Received Questions for FA8201-16-R-0005

24 February 2016

1. Does the government plan to sponsor a site visit for this solicitation?

A. The government will not be sponsoring a site visit.

2. Is this a follow-on requirement? If so, could you please provide the incumbent contract number for this opportunity? If not, is this a new requirement?

A. Yes, FA8201-11-C-0019.

3. Can the Government provide the name and address of the current contractor?

A. Incumbent is Robinson Wastes Services, Inc.

4. What is the current total price per year?

A. The Government can release the total value of the current contract, which is $3,545,332.04

5. Can the Government provide the period of performance for the current contract?

A. 1 Apr 2011 to 31 Mar 2016

6. PWS 1.1.3.1. Unscheduled Pickup and Special Events. The government lists 16 for the estimated annual quantity for Special Event Container Placements” in Attachment A. Does the 16 represent containers or number of events? If the 16 is number of annual events will the government please provide container number and collection frequency for each event?

A. Number of separate events. This Unscheduled Pick-up would be required (for example) when a 40 yard roll-off is full and needs to be taken and returned in a timely manner. Therefore, the type/size of container and frequency will vary.

7. PWS 1.1.3.7. Emergency Container Relocations. “The contractor shall provide emergency container relocations during real-world higher Force Protection Conditions (FPCON’s). The contractor shall move all specified containers to the locations identified by the Contracting Officer or the COR for the purpose of relocating containers at least 82 feet (25 meters) from the facilities.” Will the government please provide approximate number of containers to be relocated under this requirement?

A. Approximately 30.

8. PWS 1.1.8.1. Containers. “All bulk refuse dumpsters shall be cathedral type with durable plastic lids.” Will the government please provide photograph of acceptable container design as “cathedral type” may have different meanings in different regions of the country.

A. Please see the Sample Condition Pictures which are provided in the Solicitation.

9. PWS 1.1.8.1 Containers. Is there a specific shape required for the pilot project plastic containers? Please provide a photo if a specific style is required.

A. No.

10. PWS 1.1.8.2 Sawdust Containers. Please provide a photograph of any modifications required to a standard container to capture sawdust.

A. Please see Attachment 0004, titled Saw Dust Container Photos.

11. PWS 1.1.8.4 Compactor Units. Please provide specifications for the required compactors. Are these “breakaway style” (container separates from compaction unit) or self-contained units?

What hopper configurations are required, open hopper, enclosed “dog house” with door on left, right or rear of the unit?

A. Bldg 400 – Self Contained, walk on deck with hopper. Bldg 849 – Stationary with a shoot through the building. Bldg 412 – Stationary with shoot through the wall.

12. PWS 1.2 and 1.2.3 appear to conflict. 1.2 indicates that the materials should be taken to an offsite MRF, however 1.2.3 indicates that the The Base Recycling Area will be made available to the contractor. Can the Base Recycling Area be used for sorting materials? If not what is the purpose of this facility.

A. There is no conflict.. one states a facility and the other an “area”… there is an area near/on

Garland Way that the Government has designated as a Recycle Area.. No, this area cannot be used for sorting.

13. PWS 1.3.2. Disposal of Non-marketable Materials. Will the government provide historical annual volume (tons) data of non-marketable recyclables?

A. The Governments understands that “glass” is a non-marketable material. The total tons per year is unknown.

14. PWS 3.2. Recycle Containers. “The government is providing the recyclable containers “as is”.

Any repairs and/or refurbishment are at the contractor’s expense in accordance with FAR 52.245-1and 52.245-2.” Will the government please provide any records relative to the condition of the government owned recycling containers such as a listing identifying repair/refurbishment activity currently required/necessary by location?

A. Most if not all of the Recycle Containers should be in relatively good condition. Recent repairs performed have included lid replacements (3).

15. PWS 4.5.1.1 States that “escorts will be arranged and provided until controlled or restricted area badges are obtained ..” This conflicts with the statement on page 980of 102 of the solicitation a.1 Labor which states that restricted area badges will need to be obtained prior to the start of the contract. Please clarify this conflict.

