REQUESTS FOR INFORMATION

Q1. Are the employees of the AGE/TA portion of this contract, currently performed by

Trailboss, covered by the TUPE requirement?

A1. The US Government is not involved with related Transfer of Undertakings (Protection of

Employees) Regulations 2006 (TUPE) processes and associated liabilities (to include indemnification) that may transpire during pre-award or post-award phases between transferor and transferee. For more information about TUPE, please go to http://www.legislation.gov.uk/uksi/2006/246/contents/made

Q2. Can the Contracting Office confirm that contracts of employment for employees of Trailboss are based and bound by US or UK employment law?

A2. The 501 CSW/RCO are not involved with contracts of employment for contractor staff.

Both current contracts are applicable to DFARS clause 252.222-7002, Compliance with Local

Labor Laws (Overseas).

Q3. Per industry day slides and discussions, it was stated email proposal submissions are accepted. If we choose to submit via email, is the hard copy submission still required?

A3. Hard copy submission is not required if email submission is done.

Q4. Are contractors required to register and get a local UK tax number?

A4. Offerors submitting proposals shall meet all requirements to be able to conduct business within the United Kingdom.

Q5. Does the contractor have to comply with the local labor laws for the hiring and firing of employees?

A5. DFARS clause 252.222-7002, Compliance with Local Labor Laws (Overseas) is included within the solicitation

Q6. Please confirm that maintenance of the Spray Booth and its ancillary equipment is not part of the contract. In addition, could you please confirm that the quality of any breathing air supplied to the Spray Booth is routinely verified to a standard that meets the requirements detailed in HSG 53 Respiratory Protective Equipment at Work?

A6. Spray booth and associated equipment are a part of the GFE/GFP provided for performance of this contract. These are listed in Appendix E of the PWS. Contractor is responsible for all http://www.legislation.gov.uk/uksi/2006/246/contents/made

GFE/GFP IAW PWS paragraph 2.1.3. Parts and consumables for GFE/GFP are acquired IAW

PWS paragraph 1.3.

Q7. Is it a must that all drivers have their CDL licensing and the ADR endorsement from

England for on base and off base driving?

A7. All contractor personnel required to operate vehicles must have appropriate licenses to do so within the Country of performance and compliant with local laws IAW PWS paragraph 1.4.4.

Q8. The RFP states contractor required to sample/analyze Cryogenics samples. At other

Cryogenics facility samples are taken by contractor employees but the samples are sent to government lab for analysis/certification results. Are we required to have qualified/certified individuals to perform this task? If not what school/course would government accept for meeting contractor qualifications?

A8. PWS paragraph 1.2.5. and subsequent subparagraphs 1.2.5.1. through 1.2.5.9., describe what is required for Cryogenics as a part of Fuels Management. PWS paragraph 1.4.6.2. covers all required qualifications for Fuels Management, to include laboratory functions.

Q9. The Solicitation requires that the contractor comply with USAF and host nation health and safety laws. UK Health and Safety law requires that certain tests and examinations of lifting and pressure equipment are carried out. Can the Contracting Office confirm that the thorough examinations required by Lifting Operations and Lifting Equipment Regulations have been carried out and confirm their understanding that these will be required under the new contract?

A9. All lifting operations/equipment & pressure testing, along with all equipment provided under this contract, are in compliance with applicable directives, technical orders, owner’s manuals, AFOSH, & OSHA standards. PWS paragraph 3.8 Safety Requirements describes safety requirements for this contract.

Q10. In addition can the Contracting Office confirm that pressure equipment inspections and tests have been carried out as required by the Pressure Systems Safety Regulations 2000 and confirm their understanding that these will be required under the new contract?

A10. All equipment & pressure testing, along with all equipment provided under this contract, are in compliance with applicable directives, technical orders, owner’s manuals, AFOSH, &

OSHA standards. Other hydrostatic testing shall be performed IAW PWS Appendix C, paragraph 2.2.1.

Q11. Appendix C Work Load Data for JP 8 gallons issued is nearly double gallons received.

Could the government explain this difference?

A11. Recent changes to the USAFE IMP (Inventory Management Plan) have reduced JP8 inventory levels required at RAF Fairford; therefore complete replenishment of JP8 gallons issued has not been required.

Q12. Is contractor required to climb on top of GFE vehicles for inspection/maintenance? If so does the facility have applicable/certified fall protection device to ensure safety of employee when required to climb on top of GFE vehicles?

A12. Contract employees are not allowed to climb on top of GFE vehicles for inspection and/or maintenance per Working at Height Regulations 2005. The contractor shall be responsible for safety measures under their Safety Program per PWS Paragraphs 1.4.7.3, 1.4.7.4, and 3.8. All safety equipment provided, to include mobile stairs with protection guard rails, are listed in PWS

Appendix E.
