SUPPLIES OR SERVICES AND PRICES/COSTS

NOTES

The MHU-110/141 Program intends to award a minimum of (3) contracts at the time of award.

The Period of Performance will be 48 months from date of contract award.

The Government is not responsible for any costs incurred or associated with preparation and submission of a proposal in response to this solicitation. Each MHU-110/141 IDIQ contract will be awarded an initial task order of $1,000.00 (as a minimum) to fulfill the minimum guarantee. The initial task order will be a post award conference telecommunication. The Government will not be responsible for any costs incurred or associated with preparation and submission of task order proposals solicited under the MHU-110/141 IDIQ (with the exception of Government ordered changes resulting in a new proposal in an already awarded effort).

AWARDING ORDERS UNDER MULTIPLE AWARD CONTRACTS

A. All multiple award contractors shall be provided a fair opportunity to be considered for each order in excess of $3,500 pursuant to the procedures established in this note, unless the contracting officer determines that:

a. The task or delivery order should be issued on a sole source basis in the interest of economy or efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity pursuant to the procedures in this clause to be considered for the original order; or

B. Unless the procedures in paragraph (A) are used for awarding individual orders, multiple award contractors will be provided a fair opportunity to be considered for each order.

a. The Government will issue a Request for Order Proposal (RFOP). Contractors will be permitted seven (7) working days to prepare and submit order proposals, unless otherwise stated in the RFOP.

b. The Government will use streamlined procedures when competing orders and will award to the contractor whose proposal represents the lowest price.

C. Pursuant to Public Law 103-355, as implemented by FAR 16.505(a)(i), a protest is not authorized in connection with the issuance or proposed issuance of an individual task or delivery order except for:

a. A protest on the grounds that the order increases the scope, period, or maximum value of the contract under which the order is issued.

D. For this contract, the designated task or delivery order ombudsman is Ms. Kim McDonald (kim.mcdonald@robins.af.mil), WR-ALC/PKC, Bldg 300 West Wing, Robins AFB GA 31098-1611). The task or delivery order ombudsman is responsible for reviewing complaints from multiple award contractors and ensuring that all of the contractors are afforded a fair opportunity to be considered for task and delivery orders in excess of $3,500, consistent with procedures in the contract. However, it is not within the designated task or delivery order contract ombudsman’s authority to prevent the issuance of an order or disturb an existing order.

E. The rules in FAR 52.215-1(c) which apply to the submission, modification, revision, and withdrawal of proposals shall apply to the submission, modification, revision, and withdrawal of proposals for award of a task/delivery order under this IDIQ contract.

F. Attached Sample Task Orders 1 – 3 are intended to be Awardable Task Orders under this contract.

(a) Invoice payments—

(5) Computing penalty amount. The Government will compute the interest penalty in accordance with the Office of Management and Budget prompt payment regulations at 5 CFR part 1315.

(i) For the sole purpose of computing an interest penalty that might be due the Contractor, Government acceptance is deemed to occur constructively on the 7th day (unless otherwise specified in this contract) after the Contractor delivers the supplies or performs the services in accordance with the terms and conditions of the contract, unless there is a disagreement over quantity, quality, or Contractor compliance with a contract provision. If actual acceptance occurs within the constructive acceptance period, the Government will base the determination of an interest penalty on the actual date of acceptance. The constructive acceptance requirement does not, however, compel Government officials to accept supplies or services, perform contract administration functions, or make payment prior to fulfilling their responsibilities.

(a) Definitions. As used in this clause—

(1) “Contract financing payment” and “invoice payment” have the meanings given in section 32.001 of the Federal Acquisition Regulation.

(2) “Electronic form” means any automated system that transmits information electronically from the initiating system to all affected systems. Facsimile, e-mail, and scanned documents are not acceptable electronic forms for submission of payment requests. However, scanned documents are acceptable when they are part of a submission of a payment request made using Wide Area WorkFlow (WAWF) or another electronic form authorized by the Contracting Officer.

(3) “Payment request” means any request for contract financing payment or invoice payment submitted by the Contractor under this contract.

(b) Except as provided in paragraph (c) of this clause, the Contractor shall submit payment requests and receiving reports using WAWF, in one of the following electronic formats that WAWF accepts: Electronic Data Interchange, Secure File Transfer Protocol, or World Wide Web input. Information regarding WAWF is available on the Internet at https://wawf.eb.mil/ .

(c) The Contractor may submit a payment request and receiving report using other than WAWF only when—

(1) The Contracting Officer authorizes use of another electronic form. With such an authorization, the Contractor and the Contracting Officer shall agree to a plan, which shall include a timeline, specifying when the Contractor will transfer to WAWF;

(2) DoD is unable to receive a payment request or provide acceptance in electronic form;

(3) The Contracting Officer administering the contract for payment has determined, in writing, that electronic submission would be unduly burdensome to the Contractor. In such cases, the Contractor shall include a copy of the Contracting Officer’s determination with each request for payment; or

(4) DoD makes a payment for commercial transportation services provided under a Government rate tender or a contract for transportation services using a DoD-approved electronic third party payment system or other exempted vendor payment/invoicing system (e.g., PowerTrack, Transportation Financial Management System, and Cargo and Billing System).

(d) The Contractor shall submit any non-electronic payment requests using the method or methods specified in Section G of the contract.

(e) In addition to the requirements of this clause, the Contractor shall meet the requirements of the appropriate payment clauses in this contract when submitting payment requests.
