.8.13. Natural Resources Program. The contractor shall comply with federal and state regulations and requirements pertaining to Natural Resources Programs and 7 USC 136, et, seq., Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). The contractor shall store and dispose of pesticide IAW
FIFRA.

1.8.14. Underground/Aboveground Storage Tanks. If required by performance of work under this contract, the contractor shall fully comply with federal, state, and local regulations and WPAFBI 32-2002, Installation, Maintenance and Removal of Underground Storage. (Requiring activity will verify validity).
1.8.15. Green Procurement. WPAFB has a requirement for cost-effective affirmative procurement of environmentally preferable products and services. Green Procurement is defined as the process of purchasing environmentally preferable products, especially products manufactured from recycled and reclaimed materials. The United States Environmental Protection Agency (USEPA) has designated guideline items in the Comprehensive Procurement Guideline (CPG) for mandatory procurement. In the CPG, the USEPA organizes these items into 8 product categories as follows: 1) Contraction Products, 2) Landscaping Products, 3) Non-paper Office products, 4) Paper and Paper Products, 5) Park and Recreation Products, 6) Transportation Products, 7) Vehicular Products, and 8) Miscellaneous Products.
A current detailed listing of these products and recycled content requirements can be found on USEPA’s web site at http://www.epa.gov/cpg/products.htm. Once at the web site, to view the products, click on one of the 8 categories. Within a category, click on a specific product. The following information will be provided: Recommended Recovered Materials Content levels, Product Specification, and Product Information, which includes the list of manufacturers and suppliers. Click on the file to open and a list of suppliers will be provided.
1.8.15.1. In accordance with 40 CFR 247.2, the contractor shall research, propose, and utilize these designated products, and any other recycled-content products available in the market place. The contractor shall utilize CPG products with the highest percentage of recovered material practicable, unless otherwise specified, or if one or more of the following exemptions apply (these exemptions do not apply to recycled content paper):
Does not meet appropriate performance specifications Is not available competitively (from two or more sources) Is not available within a reasonable time frame.
Is only available at an unreasonable price.
1.8.16. For information concerning environmental controls at Wright Patterson Air Force Base go to https://wrigem.wpafb.af.mil/. This is the official source for WPAFB.
1.9. INDUSTRIAL SAFETYAND HEALTH REQUIREMENTS.
1.9.1. Environmental, Safety, and Occupational Health (ESOH). The contractor shall be solely responsible for compliance with all federal, state and local laws, the Occupational, Safety and Health Act (OSHA) (Public Law 91-596) and the resulting standards, OSHA Standards 29 CFR 1910 and 1926, as applicable, and for the protection of their employees. Additionally, the contractor shall be responsible for the safety and health of all subcontractor employees. The contractor shall provide protection to Government property to prevent damage during the period of time the property is under the control or in possession of the contractor.
1.9.2. Voluntary Protection Program (VPP). Wright-Patterson AFB is in the process of pursuing VPP recognition or has already been recognized under the OSHA Voluntary Protection Program (VPP). VPP impacts all “applicable contractors” operating on Air Force Installations. The contractor shall be

