Evaluations

FAR Provision *52.212-2, Evaluation -- Commercial Items (Oct 14), applies to this acquisition and the following evaluation is applicable:

(a) The Government will award a contract resulting from this RFP to the responsible vendor whose proposal conforming to the RFP will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate proposals:

(i) Price

(ii) Technical

(iii) Past Performance Technical and past performance, when combined, are significantly less important than price.

(b) Options. The Government will evaluate proposals for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a proposal is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of a proposal, mailed or otherwise furnished to the successful vendor within the time for acceptance specified in the proposal, shall result in a binding contract without further action by either party. Before the proposal’s specified expiration time, the Government may accept a proposal (or part of a proposal), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of Provision)

ADDENDUM TO FAR PROVISION 52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND

COMMERCIAL SERVICES.

52.212-2, ADDENDUM:

A. Vendor's submissions will be evaluated on price, technical, and past performance.

B. Evaluation Criteria:

1. Part I - PRICE PROPOSAL:

a. Offerors will enter Unit Price and Total Amount for each CLIN listed on the Price Schedule, in addition to the Grand Total. The Price Schedule is located on page 2 of this solicitation.

b. For award purposes, the Government will calculate the CLIN Evaluated Price (CEP) by multiplying the listed Quantity by the Unit Price entered by the offeror. In the event of a discrepancy between CEP and the Total Amounts entered on the Price Schedule, CEP will take precedence.

c. The Government will evaluate offers for award purposes by adding the CEP of the base year CLINs to the CEP of all option CLINs (including the 6-Month Extension) to calculate the Total Evaluated Price (TEP). Furthermore, the Government may determine that an offer is unacceptable if the option prices are materially unbalanced. In the event of a discrepancy between TEP and the Grand Total in the Price Schedule, TEP will take precedence. Proposed prices will become fixed prices on the contract. Evaluation of options shall not obligate the Government to exercise the option(s).

(Qty) * (Unit Price) = CEP

∑CEP = TEP

2. Part 2 - TECHNICAL:

a. Technical will be evaluated on an Acceptable/Unacceptable basis. If an offeror submits a valid Vaisala System Level Service Certification substantiating that the offeror is trained/authorized to work on Vaisala equipment, the offer will be rated as “Acceptable” under the Technical factor.

b. Failure to submit the required certification at the time of the submission of offers (RFP due date) will constitute a material omission, render the offer unresponsive, and the offer will be rated as “Unacceptable” under the Technical factor.

3. Part 3 - PAST PERFORMANCE:

a. Past performance will be evaluated on an Acceptable/Unacceptable basis using the Contractor Performance Assessment Reporting System (CPARS). CPARS is a web-enabled application that assesses a contractor's performance and provides a record, both positive and negative, based on objective facts and supported by program and contract management data. Offeror's Past performance will be determined Acceptable if the record shows that the offeror has no adverse past performance on recent and relevant contract efforts. Adverse Past Performance means a rating of Unsatisfactory in any category of the CPARS report. Consequently, a rating of "Marginal" is not considered adverse past performance, as defined in this solicitation.

ii. Recent means that the end of the period of performance was within 5 years of the date this solicitation was issued. "Within" means that no more than 5 years passed between the end of the period of performance and the date that this solicitation was issued.

iii. Relevant means contracted efforts where the government is the end user, and where the offeror has performed work in the same or related industry.

b. If CPARS data generates multiple recent and relevant reports for the offeror, the Government may only evaluate three (3) of the most recent CPARS reports in relevant contract efforts to identify any adverse past performance.

(End of Addendum)

Discussions: The government intends to award a contract without discussions with respective offerors. The government however, reserves the right to conduct discussions if deemed in its best interest.
