PART I - THE SCHEDULE
SECTION B
SUPPLIES OR SERVICES AND PRICES/COSTS
1. Scope/Purpose
This contract is an Indefinite Delivery/Indefinite Quantity (IDIQ) contract for Pacer Classic III T-38C aircraft modification kits, Contractor Furnished Equipment, Travel and Not-Separately Priced Data in support of the T-38 program for AETC customers.
Contract Line Item Numbers (CLIN's) and Terms and Conditions (T&Cs) are annotated for the acquisition of the T-38 kits and support in accordance with the Performance Work Statement in Section J, Attachment 1. Each Delivery Order (DO) shall stand alone and shall specify the kits and/or support being acquired. Section J, Attachment 3, Unit Pricing Matrix, CLINs 0001 through 0010 and Section J, Attachment 4, Supplemental Kits Labor Categories, CLIN 0011 as submitted by the offerors will be used to establish contract unit prices and labor rates five years from date of award. The ordering period will be five years from contract award. The delivery period will be six years from contract award.
2. Contract Minimum/Maximum
As defined in Section I FAR 52.216-19, Order Limitations (Oct 1995), the minimum order designated in the schedule shall be $ 1,000.00. This contract requires the Government to order and the contracor to furnish a minimum of $2,400,000.00 of supplies. This minimum order of supplies will be issued in the first Delivery Order. The contractor is not obligated to honor -
(1) Any order for a single item in excess of $ 20,000,000.00;
(2) Any order for a combination of items in excess of $ 49,000,000.00; or
(3) A series of orders from the same ordering office within 7 days that together call for quantities exceeding the limitation in (1) or (2) of this section.
3. Liquidated Damages
The contract will include FAR 52.211-11, Liquidated Damages - Supplies, Services, or Research and Development for use only when the contractor is late on delivery of aircraft kits, the contracting officer has taken all reasonable steps to mitigate liquidated damages, and the government suffers damages. For the nine (9) source directed parts in Table 1 - Source Directed Parts of the PWS, the Government will not assess liquidated damages for any late kit deliveries beyond the contractor's control unless the contractor has committed an act contributing to the delay. Examples of reasonable steps to mitigate liquidated damages include, but are not limited to actions taken by contractor to:
a. Establish subcontracts lead time away for source directed parts to meet each DO's requirements;
b. Provide adequate oversight of subcontractors; and
c. Provide documentation and notify the Government immediately upon learning late delivery is anticipated or imminent source directed parts will result in late delivery.
If the government assesses liquidated damages, for each instance of late delivery the daily amount is $5,740/day, not to exceed 5 business days, or $28,700. If multiple kits have the same delivery date, daily and maximum damage amounts are the same.

FAR 52.211-11 - Liquidated Damages - Supplies, Services, or Research and Development for use only when the contractor is late on delivery of aircraft kits, the contracting officer has taken all reasonable steps to mitigate liquidated damages, and the government suffers damages. For the two (2) source directed parts in this kit, the Government will not assess liquidated damages for any late kit deliveries beyond the contractor's control unless the contractor has committed an act contributing to the delay.
Examples of reasonable steps to mitigate liquidated damages include, but are not limited to actions taken by contractor to:
a. Establish subcontracts lead time away for source directed parts to meet each DO's requirements;
b. Provide adequate oversight of subcontractors; and
c. Provide documentation and notify the Government immediately upon learning late delivery is anticipated or imminent source directed parts will result in late delivery.
If the government suffers damages, each instance of late delivery will be assessed the daily amount of $5,740, not to exceed 5 business days, or $28,700. If more than one kit has the same delivery date, daily and maximum damage amounts remain the same.

Part Number 3-11608-503, F.S. 487.223 Former
FAR 52.211-11 - Liquidated Damages - Supplies, Services, or Research and Development for use only when the contractor is late on delivery of aircraft kits, the contracting officer has taken all reasonable steps to mitigate liquidated damages, and the government suffers damages. For the one (1) source directed part in this kit, the Government will not assess liquidated damages for any late kit deliveries beyond the contractor's control unless the contractor has committed an act contributing to the delay.
Examples of reasonable steps to mitigate liquidated damages include, but are not limited to actions taken by contractor to:
a. Establish subcontracts lead time away for source directed parts to meet each DO's requirements;
b. Provide adequate oversight of subcontractors; and
c. Provide documentation and notify the Government immediately upon learning late delivery is anticipated or imminent source directed parts will result in late delivery.
If the government suffers damages, each instance of late delivery will be assessed the daily amount of $5,740, not to exceed 5 business days, or $28,700. If more than one kit has the same delivery date, daily and maximum damage amounts remain the same.
