This question appears to ask if an Economic Price Adjustment clause is anticipated to be included in the contract, and it is not. Proper inclusion of the clause requires negotiations and the Government intends to award without discussions (negotiations).

In accordance with Specification 01 45 00, paragraph 3.2.5.1 - The QC Manager may not perform the duties of the Project Superintendent. At least two dedicated individuals are required. The Superintendent and a separate QC/SSHO. "Triple Hatting" is not allowable.

In accordance with Specification 01 91 00.15 10, Paragraph 1.1, the Commissioning Firm must be a 1st tier subcontractor of the General or Prime Contractor and must be financially and corporately independent of all other subcontractors. The commissioning firm must employe a lead commissioning specialist that coordinates all aspects of the commissioning process. Yes, the commissioning agent is required to be a third party.

In response to the guidance issued by the DoD on 25 May 2022 (which relates to price increases for firm fixed price contracts) will FAR 16.203-2 be incorporated into the contract documents for this procurement effort if awarded? The Government directive is explicitly for Firm Fixed Priced Contracts and should be included in all FFP awards per the directive on 25 May 2022

Per the requirements the SSHO may be the QC for this project. However, it does not specifically address if the SSHO by also be the superintendent. Is a "triple hat" allowed" or is the Government requirement for two separate individuals to maintain a full-time presence at the jobsite?

Sheet E001 includes a Lighting Schedule, for type LS, We see no new light fixtures to be installed?

Please provide a lighting page or note describing quantity and locations of these fixtures.

Reference Drawing Sheet E201 - Light Fixture Type "LS" is to be installed in this location. Reference Keynote 4 - to be connected to the existing lighting circuit/controls serving this area.

Is the liquidated amount of $5,527.00 per day, correct? I have never seen that high of an amount before. If that amount is correct, how does the government intend to handle delays that could be caused by supply chain issues and material lead times? Will the contractor be liable for those delays?

Can we get any info that will indiciate what is the exisitng 6" underground (specifically) CW pipe and what materials is the new 4" CW pipe needs to be as they could not find a spec on the underground CW pipe.

Reference Drawing Sheet M-201, Detail 1 - the "Existing 6" CHWS" & "Existing 6" CHWR" is assumed to be a pre-insulated Bonded Foam System with Schedule 40 PVC Carrier Pipe & Plastic Jacket. Reference Drawing Sheet M-201, Detail 1 & Sheet Note 2 - the "New 4" CHWS" & "New 4" CHWR" shall be pre-insulated PVC piping such as Thermacor's Chill-Therm pre-insulated piping material or approved equal.

Can you please identify or define the term "License holder" which occurs (3) times in this document? (Pages 3 & 11). What license is it referring to? i.e. Business License? Driver's License, Fishing License?... Or State Contractor's License (which is not required on federal jobs)?

Answer

License holder means a subcontractor employee (or the prime contractor's employee) holding a State trade specific contractor's license for an individual trade within Specification 01 45 00, paragraph 3.2.4.b including Air Conditioning/Heating, Electrical, and Fire Protection. The prime contractor is not required to hold a commercial construction license.

The government requires a continuous air barrier for new modifications. Reference Drawing Sheet A-110 & A-111 for the locations of the new R-19 Spray Closed Cell Foam Insulation (with ignition barrier).

Spray foam air barriers and referenced and building commissioning reports show as a requirement. Please confirm that with the ASHRAE standards for continuous air barrier if the Government is requiring a continuous air barrier for the entire building, new modifications or if a continuous air barrier to meet ASHRAE is not required.

In accordance with Specification 01 91 00.15 10, Paragraph 1.2. Heating, Ventilating, Air Conditioning, and Refrigerant Systems (HVAC) and the Building Automation System (BAS) are required to be commissioned. Per Specification 01 91

00.15 10, Paragraph 1.5.1.b Performance Verification Tests of the controls system must be completed prior to starting Functional Performance Tests of Mechanical Systems.

Is this a brand new install or is it retrofitting i.e. require repair of current fixtures?

Reference IBC 1704.6 - A registered design professional shall be hired by the contractor.

Can you confirm what type, model, year installed and when was the last time the HVAC unit(s) were last serviced?

Answer

No, however the site visit attendees included a mechanical contractor who may have collected that data. Please see the sign in sheet posted with the solicitation for the contact information.

Are there any pictures of the current HVAC unit(s)?

No, but see the answer to question 11 above.

10 Yes. The Liquidated Damages Amount of $5527.00 for each calendar day is correct. Delays that could be caused by supply chain issues and material lead times shall be addressed via Specification 01 32 00 Paragraph 3.9 - Requests for Time Extensions and Paragraphs 3.9.1, 3.9.2, and 3.9.3. Typically, delays caused by supply chain issues and material lead times are excusable, non-compensable delays and liquidated damages would not be assessed. These delays are evaluated on a case by case basis. Additionally, offerors are encouraged to review Specification 01 14 00, Paragraph 1.2.c which states "The building will remain in operation until all materials have been ordered, delivered and stored on-site as described above. Once all materials are stored the User will be given 30 days’ notice vacate the building. The Contractor will then have 6 months to complete all construction activities." This requirement was developed to minimize the impact to the user due to supply chain issues and material lead times for significant equipment and materials.