A. a.1 labor NOTE, “NOTE: Individuals working on the contract will need to obtain controlled or restricted area badges prior to the start of the period of performance, to operate unescorted in restricted areas on Hill Air Force Base.” has been removed from Sections L and M.

16. PWS Appendix B in the Hill AFB Recycle collection area lists containers and schedules for Glass Cans, CB, Aluminum, and plastic. Appendix A designates 23 tons annually to “Cardboard & Paper,” N/A for “Glass,” N/A for “Plastic,” and no listing for aluminum volume. Will the government please describe the actual service requirements for these containers, are they collected separately or with the organic route and marketed as single stream material? If collected separately, will the government please provide the estimated annual volumes?

A. Glass, Aluminum, Plastics are collected in a single 40-yard container and would be marketed accordingly. No estimated annual volumes are available.

17. Appendix B, Pg 37 of PWS. Relative to the Roll off Table. “* Roll off container shall be multi-use and constructed with dividers so that each in organic recyclable material will have its own compartment. The container shall be labeled according to Appendix C.” None of the containers shown on the schedule are marked with an asterisk, so it is not possible to ascertain which ones this description applies to. These containers appear to be recyclable roll off type. Are these to be provided by the contractor? If so, how many are required? “Extra roll off containers will be needed as requested.” How many extra containers are required in addition to those listed in the table? Are all of these required to be “multi use” as described above? “Roamers Roll-Off and Load & Goes (available for temporary use)” The tables lists 6 containers with a Est. Collection Frequency of Daily.” Does this description represent 30 hauls per week or 6 halls per week?

A. The PWS has been updated regarding the questioned “*Roll off container shall...” portion

(deleted). Per the Est. Collection Frequency question, 30 hauls per month or daily.

18. What is the contract value of the current contract; base year, option years and total contract award?

A. Please see answer to question 4.

19. Page 3 of 102 Period of Performance indicates that the Base Period will commence 1 April 2016 and the offer due date is 07 March 2016. We respectfully request the Government allow a minimum 30-day period from date of award to start of service to allow for an orderly transition between contractors? The technical proposal criteria (a.5.) Transition Plan indicates that there will be a 45 to 30 day transition period.

A. The Government’s current refuse service contract ends on the 31st of March 2016. The refuse service requirement must start on 1 April 2016. The transition plan in (a.5) states, “(approximately 45 to 30 days or less).” Unfortunately, there is not enough time to grant a respectful request.

20. CLIN X010 Could you please define/explain the acronym NAE?

A. Net Amount Estimated (NAE). In order to evaluate and fund the unscheduled pick up line items (X010 and X011), the NAE is used for proposal purposes. Please see the line items for further direction.

21. CLIN X010 Could you please explain the term “one pick up with return” A. You would pick-up the container and bring it back to the same location.

22. CLIN X010 Could you please explain the term “one pick up, no return” A. You would pick-up the container and NOT bring it back to the same location.

23. CLIN X015 are we to price this line item? If so are we to use the current Davis County landfill fee of $30 per ton for all years?

A. Yes, and yes.

24. CLIN X015 are we to use the quantity of 3,435 tons when pricing this line item?

A. See each X015 line item for the estimated quantity of tons. The estimated 6870 tons is for a full year and the estimated 3,435 tons is for half of a year.

25. FAR Clause 52.222-17 Nondisplacement of Qualified workers (May 2014) is not included in the list of Clauses Incorporated by Reference page 66 of 102 of Solicitation. However, it is referenced as a flow down clause required to be incorporated in any subcontract agreement, pg 85 of 102 52.212-5 (b) (1) (iii). FAR Clause 52.222-17 Nondisplacement of Qualified workers (May 2014) should be included in the solicitation.

