Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

(i) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA Federal Supply Service Specifications Section, Suite 8100, 470 East L'Enfant Plaza, SW, Washington, DC

The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS +4” followed by the DUNS or DUNS +4 number that identifies the offeror's name and address. The DUNS +4 is the DUNS number plus a 4-character suffix that may be assigned at the discretion of the offeror to establish additional CCR records for identifying alternative Electronic Funds Transfer (EFT) accounts (see FAR Subpart 32.11) for the same parent concern. If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one. An offeror within the United States may contact Dun and Bradstreet by calling 1-866-705-5711 or via the internet at http://www.dnb.com. An offeror located outside the United States must contact the local Dun and Bradstreet office for a DUNS number.

(k) Central Contractor Registration. Unless exempted by an addendum to this solicitation, by submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the CCR database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the CCR database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror. AMENDMENT OF SOLICITATION PRIOR TO PROPOSAL CLOSING TIME

The Government reserves the right to revise or amend the specifications, drawings or the solicitation prior to the proposal closing time. Such revisions or amendments, will be communicated by amendments to this Request For Proposal. If such amendments require material changes in quantities or prices, the proposal closing date may be postponed by enough days to enable offerors to revise their proposals. In such cases, the amendment will include an announcement of the new proposal closing date and time.

POSTPONEMENT OF PROPOSAL CLOSING DATE

a. An amendment postponing proposal closing may be issued even after the time scheduled for proposal closing, under the following conditions:

(1) When the Contracting Officer has reason to believe that the offers of an important segment of offerors have been delayed in the mails for causes beyond their control and without their fault or negligence (such as, but not limited to, flood, fire, accident, weather conditions or strikes); or

(2) When emergency or unanticipated events interrupt normal governmental processes so that conducting proposal closing as scheduled is impracticable.

b. At the time a determination is made to postpone a proposal closing under subparagraph a(1), above, an announcement of the determination shall be publicly posted and, if practicable before issuance of formal amendment of the RFP, otherwise communicated to prospective offerors.

c. In the case of subparagraph a(2) above, the Contracting Officer may proceed with the proposal closing date as soon as practicable after the time scheduled, without prior amendment to the RFP or Notice to Offerors when it is in the best interest of the Government. In such case, the time of actual proposal closing shall be deemed to be the time set for proposal closing for the purpose of determining late proposals.

POST-AWARD/PREPERFORMANCE CONFERENCE

( X )APPLICABLE WHEN CHECKED

(Applicable if contract is $100,000 or more or if checked at Contracting Officer's option)

52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Price and Past Performance I. Performance Price Trade-Off (PPT): This acquisition will utilize the PPT technique to make a best value award decision. Price and Past Performance will be treated as approximately equal areas and may be traded off, one against the other, as addressed in paragraph (3) below. The application of the PPT technique in the contract award and selection and approval process is as follows:

(1) All offerors will receive a performance confidence assessment rating as defined in the table under Past Performance Confidence Assessment Section, paragraph (2).

(2). If the lowest evaluated price offeror has also received a substantial confidence performance confidence rating, this offeror’s proposal represents the best value for this acquisition and award shall be made to this offeror, subject to a positive responsibility determination.

(3). The Government reserves the right to award a contract to other than the lowest evaluated price offeror if the low offeror receives other than a substantial confidence performance confidence rating. In these cases, price and past performance are both treated as approximately equal areas and may be traded off, one against the other. The source selection authority shall make an assessment of the price proposed and the performance confidence rating assigned and trade one off for the other to determine the best value for the Government.

II. Price Proposal:

(1) The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer’s opinion, adequate price competition exists no additional cost information will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists offerors may be required to submit information other than cost or pricing data to support a determination of price reasonableness.

(2) Complete blocks 12, 17a, and 30a, b, and c of the SF1449. In doing so, the offeror accedes to the contract terms and conditions as written in the solicitation, with attachments. The solicitation constitutes the model contract.

(3) Insert proposed unit and extended prices in the Pricing Schedule. The extended amount must equal the whole dollar unit price multiplied by the number of units. The proposal(s) must be submitted for a base year plus and three (3) six-month option periods. Total evaluated price will be calculated by adding the extended value of all CLINs (including option periods.)

III. Past Performance Confidence Assessment:

SUBMIT THE DOCUMENTS IDENTIFIED IN

PROVISION 52.212-1 PARAGRAPHS 2, a, 1 AND 2.

Definitions.

“Performance confidence assessment” is an evaluation of the likelihood (or government’s confidence) that the offeror will successfully complete the solicitation’s requirements; the evaluation is based upon past performance.

"Performance Confidence Assessment Group (PCAG)" is a group of experienced government personnel assigned to accomplish the Performance Confidence Assessment.

(1) Performance Confidence will be evaluated in accordance with FAR 15.305(a)(2). In assessing past performance, the evaluators will employ several approaches including:

(a) Reviewing the experience listed in the proposal.

(b) Seeking additional present and past performance information through the use of simplified questionnaires, and

(c) Using data independently obtained from other government and commercial sources. (such as the Contractor Performance Assessment Reporting System (CPARS).

(2) The offeror’s past performance will be evaluated through the accomplishment of a confidence assessment rating based on aspects of the offeror’s recent and relevant past performance and quality of performance, focusing on and targeting performance that is relevant to this project as defined in paragraph 4 below. For each contract submitted under Past Performance, the Government will make a determination of whether the contract is Recent and then will assess an overall Relevancy and Quality rating for each contract. The offeror will not receive an overall relevancy or quality rating, but the individual relevancy and quality ratings for each contract will be considered in determining the overall Confidence rating the offeror receives.

(a) Recency: Recent performance is defined as the offeror's previous experience within the past three years from the issuance date of this RFP. Performance that is more recent will have more impact in the performance assessment than less recent performance.

(b) Relevancy: The Source Selection Authority will consider performance information for relevancy in the performance of contractor’s previous efforts similar, in terms of the magnitude of effort and complexities, to this solicitation.

(i) Relevancy will also consider such things as contracts or programs involving Housing Management & Maintenance services. Services include maintenance of military family housing units, playgrounds and equipment, bus stops, operation of Housing Management Offices, Furnishings Management Office (FMO) Warehouses, and Maintenance Facility buildings, to ensure units’ structural integrity, achieve safe, sanitary, economical, operational and non-deteriorated living conditions.

(ii) The following definitions apply to determining relevancy.

UNKNOWN (N/A)
Did not observe performance in this area.

(i) In addition to evaluating the extent to which the Offeror's performance meets basic contract requirements, the assessment will consider things such as the Offeror's history of adhering to schedules, (including administrative aspects of performance), reasonable and cooperative behavior and commitment to customer satisfaction, and generally, the contractor's business-like concern for the interest of the customer.