I-12 responsible for ensuring their employees and managers have a comprehensive understanding of VPP as well as full compliance with OSHA requirements. Contractors (to include applicable contractors), whether regularly involved in routine site operations or engaged in temporary projects such as construction or repair, shall follow the safety and health rules of the installation or VPP site. Detailed information on VPP is available on the OSHA website at http://www/osha.gov/dcsp/vpp/index.html.
1.9.2.1. Applicable contractors shall submit their Total Case Incidence Rate (TCIR) and Days Away, Restricted, and or Transfer Case Incident Rate (DART) rates and OSHA Form 300A annually to the contracting office for consolidation and submission as part of the installation’s annual VPP Safety and Health Management report. TCIR and DART rates are due by the 15th of January of each year.
1.9.2.2. An applicable contractor’s Quality Control Plan shall identify the processes and procedures the contractor will use to track compliance with the Safety and Health Plan, and the process and procedures that will be used to correct violations.
1.9.2.3. (SS-1-2, SS-2-2, SS-3-2, SS-4-2) The contractor shall submit a Safety and Health Plan and corresponding site safety checklist to the contracting officer 10 days after contract award. The contractor’s plan shall include appropriate measures to ensure the contractor reacts promptly to investigate, correct, and track alleged safety and health violations and/or uncontrolled hazards in contractor work areas. The plan shall:
1.9.2.3.1. demonstrate a management commitment to employee safety and health;
1.9.2.3.2. identify the application of the safety and health plan to subcontractors;
1.9.2.3.3. identify the roles and responsibilities of the following individuals: Management, Supervisors, Employees, and Safety Coordinator;
1.9.2.3.4. identify applicable safety rules and regulations;
1.9.2.3.5. include a worksite hazard analysis to include base-line hazard identification and required control measures;
1.9.2.3.6. include a job site analysis to include hazards of tasks required to control measures;
1.9.2.3.7. identify employee safety and health training requirements and the documentation process;
1.9.2.3.8. include a workplace inspection frequency, to include identifying the individual conducting the inspections;
1.9.2.3.9. include employee hazard reporting procedures;
1.9.2.3.10. identify individual(s) responsible for corrective action of hazards;
1.9.2.3.11. identify first aid/injury procedures;

1.9.2.3.12. identify procedures for accident investigation and reporting;
1.9.2.3.13. identify emergency response procedures; and
1.9.2.3.14. identify the process for tracking controlled hazards in contractor work areas.
1.9.2.4. An applicable contractor shall be responsible for establishing these requirements for all subcontractors who qualify as applicable contractors under the resulting contract.
1.9.3. Contractor Employees. The contractor shall be exclusively obligated to comply with OSHA and other applicable laws and regulations for the protection of their employees. Air Force Occupational Safety and Health Standards (AFOSH STD) are annotated because many of the Air Force Standards exceed the OSHA standard criteria. If a conflict is noted, the most stringent requirement takes precedence. The Government will assume no liability or responsibility for the contractor’s compliance or non-compliance with such requirements. The contractor shall furnish to each of his/her employees a place of employment, which is free from recognized hazards. The contractor shall brief his/her employees on the safety requirements of this contract and on hazards associated with prescribed tasks. In addition, the contractor is required to flow down the safety requirements/specification to all subcontractors. This contract shall in no way require persons to work in surroundings or under working conditions which are unsafe or dangerous to their health. The contractor shall coordinate and perform work so as not to impact the safety of Government employees or cause damage to Government property.
This requires providing personnel with protective equipment and associated safety equipment as may be necessary. The contractor must also protect personnel from hazards generated by the work. If the contractor employs BILINGUAL speaking employees, they must post bilingual signs and have written procedures for specific tasks in applicable languages.
1.9.4. Inspections. Air Force Environmental, Safety, Occupational Health and Fire protection officials or responsible QAP may periodically enter the contractor’s workplace to verify working conditions. If an Air Force employee observes improper procedures or that unsafe conditions exists, which place Air Force personnel or equipment/facilities in jeopardy, the contractor shall remove personnel and/or equipment from the unsafe condition and immediately notify the Contracting Officer (CO) and the Installation Safety Office. Department of Labor, OSHA inspectors are authorized right of entry to inspect any place of employment operated by an Air Force contractor. They are for the most part, “NO NOTICE” inspections.
The contractor shall notify the Installation Safety Office and QAP if an OSHA inspector visits unescorted by an Air Force Safety Technician and/or QAP. Noncompliance with safety requirements can result in work stoppage, inexcusable delays, and/or costly fines issued by the Department of Labor (DOL). The Government will assume no liability or responsibility for the contractor's compliance or non-compliance with such requirements.