A. Thank you. FAR Clause 52.222-17 Nondisplacement of Qualified Workers has been added.

26. Proposal Instructions, 2. Part II Technical Proposal (a.1) Labor: pg 98 of 102. “The offeror shall demonstrate that it currently employs and is able to assign to this effort personnel that are adequately trained, qualified, and hold active controlled or restricted area badges; or, provide a detailed plan as to how it will provide personnel that are adequately trained, qualified, and able to obtain controlled or restricted area badges in accordance with the PWS.” In accordance with FAR Clause 52.222-17 Nondisplacement of Qualified workers (May 2014) any successful offeror other than the incumbent is required to first make good faith offers of employment to those employees employed under the predecessor contract. As we intend to comply with 52.222-17 and anticipate that the employees employed under the predecessor contract will accept the good faith employment offers, would this plan receive an Acceptable rating under Technical Evaluation Factor 4. (a.1) Labor?

A. There are many ways to meet the Acceptable rating for a.1 Labor. If the offeror fulfills

Section M’s requirement of “The offeror has demonstrated that it currently employs and is able to assign to this effort, personnel that are adequately trained, qualified, and hold active controlled or restricted area badges; or, provided a detailed plan of how it will provide personnel that are adequately trained, qualified, and able to obtain controlled or restricted area badges in accordance with the PWS.” for (a.1), then the offeror would be considered acceptable.

27. Please reference PWS, Appendix B, page 37. The list of Recycle Collection Stations reflects 8‐ Cubic Yard Containers. Appendix E, Government furnished containers reflects 210 each 6‐CY containers. Please explain the contradiction.

A. Appendix B is correct and the PWS has been updated.

28. Please reference PWS, Appendix B, Recycle Collection Building # 1621 ‐ the second of two containers reflects a 7‐CY container, is this an error?

A. Yes, should be 8.

29. Please reference PWS, Appendix B, Refuse Collection Stations, building # 891. The Wednesday Collection reflects 8‐CY on Wednesday and 6 CY on Monday and Friday.

A. Wednesday should be 6.

30. Please reference Appendix B, Page 22, first paragraph Note, "ALL containers are 6 Cubic Yards unless otherwise designated in the “nomenclature‐description” below. Additionally, food waste and sawdust containers will be designated. The nomenclature listed may be added to or subtracted from based on the needs of the Government." Can the government please identify the food containers and sawdust containers?

A. These are identified in Appendix B.

31. Please reference note on page 37 of the PWS ‐ "* Roll off container shall be multi‐use and constructed with dividers so that each in organic recyclable material will have its own compartment. The container shall be labeled according to Appendix C." How many of these containers are required, what is the cubic yard capacity, and who will furnish them?

A. Please see answer to question 17.

32. Please reference Appendix B schedules. In reference to Roll Off Services, does "Daily" indicate they must be picked up 5 days per week, Monday through Friday, regardless of the amount of material noted in the container, or does it mean they must be checked daily and the contractor may manage the service requirements in order to prevent unsightly full containers?

A. We will allow the Contractor to “check” it and service on an as-needed basis. However, the

Government does not know the frequency to which service is required.

33. Reference PWS 1.1.8.1 states that all bulk refuse dumpsters shall be cathedral type with durable plastic lids. Dumpsters placed along loading docks must be convenient for customers to throw refuse away from the dock. Considering this requirement, we assume these may need to be standard, or "flat top" style FEL containers. If so, how many flat top style containers will be required for dock site application and which locations will the government require this flat top style container?

A. The dumpster style/type shall be similar to those found in the photographs provided.

34. Reference PWS 1.1.8.1 Can the government identify the collection stations that required flat top style containers for dock side use?

A. The photos provided represent the flat top style containers that are being used.

35. Can the government provide historical data to provide the number of Open Top Roll Off Container Loads serviced over the past year?

A. See Page 21 (Historical Data FY12 – FY14)

36. Can the government provide historical data to provide the number of Roll Off Compactor Loads disposed over the past year?

A. See Page 21 (Historical Data FY12 – FY14)

37. Can the government provide historical data to provide the number of Front End Loader (Commercial) Loads disposed over the past year?

A. See Page 21 (Historical Data FY12 – FY14)

38. Can the government provide the age of the Government furnished Recycle Containers?

A. Approximately 16 years old.

39. Can the government provide the contractor the government's expected useful life in years of the government furnished contractors?

