viii. 52.212-1, Instruction to Offerors – Commercial, applies to this acquisition.
52.212-1 Addendum – Proposal Preparation Instructions
A. To assure timely and equitable evaluation of the proposal, the offeror must follow the instructions contained herein. The proposal must be complete, self-sufficient, and respond directly to the requirements of this solicitation. The response shall consist of three (3) separate
Parts: Part I – Price Proposal and Part II – Technical Proposal, Part III – Bid Sample.
B. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and, if in the contracting officer’s opinion adequate price competition exists, no additional cost information will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the contracting officer http://farsite.hill.af.mil/reghtml/regs/far2afmcfars/fardfars/far/15.htm#P587_118401 determines that adequate price competition no longer exists offerors may be required to submit information other than cost or pricing data to support a determination of price reasonableness.
C. Documents submitted in response to this solicitation must be fully responsive to and consistent with: (1) Requirements of the solicitation and SOW, including Government standards and regulations pertaining to the SOW; (2) Evaluation Factors and Subfactors for Award.
D. All information contained in the proposal that an offeror feels is “Proprietary Information”, and therefore, not releasable under the Freedom of Information Act (FOIA), should be labeled
“Source Selection Information – See FAR 2.101 and 3.104”.
E. Offeror should acknowledge awareness of all amendments to the solicitation by signing and dating Page 1 of each Amendment of Solicitation and include it in Part I – Price, of the proposal.
F. Part I – Price Proposal
i. Complete the solicitation Bid Schedule (section 2.2) of this RFP by inserting the proposed unit price and extended price in the respective blocks. Any offer received without the completed schedule will be determined “nonresponsive” to the RFP and will not be considered for award.
Proposed unit must be whole dollar values (e.g. $10.00). The extended amount must equal the whole dollar unit price multiplied by the number of units.
ii. For this requirement, the proposed technical solution will require extensive field testing and legal review/approval prior to the award being made. Due to this limitation, proposals must remain valid for an extended amount of time to allow for the required testing and approval to be completed. Therefore, the Government requires a minimum acceptance period of 180 calendar days from the date of receipt of offers. The offeror’s proposal must affirmatively state an acceptance period equal to, or greater than, 180 calendar days. Offerors shall include this statement in their Price Proposal. Any offer received without this statement will be determined
“nonresponsive” to the RFP and will not be considered for award.
iii. Complete the necessary fill-ins and certifications in provisions. The provision 52.212-3 shall be submitted to the Contracting Officer as part of the offeror’s price proposal or be available through the Government’s System for Award Management (SAM). The provision 252.209-7991
(included in full text in section 5.0 of this solicitation) shall be submitted to the Contracting
Officer as part of the offeror’s price proposal.
G. Part II – Technical Proposal (Product Specifications and Information and On-Site Training
Plan).
i. A – Product Specifications and Information. The offeror will include detailed specifications and product information regarding the offeror’s proposed Portable Anti-Drone Defense device.
The offeror’s proposed Portable Anti-Drone Defense product specifications and information must be detailed to show that the product can meet the minimum specifications outlined in the
SOW (Attachment 1).
ii. B – On-Site Training Plan. The Technical Proposal shall also include the offeror’s plan to conduct On-Site Training IAW the SOW to include tasks and milestones.
H. Part III – Bid Sample
i. The Government requires one (1) sample of the offeror’s proposed product to be submitted with the proposal. The sample shall include all parts and accessories (to include a shipping container to securely transport via private contracted courier) that would be provided with a delivered unit IAW the SOW. The Bid Sample will be tested to ensure it meets or exceeds the technical specifications listed in the SOW to include: technical aspects, Nuclear HERO certifications, and Law of Armed Conflict (LOAC) legal determinations. The Bid Sample will be transported by the Government to multiple test facilities.
(End of Addendum)
ix. 52.212-2 Evaluation – Commercial Items (Jan 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
1) Price
2) Technical capability of the item offered to meet the Government requirement
Award will be made to the lowest priced technically acceptable offer (LPTA).
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the
Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of Provision)
52.212-2 Addendum
A. Basis for Contract Award
i. This acquisition will be conducted as a Lowest Price Technically Acceptable (LPTA) source selection IAW FAR Parts 12, 13, and 15, as supplemented by the Defense Federal Acquisition
Regulation Supplement (DFARS), the Air Force Federal Acquisition Regulation Supplement
(AFFARS), the DoD Source Selection Procedures, Appendix A, dated 01 Apr 16, and the Air
Force Mandatory Procedures, 5315.3, dated 21 Apr 14. These regulations are available electronically at the Air Force (AF) FARSite, http://farsite.hill.af.mil. The Government will select the proposal with the lowest evaluated price from among those meeting the acceptability standards for non-price factors. Contract may be awarded to the offeror who is deemed responsible in accordance with the FAR Part 9.1, as supplemented, whose proposal conforms to the solicitation’s requirements (to include all stated terms, conditions, representations, certifications, and all other information required by 52.212-1 of this solicitation) and is judged, based on the evaluation factors and subfactors, to represent the lowest price technically acceptable proposal. While the Government will strive for maximum objectivity, the source selection process, by its nature, is subjective; and therefore, professional judgment is implicit throughout the entire process.
