The purpose of this amendment is to:

1. Add section 2(b) to the technical acceptability paragraph under 52.212-2. The language that has been added is as follows:

b) Technical Implementation – The Offeror’s method of service implementation (transmission medium – Satcom/Fiber/Radio/etc..) will be evaluated to ensure the method chosen is able to adequately support the requested services. This evaluation will only be acceptable/unacceptable, based upon the ability of the method to perform the required services.

2. Please see summary of changes

Except as provided herein, all terms and conditions of the document referenced in Item 9A or 10A, as heretofore changed, remains unchanged and in full force and effect.

SUMMARY OF CHANGES

52.212-2 -- Evaluation -- Commercial Items.

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government using a Lowest Price Technically Acceptable (LPTA) Source Selection Process in accordance with FAR PART 15.101-2.

Under the LPTA evaluation process, Technical Capability will be evaluated and rated on an acceptable/unacceptable-basis, and trade-offs with relation to Price will NOT be permitted. An ordered evaluation process will be conducted as further defined below whereby the Government will award to the lowest evaluated priced proposal meeting or exceeding the acceptability standards for Technical Capability.

1. Price Evaluation - Each offeror’s line item price will be verified by multiplying the quantities identified at the contract line item number (CLIN) level by the proposed unit price to confirm the extended amount for each CLIN (to include the base period AND the option years). The offeror’s total proposed price will be verified by adding base period CLINs and all option year CLINs.

Comparisons of the proposed pricing by offerors received in response to the solicitation will be evaluated as an aggregate total representing proposed final contract price. For the evaluation of the option price pursuant to FAR Clause 52.217-8, Option to Extend Services, 50% of the total year price proposed for the last option period (CLIN 4001) will be added to the total proposed price to calculate the offeror’s overall total evaluated price (TEP).

2. Technical Acceptability - Next, the government shall evaluate the technical acceptability of proposals submitted by offerors with the three (3) lowest TEPs on an acceptable/unacceptable basis, assigning a rating of Acceptable or Unacceptable. If fewer than three (3) quotes are received all quotes will be evaluated for technical acceptability

Technical Acceptability shall be evaluated on the following subfactors:

a) Technical Description - The Offeror's technical description will be evaluated to determine the offeror’s understanding of the requirements and their qualification to perform the IT related services required by this solicitation.

b) Technical Implementation -The Offeror’s method of service implementation (transmission medium-Satcom/Fiber/Radio/etc..) will be evaluated to ensure the method chosen is able to adequately support the requested services. This evaluation will only be acceptable/unacceptable, based upon the ability of the method to perform the required services.

3. Evaluation - Complete and accepted offers will first be sorted by total price from lowest to highest, then technical acceptability will be analyzed according to requirements set forth in this solicitation. If within the three (3) lowest priced quotes two (2) or more technical plans are rated as acceptable, the evaluation process will then be stopped and awardee selected. Award shall be made to the offeror with the lowest price and an acceptable technical proposal.

If one or none of the three (3) lowest priced quotes are deemed technically acceptable then the next lowest priced quote will be evaluated for technical acceptability. This process will continue as needed until a minimum of two (2) quotes are rated Acceptable for Technical capability, or until all quotes have been evaluated.

The government intends to award a contract without discussions with respective offerors. The government, however, reserves the right to conduct discussions if deemed in its best interest.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