A. They are Government owned containers and if maintained properly should last for many years to come.

40. The government indicates that they contractor will be responsible for government owned container maintenance. The government also provided a few pictures of the recycle containers, however the information provided states the pictures may not represent the current condition.

The contractor cannot know the present day condition of each and every government furnished container, however the contractor is expected to estimate a budget for GFE repair and maintenance. The incumbent contractor is the only one who has full knowledge of the actual container condition information. Can the government provide a complete condition report on all Recycle Containers, including the lid condition, lift pocket condition, screen condition, bottom condition, and side condition of all containers?

A. The Incumbent Contractor has adequately kept these containers in a usable condition, therefore the photographs provided do represent the current condition of these containers.

41. Will the government support a joint inspection of all government furnished containers with a representative of the contractor and a representative of the government in order to determine a base line condition of all GFE prior to the start date of the contract?

A. Upon award, yes.

42. Will the current incumbent contractor be responsible to bring all government furnished recycle containers up to the existing contract PWS standard before the current contract expires and the new awarded contract begins?

A. Please read 1.4.2. This is irrelevant since the new Contractor will be responsible to perform this effort in accordance with the requirements in this Paragraph.

43. Will the contractor be responsible to replace lids that may be removed by government employees in order to facilitate their loading of the containers?

A. Yes, but to our knowledge, this has not been a problem/issue.

44. In the event that a government furnished recycle container develops visible rust between the "every two year" scheduled painting, will the contractor be required to paint the container before the scheduled painting date?

A. Yes, paragraph 1.4.2 states “at a minimum of once every two years”, means you do not need to wait 2 years.

45. With age, and especially in certain climates, metal containers will eventually rust, especially at the lower bottom 6 inches, or so, of the sides and the bottom service. The rust will eventually reach a point that the contractor's task to find good metal to weld to becomes difficult. The task to patch rust holes as soon as rust appears will require multiple maintenance services, multiple container removals, and multiple spot paintings. At what point will the government determine the container has reached its useful life and require replacement of the container?

A. This type of incident should be reported in accordance with Paragraph 1.4.3. This issue would require resolution on a case by case basis.

46. If this contract is extended beyond the full 60‐month term (including all option) and the government furnished recycle containers, and/or refuse containers cycle into another 2‐year painting schedule, will the contractor be required to paint all of them again during a possible 1 to 6‐month extension?

A. Containers shall be maintained in accordance with PWS requirements.

47. If the government cannot provide the information requested in question # 39, will the government consider adding a CLIN for the government to reimbursement the contractor for repairs required in order for the container to maintain a condition that will satisfy the PWS?

A. An additional CLIN will not be added.

48. Will the contractor be required to provide service to Roll Off Containers with a "Daily" service collection schedule as reflected in Appendix "B" of the PWS regardless of the volume of refuse, or other material in the container?

A. Please see answer to Question #32

49. If the contractor determines that a Roll Off Container with a service collection schedule of "Daily" is not full enough to service and, in the driver's judgement, has enough empty space to remain another day at the collection station without service, will the contractor be allowed to skip the Daily service without a deduction in payment for the scheduled service?

A. With the lids in-place and closed, how will the Contractor/Driver determine whether the container is full or not? Since, the truck is already in-place, business wise, it only seems reasonable to “tip” the container no matter how full it is. However, the Contractor is responsible for the performance risk associated with a determination being made. The Government cannot predict what is disposed of on a daily basis, therefore if the dumpster becomes overfilled due to a Contractor judgement, the Government will not be responsible to unload or make the dumpster transportable.

50. If the contractor determines that a Recycle Container is not full enough to service and, in the driver's judgement, has enough empty space to remain another day at the collection station without service, will the contractor be allowed to skip the scheduled service without a deduction in payment for the scheduled service?

A. See answer to 49.

51. If the contractor determines that a FEL Refuse Container is not full enough to service and, in the driver's judgement, has enough empty space to remain another day at the collection station without service, will the contractor be allowed to skip the scheduled service without a deduction in payment for the scheduled service?

