Solicitation FA4484-11-R-0004

Integrated Solid Waste Questions and Answers #4

1) Question: If a county passes a law after a contract has been awarded, that causes the contractor to incur more cost to perform the contract, would this justify a request for equitable adjustment, thus allowing the contractor to increase the contract pricing by the new incremental cost?

Answer: Since this is a hypothetical question we are unable to provide an answer. But if a request is brought before us at a later date, we will consider the request at that later date in accordance with DFARS 252.243-7002.

2) Question: As a Federal Facility, occupying federally-owned land, is the JB MDL subject to abide by county law, such as the Burlington County Flow Control Law which is under consideration by the county?

Answer: As a federal facility we are subject to certain state and local laws as applicable.

3) Question: In the Performance work statement (in regards to Ft. Dix), it states there are regular scheduled (various X per Week) roll off containers. However, on the bid specs we can not find a line item pertaining to Ft Dix scheduled roll off containers in order to price. We do see the line items for unscheduled/temporary roll off containers pricing.

Answer: These containers are to be pick up on an on call basis
