About this file
This Purchase Determination, dated November 28, 2022, addresses the extension of evidentiary tow contracts issued by the Arizona Department of Public Safety (DPS) to all agreement holders certified under Tow Service Certification Agreements (TSAs). The determination was executed by Randy Williams, Chief Procurement Officer of the Arizona Department of Public Safety, following consultation with the Attorney General's Office, State Procurement Office, and DPS legal counsel regarding the interpretation of Arizona Revised Statutes 41-1830.51.
The determination establishes that DPS will issue evidentiary tow contracts directly to each TSA holder, eliminating the competitive bidding process for statewide citizen towing services. Under Competition Impracticable 18-002, when a tow truck is dispatched to a scene and DPS troopers discover contraband or items requiring evidence tows, the tow company may continue to the evidence facility with DPS determining the drop-off location, typically at the DPS evidence yard. TSA holders who are decertified or voluntarily disengage from the TSA will no longer maintain valid evidentiary tow contracts. This arrangement ensures continuous towing services while maintaining DPS oversight of evidence handling and resource management.