A. See answer to 49.

52. Please reference PWS, paragraph 1.1.1.1 with consideration also given to Paragraph 1.1.7 ‐ Paragraph 1.1.1.1 states "The initial vehicle routes and collection schedules shall be submitted to the Contracting Officer (CO) within five (5) calendar days after the start of contract performance. The contractor may propose adjustments to the schedule at any time but as a minimum the Contracting Officer’s designated Representative (COR) (Quality Assurance Personnel) and contractor shall monitor fill capacities during the first 30 days of performance and during one other period to be agreed upon during the same performance period. No changes are allowed to the schedule or haul route without CO or COR coordination." If, after the first 30 days of performance, the contractor determines the fill capacity is low enough to reduce the frequency of the scheduled services, will the contractor be required to provide a credit to the government for the proposed reduction in required services?

A. No, this is a Firm Fixed Price contract.

53. Please reference PWS, paragraph 1.1.1.1 ‐ "As a pilot project, 5% of the refuse containers shall be made of commercial grade plastic colorefd to match as closely as possible Dakota Brown Federal paint number 30099 (Sherwin‐Williams # 2056), while the other 95% shall be made of steel." Does the government consider the poly lids attached to steel containers to qualify for the required 5% of the refuse container for the purpose of this requirement, or does the government require the bottom floor, sides, lids, etc. to be made of commercial grade plastic?

A. Poly lids not considered part of this requirement

54. Will the government allow the contractor visit the work site prior to submittal of the proposal?

A. Please see answer to question 1.

55. Can the Government identify the applicable wage category for front load and roll of drivers?

A. Refuse Collector

56. Can the Government confirm that all employees who perform work on this contract are required to receive health and welfare benefits of $4.27 per hour?

A. The Government will require the awardee to comply with the Service Contract Labor

Standards, in accordance with the solicitation’s clauses FAR 52.222-41 and FAR 52.222-42.

57. Will the Government verify that the contractor is following the collection schedule?

A. Yes.

58. Will the contractor be allowed to deviate from the collection schedule?

A. Please read PWS Paragraph 1.1.1.1.

59. Can the contractor manage the collection schedule should they find efficiencies? Example; if a location receiving 3 times a week collection service is being over serviced, can the contractor reduce the frequency to 2 times a week and keep the savings?

A. Please read PWS Paragraph 1.1.1.1.

60. How will the Government monitor the maintenance of containers and verify that the schedule for cleaning, painting and repairs are followed?

A. The Government will be working closely with the Contractor as well as obtaining the information provided in accordance with Paragraph 1.4.3.

61. Will the contractor be allowed to deviate from the container maintenance schedule such as skip cleaning or painting if it’s not necessary?

A. No, the maintenance is vital to the life of the containers and the Government requires this service to be performed.

62. The totals for recycling containers and the associated pickups seem slightly low in Appendix B

(page 45). Please advise.

A. According to the frequency identified on Page 45, daily doesn’t seem to be low.

63. Of the 11 40 cubic yard permanent roll-offs that are listed in Appendix B (page 37) for daily pickup (not including the roamers/load and gos), how many of that total are designated for refuse, how many for C&D, and how many are for recycling?

A. First, please note there are 10, not 11. They are all for C&D.

64. Appendix B (page 37) states that there are 6 roamer/load and go roll-offs with daily service, yet Appendix A states only 22 occurrences per year for these. Please advise which is correct. Note:

The answer to this question will significantly affect price.

A. This is a Daily requirement.

65. Can the cost of disposal for food waste and/or C&D be entered against CLIN x015 with receipt?

(i.e. There will be a disposal charge for these regardless if they are taken to a landfill. It may not be $30/ton, but there will be a disposal charge. Should the cost for disposal of those items just be included in CLIN x002 for the food tons and CLIN x011 for the C&D tons or not considered since they will be covered in CLIN x015?)

A. The cost for each specific item shall be charged under the applicable CLIN. Food under CLIN

X002 and C&D under CLIN X011.