ii. The Government intends to award one (1), Firm Fixed Price (FFP), Indefinite Delivery
Indefinite Quantity (IDIQ) contract for this requirement.
iii. Discussions. If, during the evaluation period, it is determined to be in the best interest of the
Government to hold discussions, offeror responses to Evaluation Notices (ENs) and the Final
Proposal Revision (FPR) will be considered in making the source selection decision. If the offeror’s proposal has been evaluated as acceptable at the time discussions are closed, any changes or exceptions in the Final Proposal Revision are subject to evaluation and may introduce risk that the offeror’s proposal be determined unacceptable and ineligible for award.
iv. Solicitation Requirements, Terms, and Conditions. Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as factors or subfactors. Failure to comply with the terms and conditions of the solicitation may result in the offeror being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and must provide complete supporting rationale. The Government reserves the right to determine any such exceptions unacceptable.
B. Evaluation Methodology.
i. The award decision will be made on the basis of LPTA. In order to be eligible for award, offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, evaluation factor requirements, and be deemed responsible
IAW FAR Part 9. If an offeror fails to meet all solicitation requirements, the Government may not make an award to that offeror.
http://farsite.hill.af.mil/
ii. Proposals will be evaluated using the following Factors and Subfactors:
Factor A. Price
Factor B. Technical
Subfactor 1 – Product Specifications and Information
Subfactor 2 – On-Site Training Plan
Subfactor 3 – Bid Sample
ii. The Government will evaluate proposals for technical acceptability, but will not rank the proposals by the non-priced factors. Technical will be evaluated for acceptability and price will be evaluated for reasonableness. The Government reserves the right to award without discussions, to open discussions, or to establish the competitive range IAW FAR 15.306(c).
C. Evaluation Factors and Subfactors.
i. Factor A – Price. First, offers will be ranked by price. Each offeror’s price proposal will be evaluated to ensure it is fair and reasonable pursuant to FAR 15.404. For additional information, see FAR 31.201-3. Offerors whose price is determined to be unreasonable may not be considered for award and will be eliminated from competition.
ii. Factor B – Technical.
a. After ranking proposals by price, the Government’s technical evaluation team shall evaluate the written technical proposals (Technical Subfactors 1 and 2) on an acceptable or unacceptable basis, assigning one of the ratings for each subfactor. Any subfactor evaluated as “Unacceptable” will render the entire proposal unacceptable, and therefore, unawardable. Only those written proposals determined to be technically acceptable, either initially, or as a result of discussions, will move on to the evaluation of Subfactor 3 – Bid Sample. Technical Subfactors will be given an evaluation rating using the below table:
TABLE 1 - TECHNICAL RATINGS
Rating Description
Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
b. Subfactor 1 – Product Specifications and Information. This subfactor will receive an
“Acceptable” rating when the offeror’s proposed product specifications and information detail how their proposed product will meet or exceed the required specifications IAW sections 1.2.
and 2.0. of the SOW.
c. Subfactor 2 – On-Site Training Plan. This subfactor will received an “Acceptable” rating when the offeror’s proposed On-Site Training Plan details the offeror’s plan to provide on-site training to include use, service, maintenance, and basic repair IAW section 4.0. of the SOW.
d. For those offers evaluated as “Acceptable” under Subfactors 1 and 2, their Bid Sample will then be tested and evaluated for technical acceptability. The sample shall include all parts and accessories that would be provided with a delivered unit IAW the SOW, as well as a shipping container to securely transport via private contracted courier. The Bid Sample will be tested to ensure it meets or exceeds the technical specifications listed in the SOW to include the technical aspects, Nuclear HERO certifications, and LOAC legal determinations. During evaluations, the
Bid Sample unit will be transported by the Government to multiple test facilities. The Contractor will NOT have the opportunity to be present during sample testing.
e. Subfactor 3 – Bid Sample. This subfactor will receive an “Acceptable” rating when the offeror’s proposed Bid Sample meets or exceeds the specifications and requirements IAW sections 1.2., 2.0. and 3.0. of the SOW as a result of the Government testing and evaluation.
f. If the Offeror fails to deliver a Bid Sample on time, or if the Contracting Officer disapproved the Sample for failure to meet the specifications of the SOW, the Offer shall be determined to be
“Unacceptable” and will render the entire proposal unacceptable, and therefore, unawardable.
D. Small Business Subcontracting Plan: IAW DFARS 215.304(c)(i), small business participation is exempted from being part of the evaluation for LPTA source selections.
However, offerors are reminded that IAW FAR 19.702(a)(1), if the apparently successful offeror is a large business, and their total proposed amount exceeds $700,000, they will be required to submit an acceptable subcontracting plan before the contract can be awarded. If the apparently successful offeror fails to negotiate a subcontracting plan that is acceptable to the contracting officer within the time limit prescribed by the contracting officer, the offeror will be ineligible for award.
